CITY COUNCIL Regular Meeting May 1, 2017 7:30 P.M. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance to the American Flag was given by all present. CALL TO ORDER: Mayor Gottman called the regularly scheduled meeting of the Vandalia City Council to order. OATH OF OFFICE TO CITY CLERK Mayor Rick Gottman administered the PEGGY BOWEN: oath of office to City Clerk Peggy Bowen. Bowen is serving her sixth term in office. She is the longest serving Clerk for the City of Vandalia. OATH OF OFFICE TO MAYOR RICK City Clerk Peggy Bowen administered GOTTMAN: the oath of office to Mayor Rick Gottman. Gottman is serving his fifth term in office. ROLL CALL: Aldermen present were: Hubler, Rebbe, B. John Clark, Lester, Crawford, Barker and Hobler. Stunkel was absent. MOMENT OF SILENCE FOR HELEN A moment of silence was observed for CULBERTSON: Helen Culbertson who passed away last week. APPOINTMENT OF JOEL REBBE TO A motion was made by B. John Clark and FILL 2 YEAR UNEXPIRED TERM seconded by Crawford approving the FOR WARD III ALDERMAN: appointment of Joel Rebbe to fill a two year unexpired term for Ward III alderman. Motion carried. 1 SWEARING IN OF THE ELECTED At this time the Aldermen elected at OFFICIALS FROM APRIL 4, 2017 the April 4, 2017 Consolidated CONSOLIDATED ELECTION: Election were sworn in by City Clerk Peggy Bowen. MINUTES: A motion was made by Hobler and seconded by B. John Clark approving the minutes from the April 17, 2016 City Council Meeting. Motion carried. REGULAR BILLS: A motion was made by Lester and seconded by Crawford approving the regular bills as presented. Motion carried. SPECIAL BILLS: A motion was made by Hobler and seconded by Crawford approving the Special Bills: Jenner Ag, Inc. in the amount of $6,055.00 for a 200 gallon De-Ice/Chemical sprayer for the Street Department; Land of Lincoln Credit Union in the amount of $12,488.50 for payment on fire truck; Illinois South Tourism in the amount of $6,220.00 for 4th quarter advertising & marketing; Ennis Traffic Safety in the amount of $1,941.50 for street paint; Rusani Inc.in the amount of $9,400.00 for a TIF reimbursement; Community Opportunities, Inc. in the amount of $12,090.93 for the CEFS location at 517 W. Gallatin; Hurst Rosche Engineers in the amount of $14,678.46 for Fifth & Randolph Construction; U.S. Bancorp in the amount of $14,781.19 for water meters; HD Supply Waterworks in the amount of $2,781.89 for anchor couplings; South Central FS in the amount of $4,416.00 for tires for the loader for public works sewer; Brenntag Mid South, Inc. in the amount of $7,827.19 for chemicals; Hawkins, Inc. in the amount of $4,144.10 for chemicals; Motion carried. 2 TOURISM COMMISSION MEETING A motion was made by Crawford and MINUTES FROM MARCH 28,2017: seconded by Barker approving the Tourism Commission Meeting Minutes as presented. Motion carried. PLANNING COMMISSION MEETING A motion was made by B. John Clark and MINUTES FROM APRIL 18,2017: seconded by Hubler approving the Planning Commission Meeting Minutes as presented. Motion carried. ORDINANCE FAILED: A motion was made by Hobler and AMENDING THE CITY OF seconded by Hubler Amending the City VANDALIA ZONING DISTRICT of Vandalia Zoning District. Bruce & Kathleen Wright are seeking to amend the zoning from “RT” Two Family Residential to “RM” Multiple Family Residential. The Wright’s recently purchased the former Fayette County Health Department at 509 W. Edwards. After discussion it was decided that the properties in that area were simply not meant to be multi-family facilities, they were meant to be single family homes. RESOLUTION #2017-5-1-A: A motion was made by Lester and APPROVING AN AGREEMENT FOR seconded by B. John Clark Approving MARKETING SERVICES BETWEEN Resolution #2017-5-1-A, An Agreement THE CITY OF VANDALIA, IL & For Marketing Services Between The FIRETEC City of Vandalia, Illinois And Firetec for the listing of the older ladder truck. 