CITY OF VERONA MINUTES PUBLIC SAFETY COMMITTEE February 13, 2023 1. Call to order: Heather Reekie called the meeting to order at 5:49 p.m. 2. Roll Call: Heather Reekie, Evan Touchett and Phil Hoechst. Also present: City Clerk Holly Licht, Police Chief Dave Dresser, and City Administrator Adam Sayre. 3. Public Comments: None 4. Approval of Minutes from the January 23, 2023 Public Safety and Welfare Committee meeting Motion by Reekie, seconded by Touchett to approve the minutes from the January 23, 2023 Public Safety and Welfare Committee meeting. Motion carried 3-0. 5. Discussion and Possible Action Re: An application for a “Class B” Reserve Intoxicating Liquor and Class “B” Fermented Malt Beverage license from AzTec Taqueria, LLC, d/b/a AzTec Taqueria, located at 160 Keenan Ct., Suite 5, Salvado Tecpoyotl Daniel, Agent Motion by Reekie, seconded by Hoechst to approve an application for a “Class B” Reserve Intoxicating Liquor and Class “B” Fermented Malt Beverage license from AzTec Taqueria, LLC, d/b/a AzTec Taqueria, located at 160 Keenan Ct., Suite 5, Salvado Tecpoyotl Daniel, Agent contingent upon final approval of the building inspector and fire department. Motion carried 3-0. 6. Discussion and Possible Action Re: An application for a Liquor License Premises Amendment from Hodge Podge, LLC, d/b/a Hodge Podge, located at 160 Keenan Ct., Suite 1, Katelynn Gibbons, Agent Motion by Reekie, seconded by Touchett to approve an application for a Liquor License Premises Amendment from Hodge Podge, LLC, d/b/a Hodge Podge, located at 160 Keenan Ct., Suite 1, Katelynn Gibbons, Agent without the additional of the bench in the front of the building and contingent upon final approval from the building inspector and fire department. Motion carried 3-0. 7. Discussion and Possible Action Re: A change of agent request from Kwik Trip, Inc. d/b/a Kwik Trip #1075, located at 233 Wildcat Way Motion by Reekie, seconded by Touchett a change of agent request from Kwik Trip, Inc. d/b/a Kwik Trip #1075, located at 233 Wildcat Way. Motion carried 3-0. 8. Discussion Re: Parking restrictions along Prairie Heights Drive between County Highway M and Locust Drive Touchett and Reekie are in favor of limiting parking near driveways along Prairie Heights Drive from County Highway M going west to Meadowside. 9. Approval of Minutes from the December 19, 2022 Public Safety and Welfare Committee meeting Motion by Touchett, seconded by Reekie to approve the minutes from the December 19, 2022 Public Safety and Welfare Committee meeting. Motion carried 3-0. 5. Discussion and Possible Action Re: A Special Event Permit application from Bill Martin for the SBR Endurance Performance Winter Wonderland Triathlon Run on Sunday, February 12, 2023 from 8 a.m. – 5 p.m. Only the running portion of the triathlon will take place on City property. The swim portion will be at the natatorium and the cycling will take place at SBR. Runners will be using the trail, weather dependent. There is a backup route if the trail is snowy/icy. along the same route. Heats of 12 runners will run throughout the day. Police traffic control is not necessary for the event. Motion by Reekie, seconded by Hoechst to approve a Special Event Permit application from Bill Martin for the SBR Endurance Performance Winter Wonderland Triathlon Run on Sunday, February 12, 2023 from 8 a.m. – 5 p.m. Motion carried 3-0. 6. Discussion and Possible Action Re: Temporary Class “B” Fermented Malt Beverage and “Class B” Wine license applications from the Verona Area Community Theater, 103 Lincoln Street, for February 9-11, 16-18, and 20-23, 2023; and May 11-13 and 19-21, 2023 – Dee Baldock, Agent The Verona Area Community Theater (VACT) is requesting 2 temporary license to serve beer and wine at their performances of Children’s Hour and Singin’ in the Rain Sr. Licensed bartenders will be serving alcohol. Staff recommends approval of the licenses. Motion by Reekie, seconded by Hoechst to approve a Temporary Class “B” Fermented Malt Beverage and “Class B” Wine license applications from the Verona Area Community Theater, 103 Lincoln Street, for February 9-11, 16-18, and 20-23, 2023; and May 11-13 and 19-21, 2023 – Dee Baldock, Agent. Motion carried 3-0. 