Resolution A. 21-2681 Resolution for Continuity of Government Mayor Linda Colbert called the meeting to order and read into the record the Continuity of Government. The Resolution was approved through voice vote. 2. Invocation: Fr. Matthew Hillyard, Our Lady of Good Counsel Mayor Colbert recognized Fr. Matthew Hillyard, Our Lady of Good Counsel (via ZOOM) to provide the evening’s invocation. 3. Pledge of Allegiance to the Flag of the United States of America 4. Roll Call Present: 7- Council Member Chuck Anderson, Council Member Ray Brill Jr., Council Member Nisha Patel, Council Member Steve Potter, Council Member Ed Somers, Council Member Howard J. Springsteen and Mayor Linda Colbert 5. Approval of the Minutes: A. 21-2682 Acceptance of the Regular Council Meeting Minutes of October 11, 2021 The Regular Council Meeting Minutes of October 11, 2021 were accepted as submitted. A. 21-2682 Acceptance of the Regular Council Meeting Minutes of October 11, 2021 Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert 6. Receipt of petitions and communications from the Public that are not on the Agenda. (Limited to 3 minutes per issue and no formal action can be taken this evening) There were no communications from the public. 7. Reports/Presentations A. 21-2588 New Town of Vienna Police Officer Introductions Chief Morris introduced the newest members of the Vienna Police Force; Officer Emily Lichtenberg, Officer David Reed, and Officer Patrick Crandall. 8. Closed Session Report Town of Vienna Page 1 Printed on 11/16/2021 Town Council Meeting Meeting Minutes October 25, 2021 It was moved that the members of the Vienna Town Council be polled to affirm that a Closed Session was held on October 25, 2021 virtually, via ZOOM, and in-person, in accordance with Virginia Code, Section 2.2-3711.A.(1), and the Town of Vienna’s Continuity of Government ordinance, for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to Monday November 1, 2021 at 7:00 PM in accordance with Virginia Code, Section 2.2-3711.A.(1), and the Town of Vienna’s Continuity of Government ordinance, for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. Motion, Council Member Somers; second, Council Member Springsteen. Motion carried unanimously. It was moved to recommend Mala Persaud be appointed to the Conservation and Sustainability Commission to complete the unexpired term of Sean Casey. Said term shall be effective October 26, 2021 and will expire on January 8, 2023. It was further moved to appoint Gina Womack be appointed to the Bicycle Advisory Committee for a two-year term. Said term to begin October 26, 2021 and expire on October 26, 2023. Motion, Council Member Somers; second, Council Member Springsteen. Motion carried unanimously. 8. Closed Session Report Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert 9. Regular Business A. 21-2590 Proposed Change Order for Project Management Services for Police Station Construction. Mayor Colbert recognized Chief Jim Morris, Vienna Police Department, to present the item for discussion. It was moved to approve the change order request for Downey and Scott project management team in the amount not to exceed $67,680 which includes a 5% contingency. Motion, Council Member Anderson; second, Council Member Springsteen. Motion carried unanimously. A motion was made by Council Member Anderson, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert Town of Vienna Page 2 Printed on 11/16/2021 Town Council Meeting Meeting Minutes October 25, 2021 B. 21-2624 Award of IFB 22-05 to Arthur Construction Co, Inc. and request fiscal year spending Mayor Colbert called on Mike Gallagher, Director, Public Works to summarize the request. It was moved to approve award IFB 22-05 to Arthur Construction Co, Inc. and to approve FY22 spending in the amount of $899,125.00 with Arthur Construction Co, Inc. Motion, Council Member Patel; second, Council Member Potter. Motion carried unanimously. A motion was made by Council Member Patel, seconded by Council Member Potter, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert C. 21-2634 Request approval to utilize VDOT Transportation Alternative funds for Locust Street Trail Improvements, Park Street, NE sidewalk, and Freeman Store Bridge Construction Mayor Colbert called on Director Gallagher to summarize the project request. It was moved to approve utilizing VDOT Transportation Alternative funds for Locust Street Trail Improvements, Park Street, NE sidewalk, and Freeman Store Bridge Construction projects. Motion, Council Member Patel; second, Council Member Somers. Motion carried unanimously. A motion was made by Council Member Patel, seconded by Council Member Somers, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert D. 21-2656 Request approval of additional funds for Vehicle Replacement Program for FY22 Mayor Colbert recognized Director Gallagher and Chief Morris to provide information relative to the request. It was moved to approve the additional funds in the amount of $2,125 for Vehicles #7, #14 and #15 utilizing funds from account 100-190-1091-19141-48308. Motion, Council Member Patel; second, Council Member Somers. Motion carried unanimously. A motion was made by Council Member Patel, seconded by Council Member Somers, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert E. 21-2646 Adopt 2022 Capital Improvement Plan (CIP) Town of Vienna Page 3 Printed on 11/16/2021 Town Council Meeting Meeting Minutes October 25, 2021 Mayor Colbert called on Marion Serfass, Director of Finance to present the Item for consideration. Council requested discussion of each proposed change to the CIP. The following provides a summary of the major points of discussion: • ASPHALT MILL OVERLAY REQUEST OF $1.45M Would require $2.4M commitment each year for ten years to increase PCI (Pavement Condition Index) rating from fair to good; Can borrow more but will require trade-offs; • GLYNDON SE ROADWAY IMPROVEMENTS LOCUST STREET TO VALLEY DRIVE $500,000 Current project moved forward but neglected Glen SW project (traffic study sidelined by COVID); Estimated cost similar to Glyndon SE; Add project to CIP (Director Serfass to provide draft); • SOUTHSIDE PARK BALL FIELD #1 AND #2 REFURBISHMENTS $112,500 Concern expressed regarding expenditure for scoreboard and press box; Should use money for benefit of all; Support noted the upgrade would provide draw for additional tournaments; Positive support for Vienna youth; Further discussion postponed until Town Council Meeting, November 8, 2021 (Director Herman will provide breakdown of request); • CENTRAL BUSINESS DISTRICT - DESIGN AND ACQUIRE BANNERS, WAYFINDING SIGNS AND GATEWAY ARCHES Designated ARPA funds; incorrectly includes gateway arches; additional funds designated by Movers and Shakers; (Ms. Monkou will provide breakdown of request). • OTHER PROJECTS NOT ON DRAFT Maple Avenue irrigation project - ARPA funds; Maple Avenue intersection improvements – possible 2022 CIP; • ADDITIONAL ITEMS a) Director Serfass will provide list of items already discussed and agreed upon for November 8, 2021 Town Council Meeting. b) Director Serfass will provide breakdown of proposed 2022 CIP/ARPA expenditures by Town quadrant. c) Recommended that the CIP/ARPA items be brought before Council for vote. d) A Conference Session will be scheduled for additional discussion on the Asphalt/Mill Overlay item. A motion was made to postpone the Capital Improvement Plan as presented until the December 6, 2021 Town Council meeting. Motion, Council Member Somers; second, Council Member Patel. Motion carried unanimously. A motion was made by Council Member Somers, seconded by Council Member Patel, that the Action Item be deferred. It was moved to approve the proposed five (5) year License/Franchise Agreement between the Town and Level 3 Communications, LLC and authorize the Mayor to execute. Motion, Council Member Patel; second, Council Member Springsteen. Motion carried unanimously. A motion was made by Council Member Patel, seconded by Council Member Springsteen, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert 10.
