Approval of the Minutes: Regular Meetings Minutes of May 11, 2015, June 1, 2015 and the Work Session Minutes of June 8, 2015. It was moved to approve the Regular Meeting minutes of May 11, 2015, June 1, 2015 and the Work Session minutes of June 8, 2015 as submitted. A motion was made by Council Member Sienicki, seconded by Council Member Springsteen, that the Minutes be approved. Receipt of petitions and communications from the Public Local Boy Scouts from Troop 152 introduced themselves to Council. They are working on their Citizenship in the Community and the Communications Merit badge. 4. Reports/Presentations A. Report and Inquiries of Council Members Councilmember Sienicki thanked the Police Department and Parks & Recreation for a fabulous Fourth of July, it was the best fireworks show ever. The event on the Town Green was also very nice. Town of Vienna Page 1 Printed on 9/18/2015 Town Council Meeting Meeting Minutes July 6, 2015 Councilmember Colbert reminded everyone that the Vienna Youth Players will be having their show the first two full weekends in August at the Community Center, and will be showing Fiddler on the Roof. Councilmember Kelleher reported that the American Legion Auxiliary will be holding their breakfast buffet on the fourth Sunday instead of the third which will be on the 26th from 8:00 a.m. until noon at the Legion. Councilmember Springsteen congratulated the Town Manager on the birth of his newest born. B. Report of the Town Manager Mr. Payton announced that the Town Attorney is now part of the coaching staff of the Vienna All-Stars, 16-18 year old's that won districts last week and congratulated him for that. C. Report of the Mayor Mayor DiRocco reported that she too thought the Fourth of July fireworks went off really well. They were fortunate for the Police Department and especially the staff of Parks and Recreation for doing a wonderful job. She also thought the Fourth of July activities were a lot of fun, they were different then they have been normally at the Community Center. The first annual Chili Dog eating contest was very interesting and she gives a lot of credit to the gentleman that won, he ate 11 chili dogs. Mayor DiRocco thanked Ms. Cathy Salgado for her thirteen years of service. She thanked her for all her service to the Town and all the activities she worked on and sponsored. Mayor DiRocco reminded everyone that during July and August Council only has one meeting per month. It is a much lighter schedule than their normal to have some vacation time with family and friends. The next meeting will be August 24th. Mayor DiRocco welcomed Councilwoman Voigt as the newest Council member and she looks forward to working with her during the coming year. Mayor DiRocco shared that Council is putting together a Certificate of Appreciation for Shirley Damon. She has been on the Board of Architectural Review for 30 years and she has just resigned as of August 1st because she is moving in with her daughter down in Williamsburg. It really makes a difference to the Town when we have people like this serve the Town for such long periods of time. She has really made an influence to the BAR which determines a lot of what the Town looks like in certain ways. D. Proposals for Additional Items to the Agenda None E. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the Closed Session convened on Monday, June 29, 2015, the Town Council met for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of appointment to Town Boards or Commissions. Motion: Councilmember Kelleher Second: Councilmember Springsteen Carried Unanimously It was moved that the Closed Session convened this date, Monday, July 6, 2015 in accordance with Virginia Code Section 2.2-3711A(1), for purposes of discussion of personnel matters, specifically Council Member appointments to local committees and the interviewing of individuals for consideration of re-appointment to Town Boards or Commissions. And it was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution And It was further moved that the Closed Session be continued to Monday, August 24, 2015 at 7:15 p.m. in accordance with Virginia Code Section 2.2-3711A(1), for purposes of discussion of personnel matters, specifically the interviewing of individuals for consideration of appointment and /or re-appointment to Town Boards or Commissions. Motion: Councilmember Kelleher Second: Councilmember Sienicki Carried Unanimously It was moved that Mary McCullough be appointed to the Planning Commission to fill the unexpired term of Tara Voigt and a two year term of office. Said term shall be effective from July 7, 2015 through August 15, 2017. It was further moved that Sean McCall be re-appointed to the Transportation Safety Commission for a two year term. Said term shall be retroactively in effect from July 1, 2015 through July 1, 2017. And it was further moved that Mark Uhron be re-appointed to the Vienna Town/ Business Liaison Committee for a two year term. Said term shall be retroactively in effect from July 3, 2015 through July 3, 2017. And it was further moved that