Unapproved Minutes Council Special Session October 2, 2017 Monday 12:00 noon The special session of the City Council, City of Vermillion, South Dakota was held on Monday, October 2, 2017 at 12:00 noon at the City Hall large conference room. 1. Roll Call Present: Collier-Wise, Holland, Humphrey, Price, Sorensen, Ward, Mayor Powell Absent: Erickson, Meins 2. Educational Item – Chapter 70 – Alley stopping and parking - Addison McCauley, Administrative Intern Addison McCauley, Administrative Intern, reported that the issue has been raised about parking in alleys thus forcing other traffic to go around the parked vehicle encroaching into the adjoining property. Addison stated that in reviewing the City Ordinance Chapter 70 stopping, standing and parking the language is ambiguous as it applies to alleys. Addison stated that the City Attorney has reviewed and agreed that the language would need to be updated if applied to alleys. Discussion followed on the current ordinance, alley traffic and parking. The consensus of the City Council was to move forward with updating the ordinance to prohibit parking in alleys. 3. Educational Item - Access to Street Management –Jose Dominguez, City Engineer Jose Dominguez, City Engineer, updated the City Council on street access management that is used to reduce the traffic conflict points. Jose noted that access management is different in how it applies to local, collector and arterial streets. Jose reviewed the pros and cons of the current ordinance that requires a review for each property. Jose reviewed his proposal to update the ordinance and stated that he would like to advertise a public meeting to review the changes to the ordinance whereby comments would be received and included in the proposed ordinance before it is brought to the City Council. Discussion followed on access management and the ordinance with the consensus for Jose to move forward with updating the ordinance. 4. Briefing on the October 2, 2017 City Council Regular Meeting 1 Council reviewed items on the agenda with City staff. No action was taken. 5. Adoption of Agenda 311-17 Alderman Collier-Wise moved approval of the agenda with the removal of Item 8D and the addition of 8H Request to close one block section of Pine Street from National to Cedar Street on Sunday, October 8th from 4:30 p.m. to 8:30 p.m. for an Alpha Phi Sisterhood event. Alderman Price seconded the motion. Motion carried 8 to 0. Mayor Powell declared the motion adopted. 5. Visitors to be Heard - None 6. Public Hearings A. Special daily malt beverage and wine license for the Vermillion Area Arts Council on or about October 7 and October 22, 2017 at 202 Washington Street Mike Carlson, Finance Officer, reported that an application was received for a special daily malt beverage and wine license from Vermillion Area Arts Council for events on October 7 and 22 at 202 Washington Street. Mike stated that the events are the Chili Blues on October 7th and the Art of Sustainability Celebration on October 22nd. Mike stated that the Police Chief’s report, notice of hearing and the flyers on the events are included in the packet. Mike noted the Police Chief’s report stated there has not been any incidents of concern in previous events. 312-17 Alderman Meins moved approval of the special daily malt beverage and wine license for the Vermillion Area Arts Council on or about October 7 and 22, 2017 at 202 Washington Street. Alderman Collier-Wise seconded the motion. Motion carried 8 to 0. Mayor Powell declared the motion adopted. B. Special daily malt beverage and wine license for the Vermillion Area Chamber of Commerce and Development Company on or about October 13 and 14, 2017 at Ratingen Platz and portion of Market Street for Oktoberfest events 3 Mike Carlson, Finance Officer, reported that an application for a special daily malt beverage and wine license was received from the Vermillion Area Chamber of Commerce and Development Company for Oktoberfest event on or about October 13 & 14, 2017 at Ratingen Platz and portion of Market Street. Mike reported that the notice of public hearing and Police Chief’s report are included in the packet. Mike noted that the Police Chief reported that there were no incidents with the events held last year. Mike reported that, as the event will be held on a City street and City property, ordinance allows the City to include “such conditions and restrictions, as the governing body may deem appropriate and consistent with state law.” Mike stated that the request to exceed allowable noise levels and a street closure request are also on this agenda. Mike stated that the VCDC has provided a Certificate of Insurance naming the City of Vermillion as an additional insured and provided a Release and Indemnification releasing the City from liability for the event. Mike noted that staff recommends the City Council consider and attach most of the following conditions: 1) Require the applicant identify and utilize a fenced area where alcoholic beverages may be sold and consumed, as well as a plan to monitor the entrances and exits from this area; 2) Require a plan for the cleanup and disposal of the cups and other materials after the event; 3) Provide restroom facilities; 4) Hours of sale may be limited to 5:00 p.m. to 11:00 p.m. each day. Mike noted that the Police Chief’s report indicated that a fenced area would be used with staff monitoring all egress points and wristbands would be used to identify those of age. Mike noted that representatives of the VCDC are present to answer any questions. 