CITY COUNCIL Regular Meeting November 7, 2016 7:30 P.M. CALL TO ORDER: Mayor Gottman called the regularly scheduled meeting of the Vandalia City Council to order at 7:30 P.M. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance to the American Flag was given by all present. ROLL CALL: Swarm, Hubler, Rebbe, Lester, Stunkel, Hobler, Crawford and B. John Clark. MINUTES: A motion was made by Swarm and seconded by Crawford approving the minutes from the October 17, 2016 as presented. Motion carried. A motion was made by Swarm and seconded by Crawford approving the Special City Council minutes from October 24, 2016 as resented. Motion carried. REGULAR BILLS: A motion was made by Stunkel and seconded by B. John Clark approving the regular bills as submitted. Motion carried. SPECIAL BILLS: A motion was made by Stunkel and seconded by B. John Clark approving the Special Bills as submitted: Illinois Municipal League Risk Management Association in the amount of $155,744.82 for December 31, 2016-December 31, 2017 Insurance; Fayette Co. John AMENDING THE VANDALIA Clark and seconded by Crawford MUNICIPAL CODE AT TITLE V adopting Ordinance 2016-11-7-A, BUSINESS LICENSES & Amending the Vandalia Municipal REGULATIONS AT SECTION Code At Title V Business 5.08.070 NUMBER OF LICENSES Licenses and Regulations At Section 5.08.070 Number of Licenses. Not more than Eight (8) Class E Licenses shall be currently in effect at any one time. FIRST READING OF LIQUOR A first reading was for Meyer LICENSE-CLASS A-MEYER OIL Oil Company. Randy Meyer, CO: president of Meyer Oil Company has applied for a Class A liquor license along with video gaming in the location where Burger King is now. Burger King will not be renewing its lease for the space that is adjacent to the Mach I convenience store. Mr. Meyer described the expansion as a major renovation that will begin construction in March 2017. FIRST READING OF LIQUOR A first reading was for Duffy LICENSE-CLASS A-DISCOUNT and Associates, Inc. D/B/A TOBACCO: Discount Tobacco. Steve Kerber is also requesting a Class A liquor license along with video gaming. Both licenses will be voted on at the November 21st council meeting. John AN ORDINANCE PROHIBITING THE Clark and seconded by Swarm USE OF GROUNDWATER AS A adopting Ordinance #2016-11-7-B, POTABLE WATER SUPPLY BY THE Ordinance Prohibiting The Use Of INSTALLATON OR USE OF Groundwater As A Potable Water POTABLE SUPPLY WELLS OR BY Supply By The Installation Or ANY OTHER METHOD: Use Of Potable Supply Wells Or By Any Other Method. John Clark HIGHWAY AUTHORITY AGREEMENT adopting Resolution #2016-11-7- C, Approving A Highway Authority Agreement. DaLee Oil Company, Inc. has requested execution of a Supplemental Ordinance pertaining to prohibiting the use of groundwater as a potable water source in an area East of First Street. John Clark AUTHORIZING THE EXECUTION OF and seconded by Stunkel, THE IMLRMA MINIMUM/MAXIMUM Adopting Ordinance #2016-11-7-D, CONTRIBUTION AGREEMENT Authorizing The Execution Of The IMLRMA Minimum/Maximum Contribution Agreement. The agreement is for one year beginning 12/31/2016 to 12/31/2017. The city will make one payment of $155,744.82 based on the Min/Max Minimum Contribution. The ordinance now stipulates that the orange toters shall be kept and maintained upon the residential lot and shall not be upon the street side of said residential lot. RESOLUTION #2016-11-7-H: A motion was made by Stunkel and AUTHORIZATION OF CONTRACT seconded by Lester approving CHANGES Resolution #2016-11-7-H, Authorization Of Contract Change which is the contract change order on the bridge project at Fifth & Randolph St. which includes the relocation of a 6” water mains at that location. The estimated cost of the main relocations is $126,632.85. The city’s portion will be $25,326.57 due to 80%/20% share with the State. Motion carried. AUTHORIZATION TO SEEK BIDS A motion was made by B. John FOR 1 SQUAD CAR: Clark and seconded by Stunkel giving authorization to seek bids for 1 squad car. It is a budgeted item. Motion carried. AUTHORIZATION TO PURCHASE A motion was made by Swarm and CIVIC CLARITY UPGRADE FOR seconded by B. John Clark CITY CLERK AND WATER & SEWER authorizing the purchase of the DEPARTMENT: Civic Clarity Upgrade for the City Clerk & Water & Sewer Department. A down payment of $5,000 is due upon execution of the contract with $19,050 due in May 2017 and the remaining $19.050 due in May 2018. Motion carried. Motion carried. 