3 Roll Call: Rebbe, yea; Clark, yea; Crawford, yea; Hobler, yea; Barker, yea; Lester, yea; Hubler, yea; Stunkel, absent. Motion carried. APPROVAL OF BIDS FOR MFT A motion was made by B. John Clark and MATERIAL LETTING FROM APRIL seconded Hobler approving the bids 24, 2017: from the MFT Material Letting from April 24, 2017. Motion carried. AUTHORIZATION TO FILL A motion was made by B. John Clark and VACANCY AT WATER TREATMENT seconded by Hobler approving the PLANT: hiring of Alex Redman to fill the vacancy of Matt Wyant at the Water Treatment Plant. Motion carried. APPROVAL OF SALT DOME A motion was made by Lester and STRUCTURE AT CITY GARAGE: seconded by Barker approving the bid from Westendorf Construction in the amount of $29,100.00 for a Norseman Structure 50’ x 60’ w/12’ oc Truss Arch/Blue End Cap & Apron Salt Dome Structure. Motion carried. AUTHORIZATION TO REPLACE TWO A motion was made by B. John Clark and (2) CHEMICAL FEED PUMPS: seconded by Crawford authorizing to replace Two (2) Chemical Feed Pumps in the amount of $2,738.30 from USABLUEBOOK Gurnee, Il. Motion carried. AUTHORIZATION FOR REPAIR OF A motion was made by Barker and PUMP AT WAL-MART LIFT seconded by Crawford authorizing the STATION: repair of a pump at Wal-Mart Lift Station in the amount of $5,402.27 from Vandevanter Engineering. Motion carried. ORDINANCE #2017-5-1-B: A motion was made by Hobler and AMENDING THE CITY OF seconded by Hubler, Approving VANDALIA ZONING DISTRICT Ordinance #2017-5-1-B, Amending The MAP: City of Vandalia Zoning District Map. Walter Barenfanger requested a Petition for Amendment of the City of Vandalia Zoning Ordinance. 4 Barenfanger has been approached by a potential developer that is seeking to build an assisted living facility for Alzheimer patients. Therefore, the property would need to be rezoned to “RM” Multiple Family Residential to make the facility a permitted use. This would include all of Lots 3 and 4 and 50 ft of the western parts of Lots 8 & 9 of L.T.’s Central West Subdivision. John Clark Adopting VANDALIA MUNICIPAL CODE AT Ordinance #2017-5-1-C, Amending The CHAPTER 9, PUBLIC PEACE, City of Vandalia Municipal Code At MORALS AND WELFARE AT Chapter 9, Public Peace, Morals And SECTION 9.12.040 OBSTRUCTING Welfare At Section 9.12.040 STREETS Obstructing Streets. No person shall rake, deposit, dump, or cause to be raked, placed, deposited or dumped any leaves, trash, organic materials, or other debris, into any ditch or onto that portion of the public right-of-way improved by gravel, oil and chat or other hard surfacing material for vehicular traffic except when such materials are bagged or otherwise contained as required for trash or landscape/lawn waste pickup purposes. John Clark Adopting OF VANDALIA MUNICIPAL CODE Ordinance #2017-5-1-E, Amending The AT CHAPTER 9, PUBLIC PEACE, City of Vandalia Municipal Code At MORALS AND WELFARE AT Chapter 9, Public Peace, Morals And SECTION 9.12.060 BONFIRES Welfare At Section 9.12.060 Bonfires. No person shall, within the City Limits, burn any material in open air or inside a stove or other enclosed apparatus kept outside a building and designed to contain burning material. 1. Exceptions include: leaves, tree trimmings, branches, stumps & brush. 2. Apparatuses designed to burn wood, corn or pellets to heat a home. 3. Open fire pits measuring no more than four (4) feet wide from any angle and burning only wood. Burning shall not be done: 1. On streets, alleys or public right-of-ways 2. When weather conditions, such as wind, may cause burning embers to be carried off the premises. 3. When smoke generated by the fire 6 creates a visibility hazard on a street or alley. Title V Business Licenses and Regulations of the Vandalia Municipal Code is amended at Section 5.08.070 Number of Licenses by deletion of any reference therein to Class A Licenses and substitution of the following in lieu of: Not more than One (1) Class A Licenses shall be currently in effect at any one time. John Clark accepting AS ECONOMIC DEVELOPMENT & the resignation of Brian Stout as TOURISM DIRECTOR: Economic Development & Tourism Director. Motion carried. On Friday, April 28th, Stout submitted his resignation. Stout states that, “working for the city has truly been an honor. Being able to serve the citizens of the community has brought