The special session of the City Council, City of Vermillion, South Dakota
was held on Monday, July 3, 2017 at 12:00 noon at the City Hall large
conference room.
1. Roll Call
Present: Collier-Wise, Holland, Humphrey, Price, Sorensen, Mayor Powell

2. Educational Item – Chapter 114 Taxicab ordinance updates and potential
changes – John Prescott
John Prescott, City Manager, summarized discussion from the June 19th
Council meeting and introduced Malachi Petersen, Administrative Intern to
present new information.
Malachi Petersen, Administrative Intern, recapped the ordinance changes
that were discussed at the June 19th noon meeting and provided a copy of
the ordinance again. Malachi noted that an additional change was to adjust
the insurance limits for general liability with a minimum limit of
$1,000,000, auto liability of at least $500,000, and that the policies
shall not be modified or canceled without 30 days notice to the City
Manager. Malachi answered questions of the City Council members on the
proposed ordinance.
John Prescott, City Manager, stated that the draft ordinance will be
provided to the City Attorney for review and also asked City Council
members to let him know of any changes to be included in a final draft
for consideration for first reading on July 17th.
3. Informational Item – Potential project to update City of Vermillion
website - Malachi Petersen
Malachi Petersen, Administrative Intern, provided handouts with
information about website redesign with samples of other websites, survey
results, comparisons between the City’s current website (GovOffice) and
two new web design companies, Revize and CivicPlus, and his
recommendations. Malachi reported that the City’s website is almost at
maximum for storage, has an adaptive design rather than responsive, a poor
search function, and (according to the survey results) not very user
friendly. Malachi would suggest that the City update their website to be

easily navigable, highlight Vermillion with more photos, and more two-way
communication by providing feedback areas for residents to send to the
City.
Discussion followed on the shortcomings of the current website as well as
suggestions for a new website.
John Prescott, City Manager, asked City Council if they would want to put
a website redesign in this year’s budget as a revision or wait until next
year. The consensus of the City Council was to begin the website redesign
this year and make the adjustment to the revised budget.
4. Information Item - Timing of Prentis Park parking lot construction -
John Prescott
John Prescott, City Manager, recapped the Prentis Park parking lot plans.
Jose Dominguez, City Engineer, presented a map with a marked area showing
the new parking lot at Prentis Park. Jose answered questions of the City
Council members on the parking lot and sidewalks.
John expressed concern with waiting to begin construction on the parking
lot until spring 2018 and would like the bid process to start earlier with
construction beginning hopefully in September 2017. John stated that staff
estimates the project to be $250,000. Discussion followed on the timing.
The consensus of the City Council was to start the parking lot process in
2017 and adjust the revised budget.
5. Briefing on the July 3, 2017 City Council Regular Meeting
Council reviewed items on the agenda with City staff. No action was taken.

p.m. Alderman Price seconded the motion. Motion carried 6 to 0. Mayor
Powell declared the motion adopted.

was called to order on July 3, 2017 at 7:00 p.m. by Mayor Powell.

Alderman Collier-Wise moved approval of the June 19, 2017 Regular Meeting
and June 19, 2017 Special Meeting minutes. Alderman Meins seconded the
motion. Motion carried 8 to 0. Mayor Powell declared the motion adopted.
4. Adoption of Agenda

Alderman Price moved approval of the agenda. Alderman Holland seconded
the motion. Motion carried 8 to 0. Mayor Powell declared the motion
adopted.
5. Visitors to be Heard
A. Proclamation Recognizing July as Park and Recreation Month
Alderman Sorensen read the proclamation designating the month of July,
2017 as Parks and Recreation Month in Vermillion. Mayor Powell presented
the proclamation to Jim Goblirsch, Parks & Recreation Director. Jim
thanked the Mayor and City Council for the proclamation as well as their
support for the Parks and Recreation programs in the city. Jim also wanted

