Robinson, Jr. Town Hall, 127 Center Street, South Invocation: Rev. Corky Eddins, Christ Church Vienna Pledge of Allegiance to the Flag of the United States of America 1. Roll Call Present: 7- Council Member Emil Attanasi, Council Member Linda Colbert, Council Member Edythe Frankel Kelleher, Council Member Pasha Majdi, Council Member Carey J. Sienicki, Council Member Howard J. Springsteen and Mayor Laurie DiRocco 2. Approval of the Minutes: 2. Approval of the Minutes: A. 13-428 Minutes of the Regular Meetings of August 18, 2014, September 8, 2014 and September 22, 2014 and the Work Session minutes of September 15, 2014. It was moved to approve the minutes of the regular meetings of August 18, 2014, September 8th, September 22, 2014 as submitted. It was further moved to approve the Work Session minutes of September 15, 2014. A motion was made by Council Member Sienicki, seconded by Council Member Springsteen, that the Minutes be approved. The motion carried by a unanimous vote. 3. Receipt of petitions and communications from the Public Mrs. Loretta Roby, 203 Mashie Drive presented information from the Follin Lane Coalition regarding the Follin Lane re-design project. 4. Reports/Presentations A. 13-424 Proclamation for Vienna Business Saturday. Mayor DiRocco presented a Proclamation for Vienna Business Saturday. A. Report and Inquiries of Council Members Councilmember Springsteen mentioned that at a previous meeting residents from St. Roman's Drive regarding some work that had been done and he thinks there is a bigger story. He went out there to look at it thinking he would see a war zone and he could see where they did the work but the patches looked good. He drove up and down because they had mentioned pipe stems and he found the pipe stems that were shown in the pictures and they did not match the pictures at all so he gathered that Public Works had gone back. He checked with Public Works and they had gone back and cleaned it all up. Mr. Johnson stated that the pictures they saw were of the Town of Vienna Page 1 Printed on 1/9/2015 Town Council Meeting Meeting Minutes October 27, 2014 temporary patch before the permanent one was installed. Councilmember Springsteen asked if the heating and air conditioning system was still being worked on in the Town Hall. Mr. Payton stated that the HVAC system, at times, is still having some issues. John Jay Sergent is in constant contact with Sigal and they are still witholding some funds that are due to them because of their lack of doing the work that they are being paid to do for the most part. They will still withhold the $99,000 plus retainage until we have some consistency. Some of the offices are warmer than it should be or not as warm as it should be. Mr. Johnson stated they just issued a purchase order for an HVAC contractor to come in and do an independent complete survey from the top down of the old and new equipment and tell them everything that is wrong and needs to be fixed whether it is ours or Sigals, so we can get to the bottom of it. Councilmember Sienicki wished everyone a happy and safe Halloween. B. Report of the Town Manager No report C. Report of the Mayor Mayor DiRocco reported that she attended the grand opening of a trail that is off the main W&OD Trail just outside of the town limits that leads to Meadowlark Gardens. It is a beautiful trail, it was almost eight years in the making to actually get it done. Mayor DiRocco reminded enveryone that the Vienna Halloween will be held on Wednesday October 29th at 7:00 p.m. D. Proposals for Additional Items to the Agenda None E. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened this date, Monday, October 27, 2014, the Town Council met for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or re-appointment to Town boards or commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to Monday, November 3, 2014 at 7:30 p.m. in accordance with Virginia Code Section 2.2-3711A(1) for purposes of discussion of personnel matters, specifically, the interviewing of individuals for consideration of appointment and/or re-appointment to Town boards and commissions. Motion: Councilmember Kelleher Second: Councilmember Attanasi Abstain: Councilmember DiRocco Motion carried Town of Vienna Page 2 Printed on 1/9/2015 Town Council Meeting Meeting Minutes October 27, 2014 It was moved that David Steiner be appointed to the Community Enhancement Commission to fill the unexpired term of Bernie Grace. Said term shall begin October 28th, 2014 and will expire December 18th, 2014. It was further moved that Tara Voigt to appointed to the Planning Commission to fill the unexpired term of William Daly. Said term shall begin November 1st, 2014 and will expire August 15th, 2015. It was further moved that Becky Allison be appointed to the Transportation Safety Commission to fill the unexpired term of Tara Voigt. Said term shall begin November 1st, 2014 and will expire July 11th, 2015. It was further moved that DeAnna Vouvakis be appointed to fill the unexpired term of Bernie Grace as Community Enhancement Commission representative on the Windover Heights Board of Review. It was further moved that Andrew Meren be re-appointed to the Transportation Safety Commission for a two year term. Said term shall begin retroactively from October 24th, 2014 through October 24th, 2016. And It was further moved that Maureen Alonso be re-appointed to the Community Enhancement Commission for a two year term. Said term shall be retroactively in effect from October 19th, 2014 through October 19th, 2016. Motion: Councilmember Kelleher Second: Councilmember Sienicki Carried unanimously The above motions were approved. 