Unapproved Minutes Council Special Session October 6, 2025 Monday 12:00 noon The special session of the City Council, City of Vermillion, South Dakota was held on Monday, October 6, 2025, at 12:00 noon at the John “Jack” Powell Conference Room. 1. Roll Call Present: Leber, Price, Holland, Jennewein, Hellwege, Cheeseman, Mayor Cole Absent: Thaler, Murra 2. Adoption of Agenda 695-25 Council Member Leber moved approval of the agenda with adding an executive session per 1-25-2(3) – Legal Matters. Council Member Cheeseman seconded the motion. Motion carried 7 to 0. Mayor Cole declared the motion adopted. 3. Visitors to be Heard - None 4. Overview of 2024 Audited Comprehensive Annual Financial Report – Chad Regnier, Williams & Company Chad Regnier, representing Williams & Company, P.C., provided Council Members with the Audited Comprehensive Annual Financial Report for 2024. Chad reviewed the contents of the Comprehensive Annual Financial Report. Chad answered questions of the City Council on the report. Discussion followed. 5. Board/Committee Spotlight – BID #1 and BID #2 – Alex Ruth, Assistant to the City Manager Alex Ruth, Assistant to the City Manager, reported on BID #1 and BID #2. Alex reviewed that BID #1 is the $2 a night tax imposed on all short- term hotel stays to help promote tourism. Alex noted that $30,000 is held in the reserves for this fund and anything over $30,000 gets paid to the Vermillion Chamber and a 2% fee to the City for accounting fees. Alex reviewed BID #2 which was created to help facilitate the downtown streetscape project. This was to make downtown a safer space for everyone. Alex stated that a portion of the cost was then assessed to 1 the property owners for the construction of the streetscape. Alex asked if the Council would like to keep the current members or open it up to the public to apply. A consensus of the Council was to keep the same people on till the end of the 10-year assessment period. 6. Tax Increment Financing Guidelines Proposal – Alex Ruth, Assistant to the City Manager Alex Ruth, Assistant to the City Manager, presented on implementing Tax Increment Financing Guidelines to make a TIF project go smoothly. Alex presented what other cities do for TIFs and proposed an outline for Staff to follow. Discussion followed on TIFs in the state and how Vermillion fits into that. Discussion followed on the timeline of TIFs and issues that arise with developers’ TIFs. The Council wanted to receive a copy of the slides to review before a follow-up discussion is held at a later date. 7. Briefing on October 6th, 2025, City Council Regular Meeting Council reviewed items on the agenda with City Staff. No action was taken. 8. Executive Session per 1-25-2(3) – Legal Matters Council Member Cheeseman moved to go into executive session at 12:53 p.m. for legal matters per 1-25-2(3). Council Member Hellwege second the motion. Motion carried 7 to 0. Mayor Cole declared the Council in executive session. Mayor Cole declared the Council out of executive session at 1:25 p.m. 9. Adjourn 696-25 Council Member Jennewein moved to adjourn the Council special session at 1:27 p.m. Council Member Price seconded the motion. Motion carried 7 to 0. Roll Call Present: Thaler, Leber, Price, Holland, Jennewein, Hellwege, Cheeseman, Murra, Mayor Cole 2. Pledge of Allegiance 3. Minutes A. Minutes of September 15, 2025, Special Session, September 15, 2025, Regular Session, and September 22, 2025, Special Session. 697-25 Council Member Murra moved approval of the September 15, 2025, Special Session, September 15, 2025, Regular Session, and September 22, 2025, Special Session minutes. Council Member Leber seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. 4. Adoption of Agenda 698-25 Council Member Price moved approval of the agenda. Council Member Hellwege seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. 5. Visitors to be Heard 3 A. Jordan Deffenbaugh, 1052 AFSCME Council, is here about Brandon Steeneck’s employment with the City. Jordan stated he is here to support Brandon’s employment with the City of Vermillion. Jordan read a letter from Brandon’s sister. The letter talked about Brandon being a part of the military and the arrangement he has with her to stay at her house during his on-call time. The letter asked to update the on-call from 15 minutes to 30 minutes. John Jupiter, 7405 E. Donnelly Drive, Sioux Falls, stated he is the brother-in-law of Brandon Steeneck. John stated he is an auditor by trade and reviews policy as a living. John stated that this is an outdated policy. John noted he has knowledge that Brandon has stayed at hotels, at his own expense, and has stayed at his sister’s house. Brian Summervold, 4755 309th Street, Alcester, is speaking on Brandon Steeneck and how he may lose his job due