Unapproved Minutes Council Special Session January 21, 2025 Tuesday 12:00 noon The special session of the City Council, City of Vermillion, South Dakota was held on Tuesday, January 21, 2025 at 12:00 noon at the John “Jack” Powell Conference Room. 1. Roll Call Present: Thaler, Leber, Price, Holland, Jennewein, Cheeseman, Murra, Mayor Cole Absent: Hellwege 2. Adoption of Agenda 14-25 Council Member Holland moved approval of the agenda. Council Member Thaler seconded the motion. Motion carried 8 to 0. Mayor Cole declared the motion adopted. 3. Visitors to be Heard - None 4. Department Spotlight – Matt Callahan, Fire/EMS Chief Matt Callahan, Fire/EMS Chief, went over the Fire and EMS Staff along with the different duties they have. Matt explained that the 50 part- time employees may do both fire duties along with EMT training. Matt went over the training involved in his department and the different programs they are involved in. Discussion followed. 5. JJZA Subdivision Review Progress - Jose Dominguez, City Engineer Jose Dominguez, City Engineer, reported on the JJZA Subdivision progress. Jose explained that the JJZA was put in place in 2012 so the County and City could work together on development on the land that abuts city limits. Jose noted that the County and City have very different rules for development therefore a compromise should be considered. Jose noted that the current city attorney stated that the most restrictive requirement is to be considered. Jose explained an example of a process of how an application would flow through both bodies. Discussion followed. 6. Briefing on the January 21, 2025 City Council Regular Meeting Council reviewed items on the agenda with City Staff. No action was taken. 7. Black History Month Proclamation – Human Relations Commission, Cultural Wellness Coalition, and Black Student Union. Bennett Clary and Elle Hoops read the following proclamation: For National Black History Month, we proudly celebrate the vast contributions of Black people and communities to our country and recognize that Black culture, narratives, literature, and triumphs are at the core of who we are as a Nation. The heart and soul of America is what makes this country unique. We are the only country that is founded on the noble idea that we are all created equal and deserve to be treated with equal dignity throughout our lives. However, it would be doing a disservice to our country and our founding ideals if we do not confront the hard truths about what this country was founded and shaped on, slavery. WHEREAS, the origins of Black History Month date back to 1926 when Dr. Carter G. Woodson founded the organization that began as "Negro History Week" now known today as the Association for the Study of African American Life and History to recognize the achievements by Black Americans and all people of African descent in the United States; and WHEREAS, it is imperative that we do not shy away from acknowledging and refusing to forget the dark chapters of this country's legacy of slavery, violence, and institutional and structural racism that African Americans have endured in the past and still continue to confront today. It is essential that we pay tribute to African Americans who endured the brutal shackles of oppression, courageously risked their lives for justice, fought a fight that seemed insurmountable, and persistently and continually strive to fight for equality chasing the promised American Dream; and WHEREAS, throughout history Black and African Americans have yearned to be recognized as integral parts of the American identity, a sentiment reflected in the Black community's commitment to fight in every American war that shaped the nation's freedom and rights. Their legacy is one of unwavering love for thy country, selfless sacrifice for the greater good of our nation, and an enduring hope of that more perfect union; and WHEREAS, this year's theme is "African Americans and the Arts," infused with African, Caribbean, and Black American lived experiences. Throughout history, the Black community has used art as a tool for preserving history and community memory, a practice integral to our nation's growth and development. Over centuries, these contributions have often been denied or downplayed by Eurocentric intellectuals; and WHEREAS, in the face of these historical truths, it is of moral imperative that each of us learn about, shed light upon, and condemn the inhumanities of injustices and inequalities that Black and African Americans have prevailed through; and WHEREAS, to be silent in voice and complacent in action becomes betrayal and complicit in this inhumanity and injustice; and NOW THEREFORE, we the Vermillion Human Relations Commission, the Cultural Wellness Coalition, and Black Student Union designates this month of February 2025 as NATIONAL BLACK HISTORY MONTH WE CALL UPON EACH ONE OF US to remember today that there is no American history without Black history, and we take time each February to commemorate that