6 APPROVAL OF TIF ADVISORY A motion was made by Stunkel and COMMITTEE MEETING MINUTES seconded by B. John Clark FROM NOVEMBER 3, 2016: approving the TIF Advisory Committee Meeting Minutes from November 3, 2016 as presented. Motion carried. ORDINANCE #2016-11-7-I: A motion was made by Hobler and APPROVING A CERTAIN TIF seconded by Stunkel to double AGREEMENT BY & BETWEEN THE the amount recommended by the CITY OF VANDALIA AND AUSTIN City’s TIF Advisory Committee HOLDINGS GROUP, INC. from $40,000.00 to $80,000.00 to Austin Holdings Group. Chad Austin has purchased the former Eagles Club at 112 N. Sixth Street with plans to use that building for a sports bar/restaurant. Austin Holdings Group will be doing a major renovation of the building. The total costs of rehabilitation, reconstruction, or repair or remodeling of existing public or private buildings is estimated at $161,700.00 TIF eligible costs will include: complete renovation of the top story of the facility, new windows, ADA compliant restrooms, new exterior finish. Motion carried. ORDINANCE #2016-11-7-J: A motion was made by B. John APPROVING A CERTAIN TIF Clark and seconded by Hobler AGREEMENT BY AND BETWEEN THE approving Ordinance #2016-11-7- CITY OF VANDALIA AND STACIA J, TIF Agreement Between The FIELDS City of Vandalia & Stacia Fields. Ms. Fields is planning to open a coffee shop, The Coffee Bean Expresso Shed, a drive-thru Coffee Shop. The total costs of rehabilitation, reconstruction, or repair or remodeling of existing public or private buildings is $27,813.37. TIF Eligible costs will include: plumbing, bathroom addition, deck materials, and HVAC. The Developer will receive no more than $7,500.00 in the form of 1 annual payment to be paid from the Special Allocation Fund, Vandalia TIF. RESOLUTION APPROVING AN Radliff Properties, LLC proposed AGREEMENT FOR BUILDING USE an Indemnity Agreement for the BETWEEN THE CITY OF use of the former Allen’s VANDALIA, IL AND RADLIFF Furniture building to be used PROPERTIES, LLC. for the Santa House. 8  City Attorney Connor said that he has some concerns with the ambiguities in the agreement. Lester asked whether the city’s insurance carrier would have a problem with this agreement and both Connor and Mayor Gottman said that it would. The issue died for a lack of a motion. MAYOR’S REPORT: Mayor Gottman announced that the Weston House Event Center is now open. The event center will handle weddings, receptions, reunions, parties and meeting spaces. It is located at 1405 Veterans Ave., the former Good Will Store. Mayor Gottman announced that Olde Tyme Christmas is this weekend. The lighting of the Christmas tree will take place at 5:00 p.m. on Friday evening. On Thursday, November 17th, there will a community meeting with Kaskaskia College at 3:30 p.m. at the Kaskaskia College in Vandalia. Mayor Gottman announced that a Beautification Meeting is coming up also. The beautification committee has been very busy by the city parking lot. Planting mums and various other projects throughout town. 9 STANDING COMMITTEES: B. John Clark reported that Schulte Construction started on the sidewalk replacement where the building collapsed. He is working with the city to try to finish it up before Friday evening. The Vandalia Water Department received a certificate of commendation in recognition of achieving the highest standard of compliance for at least twenty years in accordance with the Illinois Fluoridation Act from The Illinois Department of Public Health. Swarm reported that the company came in on Tuesday to start working on the lift station out by Wal-Mart. They left Friday afternoon. Mayor Gottman said that the City of Vandalia and the Chamber of Commerce will meet this Thursday to talk about Economic Development. Mayor Gottman announced that the Chamber of Commerce Office has relocated above the First National Bank. This Thursday at 5:00 they will have an open house with a ribbon cutting at 5:30 P.M. The State Farm Insurance has reopened. There will be a ribbon cutting on November 19th at 10:00 A.M. Mayor Gottman mentioned the City of Vandalia hosted Cory Jobe the Illinois Director of Tourism. He spoke at the Chamber Meeting 10  and followed up with a reception for him at the Capitol View Restaurant. COUNCIL CONCERNS: Crawford stated to the council that she received a call from a resident in Vandalia, John Williams in regard to his damaged toter which was hit by a vehicle on Jefferson St. He said, that he could not get a straight answer from Doty Sanitation on who is responsible for damages to the toters not caused by the owner. He said, that he would like it stated for public record whose responsibility is it to toters damaged by someone other than the owner. Mayor Gottman said that he would follow up with Doty Sanitation.