to thank all the other city departments that assist the Parks and
Recreation Department throughout the year.
6. Public Hearings
A. Special daily malt beverage and wine license for the Fraternal Order
of Eagles on or about July 21 through 27, 2017 at the Prentis Park baseball
field.
Mike Carlson, Finance Officer, reported that the Fraternal Order of Eagles
has applied for a special daily malt beverage and wine license for the
baseball tournament on July 21 through 27, 2017 at the Prentis Park
baseball field. Mike stated that the Police Chief’s report and notice of
hearing are included in the packet. Mike stated that, since the event is
being held on City property, ordinance provides that the City Council may
include such conditions and restrictions. The Police Chief is recommending
the following parameters be established:
1. Five staff members will supervise the event’s distribution and
consumption of alcohol
2. Signage will be posted at the entry gate and the alcohol dispensing
point stating:
A. Alcohol consumption is only allowed inside the fenced spectator
area
B. No one under 21 will be served or allowed to consume alcohol
C. No intoxicated person(s) will be served
D. No alcohol can leave the fenced spectator area
E. No outside alcohol is allowed into the fenced spectator area
3. Staff will check all persons wishing to purchase and provide a wrist
band once their age has been verified.
4. Persons who have not been wrist banded or who appear to be under 21
will not be allowed to purchase or consume alcohol.
Mike recommended approval of the special permit unless information is
presented at the public hearing.

Alderman Collier-Wise moved approval of the special daily malt beverage

contingent upon complying with the conditions as indicated by the Police
Chief. Alderman Sorensen seconded the motion. Motion carried 8 to 0. Mayor

B. Special daily malt beverage and wine license for the Clay County
Agricultural Fair Association on or about August 10, 11 & 12, 2017 in the
Fairgrounds west arena
Mike Carlson, Finance Officer, reported that an application was received
from the Clay County Agricultural Fair Association for a special daily
malt beverage and wine license on or about August 10, 11 and 12, 2017
for the lawn mower and power wheels derby on Thursday, demolition derby
on Friday and barnyard Olympics and Warning Shots on Saturday during the
Clay County Fair. Mike stated that the notice of hearing and Police
Chief’s reports are included in the packet. Mike recommended approval of
the special license unless additional information is provided at the
hearing. Discussion followed on the need to include the following as part
of the special license:

Alderman Holland moved approval of the special daily malt beverage and
wine license for the Clay County Agricultural Fair Association, Inc. on
or about August 10, 11 & 12, 2017 at the Clay County Fairgrounds
contingent upon complying with the above listed three conditions.
Alderman Humphrey seconded the motion. Motion carried 8 to 0. Mayor
Powell declared the motion adopted.
7. Old Business
A. Second Reading of Ordinance 1357 – Zone Change to Exclude from the
GB-General Business District and Include in the R-3 Residential District
the S. 320’ Exc. W. 120’ of Lot 1 & S. 320’ of Lot 4 & Lot 19 through
21, Blk1, Johnson’s Addition, Clay County, South Dakota; and, to Exclude
from the R-2 Residential District and Include in the R-3 Residential

District Lot 1, Including Units 1 through 4, Block 2, Johnson’s Addition,
City of Vermillion, Clay County, South Dakota. (Property is along the
west side of Elm Street between Duke Street and Alumni Street and at the
northeast corner of Cottage Avenue and Alumni Street)
Jose Dominguez, City Engineer, reported that in July 2008 the City adopted
a new zoning ordinance that created new districts throughout the City.
Jose noted that several properties along the west side of Elm Street
between Duke Street and Alumni Street and at the northeast corner of
Alumni Street and Cottage Avenue were rezoned from B-1 General Business
District, which at that time allowed high density apartment complexes, to
a new district that either does not allow apartments, or allows only four-
plexes. Jose noted that some of these properties have non-conforming uses
that were built prior to the new zoning ordinance. Jose noted that this
poses an issue for the owner if the buildings were damaged beyond 50% of
their value; they could not rebuild the existing structures, or if a buyer
had to finance the purchase for their property, they may not be able to
finance the purchase since the zoning does not allow the use. Jose noted
that roughly 75% of the area to be rezoned already has buildings
constructed that would conform to the R-3 Residential district uses. These
buildings would be non-conforming on the districts currently zoned. Jose
stated that the zone change request was discussed at the June 12th Planning
Commission meeting. Jose noted that a few residents who could be affected
by the rezone attended the meeting. Jose stated that the main concern
expressed by the neighbors was the possibility of drainage issues if the
empty lot were to be developed. Jose reported that, after hearing all
concerns, the Planning Commission unanimously recommended approval of the
rezone. Jose stated that the Council had the first reading of this
ordinance at their June 19th meeting. At that meeting the Council heard
comments from opponents and proponents of the proposed zoning amendment.
Jose noted that most of the comments at the meeting were about drainage
related to the already built properties. Jose noted that in this situation
the drainage question between the single-family and multi-family yards is
largely a private party matter. Jose reported that the City would be
involved as the storm water would be discharged into the municipal system.
Jose noted that the City addresses storm water issues that do not involve
new construction or rezoning with examples over the last year which would
include the Linden ravine project, Burbank Road between Brandon Drive and
Natalie Court, and the recently completed Erickson retention pond. Jose
stated that the question for the Council at hand is whether to approve or
deny the zoning request. Jose noted that the City has been and is mindful
of neighborhood concerns. The issues that have been brought up are not
related to the zoning but rather to land development. Jose reported that
the current subdivision requirements will address the issues brought up
with drainage and the other City utilities in the area have more than
adequate capacity for any future development. Jose noted that the rezoning
will simply rectify a mistake that was unintentionally done when the City

