Became a Local Law with the approval of the Mayor on __________, 2025, after a public hearing on __________, 2025. ENACTED BY THE COMMON COUNCIL FOR THE CITY OF UTICA; Section 1. Legislative Intent It is the intent of this local law to allow the City of Utica to adopt a budget for the next fiscal year that requires a real property tax levy in excess of the "tax levy limit" as defined by General Municipal Law Section 3-c. Section 2. Authority This local law is adopted pursuant to subdivision 5 of the General Municipal Law Section 3-c, which expressly authorizes a local government's governing body to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent 60% of said governing body. Section 3. Tax Levy Limit Override The City of Utica, is hereby authorized to adopt or implement a budget pursuant to law for the fiscal year commencing April l, 2025 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law Section 3-c. Section 4. Severability If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court's order or judgment shall not affect, impair or invalidate the remainder of  this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision or part of this local law or the application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered. Section 5. Effective Date This local law shall be operative for the fiscal year commencing April l, 2025. Sciortino, City Clerk Certify To: Budget, Comptroller Resolution: 1 CITY OF UTICA Department of Legislation Common Council March 14th, 2025 Sponsored by: Councilmembers Aiello, Burmaster, Betar, Carcone, Ervin, Betrus, Williamson, Colosimo-Testa, LoMedico THE REAL PROPERTY TAX INCREASE FOR FISCAL YEAR 2026 SHALL NOT EXCEED 3.4% WHEREAS, the City of Utica Common Council was presented with a Fiscal Year 2026 Annual Estimate that calls for a real property tax increase of 9.77%; and WHEREAS, members of the City of Utica Common Council agree that a property tax increase of 9.77% is too high; and WHEREAS, each member of the City of Utica Common Council has worked diligently to reduce the proposed property tax increase, with the goals of saving taxpayers’ hard-earned money, proposing fiscally responsible budgetary adjustments, and maintaining essential City services; and WHEREAS, after several proposed amendments being reviewed and submitted, it is the specific intent of the City of Utica Common Council to limit the potential property tax increase for Fiscal Year 2026; therefore RESOLVED, that the City of Utica Common Council does hereby unanimously hold that in no case shall the total Fiscal Year 2026 real property tax levy increase by an amount greater than 3.4% of the total property tax levy in Fiscal Year 2025; and FURTHER RESOLVED, this legislation hereby incorporates by reference, and is incorporated by reference, with “Introductory Local Law No. 1 of 2025”, approved by the Utica Common Council on this 14th day of March, 2025. [1964 Charter Laws, § 2-18.1; L.L. No. 10-1981, § 1] Commencing April 1, 1983, and on April 1 of each year thereafter, a cost of living increase shall be added to the salaries of the Mayor, Comptroller, Treasurer, President of the Common Council and Council members each year under the following conditions and under the following formula: (1) The increase shall be based on the All Urban Consumer Price Index as computed from December 31 of one year to December 31 of the following year. If the index increases 3% or more, the increase in salary shall be increased by the percentage rate of the increase in the consumer price index, but not more than 6% in a single year. (2) If the consumer price index each year as computed above does not equal or exceed 3%, then no salary increase will be allowed. However, the percentage increase during that year shall be added to the consumer price index increase in the following years and if the total percentage rate of the following years is 3% or over, the salaries shall be increased by that percentage rate, but in no case shall the increase exceed 6% in that year. (3) The December index of 1981 as compared with the December index of 1982 shall determine any salary adjustments beginning April 1, 1983.