about a new found respect for the individuals who want to make Vandalia the best it can be.” ORDINANCE #2017-5-1-J: A motion was made by Crawford and AN ORDINANCE AMENDING seconded by Barker Adopting Ordinance SALARIES FOR FISCAL YEAR MAY #2017-5-1-J, Amending the Salaries for 1, 2017-APRIL 30, 2018 Fiscal Year May 1, 2017-April 30, 2018. APPROVAL OF APPOINTMENT OF A motion was made by Barker and JERRY SWARM TO PLANNING seconded by B. John Clark endorsing COMMISSION: the appointment of Jerry Swarm to the Planning Commission. Swarm will replace Steve Barker who was recently elected to the city council. Motion carried. MAYOR’S REPORT: Mayor Gottman announced that he attended the Illinois TIF Conference in Springfield last week. Mayor Gottman said that it was a very good meeting. Somethings brought to light in regard to TIF law and etc. Mayor Gottman announced that he and LaTisha Paslay will meet with the TIF attorney in Chicago on May 17th. Next week, Mayor Gottman will be meeting with a consultant of TIF. At the TIF Conference there was an election of the Board of Directors and Mayor Gottman was re-elected to the Board of Directors for the Illinois TIF Association. Mayor Gottman attended the IML meeting in Springfield. 12 STANDING COMMITTEES: LaTisha Paslay reported that she and Public Works Director, Marlin Filer have been working on a list of guidelines for the residents to follow in regard to Street Department pickup procedures. The ordinances will go into effect June 1, 2017. Fifth St. and Randolph is just about completed. Waiting on the striping of the road. A ribbon cutting will take place on the opening of the road very soon. Hubler said that he would like to comment on the recycling. He felt it was important to keep the electronic recycling offered by the Fayette County Soil and Water Conservation District. The nearest place to go for electronic recycling is Champaign. Mayor Gottman encouraged residents to voice their opinions on the proposal to add a $1.25 monthly surcharge to residents’ water bills to support the recycling programs. Mayor Gottman commented, I don’t know if any of you have received calls and Aldermen Clark and Rebbe said they had. All being negative towards the additional charge to the water bill. Mayor Gottman said that he received a quote from Slack Glass to replace the windows in the front office. He plans to meet with Andy Lester to review the quote. Hobler reported that the informational meeting to discuss annexation of the Vandalia Lake into the City of 13 Vandalia has been rescheduled for June 24th due to several unable to attend the meeting this Saturday evening. The meeting will be held at 10:00 A.M. in the city council chambers. Mayor Gottman is asking the media to get the word out that the City of Vandalia is looking for a full-time Economic Development Director. ANNOUNCEMENTS & CONCERNS: Lester asked where the city stands with the sidewalk replacement plan at this time. Anyone with ideas should get with Marlin Filer. Lester also questioned what kind of grants does the city have in the pipeline? Mayor Gottman said that we are working on one for the Water Plant. Lester asked about any road work, to get in line for when funding comes available. Mayor Gottman said that he has been in contact with all three engineering firms that the city has used, HMG, Hurst & Rosche and Crawford & Associates. Lester also asked, has there been any discussion with the owner of the wall across the street from City Hall when he plans to fix it? Mayor Gottman said that he has been meeting with the owner. Mayor Gottman is asking in writing the committee that you would like to chair and the committees that you would like to be on. 14 A contact information list of elected officials and department heads along with meeting dates was passed out to the alderman and the news media. Mayor Gottman said, there is nothing for Executive Session, but wanted to cover something under Executive Session; there are only three reasons to go into Executive Session: land acquisition the sale or inquiring of land; individual personnel matter; pending legal action.