rezoned the area in 2008. Jose noted that, if the issue is not rectified,
the property owners have the possibility of being severely impacted in
the future.
Jill Schafer, 1025 Cottage, reported that she questioned the stormwater
system at last meeting but not the sewer system. Jill was concerned about
the ability of the sewer system to handle the quantity of wastewater
produced from up to 64 rental units as it compared to the current zoning
for a business. Jill also questioned the age of the wastewater system in
the area. Jill stated that the rain of last Thursday impacted the
neighborhood with rivers of runoff into the backyards and a foot deep on
Cottage Avenue.
Ryan Bear, property owner, stated that he was not aware of the drainage
issue in this area until last meeting. Ryan stated that he had been
contacted about the snow pile and he changed where he piled snow to
accommodate the neighbors. Ryan noted that there are two different issues,
zoning and drainage. Ryan stated that the request is to rezone the property
to correct the change made in 2008, as the property was built prior to
this, and to also rezone the adjoining vacant lot. Ryan noted that if the
property was damaged by more than 50% he would not be able to rebuild.
Ryan noted that, as to the drainage, he would be willing to meet with the
neighbors to see if there are ways to address this issue.
Michele Maloney, local realtor, stated that the issue being requested is
the zone change which is being confused with the drainage issue. Michele
noted that with 75% of the property being considered being out of
compliance the zoning change needs to be approved and Ryan Bear can work
with the neighbors on the drainage.
John Prescott, City Manager, noted that following last meeting he had
requested the sanitary sewer capacity to serve the vacant lot from the
Utility Manager. John stated that the capacity of the 8 inch sanitary
sewer line has the capacity of 490,000 gallons per day and currently the
water usages of the properties that discharge to this main are less than
7,000 gallons per day. John noted that the sanitary sewer is more than
adequate to serve the development allowable on the vacant lot.
Discussion followed on the zone change and drainage issues.

substantially in its present form and content at a regularly called meeting

the question of the adoption of the Ordinance was put to a roll call vote
of the Governing Body, and the members voted as follows: Collier-Wise-Y,

8. New Business
A. Request to close High Street from Cherry Street to the south end of
the Fairgrounds from 7:00 a.m. on Thursday, August 10, 2017 until 5:00
p.m. Sunday, August 13, 2017 for the Clay County Fair
Mike Carlson, Finance Officer, reported that Clay County Agricultural
Fair Association is hosting the annual Clay County Fair from August 10
to 13, 2017 and is requesting the temporary closure of a portion of High
Street as it abuts the fairgrounds similar to what has been done in prior
years. Mike stated that the request is to close High Street along the
fairgrounds from 7:00 a.m. on Thursday, August 10, 2017 until 5:00 p.m.
on Sunday, August 13, 2017.

