Roll Call Present: 7- Council Member Emil Attanasi, Council Member Linda Colbert, Council Member Edythe Frankel Kelleher, Council Member Pasha Majdi, Council Member Carey J. Sienicki, Council Member Howard J. Springsteen and Mayor Laurie DiRocco 2. Approval of the Minutes: A. Minutes of the Regular Council Meeting of December 15, 2014. It was moved to approve the minutes of the Regular Council meeting of December 15, 2014 as amended. A motion was made by Council Member Attanasi, seconded by Council Member Sienicki, that the Minutes be approved. The motion carried by the following vote: Aye: 7- Council Member Attanasi, Council Member Colbert, Council Member Kelleher, Council Member Majdi, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco 3. Receipt of petitions and communications from the Public Local Boy Scouts from Troop 979 and 1128 introduced themselves to Council, they are working on the Citizenship in the Community Merit Badge and the Communications Merit Badge. 4. Reports/Presentations A. Report and Inquiries of Council Members Councilmember Sienicki thanked all of the Town staff who worked with VBA to put together a wonderful First Night. Mayor DiRocco stated that it was a a great family friendly event with lots of activities for kids and adults. Councilmember Sienicki wished everyone a Happy New Year. She is looking forward to this year especially with the 125th Anniversary of the Town which was kicked off at First Night. Councilmember Springsteen stated that with the new year and with some of the issues coming up such as the Community Center, he doesn't want to lose sight of some of Town of Vienna Page 1 Printed on 3/25/2015 Town Council Meeting Meeting Minutes January 5, 2015 the other issues and he has asked the Town Manager for an action plan regarding the lights on Church Street and asked if they could get a private contractor in to fix the lights since Dominion is so frustrating to deal with and the lights still are not fixed. There is an average between 9 and 13 lights out over the past several weeks. Councilmember Springsteen asked if they can get a list of streets that are supposed to get water pipes replaced this year. He asked for it over a year ago and he would like to see where that list is, they should be replacing pipes. Councilmember Springsteen complimented the Public Works Director for a great response when the water tower overflowed on New Year's Day. Councilmember Kelleher reported that coming up on Thursday evening January 8th at 7:30 p.m. at the Reston Community Center, Delegate Ken Plum and State Senator Janet Howell are going to be doing their legislative presentation and on February 7th from 9-11a.m. Senator Chap Petersen and Delegate Mark Keam are going to hold their Town Hall meeting at the American Legion Post on Center St. Councilmember Colbert mentioned First Night and that the entertainment was fantastic. She also thanked everyone that had worked on such a cold night, the Town Staff and the First Night committee, it was a great event. Councilmember Colbert asked Mercury Payton if the Vienna Sign coming into Town by James Madison High School was supposed to be discolored and if it could be painted. It doesn't look so perfect anymore and asked if the material it is made of naturally does that. Mr. Payton will look into it and report back at the Council meeting of January 26th. Councilmember Colbert also asked if they were starting to work on pot holes or if it was not warm enough yet. She would just like a quick update on that. Mr. Johnson stated that the plant they get their hot mix asphalt from is closed for winter maintenance so they are using cold mix which is shoveled in but never really gets hard. They may have to patch a couple times through the winter and then in the spring they will take it back out and put in hot mix. B. Report of the Town Manager Mr. Payton asked Mr. Johnson about the action plan for the lights on Church St. He knows Dominion Power has some role with it but would like a brief synopsis. Mr. Johnson stated that there is a State wide contract that Dominion establishes for any municipal use and the Town rides Fairfax County who signs on to the State wide contract so the Town pays the County each month for energy and light maintenance and Dominion will repair any lights. The problem is that they are hard to deal with and not very responsive. He is thinking they might do routine inspections and ask the Police if in the middle of the night when things slow down if they could do inspections. Public Works would provide maps or something to help facilitate that. Then they could get it into Dominion's ticketing system so that they will respond. Currently they have to wait for someone to call and say the lights are out, this way they would be proactive. He does not particularly want to take over light maintenance because we are already paying these people for this at a discount State wide rate. It will cost a lot more if we get an outside contractor to help. He will develop a more formal response. Mr. Springsteen stated that he understands but Church Street has been nagging a number of folks and he wants to get them fixed. His sense is that Dominion is just not coming out and it was an embarrassment on First Night that we didn't have them fixed. He hears what is being said but cant the Town just get a private electrical contractor in to get them fixed. Mr. Johnson stated Town of Vienna Page 2 Printed on 3/25/2015 Town Council Meeting Meeting Minutes January 5, 2015 that he spoke with the Town's electrical superintendent, Chad Charles, who told him that there are a variety of problems along Church St. including more than just bulbs. Mr. Payton asked Mr. Johnson if a couple of weeks time would be enough time for him to provide the water & sewer replacement list that Councilmember Springsteen asked about. Mr. Johnson stated that they need to provide a list of cleaning, lining and replacements for both water and sewer to Council, it is long over due and on the 26th he will bring in the new Water & Sewer Superintendent whose first order of business will be to spend the money that Council has already approved in the CIP for these projects. He