313-17 Alderman Collier-Wise moved approval of the special daily malt beverage and wine license for the Vermillion Area Chamber of Commerce and Development Company for Oktoberfest event on or about October 13 & 14, 2017 at Ratingen Platz and half block of Market Street south of Main Street with the conditions listed above and to include the use of Ratingen Platz. Alderman Holland seconded the motion. Motion carried 8 to 0. Mayor Powell declared the motion adopted. C. Special permit to exceed sound levels for the Vermillion Area Chamber of Commerce and Development Company on or about October 13 and 14, 2017 at Ratingen Platz and portion of Market Street from 5:00 pm to 11:00 pm for Oktoberfest events Mike Carlson, Finance Officer, reported that an application to exceed permissible sound levels by no more than 50% was received from the Vermillion Area Chamber of Commerce and Development Company on or about October 13 & 14, 2017 at Ratingen Platz and a half block of Market Street south of Main Street from 5:00 p.m. to 11:00 p.m. for 4 Oktoberfest event. Mike stated that the application and notice of hearing are included in the packet. Mike noted that this is the same location as last year and recommended approval. First Reading of Ordinance 1363 – Zone Change to Exclude from the GB-General Business District and Include in the R-3 Residential District Lot 4, Block 5; and, Lot 2, Block 6; and, the West 185.5’ of Lot 1, Block 5, Partridge Addition, City of Vermillion, Clay County, SD; and, the Exclude from the R-2 Residential District and Include in the R-3 Residential District Lot 3, Block 5; and, Lots 1 & 2, Block 7, Partridge Addition, City of Vermillion, Clay County, SD Joe Dominguez, City Engineer, reported on the location of the property noting that the area in question has been marketed for development for several years. Jose reported that the owners of the parcels are wanting to change the zoning from GB – General Business District, and from R-2 Residential District, to R-3 Residential District. Jose reported that the owners obtained the required number of signatures to allow the Planning Commission to consider the zone change. Jose stated that the request was discussed at the September 25th Planning Commission meeting. Jose reported that after discussing the item the Planning Commission unanimously recommended approval of the rezone. Jose stated that Ordinance 1363 is to rezone the property as recommended by the Planning Commission. Michelle Maloney, representing the property owners, noted that the property owners have installed the streets and utilities to this area and the zone change to R-3 will allow a developer to make nice improvements to the area. 315-17 Mayor Powell read the title to the above mentioned Ordinance and Alderman Collier-Wise moved adoption of the following Resolution: BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No. 1363 entitled An Ordinance Amending the Zoning Map to exclude from the GB-General Business District and include in the R-3 Residential District Lot 4, Block 5; and, Lot 2, Block 6; and, the West 185.5’ of Lot 1, Block 5, Partridge Addition, City of 5 Vermillion, Clay County, SD; and, to exclude from the R-2 Residential District and include in the R-3 Residential District Lot 3, Block 5; and, Lots 1 & 2, Block 7, Partridge Addition of the City of Vermillion, South Dakota has been read and the Ordinance has been considered for the first time in its present form and content at this meeting being a regularly called meeting of the Governing Body of the City on this 2nd day of October, 2017 at the Council Chambers in City Hall in the manner prescribed by SDCL 9-19-7 as amended. The motion was seconded by Alderman Holland. Discussion followed on storm drainage with Jose answering questions of the City Council. The question of adoption of the Resolution was put to a vote of the Governing Body and 8 members voted in favor of and 0 members voted in opposition to the motion. Mayor Powell declared the motion adopted. 