to being two minutes outside the on-call 15-minute rule. Brian stated he has served the City with no late records. Brian stated there are other employees that live outside the timeframe and shows selective policy. Candy McDonald, 2109 Old Bridge Road, Vermillion, stated that she does not personally know Brandon and thinks this is totally unfair. Candy stated that this is not a good look for Vermillion. Candy noted she is scared for her son’s job since they live right outside of town. Christina Steeneck, Alcester, Brandon’s wife, stated that he has followed the on-call policy for six years. Christina stated that she is fearful of him losing his means of support. Christina noted she is here to humanize him because you do not know him. Christina spoke on his character and stated he is a normal man trying to live, work and support his family. B. Native American Day Proclamation – Vermillion Human Relations Commission. Dwayne Williams, Human Relations Commission, read the following: Proclamation Celebrating Native American Day WHEREAS, the City of Vermillion recognizes and values the diversity of its residents and the contributions of all cultures that enrich our community; and WHEREAS, Native American Day celebrates the culture, heritage, history, and resilience of indigenous peoples all across the United States; and WHEREAS, thirty-five years ago South Dakota became the first state to officially recognize and celebrate Native American Day; 4 NOW, THEREFORE, we, the Vermillion Human Relations Commission of the City of Vermillion, do hereby proclaim October 13, 2025 as Native American Day in the City of Vermillion. We encourage residents to participate in events and activities that help us better understand and appreciate the history, culture, and contributions of Native Americans, as well as the unique challenges they continue to face; and to work together to create a more just and equitable society for all. By celebrating our diversity and promoting cultural awareness and understanding, we can create a stronger and more vibrant community. Council Member Cheeseman thanked the commission and the citizens of this community. C. Fire Prevention Week Proclamation. Mayor Cole read the following proclamation: WHEREAS, the City of Vermillion is committed to ensuring the safety and security of all those living in and visiting our city; and WHEREAS, fire remains a serious public safety concern both locally and nationally, and the presence of lithium-ion batteries in many household devices introduces unique fire risks; and WHEREAS, most of the electronics used in homes daily — including smartphones, tablets, laptops, power tools, e-bikes, e-scooters, and toys — are powered by lithium-ion batteries, which if misused, damaged, or improperly charged, can overheat, start a fire, or explode; and WHEREAS, the National Fire Protection Association® (NFPA®) reports an increase in battery-related fires, underscoring the need for public education on the safe use of lithium-ion batteries; and WHEREAS, residents should follow three key calls to action: Buy only listed products, charge batteries safely, and recycle them responsibly to prevent battery-related fires; and WHEREAS, lithium-ion batteries store a large amount of energy in a small space, and improper use such as overcharging, using off-brand chargers without safety certification, or exposing batteries to damage can result in fire or explosion; and WHEREAS, the proper disposal and recycling of lithium-ion batteries help prevent environmental hazards and reduce fire risks in the home and community; and 5 WHEREAS, the City of Vermillion’s first responders are dedicated to reducing the occurrence of fires through prevention, safety education, and community outreach; and WHEREAS, the 2025 Fire Prevention Week™ theme, “Charge into Fire Safety™: Lithium-Ion Batteries in Your Home,” serves to remind us of the importance of using, charging, and recycling lithium-ion batteries safely to reduce the risk of fires in homes and communities. NOW, THEREFORE, BE IT RESOLVED we, the governing body of the City of Vermillion, South Dakota, do hereby proclaim October 5 – 11, 2025 as FIRE PREVENTION WEEK and urge all citizens to Buy, Charge, and Recycle Safely any products powered by lithium-ion batteries during Fire Prevention Week 2025, follow key lithium-ion battery tips and guidelines, and support the many public safety activities and efforts of Vermillion’s fire and emergency services. Public Power Week Proclamation. Mayor Cole read the following proclamation: WHEREAS, we, the citizens of the City of Vermillion, South Dakota place a high value on local control over community services and, therefore, have chosen to operate a community-owned, locally controlled, not-for- profit electric utility and, as