truth. Today we shall be reminded of the quote by Amelia Boynton Robinson, an American activist who was a leader in the Civil Rights movement, who said, "You can never know where you're going unless you know where you've been." This National Black History Month, may we not only remember where we have been, but recognize that our only way forward is in unity, together. B. Lions Club 75th Anniversary Proclamation. Mayor Cole read the following proclamation: WHEREAS, the Vermillion Lions Club was chartered on February 21, 1950 and has demonstrated the Lions Club motto of “We Serve” since that time in numerous ways; and WHEREAS, the Vermillion Lions Club supports children and needy members of the community with vision and hearing needs through providing preschool vision screenings, free eye exams and corrective lenses, and hearing aid assistance. The Vermillion Lions Club also collects used eyeglasses in the community for re-use around the world and contributes to the Lions Club International Foundation’s SightFirst Program which works to eradicate blindness; and WHEREAS, the Vermillion Lions Club serves our youth though scholarships, recreation, Junior Achievement, Special Olympics, Boys State and Girls State sponsorships, and the Vermillion Public Schools; and WHEREAS, the Vermillion Lions Club fights hunger with supporting the annual Christmas Food Box Program, Backpack Program for school children, and community Food Pantry as well as serving as Meals on Wheels and Community Welcome Table volunteers; and WHEREAS, the Vermillion Lions Club supports our community through helping organizations such as the Vermillion Police Department, Vermillion Fire/EMS Department, Vermillion Public Library, W.H. Over Museum, Austin Whittemore House, National Music Museum, Main Street Center, South Dakota Public Broadcasting, Bluff View Cemetery, and Sanford Hospice; and WHEREAS, the Vermillion Lions Club has helped bring about physical assets for all to enjoy such as Lions Park and the Clay County Veterans Memorial. Special permit to exceed permissible noise levels by no more than 50% for a concert featuring the USD Vocal Jazz Choir on or about Tuesday, April 15, 2025, from 5:00 p.m. to 6:30 p.m. at the Ratingen Platz (corner of West Main Street and Market Street). Nick Doty, Deputy Finance Officer, reported that an application to exceed permissible noise levels by no more than 50% was received. Nick stated that the USD Vocal Jazz Choir will be hosting an event at Ratingen Platz on or about Tuesday, April 15th from 5:00 p.m. to 6:30 p.m. Nick noted the map indicates the stage will be on West Main Street facing towards the east. 18-25 Council Member Holland moved approval of the special permit to exceed permissible noise levels by no more than 50% for a concert featuring the USD Vocal Jazz Choir on or about Tuesday, April 15, 2025, from 5:00 p.m. to 6:30 p.m. at the Ratingen Platz (corner of West Main Street and Market Street). First reading of Ordinance 1528 to amend Title XV, Land Usage; Chapter 155, Zoning Regulations; Section 155.026 rezoning Lots 1 and 2, Block 1, Jack Powell Addition; City of Vermillion, Clay County, South Dakota from the R-3 Residential District to the GB General Business District (lots at the corner of Stanford Street and South Dakota Highway 50). Jose Dominguez, City Engineer, reported on the first reading of Ordinance 1528 to amend Title XV, Land Usage; Chapter 155, Zoning Regulations; Section 155.026 rezoning Lots 1 and 2, Block 1, Jack Powell Addition; City of Vermillion, Clay County, South Dakota from the R-3 Residential District to the GB General Business District. Jose stated the Vermillion Chamber and Development Company (VCDC), owner of the land, has requested that the City rezone Lots 1 and 2, Block 1, Jack Powell Addition, from the R-3 Residential District to the GB General Business District. Lot 1 is roughly 1.69 acres in size, while lot 2 is approximately 1.8 acres. The lots are bounded to the north by SD Hwy. 50, to the east by Stanford Street, to the south by the law enforcement center, and to the west by a future park. Jose stated the surrounding areas to the one being considered are zoned GI-General Industrial (east), GB-General Business (south), and R-3 Residential (west). The area north of the lots is zoned A-1: Agricultural in the Joint Jurisdictional Zoning Area. Jose noted zoning these two lots into the GB General Business district has been the plan since the area was platted in April 2024. The intent of these two lots was to provide space for commercial development at a prominent corner of the community (e.g. the intersection between SD Hwy. 19 and SD Hwy. 50). Jose stated this item was considered by the City’s Planning and Zoning Commission at their January 13th meeting. At that meeting, the Commission voted 7-0 to recommend the City Council adopt the rezone as proposed. There was one member of the public present at the meeting. The individual represented the VCDC and stated they were in favor of the rezoning. 