Proclamation recognizing the first Habitat for Humanity home in Clay County Alderman Collier-Wise read the proclamation recognizing the first Habitat for Humanity home in Clay County. Mayor Powell presented the proclamation to the President of the USD Habitat for Humanity group who thanked the City Council for the Proclamation. 6. Public Hearings 2 A. Special permit to exceed permissible sound levels by no more than 50% for USD Dakota Days on Ratingen Platz and a portion of Market Street south of W. Main Street and the portion of W. Main Street abutting the Platz on or about October 3, 2018 from 4:00 p.m. to 11:00 p.m. for celebration of Dakota Days event with carnival and street dance Mike Carlson, Finance Officer, reported the receipt of a special permit to exceed permissible sound levels by no more than 50% for USD Dakota Days Committee on Ratingen Platz and a portion of Market Street south of W. Main Street and the portion of W. Main Street abutting the Platz on or about October 3, 2018 from 4:00 p.m. to 11:00 p.m. for a celebration of Dakota Days event with carnival and street dance. Mike stated that the notice of hearing and application are included in the packet. Mike noted that the request to close a portion of Market and Main Streets is later on the agenda. Mike noted that the City Council will need to determine if the event is in a suitable location with appropriate facilities and if the applicant can demonstrate the public benefit of the event. Mike stated that Douglas Wagner is present to answer questions. 279-18 Alderman Ward moved approval of the special permit to exceed permissible sound levels by no more than 50% for the USD Dakota Days Committee on Ratingen Platz and a portion of Market Street south of W. Main Street and the portion of W. Main Street abutting the Platz from 4:00 p.m. to 11:00 p.m. on Wednesday, October 3, 2018 for a carnival and street dance as part of the celebration of Dakota Days. Alderman Collier-Wise seconded the motion. Motion carried 8 to 0. Mayor Powell declared the motion adopted. B. Special daily malt beverage and wine license for the Vermillion Area Chamber of Commerce and Development Company on or about September 28 & 29, 2018 at Ratingen Platz and portions of Market and W. Main Street for Oktoberfest events Mike Carlson, Finance Officer, reported that an application for a special daily malt beverage and wine license was received from the Vermillion Area Chamber of Commerce and Development Company for Oktoberfest event on or about September 28 & 29, 2018 at Ratingen Platz and portions of Market and Main Streets. Mike reported that the notice of public hearing and Police Chief’s report are included in the packet. Mike noted that the Police Chief reported that there were no incidents with the events held last year. Mike reported that, as the event will be held on a City street and City property, ordinance allows the City to include “such conditions and restrictions, as the governing body may deem appropriate and consistent with state law.” Mike stated that the 3 request to exceed allowable noise levels and a street closure request are also on this agenda. Mike stated that the VCDC has provided a Certificate of Insurance naming the City of Vermillion as an additional insured and provided a Release and Indemnification releasing the City from liability for the event as part of the street closing. Mike noted that the Police Chief’s report indicated that a fenced area would be used with staff monitoring all egress points and wristbands would be used to identify those of age. 280-18 Alderman Collier-Wise moved approval of the special daily malt beverage and wine license for the Vermillion Area Chamber of Commerce and Development Company for Oktoberfest event on or about September 28 & 29, 2017 at Ratingen Platz and portions of Market and Main Streets and to include the use of Ratingen Platz. Alderman Holland seconded the motion. Motion carried 8 to 0. Mayor Powell declared the motion adopted. C. Special permit to exceed permissible sound levels for the Vermillion Area Chamber of Commerce and Development Company on or about September 28 & 29, 2018 at Ratingen Platz and portions of Market and W. Main Street from 5:00 p.m. to 11:00 p.m. for Oktoberfest events Alderman Humphrey arrived at 7:10 p.m. Mike Carlson, Finance Officer, reported that an application to exceed permissible sound levels by no more than 50% was received from the Vermillion Area Chamber of Commerce and Development Company on or about September 28 & 29, 2018 at Ratingen Platz and portions of Market and Main Streets from 5:00 p.m. to 11:00 p.m. for Oktoberfest event. Mike stated that the application and notice of hearing are included in the packet. Mike noted that this is the same location as last year and recommended approval. 