7. Old Business - None 8. New Business A. Request to close Market Street from W. Main Street south to the east-west alley between W. Main Street and Kidder Street on Friday, October 13 and Saturday, October 14, 2017 from 4:00 pm to 11:30 pm for Oktoberfest Addison McCauley, Administrative Intern, reported that the Vermillion Area Chamber of Commerce and Development Company has applied for a street closing request for October 13 & 14 from 4:00 p.m. to 11:30 p.m. each day for Oktoberfest events. Addison stated that the closing is for Market Street from Main Street to the alley half way to Kidder Street to be closed from 4:00 p.m. to 11:30 p.m. on each day. Addison stated that the request and diagram are included in the packet. Addison noted that the application indicated that adjoining property owners have been notified and that event staff would be cleaning up. Elijah Bonde of the VCDC answering questions on the event. 316-17 Alderman Meins moved approval of the street closing request of the Vermillion Area Chamber of Commerce and Development Company for Market Street from Main Street to the alley half way to Kidder Street on October 13 & 14 from 4:00 p.m. to 11:30 p.m. each day. Alderman Price seconded the motion. Motion carried 8 to 0. Mayor Powell declared the motion adopted. B. Resolution adjusting Curbside Recycling Fee John Prescott, City Manager, reported that when curbside recycling started in 2009 the monthly fee was $3.30 and it was increased to $3.50 6 in January 2016. John noted that the original equipment was purchased with a grant/loan from the State with the loan being retired in 2016. John stated that the pickup was replaced in 2016 and the trailer is budgeted to be replaced in 2018. John noted that a grant/loan application was approved by the City Council to assist with purchasing a new trailer in 2018. John noted that the recycling markets have been low for some time now and a $.20 per month increase was discussed during the budget hearings. John noted that the fee adjustment will generate about a $6,100 increase in revenues and is to start for billing after January 1, 2018. Discussion followed with John answering questions of the City Council. 317-17 After reading the same once, Alderman Holland moved adoption of the following: RESOLUTION REVISING CURBSIDE RECYCLING COLLECTION RATES WHEREAS, Ordinance 1184 establishing mandatory curbside recycling for qualifying residences was adopted by the Vermillion City Council in April 2008 and upheld via a municipal election in November 2008; and WHEREAS, Section 52 of the Vermillion City Code of Ordinances provides the policies and procedures for curbside recycling collection; and WHEREAS, the City Council desires to provide curbside recycling on a self-sustaining user fee basis; and, WHEREAS, Section 52.32 of the 2008 Revised Ordinance of the City of Vermillion allows the City Council to establish the monthly mandatory fee for residential curbside collection via a resolution. NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the City of Vermillion, South Dakota, at a regular meeting thereof, in the Council Chambers of said City, at 7:00 p.m., on the 2nd day of October, 2017, to amend the mandatory curbside recycling fee for utility billing after January 1, 2018 to be $3.70 per month plus sales tax. BE IT FURTHER RESOLVED that the City Manager of the City of Vermillion, South Dakota is authorized to establish rates for collection of recyclable materials from locations not mandated by the ordinance at a flat fee that shall cover the collection costs. Resolution adjusting Storm Water Drainage Fee Mike Carlson, Finance Officer, reported that during the budget process it was proposed to raise the storm drainage fee to provide additional revenues for storm drainage projects. Mike noted that the fee is charged to all properties in the city and is included on the property tax statements. The proposed increase will generate $8,600 of additional revenue for the storm water fund for 2018. Mike reviewed the budgeted expenditures for 2017 and 2018 for the storm drainage fee. Mike noted for a residential lot of 10,000 square feet, the fee would go from $27.88 to $30.00 per year. Alderman Sorensen questioned the raising of fees vs special assessing the cost of stormwater improvements. Discussion followed. 318-17 After reading the same once, Alderman Ward moved adoption of the following: RESOLUTION TO CHANGE STORM DRAINAGE FEE WHEREAS, Section 53-135 of the 2008 Revised Ordinances of the City of Vermillion allows the City Council to change the city wide property drainage fee; and WHEREAS, during the annual budget process it was determined additional revenue would be needed for future storm drainage projects. BE IT HEREBY RESOLVED by the Governing body of the City of Vermillion, South Dakota, at a regular meeting thereof of said City at 7:00 p.m. on the 2nd day of October, 2017 that the fee be changed as follows: 8  The unit financial charge shall be $0.0004. Resolution of Necessity and Notice of Hearing for Sidewalk Repairs (Central Business District) Jose Dominguez, City Engineer, reported that the sidewalk inspection program was instituted in 2010 to bring deficient portions of sidewalks up to a