19-25 Mayor Cole read the title to the above-mentioned Ordinance and Council Member Murra moved adoption of the following Resolution: BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No. 1528 entitled An Ordinance Amending Title XV, Land Usage; Chapter 155, Zoning Regulations; Section 155.026 rezoning Lots 1 and 2, Block 1, Jack Powell Addition; City of Vermillion, Clay County, South Dakota from the R-3 Residential District to the GB General Business District of the City of Vermillion, South Dakota has been read and the Ordinance has been considered to advance to the second reading at this meeting being a regularly called meeting of the Governing Body of the City on this 21st day of January, 2025 at the Council Chambers in City Hall in the manner prescribed by SDCL 9-19-7 as amended. The motion was seconded by Council Member Hellwege. After discussion the question of adoption of the Resolution was put to a vote of the Governing Body and 9 members voted in favor of and 0 members voted in opposition to the motion. Mayor Cole declared the motion adopted. 7. Old Business A. Second reading of Ordinance 1527 to amend Title V, Public Works; Chapter 52, Garbage and Trash; Section 52.12 Collection to amend language to provide for a fine set by Resolution. John Prescott, City Manager, reported after several meetings with the licensed haulers in 2007 and 2008, the City Council adopted resolutions which established the days and start times for residential and business solid waste collection. John noted the City Code notes that the start time for collection and the days of the week for collection will be set by Resolution. The Code also notes that it shall be unlawful to collect garbage before the approved start time. John noted the Code does not state how a fine for a violation will be established and recently, a waste hauler was cited for collection of solid waste in a residential area before the designated collection start time. In the absence of an established fine, the City Attorney and hauler had to appear before the magistrate judge for the determination of a fine. John stated the proposed ordinance will amend City Code to allow the City Council to set a fine for a violation of the ordinance via adoption of a resolution. This would allow any future violators to pay the ticket, if agreeable, vs. going to court. A fine for a violation of this section of City Code will be established later on the agenda under New Business. 20-25 Second reading of title to Ordinance No. 1527, entitled An Ordinance Amending Title V, Public Works; Chapter 52, Garbage and Trash; Section 52.12 Collection to amend language to provide for a fine set by Resolution for the City of Vermillion, South Dakota. Mayor Cole read the title to the above-named Ordinance, and Council Member Holland moved adoption of the following: BE IT RESOLVED that the minutes of this meeting shall show that the title to the proposed Ordinance No. 1527 entitled An Ordinance Amending Title V, Public Works; Chapter 52, Garbage and Trash; Section 52.12 Collection to amend language to provide for a fine set by Resolution was first read and the Ordinance considered substantially in its present form and content at a regularly called meeting of the Governing Body on the 6th day of January, 2025 and that the title was again read at this meeting, being a regularly called meeting of the Governing Body on this 21st day of January, 2025 at the City Hall Council Chambers in the manner prescribed by SDCL 9-19-7 as amended. BE IT RESOLVED and ordained that said Ordinance be adopted to read as follows: ORDINANCE 1527 AN ORDINANCE AMENDING TITLE V, PUBLIC WORKS; CHAPTER 52, GARBAGE AND TRASH; SECTION 52.12, COLLECTION REQUIREMENTS TO AMEND LANGUAGE TO PROVIDE FOR A FINE SET BY RESOLUTION. BE IT ORDAINED, by the Governing Body of the City of Vermillion, South Dakota, that the City of Vermillion Code of Ordinances Title V, Chapter 52, Section 52.12 Collection Requirements be amended as follows: Every licensed commercial collector or hauler shall collect receivable solid waste from the residential districts at least once in each week. Residential collection will be permitted during a maximum of 3 days per week with the days to be determined by Resolution of the City Council. Every licensed commercial collector or hauler shall collect receivable solid waste from the business district at least 3 times in each week. The start time for residential and business district collection will be determined by Resolution of the City Council. It shall be unlawful to collect garbage in those districts before those established start times. A fine set by Resolution of the City Council shall be assessed for the unlawful collection of solid waste before the established start time or on a day not provided for by Resolution. Commercial garbage collectors shall be under no obligation to remove receivable solid waste unless the payments for the removal of the receivable solid waste, as provided by arrangement with the customer, shall