CITY OF VERONA MINUTES PUBLIC WORKS/SEWER & WATER COMMITTEE MONDAY, JANUARY 25, 2021 1. The meeting was called to order by Mr. Touchett at 5:06pm. 2. Roll Call: Present: Evan Touchett, Charlie Ryan, Chad Kemp. Also present: Theran Jacobson, Director of Public Works; Carla Fischer, City Engineer, AECOM; Dave Walker, Director of Parks and Urban Forestry. Note: This was a remote meeting via Zoom and phone conference, instructions on how to join were included with the posted agenda. 3. MOVED by Touchett, seconded by Kemp, to approve the minutes of the January 11, 2021 meeting of the Public Works/Sewer and Water Committee. Motion carried 3-0. 4. MOVED by Touchett, seconded by Ryan, to recommend approval of amendment no. 2 with AECOM for construction related services for Project ID 2017-115 Well 6. Motion carried 3-0.Touchett asked how the city can better control and plan for amendments. Fischer answered that construction contract amounts are always best guess estimates based on scope and schedule and that every project varies. 5. MOVED by Touchett, seconded by Ryan, to recommend approval of professional services agreement with Short Elliot Hendrickson for Project ID 2018-108.3 Badger Mill Creek restoration, in the amount not-to-exceed $28,804.00, contingent upon legal and city administrator review. Motion carried 3-0. 6. Discussions regarding Project ID 2018-108 Eastside interceptor gravity sanitary sewer replacement. Mr. Jacobson provided an overview of the recent communication and presentations regarding the Eastside interceptor gravity sanitary sewer replacement project (ESI). Jacobson noted the following: 1. On January 11th the interceptor project was discussed at the Common Council level and action was taken to discuss the project at the committee level for at the Parks Board and PWS&W Committee. 2. A neighborhood meeting for this project was held on January 13th at 5:30 p.m. via Zoom. The meeting included presentations and discussions by the City of Verona, Ice Age Trail Alliance, Madison Metropolitan Sewerage District, and Dane County. The public had the opportunity the ask questions after the presentation and staff responded. This meeting was broadcasted on YouTube and recorded. This presentation can be viewed on the City YouTube channel. 3. Monthly process meetings have been scheduled and will occur on the third Wednesday of the month by Zoom. Staff will update the public on the construction schedule and answer questions. 4. Information on the ESI project is located on the City’s website below and the website is updated as the project progresses. http://www.ci.verona.wi.us/729/Eastside-Interceptor-Gravity-Sanitary-Se Jacobson noted the following items for discussion and potential action are as follows: 1. Engage in contract with a consultant for review and oversight of the work regarding the Badger Mill Creek Corridor 2. Multi-use path a. Overall needs b. Utility access c. Connectivity to Parks d. Separation from Ice Age Trail 3. Tree plantings along corridor and offset from the utilities. Discussion regarding “Engage in contract with a consultant for review and oversight of the work regarding the Badger Mill Creek Corridor”. Jacobson noted the following: Multiple agencies were involved in the review of the prepared engineered plans that included the restoration plans for the ESI project. The Wisconsin Department of Natural Resources (WDNR) was communicated with verbally, via e-mail, and also on site. The construction engineer on site is fully capable of implementing all aspects of the project and has been communicating with engineers and WDNR as necessary throughout construction. WDNR has been on site with the construction engineer and has been pleased with the project status, progress and communication. WDNR noted to staff that there is no need for them to be on site, WDNR role is to ensure permit conditions are delivered to project staff as stated in the issued permits and follow up with complaints. WDNR does not act as an inspector. Touchett added he is not in favor of using additional consultants, and would rather spend money on trees. Ryan stated that ecologically the corridor will be preserved and that the WDNR thinks their participation is adequate. Ryan would like them to be notified of key milestone dates. Jacobson noted he will have construction engineer work with WDNR of key milestone dates. Kemp noted to Jacobson that we have been working together for three years and you have never steered the City in the wrong direction. Jacobson noted, as on any project, if there is a need for additional resources we have a large network of resources with the regulatory agencies and other consultants Discussion regarding “Multi-use path”. Jacobson noted the following: The multi-use asphalt path will serve multiple purposes for the sewer pipelines; maintenance path for cleaning and unexpected repairs, access for locating utilities, and protection. The path will also serve the greater public on a day-to-day