Robinson, Jr. Town Hall, 127 Center Street, South Regular Council Meeting Invocation: Reverend Craig Burns, Vienna Assembly of God Pledge of Allegiance to the Flag of the United States of America 1. Roll Call Present: 7- Council Member Howard J. Springsteen, Council Member Carey Sienicki, Council Member Tara L. Voigt, Mayor Laurie DiRocco, Council Member Linda Colbert, Council Member Pasha Majdi and Council Member Douglas Noble 2. Approval of the Minutes: A. Approval of the Minutes of the Regular Council Meeting of January 30, 2017. It was moved to approve the minutes. A motion was made by Council Member Sienicki, seconded by Council Member Majdi, that the Minutes be approved. The motion carried by the following vote: Aye: 7- Council Member Springsteen, Council Member Sienicki, Council Member Voigt, Mayor DiRocco, Council Member Colbert, Council Member Majdi and Council Member Noble 3. Receipt of petitions and communications from the Public Ms. Laurie Genevro Cole addressed Council to ask them to adopt a Resolution in support of re-districting reform in Virginia. She stated that it is non-partisan which is very important and a tradition that the Town of Vienna respects, they have been served very well for many years by their tradition of non-partisan governments. Virginia has a less than distinguished history of re-districting and neither major political party has the high ground in this debate, there have been efforts by both parties to use the system to further their own ends often landing the commonwealth in court. In addition to adopting the Resolution she is hoping that Council will consider supporting Bill SJ290 patroned by Senator Janet Howell, co-patroned by Senator Chap Petersen, which seeks a constitutional amendment in support of re-districting reform. She thinks this is an important issue and one she hopes the town would support. Councilmember Springsteen asked that they add this to the agenda. Mr. Craig Burns, 301 Center St. North addressed Council stating that he wanted to publicly thank the Finance Department. He stated that no one really sees the hard work they do. He further made one recommendation to Council in that they try and find a way to cap the property taxes on our smaller Vienna homes to make it possible for our smaller home residents to remain here and to keep these smaller homes as a kind of a historic aspect of what it is to be in Vienna. Mr. Mike Lyons, 826 Glyndon Street SE, Cubmaster of Pack 833 addressed Council stating that he had 4 members of the Arrow of Light rank that are about to graduate from Cub Scouts and working on their achievement in Civic Governement. The Arrow of Light Scouts introduced themselves to Council. Also a local Boy Scout from Troop 987 introduced himself to Council, he is working on his Life Skills badge. 4. Reports/Presentations A. Report and Inquiries of Council Members Councilmember Majdi reported that he had talked to a couple of residents that had some questions regarding the town procedures for replacing pipes on someone's property that are in the town right-of-way, what type of notice that they give and how they interact with the citizens, do they send them a letter or a phone call. Mike Gallagher, Director of Public Works explained that there are various ways citizens are notified, it depends on the type of work. If they are going to be impacting somebody's water service by shutting off their water service or stopping their sewer service they give a 24-48 hour notice with a door hanger on their door. If they are going to be paving their road and impacting access to their driveways they post the road with no parking signs. If they are going to be impacting somebody's driveway they provide letters either via mail or post on their doors saying what they plan to do. Typically people will call in and then they will coordinate directly with them as far as timing and when they may need access to their driveway. Councilmember Majdi further asked how the door hangers are working when shutting off water. Mr. Gallagher stated they get a marginal amount of questions and complaints but he thinks it works well. Councilmember Majdi did hear about one instance where the door hanger may have been misplaced or something and he just asks that they try and get it up to 100%, Councilmember Majdi also asked if it was possible to focus on doing the work in the afternoons instead of the mornings. Mr. Gallagher stated that they typically try and wait until later in the morning, it would be tough to start the work in the afternoon because the crews only work until 3:30 p.m. Councilmember Majdi asked how often are there errors or mis-communications where the citizen is just not aware that their water is being shut off. Mr. Gallagher stated that he does not have a statistic for him but it is less than 1 in 10. Mr. Payton thanked Mr. Gallagher for letting them know how they go about this and shared that they do have a citizen call in from time to time and there may be an instance where it doesn't go according to plan but the majority of the time we do have a pretty high rate of these water/sewer situations where they conduct the work and it goes pretty well and they don't hear from anyone at all. He also mentioned that Mike has been in communication with him and the Marketing and Communication Manager on how they communicate to residents. They are constantly monitoring how each instance occurs and he is happy with how Mike's approach has gone so far in regards to identifying some of the out lyers and making those situations better. Councilmember Noble asked if this procedure changes when it is an emergency water main break repair. He asked how emergency repair notification was different than planned work. Mr. Gallagher stated that unfortunately in an emergency situation they obviously can't predict that in 24 - 48 hours so a lot of times there isn't any notice but the crews are out there and are happy to talk with residents about what is happening. The crews do knock on doors during daylight hours and notify as many people as possible. Councilmember Voigt reported that on January 28th she was a judge at the Madison Town of Vienna Page 2 Printed on 3/10/2017 Town Council Meeting Meeting Minutes February 6, 2017 High School Charity Coding Competition. There were over 15 groups that participated and of all the groups and the judges she was the least technical of all of them so she was judging on how things worked rather than the detail coding behind the projects. Students came from all over and some had coding experience and some had never coded before. They had 12 hours to learn coding and put something together and present to the judges. The entrance fees raised over $2800 for a coding camp in Zambia for girls. It was a wonderful experience and she thinks they will continue this on an annual basis. Councilmember Springsteen reported that he had a