have been made. Every licensed commercial collector or hauler may, in addition to the regular collection, collect all yard waste. Every licensed commercial collector must inspect each container of residential deposit of yard waste. This inspection shall be made prior to the collector or hauler emptying or debagging the container and depositing the yard waste in the collector’s vehicle for transportation to the landfill; and except as otherwise provided by §52.03, none of the contents of any container containing solid waste other than yard waste shall be accepted by any commercial hauler on any day other than the day designated for collecting yard waste. Request to close Market Street from West Main Street to the alley between West Main Street and West Kidder Street on Tuesday, April 15, 2025, from 5:00 p.m. to 6:30 p.m. for USD’s Vocal Jazz Concert at the Platz. Jack Baustian, Assistant to the City Manager, reported on an application received to close Market Street from West Main Street to the alley between West Main Street and West Kidder Street on Tuesday, April 15, 2025, from 5:00 p.m. to 6:30 p.m. for USD’s Vocal Jazz Concert at the Platz. Jack states the closure provides ample space for setup of the event along with participants, hosts, and attendees to support the event. Jack noted the applicant contacted the business owners directly impacted by the event. The applicant heard back from all representatives except Leo’s Sports Bar & Grill. The noise permit that is listed previously on the agenda as item 6.a is also directly related to this event. 21-25 Council Member Jennewein moved approval of the request to close Market Street from West Main Street to the alley between West Main Street and West Kidder Street on Tuesday, April 15, 2025, from 5:00 p.m. to 6:30 p.m. for USD’s Vocal Jazz Concert at the Platz. Council Member Price seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. B. Final Plat of Lots 1 through 14, Block 1, Jolley Addition; City of Vermillion, Clay County, South Dakota. Jose Dominguez, City Engineer, reported that the City of Vermillion has submitted a final plat as the owner of the land. The area to be final platted is roughly 3.5 acres in size and is the former Jolley School site addressed as 224 S. University Street. Jose noted the land will be bordered on the west by South University Street, on the east by Linden Avenue, and on the south by Maple Street. The north will be directly adjacent to single-family residences. The final plat proposes to subdivide the area into 13 single-family detached lots and an additional lot for park space. Jose stated this area was rezoned in November 2023 into the Jolley Planned Development District which allowed single-family homes and parks as the permitted uses. The PDD was divided into three areas. The area along South University Street allowed for residences but had a larger front yard setback (e.g. 40 feet); while the area fronting Linden Avenue had a front yard setback of 25 feet. The third area was along Maple Street and intended for park usage. Jose noted Staff reviewed the final plat and found that it complies with all code provisions except for the right-of-way width along Maple Street. The Subdivision Ordinance requires that rights-of-way be at least 66 feet in width, in this instance Maple Street was constructed in a 30-foot right-of-way in the 1920s. In the late 1990s the school dedicated an easement of 14 feet wide along Maple Street to construct a parking lane. Jose stated because Maple Street is not planned to be widened, and because the City will own the adjacent park, Staff believes that the right-of- way width along Maple Street should remain 44 feet and not be increased to 66 feet. Jose noted the applicant will also be dedicating all utility easements and rights-of-way for the necessary streets. The lots vary in size to promote different sizes and styles of houses to be constructed in the area. The lots are similar in size to those found in the neighborhood. Jose stated this item was considered by the Planning and Zoning Commission at their January 13th meeting. At that meeting, the Commission had several questions regarding the size of the park and what possible amenities would be located there. Additional conversation was had regarding the width of the existing and proposed Maple Street right-of- way. After a brief discussion, the Commission recommended 7-0 that the City Council approve the plat as presented. Discussion followed on the size of the lots and construction of the area. Jose explained the process for the asbestos and timeline for construction. 