281-18 Alderman Willson moved approval of the special permit to exceed permissible sound levels by no more than 50% for the Vermillion Area Chamber of Commerce and Development Company on or about September 28 & 29, 2018 at Ratingen Platz and portions of Market and Main Streets from 5:00 p.m. to 11:00 p.m. for Oktoberfest event. Main Street between Prospect Street and the alley west of CorTrust Bank and close Market Street from W. Main Street to Kidder Street on Wednesday, October 3, 2018 from 4:00 p.m. to Midnight for Vermtown Bash John Prescott, City Manager, reported that Douglas Wagner, on behalf of the USD Dakota Days Committee, has requested the closing of W. Main Street between Prospect Street and the alley west of CorTrust Bank and close Market Street from W. Main Street to Kidder Street on Wednesday, October 3, 2018 from 4:00 p.m. to Midnight for Vermtown Bash for a Celebration of Dakota Days. John stated that the street closing request is included in the packet and indicated that those affected by the street closure have been notified of the request. John stated that the special permit to exceed permissible sound levels was approved earlier on the agenda. Main Street between Prospect Street and the alley west of CorTrust Bank and close Market Street from W. Main Street to Kidder Street on Wednesday, October 3, 2018 from 4:00 p.m. to Midnight for USD celebration of Dakota Days event. Alderman Collier-Wise seconded the motion. Motion carried 9 to 0. Mayor Powell declared the motion adopted. B. Request to close W. Main Street between Prospect Street and the alley west of CorTrust Bank and close Market Street from W. Main Street to Kidder Street on Friday, September 28 and Saturday, September 29, 2018 from 3:30 p.m. to Midnight for Octoberfest John Prescott, City Manager, reported that the Vermillion Area Chamber of Commerce and Development Company has applied for a street closing request for September 28 & 30 from 3:30 p.m. to midnight each day for Oktoberfest events. John stated that the closing is for W. Main Street between Prospect Street and the alley west of CorTrust Bank and Market Street from W. Main Street to Kidder Street. John stated that the request and diagram are included in the packet. John noted that the application indicated that adjoining property owners have been notified and that event staff would be cleaning up after the event. 283-18 Alderman Willson moved approval of the street closing request of the Vermillion Area Chamber of Commerce and Development Company for W. Main Street between Prospect Street and the alley west of CorTrust Bank and close Market Street from W. Main Street to Kidder Street on September 28 & 29 from 3:30 p.m. to midnight each day. Alderman Humphrey seconded the motion. Motion carried 9 to 0. Mayor Powell declared the motion adopted. 5 C. First Reading of Ordinance 1384 to amend Chapter 51 Electricity, Section 51.22 Residential Service Rate to add 51.22(B)(2)(c) to provide for a master electric meter serving exclusive student housing facilities providing dormitory style apartment units John Prescott, City Manager, reported that The Heights is building a 74 unit building to house 200+ post-secondary students on the west side of N. Dakota Street. John noted that the developer would like to utilize a single master electric meter for the residential uses in the building. John noted that City code requires a separate electric meter for all multi-family units within a structure. John reported that the Utility Committee met with the developers on May 16th to hear a request for a single master meter for the residential services. John noted that the PUC does provide for a variance from the individual meter requirement for dormitories. John stated that The Heights expressed that their project is similar to a dormitory and should be allowed to have a master meter. John stated that the Utility Committee directed staff to develop ordinance language to provide for a master meter at a large privately owned student housing project. John reported that the Utility Committee met on May 30th to consider the ordinance language to allow a single master meter for a large dormitory style apartment building. John reported that the Utility Committee report was presented to the City Council at the June 4th meeting. John reported that following that Council meeting the developer offered additional comments on the proposed ordinance language. John reported that the Utility Committee reviewed the proposed changes to language and presented the proposed ordinance section 51.22(B)(2)(c) to the City Council at the August 6th meeting. John reported that the proposed ordinance would add another rate class to the residential rate classes in 51.22(B)(2)(c) for dormitory style apartment unites as provided in the proposed ordinance. Discussion followed on the proposed ordinance. John noted that if the proposed