proficient standard. Jose stated that in 2015 the City amended the resolution requiring the sidewalks to be repaired by extending the deadline for repairs to 2017. Jose stated that, at that time, the City was exploring the option of doing a Main Street project that would have reconstructed all of the sidewalks rather than undertaking spot repairs on the deficient sidewalks. Jose stated that staff is asking to amend the existing special assessment resolution to remove the requirement from the owners to complete the repairs. Jose stated that staff is exploring the option of performing a Main Street project that would reconstruct all of the sidewalks. Jose noted that some of this cost would more than likely be passed along to the property owners. Jose stated that requiring the owner to complete a sidewalk repair and then pay for the downtown sidewalks seems unreasonable. Jose noted that, if the Main Street project were not to take place, the downtown sidewalks would be re-inspected in 2018 with repairs occurring in 2020. Jose reported to amend a special assessment requires that the governing body: (1) set a public hearing and (2) notify the property owners of the hearing by both sending notice and publishing the notice of the hearing. Jose stated that the notice calls for the public hearing to be held on October 16, 2017 at which time the City Council will be asked to adopt a resolution allowing Staff to notify the owners of the cancellation of the special assessment. Resolution of Necessity and Notice of Hearing for Sidewalk Repairs (NW Quadrant) Jose Dominguez, City Engineer, reported that the sidewalk inspection program was first presented to the City Council in 2010. Jose reported that the program divided the City into quadrants with the northwest (north of National Street and west of Dakota Street) quadrant being inspected this year. Jose reported that, during City inspections, staff looked for a couple of deficiencies: trippers and surface conditions and that sidewalk tiles were functioning as originally constructed. Jose noted that, if the panels were found to be deficient, they were also marked for replacement. Jose reported that the special assessment process requires that the governing body: (1) set a public hearing and (2) notify the property owners of the hearing by both sending notice and publishing the notice of the hearing. Jose reported that the notice calls for the public hearing to be held on October 16, 2017. Jose stated that following the hearing the City Council will be asked to adopt a resolution allowing Staff to notify the owners of the repairs that are needed. Jose reported that, if the property owner does not submit a permit by June 30, 2018 to complete the repairs before the end of 2018 as required in the resolution, Staff will then hire a contractor to complete the repairs at the property owner’s expense. Jose stated that this contract for repairs will be in 2019. Jose reported that this resolution involved the sidewalks in the northeast quadrant of the community. Jose stated that the contractor has completed work and the final payment has been authorized. Jose stated that the special assessments were calculated and filed with the Finance Officer on September 19, 2017. Jose stated that, per State statute, the City is required to hold a public hearing to allow the affected property owners to review and discuss any concerns regarding the assessed value. Jose reported that the resolution provides that the property owners to be assessed will also be notified of the hearing by mail and the notice will also be published in the Plain Talk. Jose reported that the construction costs to be assessed are $16,644.04 which does not include the administrative fee, which is either $50 or 8% of the construction cost, whichever is greater. John reported that he was notified by the tower company representative who stated that he will be able to attend the October 16th evening meeting to answer questions in response to the ordinance about providing an exception for towers closer than 300 feet of residential zoning or uses. John noted that this would be the second reading of Ordinance 1355. John stated that the information is to be provided in advance and will be distributed to the Council members. B. John reported that the USD Dakota Days parade is this Saturday, October 7th. John reported that Main Street from High Street to S. Norbeck Street will be closed from 7:00 am to 12:30 p.m. for the parade. C. John reminded citizens that West Main, as it abuts Ratingen Platz and Market Street from Main Street to Kidder Street, will be closed on Wednesday, October 4th from 4:00 p.m. to 11:00 p.m. for a USD Dakota Days event – VermTown Bash D. John reported that the Fire/EMS Department Open House is at the Dakota Street Fire Station on Wednesday, October 11th from 5:30 p.m. to 7:00 p.m. John stated that Dakota Street from north of the McDonald’s entrance to W.