concern regarding how a TSC traffic calming petition was handled and the money that was spent on a consultant. He will meet with the Town manager and the Director of Public Works about how this was handled. Councilmember Sienicki reported that there will be a fund raiser from the Friends of Vienna Public Art who will be hosting an event at Jammin Java from 7-11 p.m. on Thursday February 9th to raise money to go towards a memorial for Mayor Seeman. Councilmember Noble reported that the ladies swim and dive team from Madison High School not only won conferences they won regional's this past week. The girls in the gymnastics team unfortunately finished fourth at conferences. They have one young lady going on to regional's in balance beam. B. Report of the Town Manager No report C. Report of the Mayor Mayor DiRocco reported that on February 1st she met with the Women in Politics Club at Marshall High School. It is a new club that was formed in the fall of 2016 and the President had invited her to talk and talk about how she got involved in the town as well as some of the challenges that come up. It was a very good overall discussion, there were about 25-30 high school women in attendance. D. Proposals for Additional Items to the Agenda It was moved to add an item to the agenda to discuss the non partisan re-districting in Virginia. Motion: Councilmember Springsteen Second: Councilmember Voigt Carried Unanimously It was moved to add an item to the agenda to propose that the town brings forward a Resolution to the General Assembly in conjunction with the Towns of Northern Virginia regarding the current Senate Bill 1282 insuring that the town maintains it's legal authority to review applications and remunerate for use of public town right-of-ways owned by the town and town owned land on which companies may wish to place telecommunication structures. Closed Session It was moved that the members of the Vienna Town Council be polled to affirm that during the first Closed Session convened this date, Monday, February 6, 2017, the Town Council met for purposes of discussion of personnel matters, specifically, the interviewing of individuals for consideration of appointment and/or re-appointment to Town Boards and Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to later this date, Monday, February 6, 2017 at the conclusion of the Regular Council Meeting in accordance with Virginia Code Section 2.2-3711A(1), for purposes of discussion of personnel matters, specifically the annual performance evaluation of the Town Manager. Motion: Councilmember Voigt Second: Councilmember Springsteen Carried Unanimously It was moved to recommend Donald Chumley to the Fairfax County Circuit Court for re-appointment to the Board of Zoning Appeals for a five year term. Regular Business A. Adoption of the Deferred Compensation Plan [457(b)] of the Commonwealth of Virginia It was moved to adopt the Resolution to adopt the Deferred Compensation Plan of the Commonwealth of Virginia; to authorize the Town Manager to execute the Adoption Agreement with the Virginia Retirement System as well as other administrative documents required after the resolution is adopted; and authorize the Town to pay the VRS administration fee of approximately $8.50 per participant, or an approximate total of $765, which is currently available through savings achieved within the Human Resources budget from the account listed above A motion was made by Council Member Springsteen, seconded by Council Member Town of Vienna Page 4 Printed on 3/10/2017 Town Council Meeting Meeting Minutes February 6, 2017 Voigt, that the Action Item be approved. Increase funds for the Vienna Community Center renovation and expansion project It was moved to approve payment to Keller Brothers in the amount not to exceed $241,874 for the Vienna Community Center project IFB #16-04, account # 300-0000-0000-39425-48803 and it was further moved to approve payment to Lukmire Partners in an amount not to exceed $70,000 for the Vienna Community Center Project IFV #16-04, account # 300-000-0000-39425-48803 and it was further moved to increase the Vienna Community Center contingency account in the amount not to exceed $200,000 for the Vienna Community Center Project IFB #16-04, account #300-0000-0000-39425-48803 and it was further moved to do a budget transfer from DPW 100-104-1041-14110-41000 for $30,000 from Parks 100-107-1071-17130 and 17150 (Community Center Operations and Programs - accounts to be determined) for $75,000 and from Risk Management 100-102-1021-11255-42013 for $20,000 to the Capital Project Fund. A motion was made by Council Member Colbert, seconded by Council Member Voigt, that the Action Item be approved. Resolution supporting re-districting Reform It was moved that the Town of Vienna supports the re-districting reform in Virgina as follows: WHEREAS, the Town of Vienna supports redistricting reform in Virginia for state legislative and congressional districts; and WHEREAS, the Town of Vienna maintains that transparent and nonpartisan legislative districting is a reform essential to build more trustworthy, accountable, and healthy democracy for our commonwealth and nation; and WHEREAS, the Town of Vienna maintains that redistricting reform is necessary to eliminate the conflict of interest that allows General Assembly members to pick their voters; and WHEREAS, the Town of Vienna maintains that eliminating political data would help resolve the problem of split precincts and divided jurisdictions throughout Virginia; and WHEREAS, action is needed now given the multi-year process required to amend the Virginia Constitution in order to institute a reformed redistricting process by the time the next redistricting occurs in 2021. NOW, THEREFORE, BE IT RESOLVED that the Town of Vienna fully supports and urges action to protect and promote democracy in Virginia through redistricting reform. Resolution opposing SB1282 It was moved to support the Resolution opposing wireless bill SB2182 and authorize the Mayor to sign the Resolution. A motion was made by Council Member Howard J. Letter to Fairfax County Planning Commission It was moved for the Mayor to provide a letter and comment to Fairfax County Planning Commission for the Tysons Plan Amendment. A motion was made by Council Member Sienicki, seconded by Council Member Colbert, that the Resolution be approved. Closed Session It was moved to recess into the second Closed Session at 9:57 p.m. Mayor DiRocco called the meeting back to order at 11:55 p.m. The Town Clerk called the role and all members of Council were present. It was moved that the members of the Vienna Town Council be polled to affirm that during the second Closed Session convened this date, Monday, February 6, 2017, the Town Council met for purposes of discussion of personnel matters, specifically, the annual performance evaluation of the Town Manager.