22-25 After reading the same once, Council Member Jennewein moved approval of the following plat: WHEREAS IT APPEARS that the owners thereof have caused a plat to be made of the following described real property: Lots Lots 1 through 14, Block 1, Jolley Addition City of Vermillion, Clay County, South Dakota for approval. BE IT RESOLVED that the attached and foregoing plat has been submitted to and a report and recommendations thereon made by the Vermillion Planning Commission to the City Council of Vermillion which has approved the same. BE IT ALSO RESOLVED that access shall be granted to the lot in accordance with the City of Vermillion street access and driveway approach policy, which requires an application permit. BE IT FURTHER RESOLVED that the attached and foregoing plat has been submitted to the Governing Body of the City of Vermillion which has examined the same, and it appears that the systems of streets and alleys set forth therein conforms to the system of streets and alleys of the existing plat of such city, and that all taxes and special assessments, if any, upon the tract or subdivision have been fully paid and that such plat and survey thereof have been executed according to law, and the same is hereby accordingly approved. The motion was seconded by Council Member Thaler. Discussion followed and the question of the adoption of the Resolution was presented for a vote of the Governing Body. 9 members voted in favor of and 0 members voted in opposition to the Resolution. Mayor Cole declared that the Resolution was adopted. C. Resolution to establish a fine for violating City Code section 52.12. John Prescott, City Manager, reported that earlier on the agenda is the second reading of Ordinance 1527. The ordinance would add language to City Code section 52.12 to allow the City Council to set a fine via adoption of a Resolution for collecting garbage on a day not permitted or before the designated start time. As the second reading of Ordinance 1527 was approved, Resolutions to establish a fine are attached for City Council consideration. John noted based on not having a current fine in place, Staff proposes to adopt a resolution amending fines related to violating the collection requirements for trash and garbage. John noted there are two resolutions to consider. The first resolution sets a fine for each violation being $56.50. The second resolution sets a progressive fine scale with the first offense within a calendar year being $56.50 and each offense thereafter being $106.50. In both resolutions, court costs are additional on top of these fines. The City Council is not limited to these two options. A different resolution can be developed to reflect the direction of the City Council. 23-25 After reading the same once, Council Member Price moved adoption of the following: RESOLUTION ESTABLISHING FINE FOR GARBAGE AND TRASH COLLECTION REQUIREMENTS WHEREAS, Section 52.12 of the Vermillion City Code established collection requirements for garbage and trash haulers within Vermillion City limits; and WHEREAS, Section 52.12 of the Vermillion City Code allows for the City to establish and enforce fines assessed for unlawful collection of solid waste before the established start time or on a day not provided for by Resolution; and WHEREAS, all garbage and trash haulers must follow the requirements set in sections 52.01 through 52.21 in the Vermillion City Code; and NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Vermillion, South Dakota, at a regular meeting thereof in the Council Chambers of City Hall at 6:00 p.m. on the 21st day of January 2025 that fee and fine rates be adopted as follows: Fine: Unlawful Collection of Solid Waste: Fifty-Six Dollars and Fifty Cents ($56.50) plus court costs for the first offense within a calendar year and One Hundred and Six Dollars and Fifty Cents ($106.50) plus court costs for each additional offense within the same calendar year thereafter. John reported on the BID Board #1 – Wednesday, January 29 at Powell Conference room at 4:00 p.m. B. John reported on four raffle notifications: • The USD Student Occupational Therapy Association will be selling raffle tickets at 1 for $10 or 3 for $25 from February 3, 2025 to March 3, 2025. The drawing will be on March 4, 2025. Prizes are a Ninja Creami, a $100 Amazon gift card, and an Owala water bottle with gift cards. Proceeds from the raffle will be used for educational classes and a conference costs. • Vermillion After Prom Committee is selling $20 raffle tickets from January 26 to February 9, 2025. Each raffle ticket is numbered and matches up with a square on a Super Bowl Board. The intersection of the last digit of the score of each team in the Super Bowl at the end of each quarter will determine the winner of the $100, $150, $200, and $250 prize. The proceeds will be used for food, prizes,  and entertainment for the 2025 after prom party and post prom breakfast. • St. Agnes will be selling $5 raffle tickets during their Classic event on Friday, January 31, 2025. The prize is $250 in pork loins. The raffle proceeds will be used to cover technology and other maintenance and expenses. • St. Agnes will be selling $20 raffle tickets during their Classic event on Friday, January 31, 2025. The prize is $250 towards a silent or live auction event that evening. The raffle proceeds will be used to cover technology and other maintenance and expenses.
