Robinson, Jr. Town Hall, 127 Center Street, South Regular Meeting Invocation: The Baha’i Community of the Town of Vienna Pledge of Allegiance to the Flag of the United States of America 1. Roll Call Present: 5- Council Member Laurie Genevro Cole, Council Member Edythe Frankel Kelleher, Council Member Carey J. Sienicki, Council Member Howard J. Springsteen and Mayor Mayor DiRocco 2. Approval of the Minutes: Regular Meeting of April 28, 2014 and the Work Session Minutes of April 21, 2014. It was moved for the approval of the minutes as submitted. Motion: Councilmember Cole Second: Councilmember Sienicki Carried Unanimously A motion was made by Council Member Cole, seconded by Vice Mayor Sienicki, that the minutes be approved. The motion carried by a unanimous vote. Aye: 5- Council Member Cole, Council Member Kelleher, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco 3. Receipt of petitions and communications from the Public Mr. Bob McCahill, 429 Center St. North addressed Council regarding the mid-point of the grant that the town received from Fairfax for the neighborhood enhancement partnership program to bring the community garden to fruition. They have built a fence, planters in place, on with perenials that were donated by a local resident and one with herbs, they will plant crops soon. They still have yet to put in a metal interior fence to keep the little critters out. The exterior eight foot part of the fence is to keep the deeer out. They would like to bring water to the garden and that was actually the reason for the grant and he would like to get assurances that it will be coming soon since that needs to be in place before they can complete the fencing. He just asked if Council could move that along. Dennis Johnson stated that he is well aware of the order and they have had a little back and forth, they have been overwhelmed with water breaks and repairs. They are now looking into getting a plumber so they can get it installed in a timely fashion. Councilmember Springsteen mentioned an email that he received from Mr. McCahill regarding commercial properties and how they are taxed when it is vacant for awhile. He asked Councilmember Kelleher to respond. Councilmember Kelleher stated that the assessment value is based on the rent role which is how much rent they are Town of Vienna Page 1 Printed on 6/26/2014 Town Council Meeting Meeting Minutes May 12, 2014 getting on the property. For instance if you have a property that is vacant like one over near Navy Federal, due to earthquake damage, then the County will reasses the building value to $10. Mr. Cahill stated that the property he is questioning is the gas station that has been vacant for years at the corner of Park Street and Maple Avenue. It's valuation is under $500,000, its in the 200 block of East Maple and there is another gas station on the 200 block of West Maple that is valued at over $1.2 million. He sees that as a possible source of income for the town. Mr. Briglia followed up on the assessment with the 200 block of Maple avenue and reported that there is actually two lots there, the whole parcel is two assessed lots, one is $496,000 in tax assessed value, the other is $855,000 so the total lot is $1.35 million so it is more in line with some of the other properties. 4. Reports/Presentations A. Report and Inquiries of Council Members Councilmember Cole reported that she attended the Dare graduation at Cunningham Park Elementary School and the 5th grade class had completed the program. She complimented Officer Gary Lose for his participation in the program, it was clearly well received by the school, the teacher and the kids. The kids were given t-shirts that were donated by the Optimist Club. This is something that is part of his job but it all depends on how you do it and she thinks he does it with a great deal of enthusiasm . She thanked Officer Lose and the Police Department for continuing to support the Dare program. Councilmember Springsteen asked if they could get a list on the Town website of all the streets that need repair. He gets a lot of comments and he realizes they can't give a date on when they will be repaired but he thinks we should get a list on the website so people can see. Mr. Payton stated the the Department of Public Works staff has been working very diligently on repairing the streets. There have been a number of streets repaired within in the last few weeks. Mr. Johnson stated that were doing some paving on Maple Ave, Glyndon St. Ninnovan Rd., Plum St., in front of the Post Office and Malcom to name a few. He stated that they are working every day to try and get caught up. Councilmember Springsteen stated to be transparent he would like to get a list on the website so people can see. Mr. Payton mentioned that the number of streets that they have to repair is based on the need and what the condition is of the street. Councilmember