consumers and owners of our electric utility, have a direct say in utility operations and policies that are decided at open public meetings; and WHEREAS, the City of Vermillion Light & Power Department provides our homes, businesses, industry, social services, and government agencies with reliable, efficient, and cost-effective electricity, employing 6 sound business practices designed to ensure the best possible service at not-for-profit rates; and WHEREAS, the City of Vermillion Light & Power Department is a valuable community asset that substantially contributes to the well-being of local citizens through energy efficiency, customer service, environmental protection, economic development, and safety awareness; and WHEREAS, the City of Vermillion Light & Power Department is a dependable and trustworthy institution whose local operation is transparent and continues to make our community a better place in which to live and work; and WHEREAS, the City of Vermillion Light & Power Department will continue to work to bring low-cost, safe, and reliable electricity to community homes and businesses just as it has since 1915, the year in which the utility was created to serve the citizens of the City of Vermillion. NOW, THEREFORE, BE IT RESOLVED that we, the governing body of the City of Vermillion, South Dakota, do hereby proclaim that the week of October 5 through October 11, 2025, be designated as PUBLIC POWER WEEK In order to honor the City of Vermillion Light & Power Department for its contributions to the community and to educate consumer-owners, policy makers, and employees on the benefits of public power. BE IT FURTHER RESOLVED, that our community joins hands with more than 2,000 other public power systems in the United States in this celebration of public power, which put our residents, businesses, and the community before profits. Public Hearings 7 A. Special Assessment Roll Resolution for nuisance abatement. Katie Redden, Finance Officer, reported that on September 2nd the City Council adopted a resolution setting the public hearing for tonight for consideration of the special assessment roll. Katie stated that the Notice of Hearing Resolution was published and mailed to the property owners. Katie stated that the assessments are for nuisance abatement for grass/weed removal, snow removal and removal of debris. Katie reported that fourteen assessments have been paid since the notices were mailed and have been removed from the listing. Katie reported that, if adopted, the listed property owners will be sent this resolution allowing 30 days to pay the assessment without interest and if not paid it will be certified to the County to be included on next year’s taxes. Discussion followed. 699-25 After reading the same once, Council Member Jennewein moved adoption of the following: RESOLUTION APPROVING THE SPECIAL ASSESSMENT ROLL AND NOTICE OF SPECIAL ASSESSMENTS FOR NUISANCE ABATEMENT IN THE CITY OF VERMILLION, SOUTH DAKOTA WHEREAS, the Governing Body of the City of Vermillion, Clay County, South Dakota has established a special assessment roll for defraying the cost of nuisance abatement against the several tracts of real property upon: NUISANCE ABATEMENT as listed at the end of this Resolution in the City of Vermillion, Clay County, South Dakota. The assessment roll was filed in the office of the City Finance Officer of the City of Vermillion, South Dakota on the 28th day of August 2025; and WHEREAS, said Governing Body, by resolution, fixed this time and place for hearing upon the assessment roll for the 6th day of October, 2025 and directed the City Finance Officer of the City of Vermillion, Clay County, South Dakota to publish a Resolution and Notice for such hearing in the official newspaper of Vermillion, South Dakota, one week prior to the date set for said hearing; and WHEREAS, said Resolution and Notice described, in general terms, the improvement for which the special assessment is levied, the date of filing of the assessment roll, the time and place for the hearing, that the assessment roll would be open for public inspection at the office of the City Finance Officer of Vermillion, South Dakota, and referred to the assessment roll for further particulars; and 8 WHEREAS, the Finance Officer was further directed to mail a copy of the Resolution and Notice by first-class mail, postage thereon fully prepaid, addressed to the property owners of any property to be assessed for such improvement at their address, as shown by the records of the Director of Equalization, at least one week prior to the date set for the hearing; and WHEREAS, it now appears that the Finance Officer has caused notice of the hearing to be given in the manner provided by the aforementioned Resolution and Notice, and by law; and WHEREAS, all