ordinance is approved at first reading a rate resolution will be prepared for consideration following second reading to establish the rate. 284-18 Mayor Powell read the title to the above mentioned Ordinance and Alderman Willson moved adoption of the following Resolution: BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No. 1384 entitled An Ordinance Amending Chapter 51 Electricity, Section 51.22 Residential Service Rate to add 51.22(B)(2)(c) to provide for a master electric meter serving exclusive student housing facilities providing dormitory style apartment units of the City of Vermillion, South Dakota has been read and the Ordinance has been considered for the first time in its present form and content at this meeting being a regularly called meeting of the Governing Body 6 of the City on this 20th day of August, 2018 at the Council Chambers in City Hall in the manner prescribed by SDCL 9-19-7 as amended. The motion was seconded by Alderman Hellwege. After discussion, the question of adoption of the Resolution was put to a vote of the Governing Body and 9 members voted in favor of and 0 members voted in opposition to the motion. Mayor Powell declared the motion adopted. D. Human Relations Commission appointments Mayor Powell reported that the City Council created the Human Relations Commission with the adoption of Ordinance No. 1377 that became effective on July 19, 2018. Mayor Powell reported that the ordinance provided for the creation of a seven member board with six members in staggered three year terms and seventh member being a student enrolled in a post-secondary education for a one year term. Mayor Powell reported that seven expression of interest applications were received and recommended the following as members of the City of Vermillion Human Relations Commission: Addison McCauley, student, one year term; Daniel Sundberg, one year term; Quinn Thornton, one year term; Mark Daniels, two year term; Travis Letellier, two year term; Calvin Petersen, three year term and Lamont Sellers, three year term. 285-18 Alderman Sorensen moved approval of the Mayor’s recommendations for appointment to the Human Relations Commission. Alderman Hellwege seconded the motion. Motion carried 9 to 0. Mayor Powell thanked the individuals for expressing interest to serve on the commission and asked the City Manager to notify the individuals of their appointment. E. Historic Preservation Commission appointments Mayor Powell reported that the City Council created the Historic Preservation Commission with the adoption of Ordinance No. 1376 which became effective on July 19, 2018. Mayor Powell reported that the ordinance provided for the creation of a seven member board with four members being property owners in an officially designated historic district, and when available, two members who have expertise in the disciplines of history, architectural history, architecture, architecture, planning, urban planning, American studies, American civilization, cultural geography, cultural anthropology, or related fields. Mayor Powell reported that the terms of appointment are for three years with the initial appointments having staggered expirations. Mayor Powell reported that seven expression of interest applications were received and recommended the following as members of the City of Vermillion Historic Preservation Commission: one year term - D. Cynthia (Cyndy) Chaney, Dietrick Vanderhill, Ed Gerrish; two year term - Susan 7 Keith Gray, William Dendinger and three year term - Gloria Hensley, Jim Wilson. 286-18 Alderman Sorensen moved approval of the Mayor’s recommendations for appointment to the Historic Preservation Commission. Alderman Collier- Wise seconded the motion. Motion carried 9 to 0. Mayor Powell asked the City Manager to notify the individuals of their appointment. Alderman Sorensen thanked the individuals for expressing interest to serve on the Historic Preservation Commission. F. Plat of Lot 11A in Block 4 of Bliss Pointe Addition to the City of Vermillion in the S ½ of Section 14, Township 92 North, Range 52 West of the 5th P.M., Clay County, South Dakota John Prescott, City Manager, reported on the location of the lot in Bliss Pointe that added 6 feet to the existing lot and included the dedication of all the required utility easements around the lot. John reported that the Planning Commission recommended approval of the plat at their August 13th meeting. 