Springsteen would still like to see a list on the website so people can look and see that the road is scheduled for repair. Councilmember Cole respectfully disagreed with Councilmember Springsteen, she would rather have the Public Works staff working on fixing the streets rather than updating and maintaining a list. She thinks if we put things up and it' s been up there and something happens that they get distracted from it then it has created an expectation that there is some sort of immediate action. She understands the desire to keep people informed and that is fine but she thinks in the world of limited resources and time that might not be the best use of their efforts. Mayor DiRocco asked if this could be directed to someone in the Public Works Department if someone is looking at a specific street that needs to be addressed. Mr. Johnson stated they do have Public Works tracker, a computer program, but it doesn't link to anything, it is an old program that they have to use until IT has completed a program that allows you to submit a complaint, to get an email back and then another email once the complaint is taken care of. Mr. Johnson stated that anyone can call Jennifer Sigler and she can look in the program to make sure the repair is listed. They are trying to be responsive and what they can within their capabilities. Mr. Payton asked if it would be Town of Vienna Page 2 Printed on 6/26/2014 Town Council Meeting Meeting Minutes May 12, 2014 satisfactory if they put a list out in alphabetical order that demonstrates it is being worked on. Mr. Johnson stated they would have to limit it to big cuts, they can't put all the minor pot holes but they can do the big cuts, they certainly know about those. Councilmember Sienicki reported that the Park Authority has a draft Tysons Park System Concept Plan that just came out and they are looking for public comment. It can be found on Fairfax County Parks website and make public comment before June 16th. There is also going to be two open houses, one will be on Monday, May 19, 2014 at 7:00 p.m. at the Springhill Elementary School and the other will be on Thursday, May 29, 2014 from 12:15 p.m. to 1:30 p.m at the Tysons Pemmet location. She thinks it is vitality important for members of the public to look it over and provide comments if they deem necessary. Councilmember Kelleher congratulated everyone who had participated in the Election on May 6th, everyone who voted and all the candidates. It was a very exciting election and it was gratifying to so so many thoughtful people running for Council, it was very interesting and very nice. She thoroughly enjoyed the campaign. Councilmember Kelleher congratulated Pasha Majdi and Linda Colbert for being elected and she informed them that they should mark their calendars for July 10th -12th to attend the newly elected officials conference, it would be a good thing for them to attend. Councilmember Kelleher also reported that former Councilmember Dick Dingman has passed away and the arrangements have been made for June. The visitation will be at Money & King the evening of June 12, 2014 from 5:00 p.m. - 7:00 p.m. and the funeral service will be June 13, 2014 at 1:00 p.m at McLean Bible Church. B. Report of the Town Manager Mr. Payton asked Deputy Chief Dan Janeki to introduce Officer Brad Reedy. Officer Reedy has been with the Department for almost a year. He is a graduate of Virginia Tech, grew up in Sterling and he is assigned to the patrol division. C. Report of the Mayor Mayor DiRocco reported that the Town elections were held on May 6th for Mayor and three Council seats and she congratulated Councilmember Kelleher on winning her seat and she also congratulated Pasha Majdi and Linda Colbert for winning a seat on Council. Their two year term will begin on July 1st. Mayor DiRocco also thanked all the candidates for running, it is a large endeavor to run for Town Council and to put yourself out there. Mayor DiRocco reported that a walk/bike challenge among the seven elementary schools compted for how many students would walk as well as bike to school. All the elementary schools did a really great job! The challenge cup this year went to Westbriar Elemenatary who kind of came out of nowhere at the end, they beat out Vienna Elementary who were the winners last year and 2nd this year, Wolftrap came in 3rd. The Biking cup went to Vienna Elementary who actually handed out bracelets to students who biked to school and there were 155 bikers, Wolftrap came in 2nd and Marshal Road came in 3rd. She congratulated all the elementary schools for participating and having children exposed to walking and biking. Mayor DiRocco reported that Public Works Day is being held on May 15, 2014 from 2:00 p.m. - 6:00 p.m. at Northside Property Yard. There are more details on the website and everyone is welcome. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened this date, Monday, May 12, 2014, the Town Council met for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of re-appointment to Town boards and commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. It was further moved that the Closed Session be continued to the conclusion of tonight’s work session, in accordance with Virginia Code Section 2.2-3711A(1) for purposes of discussion of personnel matters, specifically vacated Town Council seats. Motion: Councilmember Kelleher Second: Councilmember Cole Carried Unanimoulsy It was moved that David Miller be re-appointed to the Planning Commission for a two year term. Said term shall be retroactively effective from February 2, 2014 through February 2, 2016. It was further moved that Susan Stillman be re-appointed to the Community Enhancement Commission for a two year term. Said term shall be retroactively effective from April 19, 2014 through April 19, 2016. It was further moved that Margaret (Peggy) James be re-appointed to the Vienna Town/ Business Liaison Committee for a two year term. Said term shall be retroactively effective from April 19, 2014 through April 19, 2016. Public Hearings 7. Regular Business A. 13-248 Intent to adopt the Real Estate Property Tax Rate for Fiscal Year 2014-2015. It was moved for approval of the Resolution setting the tax rates for the Fiscal Year beginning July 1, 2014 as follows: Real Estate Tax Rate of $0.2288 per $100 of Assessed Valuation, Bank Net Capital Tax Rate of $0.80 per $100 of Valuation, Residential Utility Tax Rate of 20 percent of the first $15.00, and Commercial Utility Tax Rate of 15 percent of the first $300.00. A motion was made by Council Member Cole, seconded by Council Member Springsteen, that the Action Item be approved. It was further moved that the Town Clerk be directed to advertise a Notice of Adoption. A motion was made by Vice Mayor Sienicki, seconded by Council Member Cole, that the Action Item be approved. The motion carried by the following vote: Aye: 5- Council Member Cole, Council Member Kelleher, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco C. 13-262 Intent to Adopt the Fiscal Year 2014-2015 Budget It was moved for the adoption of the FY 2014-2015 Proposed Budget as amended by the proposed list of changes presented by the Town Manager in the total amount of $32,359,620. It was further moved that of said total, $22,590,440 be appropriated for General Fund expenditures; $2,702,640 be appropriated for Debt Service Fund expenditures; and $6,821,000 be appropriated for Water and Sewer Fund expenditures; and $245,540 for Stormwater Fund expenditures. It was further moved the Town Clerk be authorized to publish a Notice of Adoption. A motion was made by Council Member Springsteen, seconded by Council Member Kelleher, that the Action Item be approved. Contract for Administrative Software with Town of Vienna Page 5 Printed on 6/26/2014 Town Council Meeting Meeting Minutes May 12, 2014 Related Goods and Services It was moved to award a not-to-exceed, $651,626 Administrative Software with Related Goods and Services contract to Tyler Technologies Inc., riding National Joint Power Agreement Acceptance and Award #11301-TTI, from account 300243-48803 for $626,626 and from account 55111-46040 for $25,000. E. 13-252 Request Approval for Vienna Community Center Emergency Repairs to AC - #2 Compressor from Advanced Building Services. It was moved to approve emergency funding not to exceed $5,728.00 from account #10714-43304 for repairs to Vienna Community Center air conditioning unit AC # 2 and to cover the remaining preventive maintenance contract for FY 13-14.. A motion was made by Council Member Springsteen, seconded by Council Member Kelleher, that the Action Item be approved. It was moved to approve the purchase of the online facility reservation module from Vermont Systems at a cost not to exceed $1,468 from account #10711-43303. A motion was made by Council Member Kelleher, seconded by Council Member Cole, that the Action Item be approved. It was moved to adopt the ordinance to amend the Vienna Town Code, Chapter 18, Zoning, Article 25, Site Plan Control Provisions, Section 18-251, where applicable and section 18-252, Site Plan Specifications (addition of minimum tree canopy requirements for the single-family detached residential zones). A motion was made by Council Member Springsteen, seconded by Vice Mayor Sienicki, that the Action Item be approved. It was moved to cancel the 2011 St. Romans Drive water main construction contract with EE Lyons Construction Corporation because it was bid with inadequate trench patching limits. It was further moved to award a $210,000 St. Romans Drive water main construction contract to EE Lyons Construction Corporation under Arlington County contract 140-11 from account #380503-48803. A motion was made by Council Member Springsteen, seconded by Vice Mayor Sienicki, that the Action Item be approved.