persons interested have been given an opportunity to appear and show cause why the Governing Body should not approve the assessment roll, and the assessments against the respective premises of the owners, and the Governing Body has determined that the assessment roll is in all respects true and correct, and according to law. NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the City of Vermillion, Clay County, South Dakota that the special assessment roll is hereby approved without amendment or change. BE IT FURTHER RESOLVED, that the approved assessment roll be filed in the office of the City Finance Officer the day after approval of the assessment roll. The City Finance Officer shall publish once in the official newspaper of Vermillion, South Dakota, a copy of this Resolution and Notice, along with the approved assessment roll. BE IT FURTHER RESOLVED, that the City Finance Officer shall immediately mail to the owner, or owners, of each lot, parcel or piece of ground as shown by the assessment roll, a copy of this Resolution and Notice along with the approved assessment roll. NOTICE IS HEREBY GIVEN, that the assessments mentioned in the assessment roll will be payable according to the provisions of Plan One as set forth in SDCL Sections 9-43-102 to 9-43-113. NOTICE IS FURTHER GIVEN, that any assessment under Plan One, or any installment thereof, may be paid without interest to the City Finance Officer whose office is located in the Municipal Building at 25 Center Street in the City of Vermillion, South Dakota, at any time within thirty (30) days after the filing of the approved assessment roll in the office of said City Finance Officer. Thereafter, and prior to the due date of the first installment, the entire assessment remaining, plus interest thereon from the filing date to the date of payment may be paid to the said City Finance Officer. No installment under Plan One shall be paid to the said City Finance Officer on or after its due date, and on and 9 after said date such installment shall be paid only to the County Treasurer with interest. NOTICE IS FURTHER GIVEN, that the approved assessment roll will be filed with the City Finance Officer on 6th day of October 2025. The assessment is payable in one (1) installment at ten percent (10%) per annum interest on unpaid installments. The first installment due date is January 1, 2025. First Reading of Ordinance 1545 to amend Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Lot 5, Block 1, Bliss 2nd Addition, City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation to the R-1 Residential District (property located at 1200 W. Main Street). Jose Dominguez, City Engineer, reported on the first reading of Ordinance 1545 to amend Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Lot 5, Block 1, Bliss 2nd Addition, City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation to the R-1 Residential District. Jose stated the owners of the land, Heines, have requested that the City rezone their property from the NRC Natural Resource Conservation District to the R-1 Residential District. Jose stated the area is roughly 4.86 acres in size and is addressed as 1200 W. Main Street with the existing uses surrounding the property are commercial to the north and east and residential to the west and south. Jose stated the zoning to the north is GB General Business, to the east it is GB General Business and LI Light Industrial, and to the west it is R-1 Residential. Jose noted the property to the south is outside of City limits and is in the Joint Jurisdiction zoning area and is within the A-1 Agricultural zoning district. Jose reported that when property is annexed into the City it is automatically placed in the most restrictive zoning district which is the most conservation district. Jose noted the owners of lots 2 through 4 rezoned their parcels in January 2012 from the NRC Natural Resource Conservation district to the R-1 Residential district. The owner of lot 1 rezoned his property from the NRC Natural Resource Conservation District to the GB General Business district in December 2021. The owner of lot 5 never requested their parcel to be rezoned. Jose noted the City provided the Heines with information to contact the owners of 18 properties that cover 801,455 square feet. Jose stated for the meeting to occur, the Heines had to collect signatures from the owners of at least 360,655 square feet, or 45% of the aggregate area. 17 The Heines collected signatures from owners of six properties who owned 618,508 square feet. Jose stated the Heines desire for rezoning their property is to allow for the construction of an addition to the existing house which the current zoning does not allow for residential uses. Jose noted the existing residence can remain in the district, but