CITY OF VERONA PUBLIC SAFETY AND WELFARE COMMITTEE NOVEMBER 12, 2018 VERONA CITY HALL MINUTES 1. Call to order: Heather Reekie called the meeting to order at 5:35 p.m. 2. Roll Call: Heather Reekie and Katie Kohl were present. Evan Touchett was absent. Also present: Police Chief Bernie Coughlin, City Attorney Bryan Kleinmaier, and City Clerk Ellen Clark. 3. Approval of Minutes: Motion by Reekie, seconded by Kohl, to approve the minutes from the October 22, 2018 Public Safety and Welfare Committee meeting. Motion carried 3-0. 4. Discussion and Possible Action Re: An application for a Class “B” Fermented Malt Beverage Retailer’s License from n + 1 Coffee and Beer Bar, LLC, 507 Bruce Street, #101, Verona, Wisconsin, Jessica Laufenberg, Agent. The applicant would like to serve coffee and beer to customers at Rocket Bicycle Studio and SBR Endurance Performance located at 507 Bruce Street. An espresso bar, coffee, two nitro coffees, six tap beers, and grab- n-go snacks will be served. Winter hours will be Tuesday – Saturday, 6:30 a.m. – 10 a.m., and 4:30 p.m. – 8 p.m.; Saturday 8 a.m. – Noon. Summer hours will be Tuesday – Friday 6:30 a.m. – 10 a.m., and 4:30 p.m. – 8:30 p.m.; Saturday 6:30 a.m. – 1 p.m. The café area is approximately 1,000 square feet, with room for approximately 25 customers. An outdoor patio area will be expanded to seat approximately 20 customers. Motion by Kohl, seconded by Touchett, to recommend to the Common Council to approve an application for a Class “B” Fermented Malt Beverage Retailer’s License for n + 1 Coffee and Beer Bar, LLC, 507 Bruce Street, #101, Verona, Wisconsin, Jessica Laufenberg, Agent, with the following conditions: 1. The outdoor patio fencing shall be a minimum of 48 inches tall. 2. Alcohol consumption shall be limited to the fenced area around the outdoor patio or inside the building. All areas where alcohol is consumed shall be monitored by staff. 3. The fence and gate for the outdoor patio shall comply with the requirements from the Police Department and Building Inspector. 4. The exit for the patio shall be labeled as an “exit only”. 5. The use of the outdoor seating area is permitted to operate from 7:00 a.m. to 10:00 p.m. seven (7) days per week. 5:38 p.m. – Mr. Touchett now present. Jessica Laufenberg explained that they refurbished 507 Bruce Street, and want to be able to serve coffee or beer after biking. They will want to expand to the patio this summer. The vibe is relaxed and experiential. They will come back to the committee to request a premise description amendment when the patio is ready to be used this summer. Motion carried 3-0. 5. Discussion and Possible Action Re: A Change of Agent request from Casey’s Marketing Company, d/b/a Casey’s General Store, 103 Prairie Oaks Drive, Verona, Wisconsin. Casey’s General Store is requesting a change of agent for their Combination Class “A” and “Class A” Liquor License from Emma Monheim to Susan Marie Dean. Motion by Reekie, seconded by Kohl, to recommend to the Common Council to approve the Change of Agent request for Casey’s Marketing Company, d/b/a Casey’s General Store, 103 Prairie Oaks Drive, Verona, Wisconsin, contingent upon a background check conducted by the Verona Police Department. Motion carried 3-0. 6. Discussion and Possible Action Re: Resolution No. R-18-059 approving entering into an intergovernmental agreement for a crowd control unit. This intergovernmental agreement includes the Cities of Verona, Monona, and Stoughton, and the Villages of McFarland and Oregon, to provide mutual assistance for crowd control during events where crowd control is warranted to protect public safety. Three members of City Staff will be trained and equipped to be part of the crowd control unit. The necessary training for this unit is funded by a grant from Wisconsin Emergency Management. The agreement has been reviewed by Stafford-Rosenbaum staff. Motion by Reekie, seconded by Kohl, to recommend to the Common Council to approve an intergovernmental agreement for a crowd control unit. Motion carried 3-0. 7. Discussion and Possible Action Re: Ordinance No. 18-933 amending Section 13 of Chapter 1 of Title 10, Motor Vehicles and Traffic, of the Code of Ordinances of the City of Verona, relating to stop signs. This amendment to Section 13 allows for the addition of stops signs in Phase 9 of Cathedral Point subdivision to include the intersections of Blackburn Bay Drive and Santa Maria Parkway, Santa Maria Parkway and East Chapel Royal Drive, and East Chapel Royal Drive and Cathedral Point Drive. Motion by Touchett, seconded by Kohl, to recommend to the Common Council to approve Ordinance No. 18-933 amending Section 13 of Chapter 1 of Title 10, Motor Vehicles and Traffic, of the Code of Ordinances of the City of Verona, relating to stop signs. Motion carried 3-0. 8. Discussion and Possible Action Re: Ordinance No. 18-934 amending Title 7, Chapter 1 of the Code of Ordinances of the City of Verona, relating to dangerous animals. The amendment to Code 7-1-6 adds the standards for the Police Chief to declare an animal dangerous, which include: 1. An animal that has attacked, bitten, injured or killed another animal or human being. 2. An animal that has chased, confronted or approached a person in a menacing fashion that would put a reasonable person in fear of being attacked, either off of the owner’s property or while on the owner’s property toward a person on adjacent public or private property 3. The animal has been trained for fighting or attack. 4. The animal has acted in any manner demonstrating that the animal is a threat to public safety. Animals declared to be dangerous are required to be removed from the City, or remain in the City subject to restrictions. An animal that has been trained for fighting or attack must be removed from the City. A penalty clause was also added in Section 4. Motion by Kohl, seconded by Touchett, to recommend to the Common Council to approve  Ordinance No. 18-934 amending Title 7, Chapter 1 of the Code of Ordinances of the City of Verona, relating to dangerous animals. Motion carried 3-0. 9. Discussion Re: Dane County Community Restorative Court Memorandum of Understanding. Mr. Kleinmaier stated this policy is a fundamental change in the way a person would be handled if they violate a particular ordinance or commit a misdemeanor. The Committee and Common Council will have to decide if you want to follow the codes we have now, or if you want the City to participate in this program. With this policy, someone not within City government would be looking at what the City is doing as regards charging people between the ages of 17 and 25. It is a significant enough change that it should be a policy determination to be made by the City. It leaves a lot of discretion to the City, but also adds oversight over the Police Department by another entity. He is not in favor of that. Chief Coughlin stated the Restorative Court adds another layer to the first offender program. One division is for municipal court, and one is for circuit court. The offender goes before a review committee established by the County, and is given a chance to repair the harm done in some way. The apology or repair of harm may dismiss the violation if the person that was hurt agrees. An argument in favor of this kind of agreement is that, in all likelihood, an offense that would be appropriate for this program probably would not be charged at all through the County. On the other hand, it may be that better charging decisions are required at the County level. It is important to find out if the program will include record keeping regarding results. It would be good to see some data that supports that this is an effective program. The consensus of the committee was to direct the Chief to request more data from the program to see how it is working. 10.