Laura Goyer be appointed to the Town Business Liaison Committee for a two year term of office. Said term shall be effective from July 7, 2015 through July 7, 2017. And it was further moved that Dale Sawaya be appointed to the Board of Architectural Review to complete the unexpired term of Shirley Damon. Public Hearings Public Hearing on a Proposed Ordinance to Amend the Code of the Town Of Vienna, Chapter 18, Zoning, Article 2, Definitions and Article 23, Board of Zoning Appeals, Updating Variance Standards Consistent With the Code of Virginia. Mayor DiRocco call the public hearing to order at 8:18 p.m. The Town Clerk called the roll and all members of Council were present. Mr. Patrick Mulhern, Director of Planning and Zoning explained that this item was discussed somewhat when it was sent to the Planning Commission and set the date for the public hearing. He further explained that in the new provisions in the Code of Virginia that were passed and took effect July 1st, which is why they hurried this through, and the most significant standard is by which a variance will now be granted. It used to be unnecessary or an unreasonable hardship to the property owner and now the test is unreasonably restrict utilization of property. It is basically a lower bar, you will get more applications, probably more will be approved and gives the BZA a little more flexibility. This went through the Planning Commission and they voted unanimously to approve it. They will inform the BZA of this measure in a Work Session. Councilmember Springsteen stated that the Town has a pretty strict 25% lot coverage, could someone come in and ask to put an addition on that would exceed the lot coverage requirement. Mr. Mulhern stated they could request a variance but it has to be a unreasonable use of the property and they could just make the house smaller, it would be a tough test. Town of Vienna Page 4 Printed on 9/18/2015 Town Council Meeting Meeting Minutes July 6, 2015 Mayor DiRocco asked how would they do it now. People come in and ask that now, the question is, is it changing that much with this code change from the State of Virginia. Mr. Briglia stated that it is definitely a lesser standard. He thinks the example of lot coverage, which they have mentioned before and happens rarely in most jurisdictions and he can't remember in recent history when it has happened in Town, if the BZA grants a variance that the Town believes is not in keeping with the Town Code and a hardship was not shown, it's still a hardship but its a hardship that would unreasonable restrict utilization. If the Town disagrees with the BZA's ruling the Town has the right to appeal to the Circuit Court. There is a check on this system. This is a new standard but for example there are some lots in Town that are below the minimum lot size of 10,000 square feet and that might be an area where the BZA might say they will let them have a slightly bigger house coverage slightly more than 25% because this lot is unnecessarily small and you would only get a very, very small house. They are going to see what other jurisdictions do. Mr. George Creed, 217 Audreys Court SE, Vice-Chair of the BZA, stated that speaking personally, he is not sure that when they talk about it, its loosening the standards a little bit and they are looking at the unreasonableness of restricting the use of a property. If you have a lot that you have a house on he does not think it is going to be a real difficulty to say, you can build a house but you are not going to build a house this big on this big of a lot. They are going to be looking at the reasonableness of the size of the property and what people are asking for. They have not heard yet from the Town Attorney who is going to come to the next BZA meeting where they will hear more from him. He is not sure this is really going to tie their hands or the Town's hands all that much. Councilmember Sienicki stated that she just had a grammatical change, in 18-231- Membership, she was wondering if they could change the last sentence to say "A member whose term expires shall continue to serve until a successor is appointed and qualifies." Everyone was comfortable with that. It was moved to close the Public Hearing. Motion: Councilmember Sienicki Second: Councilmember Kelleher Carried unanimously It was moved for approval of the proposed ordinance to amend the Code of the Town of Vienna, Chapter 18, Zoning, Article 2, Definitions and Article 23, Board of Zoning Appeals, updating variance standards consistent with the Code of Virginia and it was further moved to direct the Town Clerk to place the ordinance amendment on the agenda of August 24, 2015 for adoption and to advertise a Notice of Intent to Adopt, as amended. Mayor DiRocco called the Public Hearing to order at 8:27 p.m. The Town Clerk called the roll and all members of Council were present. Mr. Briglia, Town Attorney, explained this is more of a house keeping ordinance. The Town is allowed to incorporate by reference, changes in the State Code as they relate to DWI code sections of the State Code