has various lists but he doesn't really trust them, he needs a competent Engineer that they can all trust to organize it and get the contracts out. Councilmember Springsteen stated as far as the lights on Church Street, he thinks they should just bite the bullet and try and get them fixed, it's a low hanging fruit, take care of the bulbs or sensors. He hears what he is saying about Dominion but can we get them fixed by a private contractor. Mr. Johnson stated they can but we have to pay for them. Councilmember Springsteen stated he understands that but this has been going on for weeks and it is a safety issue. They need to figure out what it would cost and get them fixed. Mayor DiRocco stated that it has obviously been an issue the last couple of weeks and there have been a number of things that Dominion has not done in a timely fashion but she thinks at a time other than this meeting they can talk more about what can be done to get Dominion to be more proactive since we do have a contract with them, and if there is a cost for us to fix them we need to know what the cost is first. Councilmember Sienicki asked if we could tag team with Fairfax County since we are actually paying them, to have some extra voices in this to get these issues resolved. Maybe the Mayor could send something in to the person in charge and get somebody at the County level to weigh in. This is important for safety reasons and we should get multiple voices on this issue to do that if possible. C. Report of the Mayor Mayor DiRocco stated that First Night was wildly successful and she thanked Michael Amouri and the entire First Night Committee for doing a fantastic job! It was a very successful second First Night. She also thanked the Town Staff, Cathy Salgado and the Parks and Recreation group who did a wonderful job, as well as the Police Department in supporting all the efforts, it was greatly appreciated and it made for a very memorable event for the families that were able to attend. D. Proposals for Additional Items to the Agenda None E. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the first Closed Session convened this date, Monday January 5, 2015, the Town Council met for purposes of discussion of personnel matters, specifically honorary degrees or special awards, and for purposes of discussion of the possible acquisition of real property for a public purpose. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. It was further moved that the Closed Session be continued to later this date, Monday, January 5, 2015, at the conclusion of the regular Council meeting, in accordance Town of Vienna Page 3 Printed on 3/25/2015 Town Council Meeting Meeting Minutes January 5, 2015 with Virginia Code Section 2.2-3711A(1), for purposes of discussion of personnel matters, specifically the annual review of the Town Clerk. A motion was made by Council Member Kelleher, seconded by Council Member Attanasi, that the item be approved. Public Hearings 6. Regular Business A. Request Approval for Sole Source Purchase of LED Baseball Field Lights For Glyndon Park from Musco Lighting. It was moved to award a sole source purchase of LED lights for the Glyndon Park baseball field to Musco Lighting in the amount of $171,860 from account number 300710-48803. It was moved by Councilmember Kelleher to amend the motion to add that Council has found justification for the reasoning behind the sole source. All were in favor of the amendment. A motion was made by Council Member Springsteen, seconded by Council Member Sienicki, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Attanasi, Council Member Colbert, Council Member Kelleher, Council Member Majdi, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco B. Request to set Public Hearing for Vacation of a Portion of Ninovan Road SE East of Tapawingo Road and adjacent to 911 Ninovan Road SE. It was moved to set a Public Hearing for the February 2, 2015, Town Council meeting to consider disposal of a portion of Ninovan Road SE East of Tapawingo Road and adjacent to 911 Ninovan Road SE. It was further moved to direct the Town Clerk to advertise the notices of Public Hearing. A motion was made by Council Member Sienicki, seconded by Council Member Kelleher, that the Action Item be approved. The motion carried by the following vote: Aye: 4- Council Member Colbert, Council Member Kelleher, Council Member Sienicki and Mayor DiRocco Nay: 3- Council Member Attanasi, Council Member Majdi and Council Member Springsteen C. Tapawingo & Cottage Street SW Sidewalk Construction Contract Award. It was moved to award a $1,185,000 Tapawingo & Cottage Street SW sidewalk construction contract to Sagres Construction, IFB 14-16, account #338425-48803 and 388422-48803. A motion was made by Council Member Springsteen, seconded by Council Member Sienicki, that the Action Item be approved. Setting of Public Hearing for Vienna Arts Commission for February 2, 2015. It was moved to set a public hearing for the establishment of the Vienna Arts Commission on February 2, 2015. A motion was made by Council Member Kelleher, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Attanasi, Council Member Colbert, Council Member Kelleher, Council Member Majdi, Council Member Sienicki, Council Member Springsteen and Mayor DiRocco Second Closed Session It was moved by Councilmember Kelleher to recess in to the second closed session at 8:51 p.m. Mayor DiRocco called the meeting back to order at 9:38 p.m. All members of Council were present. It was moved that the members of the Vienna Town Council be polled to affirm that during the second Closed Session convened this date, Monday January 5, 2015, the Town Council met for purposes of discussion of personnel matters, specifically the annual review of the Town Clerk. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. It was further moved that the Closed Session be continued to Monday, January 26, 2015, at 7:30 p.m. in accordance with Virginia Code Section 2.2-3711A(1), for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of re-appointment to Town Boards and Commissions and potentially for purposes of discussion of potential land acquisition of real property for a public purpose.