Alderman Sorensen moved approval of the closing of High Street along the
fairgrounds from 7:00 a.m. on Thursday, August 10, 2017 until 5:00 p.m.
on Sunday, August 13, 2017 for the Clay County Fair. Alderman Price
seconded the motion. Motion carried 8 to 0. Mayor Powell declared the
motion adopted.
B. Engineering Agreement with Banner Associates, Inc. for design of
Jefferson Street between East Duke Street to East Clark Street

Jose Dominguez, City Engineer, reported that Jefferson Street from East
Duke to East Clark Street was constructed in the mid 1980’s as an asphalt
road. Jose noted that over the years the road has deteriorated due to
poor subgrade conditions and having an inadequate pavement section for
the current traffic. Jose noted that the multiple utility cuts across
the street offer a poor ride quality to its users. Jose stated that this
segment of Jefferson Street was placed on the City’s capital improvement
plan for reconstruction since 2015 with the intention to complete the
project in 2018. Jose stated that, in order to complete the
reconstruction of Jefferson Street, engineering plans and construction
documents need to be completed and sent out for bid. Jose stated that
the City has adopted a process to reduce the consultant cost as much as
possible with the City Engineering staff completing portions of the
information that is sent to the consulting engineer. The consulting
engineer will then complete the engineering plans and provide the City
Engineering staff with any documentation required to complete the
specifications. Jose noted that from these specifications the City
Engineering staff will put together the construction documents and
engineering plans and then send the packet out to the contractors for
bids. Jose stated that the engineering agreement is the scope of services
for this project with a cost not to exceed $32,000 plus a geotechnical
surveying consultant for soil testing estimated at $2,500. Jose
recommended authorizing the City Manager to enter into the agreement with
Banner Associates, Inc. for engineering services to complete the design
of Jefferson Street from East Duke Street to East Clark Street.
Discussion followed with Jose answering questions on the existing
contracts with Banner Associates.

Alderman Holland moved to authorize the City Manager to enter into the
agreement with Banner Associates, Inc. for engineering services to
complete the design of Jefferson Street from East Duke Street to East
Clark Street at a cost of $32,000. Alderman Meins seconded the motion.
Motion carried 8 to 0. Mayor Powell declared the motion adopted.
C. Business Improvement District #1 Board member appointment
Mayor Powell stated that in 2013 the City Council adopted the resolution
establishing that the Board of Directors for Business Improvement District
(BID)#1 would be comprised of five people. Mayor Powell noted that the
terms of office are for three years and, per the by-laws, one member of
the Board is to be specifically involved in the lodging industry. Mayor
Powell reported that Jonathan Buckles previously served as a Board member
and represented the lodging industry. Mayor Powell stated that he has
relocated from Vermillion, leaving a vacancy for the remainder of his
term. Kyle Eberts, the president and owner of Crew Construction and
Restoration that owns the Red Roof Inn, has expressed interest in serving

on the BID Board. Mayor Powell recommended the appointment of Kyle Eberts
to fill the remainder of the term expiring in 2019.

Alderman Collier-Wise moved approval of the Mayor's recommendation of
the appointment of Kyle Eberts to the Business Improvement District #1
Board of Directors with term expiring in 2019. Alderman Sorensen seconded
the motion. Motion carried 8 to 0. Mayor Powell declared the motion
adopted.
9. Bid Openings
A. Fuel quotes
Mike Carlson, Finance Officer, read the monthly fuel quotes and
recommended the low quote of Brunick’s Service on all four items.
Item 1 - 4,350 gal unleaded 10% ethanol: Stern Oil $1.9388, Brunick’s
Service $1.87; Item 2 – 1,000 gal unleaded: Stern Oil $2.1175, Brunick’s
Service $2.00; Item 3 – 3,000 gal No. 2 Diesel fuel dyed: Stern Oil

Alderman Sorensen moved approval of the low quote of Brunick’s Service on
all four items. Alderman Meins seconded the motion. Motion carried 8 to
0. Mayor Powell declared the motion adopted.
10. City Manager's Report
A. John reported that the tower zoning ordinance exception will not have
2nd reading on Monday, July 17th as the tower company representative
requested additional time to prepare information to answer questions that
had been raised. John stated that notice will be made when a date is set.
B. John reported that City offices are closed on Tuesday, July 4th for
the holiday.
C. John reported that City code does allow for the discharge of novelty
consumer fireworks on July 4th from 9:00 a.m. to midnight. John stated
that information is available on the City’s website describing what legal
fireworks in the City limits are.
D. John reported that curbside recycling pickup on Tuesday, July 4th will
be delayed until Monday, July 10th due to the holiday.

E. John reported that the DOT public meeting on SD Highway 50 bypass
construction project will be on Tuesday, July 25th from 4:00 p.m. to 7:30
p.m. in City Council chambers.
