The special session of the City Council, City of Vermillion, South Dakota
was held on Friday, June 17, 2022 at 9:00 a.m. at the John “Jack” Powell
Conference Room, 25 Center Street Vermillion, SD.
1. Roll Call
Present: Hellwege (Teleconference), Holland, Humphrey, Jennewein,
Letellier, Price (Teleconference),
Absent: Mayor Collier-Wise
2. Adoption of Agenda

Council Member Holland moved approval of the agenda. Council Member
Humphrey seconded the motion. Motion carried 6 to 0. Mayor Collier-Wise
declared the motion adopted.

4. Public Hearing
A. Special daily malt beverage and wine license for the South Dakota
Shakespeare Festival on or about June 17-19, 2022 at the Prentis Park
band shell area
Katie Redden, Finance Officer, reported that the South Dakota Shakespeare
Festival has applied for a special daily malt beverage and wine license
for the Shakespeare performances on June 17-19, 2022 at the Prentis Park
band shell area. Katie stated that the Police Chief’s report and notice
of hearing are included in the packet. Katie stated that, since the event
is being held on City property, ordinance provides that the City Council
may include such conditions and restrictions as the governing body deems
appropriate. Katie stated that the certificate of insurance naming the
City as additional insured with liquor liability has not been received
at this time. The Police Chief is recommending the following parameters
be established:
1. Wristbands will be distributed by the volunteers when IDs are
checked to ensure purchases and consumers are over 21 years of age.
2. The South Dakota Shakespeare Festival will provide ushers who will
monitor both the purchase area and the audience grounds within the

area delineated. Ushers will ensure that no one removes a beverage
from the audience area or the fenced concession area.
3. The fenced concession area and the audience area will have posted
signs instructing consumers not to remove alcoholic beverages from
the two designated areas, and the direct path between them.
Katie recommended approval of the special permit contingent upon the
receipt of the certificate of insurance and complying with the Police
Chief’S recommendations, unless information is presented at the public
hearing. Discussion followed.

Council Member Holland moved approval of the Special daily malt beverage
and wine license for the South Dakota Shakespeare Festival on or about
June 17-19, 2022 at the Prentis Park band shell area contingent on the
procedures outlined by the Police Chief are followed. Council Member
Hellwege seconded the motion. Motion carried 6 to 0. Mayor Collier-Wise
declared the motion adopted.

12:04 p.m. Council Member Hellwege seconded the motion. Motion carried
6 to 0. Mayor Collier-Wise declared the motion adopted.

Subject: Canvass of June 7, 2022 Election Results
Presenter: Katie Redden
Background: State law requires the canvass of the election results by the governing body
within seven days of the election.
9-13-24. Return and canvass of votes.
The election returns shall be reported as soon as possible to the finance officer, and within seven
days of the election, the governing body shall canvass the election returns, declare the result, and
enter the result on its journal.
Discussion: The Administrative Rules list the duties of the board of canvassers as follows:
5:02:17:12. Duties of official board of canvassers for local jurisdiction.
The duties of the official board of canvassers for a local jurisdiction are as follows:
(1) Open the returns from each precinct which are found in each poll book;
(2) Satisfy itself that the returns are genuine and not forged;
(3) Tabulate the returns from the precincts and the certification of provisional ballot count;
(4) Declare the result; and
(5) Make an abstract of the results of the votes cast for each of the candidates and each of the issues.
The abstract must be signed and certified by the canvassers under the seal of the business
manager or finance officer of the local jurisdiction.
As the County Commission and School Board have canvassed the results the poll book
envelopes will have already been opened.
There were no provisional ballots.
The total number of voters in the poll book should be compared to the total ballots counted
from the tabulation machine printout labeled Detail Results by Precinct. The Detail Results
by Precinct have the abbreviations for the wards in the top left with C1 for Central Ward,
E1 for Northeast Ward, W1 for Northwest Ward, S1 and S2 for Southeast Ward.
I have completed an abstract of the results from the unofficial election results sheets and
have included which will need to be signed unless there are any changes found.

Financial Consideration: None.
Conclusion/Recommendations: A motion will need to be made to certify the election
results and all members will need to sign the abstract. It should be noted that Mayor Collier-
Wise, Katherine Price, and Julia Hellwege should abstain from voting or signing.