no additions can be completed. For the Heines to be able to construct the desired addition, the property needs to be rezoned to the R-1 Residential district. Jose noted rezoning this property will not be construed as offensive to the neighbors. Similarly zoned property exists to the west and the property to the east and north is in a different zoning district that allows for what may be considered offensive uses by residential construction. Jose reported this item was considered by the City’s Planning and Zoning Commission at their September 22nd meeting with four members of the public present at the meeting, the owners and VCDC staff. Jose noted the VCDC spoke in favor of the rezone and that it would not be harmful to the neighboring properties. City Staff answered questions from the Commission regarding the possibility of developing part of the lot south of the bluff. After discussion, the Commission voted 6-0 to recommend the City Council adopt the rezone as proposed. 701-25 Mayor Cole read the title to the above-mentioned Ordinance and Council Member Holland moved adoption of the following Resolution: BE IT RESOLVED that the minutes of this meeting shall show that the title to proposed Ordinance No. 1545 entitled An Ordinance amending Title XV, Land Usage; Chapter 155 Zoning Regulations; Section 155.026 rezoning Lot 5, Block 1, Bliss 2nd Addition, City of Vermillion, Clay County, South Dakota from the NRC Natural Resource Conservation to the R-1 Residential District (property located at 1200 W. Main Street) of the City of Vermillion, South Dakota has been read and the Ordinance has been considered to advance to the second reading at this meeting being a regularly called meeting of the Governing Body of the City on this 6th day of October, 2025 at the Council Chambers in City Hall in the manner prescribed by SDCL 9-19-7 as amended. The motion was seconded by Council Member Price. After discussion the question of adoption of the Resolution was put to a vote of the Governing Body and 9 members voted in favor of and 0 members voted in opposition to the motion. Appeal of Zoning Administrator’s Decision Denying a Conditional-Use Permit for the Operation of a Small Animal Veterinarian at 306 Bower Street due to the location being within 150 feet of a residential structure. Jose Dominguez, City Engineer, reported on the appeal of the Zoning Administrator’s decision denying a Conditional-Use Permit for the operation of a small animal veterinarian at 306 Bower Street due to the location being within 150-feet of a residential structure. Jose stated the City received an application for a Conditional-Use Permit (CUP) from the Vermillion Area Chamber and Development Company (VCDC), on behalf of the owner, on September 19, 2025. The CUP was for the operation of a small animal veterinarian at 306 Bower Street. Jose noted the application could not be presented to the Planning and Zoning Commission since it did not meet the ordinance criteria of the use being at least 150-feet from a residential structure within a residential district. Staff does not have the authority to modify the Code or overlook the required criteria. Due to this the application was denied. Jose stated Staff’s decision was appealed within the allowable window for an appeal; the City received an appeal from the VCDC and is included in the packet. Jose noted the City’s current process for appeals follows the Code of Ordinances Section 155.100. This section sets the City Council, acting as the Board of Adjustments, as the body that considers and decides on appeals. Jose noted any decision made by the Zoning Administrator can be appealed by anyone aggrieved by the decision. The appeal must be filed within 30 days of the Zoning Administrator’s decision. To approve any appeal, a concurring vote of 2/3 of the members of the Board is required (e.g. 6 votes in favor of the appeal). Jose reported the small animal veterinarian use is a conditional use within the GB General Business district. Conditional Use Permits (CUP) are considered by the City’s Planning and Zoning Commission, however, CUPs sometimes must meet standards prior to being considered by the Planning and Zoning Commission. In this instance, the ordinance requires that small animal veterinarians be “located 150 feet from residential district area (measured from the closest point of the outside walls of both structures).” The proposed location is within 150 feet of three residential structures located in the R-3 Residential district. The map showing the 150-foot distance from 306 Bower Street is attached. Due to this fact Staff denied the application and prohibited it from being considered by the Planning and Zoning Commission. 