7. Discussion and Possible Action Re: Ordinance No. 23-1017 amending Title 11, Chapter 2 of the Code of Ordinances relating to possession and use of marijuana Chief Dresser stated that he was concerned about OWIs and youth possession. His preference would be to not lower the fines for possession of marijuana. Reekie stated that she doesn’t want to make it look like the City condones marijuana use for kids. Hoechst stated that he didn’t think Verona needed to be at the forefront of reducing marijuana charge fees. Hoechst asked how frequently the City issues citations for marijuana possession. Chief Dresser stated that they had issued 6 so far in January. He added that possession is usually a secondary offense. Typically, they pull someone over for speeding or other violations and discover marijuana. Touchett suggested an escalating fee schedule for each additional offense. Hoechst stated he did not support the escalating fees and wants to keep the citation amount as is. Hoechst asked how long it take for an officer to issue a possession citation. Chief Dresser stated that it typically takes 15 minutes on scene and a half hour to complete the administrative paperwork and package as evidence. Motion by Reekie, seconded by Touchett to recommend that council approve the ordinance with an amendment that the citation fees double per each subsequent offense. Motion carried 2-1 with Hoechst voting no. 8. Adjournment: Motion by Touchett, seconded by Hoechst to adjourn at 6:17 p.m. Motion carried 3-0. Discussion and Possible Action Re: An application for a “Class B” Reserve Intoxicating Liquor and Class “B” Fermented Malt Beverage license from AzTec Taqueria, LLC, d/b/a AzTec Taqueria, located at 160 Keenan Ct., Suite 5, Salvado Tecpoyotl Daniel, Agent AzTec Taqueria is applying for a liquor license for their existing business on Keenan Ct. The license will cover the inside restaurant and the outdoor patio. Staff recommends approval of the license contingent upon final approval from the building inspector and fire department. Motion: Recommend that the Common Council approve an application for a “Class B” Reserve Intoxicating Liquor and Class “B” Fermented Malt Beverage license from AzTec Taqueria, LLC, d/b/a AzTec Taqueria, located at 160 Keenan Ct., Suite 5, Salvado Tecpoyotl Daniel, Agent contingent upon final approval from the building inspector and fire department. 2. Discussion and Possible Action Re: An application for a Liquor License Premises Amendment from Hodge Podge, LLC, d/b/a Hodge Podge, located at 160 Keenan Ct., Suite 1, Katelynn Gibbons, Agent Hodge Podge is requesting a liquor license premises amendment to include their newly constructed patio. The proposed hours of operation for the patio are 6 a.m. to 11 p.m. starting in March. Staff recommends approval of the amendment, without the addition of the bench in front of the building, contingent upon final approval from the building inspector and fire department. Motion: Recommend that the Common Council approve an application for a Liquor License Premises Amendment from Hodge Podge, LLC, d/b/a Hodge Podge, located at 160 Keenan Ct., Suite 1, Katelynn Gibbons, Agent contingent upon final approval from the building inspector and fire department. 3. Discussion and Possible Action Re: A change of agent request from Kwik Trip, Inc. d/b/a Kwik Trip #1075, located at 233 Wildcat Way Kwik Trip is requesting a change of agent due to new management. The background check on the new agent is complete and no issues were identified. Staff recommends approval. Motion: Recommend that the Common Council approve a change of agent request from Kwik Trip, Inc. d/b/a Kwik Trip #1075, located at 233 Wildcat Way. 4. Discussion Re: Parking restrictions along Prairie Heights Drive between County Highway M and Locust Drive During the rezoning process for 411 Prairie Heights Drive, the Plan Commission and neighbors raised concerns regarding parking along Prairie Heights Drive during events at the Verona Athletic Center. In response to those concerns, Staff was directed to take the on-street parking matter to the Public Safety Committee for review. The on-street parking concerns raised during the rezoning include reduced sight lines due to parking, difficulty driving on the roadway due to parking, and general concerns with the amount of parking on the roadway during events. Staff has identified the following alternative: • Do nothing. The parking situation has been occurring for years. • Restrict parking on the north side of the roadway adjacent to driveways to help improve sight lines of people exiting the residential area. • Prohibit parking on the entire north side of the roadway. • Prohibit parking on both sides of the entire roadway. Staff believes the best alternative at this time would be to restrict parking on the north side of the roadway adjacent to driveways. The City has already done this in areas along the Military Ridge State Trail as the intent is to create greater visibility and improve sight lines. If this matter remains an issue, the City could impose further parking restrictions on this roadway, but Staff believes an incremental approach is best.