and traffic infractions, there are literally hundreds of individual code sections. The General Assembly doesn't change each one every year but they usually change enough of them and rather then having to go back and amend each section of our DWI or Traffic Infractions ordinances in the Town Code they are allowed to adopt by reference. Any changes that were affected in the last General Assembly session are being incorporated by reference as they relate to our code. It was moved that the Public Hearing be closed. Motion: Councilmember Kelleher Second: Councilmember Springsteen Carried Unanimously It was moved for adoption of the proposed ordinance to amend the Code of the Town of Vienna Chapter 9, Motor Vehicles and Traffic, Article 1, In General, Section 9-3, Adoption of State Code and it was further moved that the Town Clerk be directed to advertise a Notice of Adoption. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Kelleher, Council Member Majdi, Mayor DiRocco, Council Member Springsteen, Council Member Sienicki and Council Member Voigt Public Hearing on the proposed Adoption of an Ordinance Authorizing the Collection of E-Summons Fees. Mayor DiRocco called the Public Hearing to order at 8:29 p.m. The Town Clerk called the role and all members of Council were present. Mr. Briglia, Town Attorney, explained that this is a fee that the Town, as proposed, will begin collecting as part of the cost for criminal traffic infractions if there is a fine. The fee has to be used to fund and implement an electronic summons system. It has been over two years ago now that the General Assembly authorized localities to start using the E-Summons system which means when you get a traffic ticket, the Town of Vienna Page 6 Printed on 9/18/2015 Town Council Meeting Meeting Minutes July 6, 2015 Police Officer can literally run your drivers license, which has a magnetic strip on it, downloads that information to the summons and it automatically uploads into the State system and to the courts to issue the summons. It is designed to streamline the process and speed the process up. For reasons known only to General Assembly they left off Towns as having the ability to collect the fees. The County has been collecting the fee and going into their system so the Town Council asked the General Assembly to amend the State statute to also allow town's that have courts to collect the fee so we can implement the system for our Police Department. Once we collect the fee and start having money in the budget then there will be the implementation of the E-Summons system so our Police Officers will use the same system as departments across the State of Virginia, Fairfax is already using it. Mayor DiRocco stated the Delegate Mark Keam was in the audience and he actually helped carry this and to make the change to make sure that towns were covered and also Senator Chap Petersen did it on the Senate side. The Town greatly appreciates their support of that to include us. Councilmember Sienicki thanked the Town Attorney for also going down to Richmond and also being the voice for the towns and for taking the time off to do that. Mayor DiRocco stated that the Town Attorney does that every year. He takes the time out of his schedule to do that with the things that are important to the Town and to go and legislate before the General Assembly and the Town greatly appreciates it. A motion was made by Council Member Kelleher, seconded by Council Member Sienicki, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Kelleher, Council Member Majdi, Mayor DiRocco, Council Member Springsteen, Council Member Sienicki and Council Member Voigt Public Hearing and Proposed Adoption of an Ordinance re-locating the polling place for Town elections. Mayor DiRocco called the Public Hearing to order at 8:34 p.m. The Town Clerk called the role and all members of Council were present. Mr. Briglia, Town Attorney explained that due to the upcoming renovations to the Vienna Community Center which is the polling place for the Town elections in May. The Town Council met with the Fairfax County General Registrar to come up with an alternative polling place for the Town Elections. The County Registrar has already taken the step of moving the polling place for the fall elections and will advertise it. For the Town elections, the Town is required to establish a polling place by Ordinance. The Town has been using the Community Center since it opened in the Town of Vienna Page 7 Printed on 9/18/2015 Town Council Meeting Meeting Minutes July 6, 2015 mid 60's so this will be a temporary movement of the Town's polling place for the Town's May elections. The suggested, and most ideal polling place due to its location, its ADA access and also based on recommendation of the Fairfax County, is the Vienna Presbyterian Church. and the Church was amenable to hosting as a temporary polling place. The Church is located on Church Street which is just a few blocks away from the Community Center. This ordinance basically transfers the polling place, temporarily from the Community Center to