287-18 After reading the same once, Alderman Ward moved approval of the following plat: WHEREAS IT APPEARS that the owners thereof have caused a plat to be made of the following described real property: Lot 11A in Block 4 of Bliss Pointe Addition, City of Vermillion, Clay County, South Dakota for approval. BE IT RESOLVED that the attached and foregoing plat has been submitted to and a report and recommendations thereon made by the Vermillion Planning Commission to the City Council of Vermillion which has approved the same. BE IT ALSO RESOLVED that access shall be granted to the lot in accordance with the City of Vermillion street access and driveway approach policy, which requires an application permit. BE IT FURTHER RESOLVED that the attached and foregoing plat has been submitted to the Governing Body of the City of Vermillion which has examined the same, and it appears that the systems of streets and alleys set forth therein conforms to the system of streets and alleys of the existing plat of such city, and that all taxes and special assessments, if any, upon the tract or subdivision have been fully paid and that such plat and survey thereof have been executed according to law, and the same is hereby accordingly approved. 8 The motion was seconded by Alderman Humphrey. Discussion followed and the question of the adoption of the Resolution was presented for a vote of the Governing Body. 9 members voted in favor of and 0 members voted in opposition to the Resolution. Mayor Powell declared that the Resolution was adopted. G. Resolution Fixing the Time and Place for a Hearing and Notice of Hearing on the Special Assessment Roll for Nuisance Abatement Mike Carlson, Finance Officer, reported that, as part of the nuisance abatement process, the City incurred costs for tagging, hiring contractors to mow or remove the snow and remove debris. Mike reported that the State statute provides for the special assessment of these costs and requires that the City Council set a public hearing date, notify the property owners by sending notice and publishing the notice of hearing. The resolution will set a public hearing date of September 17, 2018 and provides for notice to be published and mailed to the property owners. Any interested person may appear and show cause as to why the Governing Body of the said City of Vermillion, South Dakota should not approve and levy said assessments against the respective premises as set forth in said assessment roll, to defray the costs of the nuisance abatement. BE IT FURTHER RESOLVED, that the Finance Officer of the City of Vermillion, Clay County, South Dakota shall be and is hereby authorized and directed to cause this Resolution and Notice to be published in the official newspaper in the City of Vermillion, South Dakota, one week prior to the date set for such hearing. BE IT FURTHER RESOLVED, that the Finance Officer of the City of Vermillion, Clay County, South Dakota shall mail a copy of this Resolution and Notice, by first-class mail with postage thereon fully prepaid, addressed to the owner(s) of any property to be assessed for such nuisance abatement at their address as shown by the records of the Director of Equalization. Sale of surplus Fire Department air packs 12 Mike Carlson, Finance Officer, reported that the Fire Department has received an offer from the City of Clark Fire Department to purchase the surplus air packs for $7,200. Mike noted that these air packs were declared surplus on May 21, 2018 and appraised at $8,000. Mike stated that there were no bids received at the bid opening on June 26th and the Fire Department noted that it would continue to market the air packs. Mike noted that this offer is 90% of the appraised value and recommended approval of the sale. 289-18 Alderman Sorensen moved approval of the sale of the five surplus air packs to the City of Clark Fire Department for $7,200. Alderman Hellwege seconded the motion. Motion carried 9 to 0. Mayor Powell declared the motion adopted. 9. Bid Openings - None 10. City Manager's Report A. John reported that City offices will be closed on Monday, September 3rd due to the Labor Day holiday. John noted that with the Labor Day holiday the next City Council meeting will be on Tuesday, September 4th. B. John reported that at the Tuesday, September 4th City Council meeting will be the annual agenda item to review the use of the malt beverage markup proceeds and the first reading of appropriations ordinance to adopt the 2019 budget and revise the 2018 budget. C. John reported that Prentis Plunge has shifted to fall hours today until Sept 3rd: Monday – Friday open 4-7; Water walking 11-1 & 5-6, Saturday - Sunday open 1-5; Water walking 12-1 & 5-6. D. John reported that the Bike Master Plan Open House will be at City Hall in the Council chambers on Monday, September 10th from 5:30 p.m. to 7:30 p.m. E. John reported that the Planning Commission meets on Monday, August 27th at 5:30 p.m. Items on the agenda include a conditional use permit for new SAE fraternity house and a conditional use permit for the SAE parking lot. F. John reported that information was provided in regard to the amount of Outside Agency funding proposed in the 2019 budget as it compares to past years as was prepared by the committee last year.