5. Public Hearings A. 13-402 Public Hearing for alley vacation at 101 Wilmar Place NW. Mayor DiRocco called the Public Hearing to order at 8:15 p.m. The Clerk called the roll and all members of Council were present. Mr. Dennis Johnson, Director of Public Works explained that this is a continuation of the alley vacations that have been happening up and down the alley between Wilmar and Ayr Hill. Council set this Public Hearing at the September 22, 2014 meeting to get input from the public. The viewers have already viewed it and have determined that there is not public need to keep the alley. Mr. Briglia stated that the Pellegrino's had actually came in when the Kaplan/Strimmels, their alley neighbors, had come in and asked for all or a portion of the alley to be vacated to their side and the Pelligrinos submitted their application at the same time. Council seemed amenible to split it and then the Pelligrino's got all the paper work in order so this is really a continuation to the Strimmel/Kaplan's request for that portion of the alley in giving the other half of the alley to the Pelligrino's. No members of the public came forward to speak. It was moved to close the Public Hearing. Councilmember Kelleher asked Mr. Johnson if it was correct that with the temporary access easement the homeowner would not be able to put up fencing or anything until that temporary easement was no longer needed. Mr. Johnson stated that was correct. Mr. Pelligrino came forward and asked Mr. Johnson about the temporary easement. Mr. Johnson explained that the temporary easement allows the Town to access the landlock portions of the alley further up the street and it expires when those pieces are sold. Mr. Pelligrino asked if it would be through what he is buying. Mr. Johnson stated that was correct and the Kaplan/Strimmel's have an identical easement that they granted for the same access. It would be 7 1/2 feet on his side and 7 1/2 feet on the Strimmel's side, just like the existing alley. It was moved to adopt the Ordinance to Vacate the public alley behind 101 Wilmar Place NW, accept payment of $1,687.50 from Mr. Pellegrino for the vacated portion subject to a lot consolidation, accept the temporary access easement, and authorize the Mayor to execute. A motion was made by Council Member Attanasi, seconded by Council Member Kelleher, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Attanasi, Council Member Colbert, Council Member Kelleher, Council Member Majdi, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco 6. Regular Business A. 13-411 Request to approve Department of Public Works vehicle purchases within the Vehicle Replacement Program. It was moved to approve purchase of the replacements for vehicles: #70, #2021 (to become #81), #2033, #60 and #71 for the Department of Public Works, under the VRP and ride the listed contracts for a total cost of $140,940.36 from account number 10912-48308. A motion was made by Council Member Springsteen, seconded by Council Member Sienicki, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Attanasi, Council Member Colbert, Council Member Kelleher, Council Member Majdi, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco B. 13-416 Mill Street Reconstruction Design Contract Increase. It was moved to award $98,721 Mill Street NE design contact to RDA based upon RFP 12-01, account #200425-48801. A motion was made by Council Member Sienicki, seconded by Council Member Colbert, that the Action Item be approved. It was moved to increase the Sagres Construction Vienna Train Station Sidewalk Construction Project, IFB 14-15 to $267,969, account 200741-48803. A motion was made by Council Member Sienicki, seconded by Council Member Attanasi, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Attanasi, Council Member Colbert, Council Member Kelleher, Council Member Majdi, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco D. 13-420 Award asphalt repair and remarking contract to Espina Paving, Inc. It was moved to award IFB 15-07, Asphalt Repair and Remarking, to Espina Paving, Inc. 15441 Farm Creek Drive Woodbridge, VA 22191, in the amount of $58,540.00 from accounts 10412-47407, 50111-47407 and 50114-47407. A motion was made by Council Member Springsteen, seconded by Council Member Sienicki, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Attanasi, Council Member Colbert, Council Member Kelleher, Council Member Majdi, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco E. 13-417 Set Date for a Public Hearing on a Request for Approval of a Revised Site Plan and certain Site Plan Modifications for the expansion of the Vienna Community Center on property principally located at 120 Cherry Street, SE, along with a limited portion of 130 Cherry Street, SE, in the PR-Park & Recreation zone and a portion of the W & O D Trail property zoned RM-2, Multi-Family Low Density. Application filed by Adtek Engineers, Inc. and the Department of Parks and Recreation, Agents for the Town of Vienna, owner. It was moved that a Public Hearing be set for November 17, 2014 on a Request for Approval of a Revised Site Plan and certain Site Plan Modifications for the expansion of the Vienna Community Center on property principally located at 120 Cherry Street, SE, along with a limited portion of 130 Cherry Street, SE, in the PR-Park & Recreation zone, and a portion of the W & O D Trail property zoned RM-2, Multi-Family Low Density. Application filed by Adtek Engineers, Inc. and the Department of Parks and Recreation, Agents for the Town of Vienna, owner. It was further moved that the Town Clerk be directed to advertise Notices of Public Hearing. A motion was made by Council Member Sienicki, seconded by Council Member Kelleher, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Attanasi, Council Member Colbert, Council Member Kelleher, Council Member Majdi, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco F. 13-421 Approval of 2015 Town Council Meeting Schedule and Calendar Town of Vienna Page 5 Printed on 1/9/2015 Town Council Meeting Meeting Minutes October 27, 2014 It was moved to accept the 2015 Town Calendar as amended by comments this evening and direct the Clerk to advertise the adoption of the Town Council's regular meeting schedule for 2015 and approval of the Town Calendar. A motion was made by Council Member Kelleher, seconded by Council Member Springsteen, that the Action Item be approved.