basis providing a connection to the following: other pedestrian travel ways in the City, East View neighborhood, and connectivity between City parks. The path’s ultimate goal is be a segregated path from the Ice Age Trail, but Jacobson noted there may be common segments due to on-site challenges such as topography and drainage. This path was one of the many pedestrian improvements projects that were identified in the Ped and Bike plan prepared by AECOM that was presented to the Common Council in spring of 2017. The plan identified multiple improvements throughout the City with many already being constructed. Touchett stated he recalled the plan and presentation in 2017 and was involved in the preparation. Ryan asked for the bike survey, and Jacobson responded there was no survey but he would send the link to the Ped and Bike plan. Ryan noted he is in favor of pedestrian improvements. Kemp noted he likes the path, and noted he doesn’t think a bill of goods was sold. Discussion regarding “Tree plantings along corridor and offset from the utilities”. Jacobson noted the following: The goal through project planning and permitting development has been to perform a restoration plan of habitat along the Badger Mill Creek segment common with the Ice Age Trail, after the construction of the sewer project is complete. Ice Age Trail and Mr. Walker wanted to be able to communicate and have a visual of the landscape after the sewer project is completed so the proper plan can be developed. Mr. Jacobson noted the plan is to not plant any trees within the permanent limited easement to protect the sewer pipes below. Planting outside of the permanent limited easement can occur per the direction of Mr. Walker. Walker discussed the tree planting schedule, path concerns, Park Board overview, and connectivity to City parks. The rough plan for replanting is to restore grassland during the sewer project and then go to Ice Age Trail for placement, staking out trees after the sewer project is complete. The city is not locked into anything per the plan renderings that were developed for presentation to the public. The schedule is to begin restoration summer/fall of 2021 for ESI project, but the true design for tree placement won’t occur until fall of 2021. Tree placement won’t happen until 2022. Walker noted that native trees are a spring plant and most nurseries will not provide natives trees in the fall. Touchett asked about naming the area, and commented that he wants to keep the paved trail. Walker responded this area has been previous know as the “East View Nature Sanctuary”. Touchett commented that the planting approach is ideal in order to locate placement in the field. No action was taken by the Committee. Staff proposal was presented to the Committee. Based upon discussion, no concerns were raised by the Committee. Staff will proceed with the ESI project and tree planning approach. 7. MOVED by Touchett, seconded by Ryan adjourn at 5:57pm. DISCUSSION regarding Project ID 2020-109 N Main Street water main replacement. No action taken. Mr. Jacobson provided an update on the N. Main street water main project. Jacobson noted the project has been delayed due to private utilities not being located as they are required delaying final design by six (6) weeks. Utilities were finally located and design is in the process of being finalized. The overall schedule to bid the project is not effected as the schedule had buffer built in. The anticipated schedule is to bid the project in February 2021 and construction to commence in June / July of 2021. Mr. Jacobson and Ms. Fischer presented the 90% plans. Ms. Fischer presented the current 90% plans over zoom: • Overview of the plan and profile with the layout of the water main. • Location of the water main to be under the bike path or adjacent. • Two water main connections in N. Main Street that require a traffic shift. • Northbound N. Main Street will be tapered to one lane and southbound traffic will be tapered to one lane and shifted into the existing northbound lane. N. Main street will remain open but with bi-directional traffic with one lane for each direction. A crossover will be constructed at the intersection of N. Main Street and Llanos. • Coordination started last fall with Verona Area School District (VASD) and we are in the process of scheduling a meeting with them to present the project to ensure we are all on the same page for schedule and traffic impacts. o An easement is needed from VASD. VASD staff is aware of this need. • A pubic information meeting is not yet schedule but is anticipated to occur after meeting with VASD. The committee noted no need for action. The committee noted they have no concerns and appreciated the update on the project. 