the Vienna Presbyterian Church. When the Community Center renovation is done then Council will have to adopt a new ordinance to move it back to the Community Center. Mayor DiRocco stated that they mentioned to the Town Manager that it is important to keep this information in the newsletter and should be in there every month moving forward announcing changes and what is happening in Town because of the Community Center renovation. It is important that the information regarding changes that are happening get out to the residents. Mr. George Creed, 217 Audrey's Court, SE, stated he has no problem with this, he thinks it's a great idea. The only concern he has is that once the Community Center is finished it will have to come back before Council again to reinstate it back to the Community Center. Why can't that be done under this ordinance that says once its complete it automatically reverts back. Mr. Briglia stated that Council has to designate a polling place and he thought it was more wise to designate a temporary place just in case the Community Center was delayed or if there was some issue that they would have to remain another year or if it got done earlier. Councilmember Majdi mentioned that when they met with the General Registrar there was discussion of notification requirements and meeting of deadlines such that the voting place location would be listed on the voting cards and he doesn't know if they could have staff get the information out as well. Mayor DiRocco stated that is why we have it on the agenda now and made that change even before the May 2016 Election but once the change is made they will put it on the notifications that will come out this fall. It was moved that the public hearing be closed. Motion: Councilmember Colbert Second: Councilmember Voigt Carried Unanimously It was moved for approval of the proposed ordinance to amend Chapter 2, Administration, adding new Article 6, Section 2-68, Polling Place, to the Code of the Town of Vienna to temporarily move the Town of Vienna precinct polling place (Town Precinct - 2510) from the Vienna Community Center to Vienna Presbyterian Church during the period of renovations to the Vienna Community Center. A motion was made by Council Member Colbert, seconded by Council Member Sienicki, that the Action Item be approved. It was moved to approve an amount not to exceed $42,500 for UK Elite, and $29,000 MVP Baseball through August 31, 2015 for classes and camps from account number 10712-43308. A motion was made by Council Member Springsteen, seconded by Council Member Kelleher, that the Action Item be approved. It was moved to approve the license agreement between NOVA Parks and the Town for the W&OD Trail relocation and safety enhancements as part of the Community Center renovation and expansion project and authorize the Mayor to execute. It was moved to authorize the Mayor to execute the MOU between the Town and the Vienna Business Association for Vienna First Night 2015-16. A motion was made by Council Member Springsteen, seconded by Council Member Kelleher, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Colbert, Council Member Kelleher, Council Member Majdi, Mayor DiRocco, Council Member Springsteen, Council Member Sienicki and Council Member Voigt Award Follin Lane SE Reconstruction contract. It was moved to award IFB 16-02, Follin Lane SE Reconstruction to Jeffrey Stack, Inc. in the amount of $1,761,200.00 account 388428-48803 and it was further moved to approve an additional $20,000.00 engineering services expenditure with Urban, Ltd. Account 388428-48801 under RFP 13-05 and it was further moved to accept permanent easements required by the project, authorize the Mayor to execute the documents, and authorize the Town Attorney to record the documents in the Land Records. A motion was made by Council Member Majdi, seconded by Council Member Sienicki, that the Action Item be approved. It was moved to approve the Old Courthouse Road NE, Fairfax County Agreement and authorize the Town Manager to execute all related documents and it was further moved to award a $200,000 design contract to Rinker Design Associates under IFB-12-01 On-Call Engineering Services, account 388439-48801 for the project. A motion was made by Council Member Springsteen, seconded by Council Member Majdi, that the Action Item be approved. It was moved to approve a $65,000 Virginia Paving contract increase, $25,000 from account 380503-48803 and $40,000 from account 10412-47401 for a FY 2015 total contract of $440.643.00. It was moved to authorize the Mayor to execute the lease between First Washington Realty and the Town for temporary administrative and programming space in units M4, M6 and M10 for approximately 615 square feet for the Parks and Recreation Department in the amount of $31,218.75 for a total of 15-months from the Community Center CIP account #300707-48803. A motion was made by Council Member Sienicki, seconded by Council Member Springsteen, that the Action Item be approved. It was moved to direct the Town Manager to implement Option two listed in the report.