19 Jose stated the ordinance does not layout specific items for the Board to consider when deliberating on the appeal. Rather, the ordinance states that anyone aggrieved by the decision can appeal it. The aggrieved person shall explain why “such decision is illegal, in whole or in part, specifying the grounds of the illegality.” Jose gave background that prior to 2019 the ordinance had two uses associated with veterinarians in the GB General Business district. Both uses were CUPs, and they both had standards that needed to be met prior to being considered by the Planning and Zoning Commission. The uses were “veterinarian” and “kennel”. The “veterinarian” use did not allow outdoor kenneling of dogs within 150 feet of a residential area, while “kennels” could not be located within 150 feet from a residential area measured from the closest point of the outside walls of both structures. In 2019 the “kennel” use was removed as a separate use and included as part of the “small animal veterinarian” use. Regardless, the distance requirement of 150 feet was kept to reduce the negative effect on residential uses of dogs barking. Jose stated there are other locations within the strip mall that could be used for a “small animal veterinarian” use that will not be affected by the 150-feet distance. Steve Waller, 417 Lewis, is in favor of a vet and stated that Vermillion is in need of a vet clinic. Mary Waller, 417 Lewis, stated she is a client of the Lewis and Clark Vet Clinic. Mary stated that Steve and herself can transport to Yankton, but some people that live in this town are not able to. Jim Peterson, VCDC CEO, stated that MMB investments is okay with having a vet clinic within 150 feet of their residence. Jim stated that the VCDC has looked to get a vet here for a long time and to consider the appeal. Donny Stewart, building owner, stated that the end spot works best for the building and the vet. Donny noted that if animals need to go to the bathroom there is a grass area there that wouldn’t be in front of other businesses. Council Member Leber asked if they are kenneling overnight and if animal waste was going to be cleaned up immediately. Donny Stewart stated that there will be no overnight kenneling and the property will be cleaned up. 20 Council Member Jennewein asked if this needs to be revisited to look at hospital vs clinic uses. Jennewein noted that this is a challenging one because it was applied as written but was the way it was written the intention. Council Member Price asked if the Council has any freedom with this distance in the ordinance. Darrell Jesse, Crary Huff, stated the Council does not have any legality to approve this appeal due to it being a distance. Discussion followed on the appeal process. Discussion followed on changing the ordinance to allow for a small animal vet clinic. Cherry Street). Jose stated that Lawrence Brady (Mr. Brady), owner of the land, has requested that the City rezone his property from the GB General Business District to the R-3 Residential District. The area is roughly 2.00 acres in size and is addressed as 1313 W. Cherry Street and the existing uses surrounding the property are mobile homes to the north and west, and businesses to the east and across West Cherry Street to the south. The zoning to the north and west is R-4 Residential and to the east and south is GB General Business. Jose noted the City has published a notice advertising tonight’s meeting in the Plain Talk, on the City’s website, and posted a notice on the land being rezoned and sent letters to the 13 property owners notifying them of tonight’s meeting. Jose stated Mr. Brady’s desire for rezoning his property is to redevelop the area in the future into apartments by using portions of the existing Studio 13 Motel for studio apartments and possibly construct a new building for one-bedroom apartments. Jose noted General Business zoning district does not allow any residential uses and Mr. Brady cannot construct apartments or use the existing property for residential uses. Jose reported that Mr. Brady is allowed by ordinance, and statute, to rent rooms in the existing hotel on a “extended stay” basis. This is a loophole that would allow this hotel, or any other hotel, to serve as an apartment complex since the rooms could be rented on a yearly basis. The $2.00 per night, per occupied hotel room would be due for the first 28 days of any “extended stay” hotel rental. Jose stated rezoning the parcel to R-3 Residential would allow Mr. Brady to utilize his property as desired (e.g. apartments) and, if desired, give the City time to amend the ordinance to address the issues with “extended stays.” Jose stated besides the discussed loophole, the other issue with the request is the appearance of it being “spot zoning.” This type of zoning is only considered illegal when: It is to the benefit of a singular