Councilmembers were in attendance electronically via Zoom.
Present: 7- Council Member Linda Colbert, Council Member Pasha Majdi, Council Member
Douglas Noble, Council Member Nisha Patel, Council Member Steve Potter, Council
Member Howard J. Springsteen and Mayor Laurie DiRocco
2. Resolution for Continuity of Government
Resolution for Continuity of Government
BE IT RESOLVED that the Town Council for the Town of Vienna does hereby approve
and find for the April 27, 2020, Town Council meeting that the usual Council meeting
procedures cannot be implemented safely or practically; and (a) all agenda items
are necessary to address the attack, emergency, crisis, or disaster, and the failure to
act on these agenda items could result in irrevocable public harm; and/or (b) all
agenda items are necessary and essential to assure the continuity of Town
government and operations.
A motion was made that the Resolution be approved.
3. Acceptance of the Minutes:
A. Acceptance of the Regular Council Meeting Minutes of April 13, 2020.
The Regular Council Meeting Minutes of April 13, 2020 were accepted as submitted.
A motion was made that the Minutes be approved. The motion carried by a unanimous vote.

Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco
5. Public Hearings
A. Public hearing regarding FY 2020-21 proposed real estate tax rate
Mayor DiRocco called the Public Hearing to order at 8:10 PM. The Town Clerk
called the roll; all members of Council were present.
Mayor DiRocco set forth the guidelines for conduct. She then called on Marion

Serfass, Director of Finance to provide background for the hearing. Director Serfass
noted that this is the sixth consecutive year with no change in Vienna’s real estate
tax rate. The proposed FY2020-21 budget is based on this $0.2250 per $100 of assessed
value rate along with continuation of the current bank net capital rate of $0.80 per
$100 of valuation as well as a residential utility tax rate of 20% of the first $15 and a
commercial utility tax rate of 15% of the first $300.
Mr. Ray Brill, John Marshal Dr., NE. opened his remarks noting the need for
leadership during this difficult time. He stressed that the 2.6% tax increase should be
reconsidered and potentially reduced to zero. Having talked with numerous
residents, he emphasized that there are many who are financially struggling and
that the Town should be responsive to this need.
Director Serfass responded stressing that the current proposed budget has been
revised during each work session and tonight reflects a 2.6% decrease. Based upon
further input from Council, it will be reworked once again for presentation at the
May 18, 2020 work session. The budget slated for adoption will potentially reflect
even further reductions.
It was moved to close the public hearing.

Second: Councilmember Colbert
Carried unanimously
It was further moved to approve the Fiscal Year 2020-21 proposed real estate tax
rate, bank net capital rate, residential utility tax rate, and commercial utility tax
rate as presented. I further move that the Town Clerk be directed to advertise a
Notice of Intent to Adopt at the May 11, 2020 Council meeting.
Motion: Councilmember Colbert
Second: Councilmember Springsteen
Carried unanimously
A motion was made by Council Member Colbert, seconded by Council Member
Springsteen, that the Action Item be approved. The motion carried by the following vote:

6. Consent Agenda
A motion was made by Council Member Springsteen and seconded by Council
Member Patel to accept the consent agenda as presented.
The consent agenda was approved by the following vote:

A. Approval of spending with Moody’s Investor Services for bond rating services
B. Request CIP and revenue-share funding for roadway maintenance utilizing IFB 20-03
C. Request approval for spending $1,000,000 with E.E. Lyons Construction for water

main and appurtenance improvements within the Town’s water service area
D. Request approval of a memorandum of understanding between the Optimist Club of
Greater Vienna and Town of Vienna regarding use of the Vienna Community Center
parking lot for the 2020 Vienna Farmers Market
7. Regular Business
A. Request to set a June 1, 2020 public hearing to extend temporary suspension of the
Maple Avenue Commercial (MAC) Zone, set currently to expire June 30, 2020, to
June 30, 2022, and refer the matter to the Planning Commission for consideration.
Mayor DiRoco called on Cindy Petkac, Director of Planning and Zoning, to present
a brief summary of the request for MAC extension.
It was moved to refer to the Planning Commission for consideration 1) a proposed
extension of temporary suspension of Article 13.1 - MAC Maple Avenue Commercial
Zone Regulations of Chapter 18 of the Town Code to June 30, 2022, and 2) a repeal of
the subject Article; and for the Planning Commission to report back their
recommendations to Council on both options.
And
It was further moved to set a June 1, 2020 public hearing to receive the Planning
Commission's recommendations as well as public input on the proposed extension of
temporary suspension to June 30, 2022 or repeal of Article 13.1 - MAC Maple Avenue
Commercial Zone Regulations of Chapter 18 of the Town Code. It was further moved
to direct the Town Clerk to advertise the public hearing and a Notice of Intent to
Adopt at the June 1, 2020 Town Council meeting.
Motion: Councilmember Noble
Second: Councilmember Springsteen
CouncilMember Majdi moved to include an amendment that included verbiage as
follows " and 3) corresponding changes to the comprehensive plan". Council
Member Patel seconded the amendment. The amendment failed on the following
vote:
Aye: Council Member Majdi; Council Member Patel
Nay: Council Member Potter, Council Member Colbert; Council Member Noble;
Council Member Springsteen and Mayor DiRocco.
The original motion carried unanimously.
A motion was made by Council Member Noble, seconded by Council Member Springsteen,
that the Action Item be approved. The motion carried by the following vote:

Patel, Council Member Potter, Council Member Springsteen and Mayor DiRocco