10. DISCUSSION regarding Project ID 2018-114 Lincoln Street stormwater management facility. No action taken. Mr. Jacobson introduced the design team that consists of Mr. Wegner of Brown and Caldwell and Ms. Fischer of AECOM. Two consultants were required due to the technical design work necessary for the dam design and permitting. Mr. Jacobson noted that this project was last presented by Mr. Wegner and City staff at a committee meeting on September 30th, 2019. Mr. Jacobson provided an overview of the upcoming schedule: • Website created and is live as of second week of January • Finalize design January / February • Bid project in February • Public Information Meeting in February • Start construction in April / May • Substantial completion to be determined by looking at August / September time frame Jacobson stated that adjacent property owners have been informed as part of the permit application requirements. Jacobson noted a much broader notification will be completed for the Public Information Meeting. Jacobson’s noted his goal is to have a public information meeting in February. Mr. Wegner and Ms. Fischer presented the figure included in the packet and the 90% plans over Zoom. The following information was presented: • Wegner presented to overview of the project and pond specifics including the wet pool and bio- filtration areas. Wegner discussed how runoff will enter and exit the pond from the Lincoln Street Channel. • Wegner noted that two construction accesses are planned with the primary located off of Lincoln Street and the secondary located through City property at the ice rink. • Wegner noted no road closures are anticipated but an increase in trucking traffic will occur due to the mass excavation and material deliveries. • Fischer noted the location of low height diversion / dam that is being constructed within and adjacent to the Lincoln Street Channel. • Wegner noted the existing storm water feature for City Center is being re-constructed and incorporated into this facility. • Wegner noted that the engineered material that is being used in the bio-filtration device is from recycled material generated from the processing of the City of Verona brush and leaves. • Fischer noted that the in-stream diversion / dam to divert the water into the pond will overtop at approximately the 2-inch storm event or less depending on intensity. The goal of this facility is water quality, not flood control. Fischer noted that with the current design features there is no adverse upstream water surface elevation effects from high flows within the channel. • Wegner noted that the area would be restored with a mixed native seed and also trees planted on the north slope that were identified by Mr. David Walker, Park Director and City Forester. • Wegner noted that construction fence will be placed along the northern construction limits to provide a perimeter from Hometown Days if that event proceeds in 2021. Ryan asked how deep is the pond? Wegner noted the wet pool under dry conditions would be five (5) feet in depth and have the typical design standard safety shelf of 10-ft in width at the outer perimeter. Wegner noted that depths will vary as flow enters and exits the pond during storm events. Touchett asked about the use of the grassed trail during construction and after? Jacobson noted during construction the path will be routed east and outside of the construction limits. Wegner noted as part of the design the intent is to have the tail re-established at the perimeter of the slope after construction. The committee noted no need for action. Item (4) Amendment No. 2 with AECOM for construction related services for Project ID 2017- 115 Well 6. This amendment is for additional and extended services provided during the construction of Well 6. The services provide are as follows: • Additional site walk with contractor and staff • Additional virtual meetings for start-up documentation • Additional submittals for diagnostics of certain mechanical processes from contractor • Extension of contract schedule requiring additional consultant staff time and additional progress meetings • Additional shop drawing review and/or substitutions This amendment is for additional $8,260 above the contract of $166,100, therefore a new contract value not to exceed $174,360. This project will be final billed. No additional work is to be completed by AECOM. Item (5) Professional services agreement with Short Elliot Hendrickson for Project ID 2018- 108.3 Badger Mill Creek restoration. This professional services agreement with Short Elliot Hendrickson is for the preparation of construction documents for stream bank improvements along Badger Mill Creek between Bruce Street and the Lincoln Street Bridge. The contract includes the following services: project management, design, permitting, and construction documentation preparation. Short Elliot Hendrickson was the design consultant for the eastside interceptor project and is familiar with corridor and needs of the project. The proposed improvements have the intention to mirror the work that was prepared by Dane County east of the Lincoln Street Bridge. The Wisconsin Department of Natural Resources will ultimately have the permitting authority for the project, therefore we will use them as a resource as part of the design process. This is part of their permitting requirements. The agreement with Short Elliot Hendrickson shall be contingent on legal counsel review and not to exceed $28,804.00. Collectively, the above-referenced documents shall be referred to as the Agreement. In the event of any conflict between the terms of this Addendum and the terms of the documents identified in b. – g. above, the terms of this Addendum shall control. 