small parcel, not in the public’s interest, does not follow the comprehensive plan, and the decision by the governing body could be considered unreasonable. Jose reported the following are Staff’s comments regarding the items if the rezone could be considered “spot zoning”: 26 1. Rezoning is for the benefit of a singular small parcel: The parcel in question is roughly 2 acres in size. This parcel could be further subdivided to allow for additional commercial lots. 2. Rezoning is not in the public’s interest: Rezoning the parcel would be in the public’s interest. First, the property is currently bounded on two sides by residential uses. The existing zoning would allow for uses that could be considered offensive to residential uses (i.e. bars, restaurants, car sales, lumberyards, car washes, etc.). Leaving the current zoning may prove more harmful to the existing neighbors than rezoning the land to other residential uses. Secondly, the proposed use will provide additional housing in the community. Multi-family residential uses would be inspected by the City to maintain a minimum standard that may not be required from hotel rooms (i.e. the City does not inspect hotel rooms). 3. Rezoning does not follow the comprehensive plan: Rezoning this parcel will meet several goals and objectives found in the comprehensive plan. For example: Will provide a variety of housing (pg. 13), will address density and affordability of housing (pg. 13), will create a neighborhood that is compatible with adjacent land uses (pg. 48), will increase the supply of housing (pg. 48), will focus new development within City limits (pg. 67), will encourage compact development (pg. 67), will ensure health and safety of citizens (pg. 69), will utilize standards that minimize conflicts and nuisances (pg. 69). Although the rezoning will remove available land for commercial development there are other parcels available for commercial development and there are also vacant spaces on existing buildings for commercial uses. 4. Rezoning is not considered unreasonable: When making the recommendation, the Council will consider the effect on the neighboring area, how the rezoning will affect the public in general, and any comments from the public. This means that the rezoning will not be arbitrary and capricious. Jose noted this item was considered by the City’s Planning and Zoning Commission at their September 8th meeting. There were two members of the public present at the meeting, the owner and VCDC staff. The VCDC spoke in favor of the rezone and explained that there was a need for housing in the community. The owner answered questions regarding how the building would be used and the need for one-bedroom apartments in the community. After discussion, the Commission voted 7-0 to recommend the City Council adopt the rezone as proposed. Council Member Cheeseman asked if there was a plan for this location. Logan Peterson, Bluepeak, presented on Bluepeak’s expansion into Vermillion. Logan stated that in early 2024 the expansion to Vermillion was competed with $8.3M investment. Logan went over upgrades they will do for customers as new technology becomes available. Logan stated Blue Peak has invested $27,000 in 2025 for organizations in Vermillion. Discussion followed on issues with cables being buried in a timely manner and reliability. B. Tom Street Engineering Amendment #2. Shane Griese, Utility Manager, reported on an amendment #2 for Banner Engineering. Shane noted on February 22, 2022, an Engineering Agreement was entered between the City of Vermillion and Banner Associates for the design of the Tom Street Lift Station. This design was to replace the existing Tom Street Lift Station which was originally constructed in 1975. The total cost for that agreement is $112,200.00. Shane noted the project design was delayed after City Staff requested modifications to the lift station design to accommodate sewer service to the recently purchased land now known as the Jack Powell Addition. Shane stated on May 1, 2023, the Tom Street Lift Station replacement project was awarded to H&W Contracting for $1,553,066.45. That project had a substantial completion date of June 1, 2024. The substantial completion date was not met. The project is currently 494 days behind schedule, Liquidated Damages (LD) are being tracked on this project at a rate of $1,350/day. As of October 5, 2025, $666,900.00 in LDs have been accumulated. Shane reported on March 3, 2025, the City Council approved Amendment #1 to the Banner contract. That amendment included design modifications and additional work due to delays in construction. That amendment increased the contract with Banner by $26,762.30 bringing the total contract to $138,962.30. 34 Shane reported that Banner Associates has prepared Amendment #2. This amendment has four modifications to the original contract; these modifications are all due to project delays in construction. 1. Construction Administration Effort - $15,684.00 2. Construction Observation Effort - $9,176.00 3. Remaining Effort - $19,500.00 4. Contingency - $15,000.00 Shane noted these four modifications combine for a total increase of $59,360.00, bringing the total cost of the engineering contract to $198,322.30. Council Member Murra stated that this is frustrating to increase the project by $60,000 because Banner is standing around and watching. Murra stated he is frustrated and mad and this project needs to be done. Shane stated that Banner is doing weekly meetings to get the contractor to do the work. Shane stated that Banner is trying to do as much as they can to get this going. Shane noted that no one can force people to come to work and get going. Discussion followed on liquidated damages, hard costs, and how to move forward. 707-25 Council Member Thaler moved approval of the amendment #2 for Banner Construction to increase the contract by $44,860 to $183,822.30 and to have a Banner Associate here if they would like the additional $15,000 at the end of the project. Katie stated that the Department of Legislative Audit has reviewed the audit, and their letter of acceptance has not yet been received. Katie noted that the City Council will need to accept the report. Katie noted that the report is available on the City web site. Katie Redden, Finance Officer, reported that during the budget process it was proposed to raise the storm drainage fee to provide additional revenues for storm drainage projects. Katie noted that the fee is charged to all properties in the City and is included on the property tax statements. Katie stated that the proposed increase will generate $9,000 of additional revenue for the storm water fund for 2025. Katie reviewed the budgeted expenditures for 2025 and 2026 for the storm drainage fee. Katie noted that for a residential lot of 10,000 square feet, the fee would go from $37.88 to $39 per year. Mayor Cole declared that the Resolution was adopted. E. Historic Preservation Commission appointment. Mayor Cole recommended appointing Dennis Felecos. 710-25 Council Member Jennewein moved approval of the Dennis Felecos to the Historic Preservation Commission. Council Member Hellwege seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. F. Tree Board appointment. Mayor Cole recommended appointing Russell Olson. 711-25 Council Member Thaler moved approval of Russell Olson to the Tree Board. Council Member Hellwege seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. G. Business Improvement District #1 appointment. Mayor Cole recommended appointing Joseph Tyner. 712-25 Council Member Hellwege moved approval of Joseph Tyner to the Business Improvement District #1. Council Member Price seconded the motion. Motion carried 9 to 0. Mayor Cole declared the motion adopted. 10. Bid Openings - None 11. City Manager's Report A. John reported on two meetings or events before the next City Council meeting on Monday, October 20, 2025: • Historic Preservation Commission meets on Wednesday, October 8 at 9:00 a.m. at the Powell Conference room at City Hall. • The Library Board of Trustees meets on Wednesday, October 15 at 6:00 p.m. at the Library. B. John stated recently, the City concluded a survey on the needs of established owner-occupied housing in the community. The survey helped identify repairs to help maintain viability and to determine how best to spend the $20,000 of grant funding recently awarded. There will be a public open house on Wednesday, October 15 from 5:00 to 37 7:00 p.m. where community residents can tell us about their specific needs and apply for funding. C. John noted the ribbon cutting of the new Law Enforcement Center is Tuesday, October 7 at 1250 Stanford Street at 4:00 p.m. D. John reported Wednesday, October 8 is the annual Police, Fire and EMS Open House. It is from 5:00 to 7:00 p.m. at the Law Enforcement Center. Tours are not part of this event but will have activities for the kids and free food available. E. John stated Friday, October 10 is the annual Vermillion Light & Power Open House. It is from 11:00 a.m. to 1:00 p.m. at the Municipal Service Center, 115 W. Duke Street. Enjoy a free lunch of a hamburger or brat and learn about public power. F. John noted the City offices will be closed next Monday, October 13 for the Native American Day holiday. G. John stated one raffle notification was received: St. Agnes is selling $1 raffle tickets from September 27, 2025 to October 19, 2025. The prize is a cooler with items valued at $300. The ticket sales are part of the Fall Festival held on October 19, 2025. Proceeds from the raffle go to the parish.