2. The Project is identified as the Badger Mill Creek Stream Bank Restoration Design (City Project ID 2018-108.3). 3. The Project Scope is identified in Exhibit “B” Badger Mill Creek Stream Bank Restoration Design Services (Project 2018-108) Scope of Work and Schedule, referenced in Section 1.e. above. 4. The total Consultant’s estimated fee is subject to a not-to-exceed amount of $28,804.00. 5. Notwithstanding anything to the contrary in the documents referenced in Section 1.b. – g. above, the City shall own and may use all drawings, specifications, plans, reports, and other documents/records, electronic or otherwise, prepared by Consultant for the Project. For avoidance of doubt, if the City terminate the Agreement or choose, for any reason, not to proceed with the Project, the City shall own all drawings, specifications, plans, reports, and other documents/records prepared by Consultant for the Project under the Agreement. 6. Notwithstanding anything to the contrary in the documents referenced in Section 1.b. – g. above, the City shall be required to furnish information or services related to the Project only to the extent that such information or services are both 1 reasonably required and actually requested by Consultant in order to perform Consultant’s services under the Agreement. 7. The Agreement shall be governed by the law of the State of Wisconsin. 8. Consultant shall comply with all applicable federal, state and local laws in the performance of this Agreement. (Consultant) Dated January 19, 2021 Payments to Consultant for Services and Expenses Using the Hourly Basis Option The Agreement for Professional Services is amended and supplemented to include the following agreement of the parties: A. Hourly Basis Option The Client and Consultant select the hourly basis for payment for services provided by Consultant. Consultant shall be compensated monthly. Monthly charges for services shall be based on Consultant’s current billing rates for applicable employees plus charges for expenses and equipment. Consultant will provide an estimate of the costs for services in this Agreement. It is agreed that after 90% of the estimated compensation has been earned and if it appears that completion of the services cannot be accomplished within the remaining 10% of the estimated compensation, Consultant will notify the Client and confer with representatives of the Client. to determine the basis for completing the work. Compensation to Consultant based on the rates is conditioned on completion of the work within the effective period of the rates. Should the time required to complete the work be extended beyond this period, the rates shall be appropriately adjusted. B. Expenses The following items involve expenditures made by Consultant employees or professional consultants on behalf of the Client. Their costs are not included in the hourly charges made for services and shall be paid for as described in this Agreement but instead are reimbursable expenses required in addition to hourly charges for services: 1. Transportation and travel expenses. 2. Fees paid, in the name of the Client, for securing approval of authorities having jurisdiction over the Project. 3. Expense of overtime work requiring higher than regular rates, if authorized in advance by the Client. 4. Renderings, models, mock-ups, professional photography, and presentation materials requested by the Client. 5. All taxes levied on professional services and on reimbursable expenses. 6. Other special expenses required in connection with the Project. 7. The cost of special consultants or technical services as required. The cost of subconsultant services shall include actual expenditure plus 10% markup for the cost of administration and insurance. The Client shall pay Consultant monthly for expenses. C. Equipment Utilization The utilization of specialized equipment, including automation equipment, is recognized as benefiting the Client. The Client, therefore, agrees to pay the cost for the use of such specialized equipment on the project. Consultant invoices to the Client will contain detailed information regarding the use of specialized equipment on the project and charges will be based on the standard rates for the equipment published by Consultant. The design intent is to mirror the plans developed by Dane County Parks that are included in the City of Verona eastside sanitary sewer interceptor replacement project under ID 2018-108. 1.
