Resolutuion A. 21-2692 Resolution for Continuity of Government Mayor Linda Colbert called the meeting to order and read into the record the Continuity of Government. The Resolution was approved through voice vote. 2. Invocation: Reverend Kyungsuk Cho, Wesley United Methodist Church Mayor Colbert recognized Reverend Kyungsuk Cho, Wesley United Methodist Church to provide the evening’s invocation. 3. Pledge of Allegiance to the Flag of the United States of America 4. Roll Call Present: 7- Council Member Chuck Anderson, Council Member Ray Brill Jr., Council Member Nisha Patel, Council Member Steve Potter, Council Member Ed Somers, Council Member Howard J. Springsteen and Mayor Linda Colbert 5. Acceptance of the Minutes: A. 21-2693 Acceptance of the October 18, 2021 Conference Session Minutes The October 18, 2021 Conference Session Minutes were accepted as submitted. 21-2693 Acceptance of the October 18, 2021 Conference Session Minutes Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert 6. Receipt of petitions and communications from the Public that are not on the Agenda. (Limited to 3 minutes per issue and no formal action can be taken this evening) Mayor Colbert called for public comment on topics not on the Agenda. Mike Jreige, 362 Park St. introduced himself as president of Vienna Little League. Having also served twelve years on the Board, he noted the longtime partnership with the Town of Vienna and the Department of Parks and Recreation. Thanking Council for the support, he pointed to the success of the 2021 State Little League Tournament which brought sixteen teams from throughout the State to Vienna for a five-day event. As the Town considers renovations to Southside park Mr. Jreige wished to impress upon Council the significance this project would have on the Town. With the inclusion of a scoreboard and a pressbox, the upgrade would allow Vienna to host both District and State tournaments every summer, as well as Travel League events. The overall impact would be substantial as Vienna Little League Town of Vienna Page 1 Printed on 11/16/2021 Town Council Meeting Meeting Minutes November 1, 2021 includes 900-1100 youth involved in Spring ball, 600-650 youth involved in Fall ball and an additional 60-70 youth involved in a ten month Select program. David Minyard, 635 Tazewell Rd., NW Could not hear recording Dale Sanders, 610 DeLano Dr., SE questioned why citizens are not allowed to speak when an item is on the agenda. Mayor Colbert clarified that the time for public comment is during scheduled Public Hearings. Mr. Sanders stated that the process was unprofessional and wished to express his opposition to it. He then offered Council a petition signed by residents along Alma Dr. who are opposed to sidewalks on their street. Max Catalano, 364 Park St., NE, wished to speak to Council regarding possibilities for noise abatement on Mill St. (notably prior to 7:00 AM). Over the past several years more families with small children have moved onto the street. The night time and early morning noise has become excessive, disturbing the sleep of children and adults (potentially impacting school performance). An amendment in the noise violation section of the Town Code allows loading and unloading to begin at 6:00 AM. Mr. Catalano would appreciate an opportunity to discuss a way to move toward a resolution. Mayor Colbert requested an email outlining this issue. She will then involve the correct department. Paul Leighton, 502 Alma St. inquired about the existence of sidewalks on Mayor Colbert’s cul-de-sac. Mayor Colbert acknowledged that there are sidewalks. Mr. Leighton explained that he is attempting to verify his observation that opposition to sidewalks is generated from those who are effected; the “not in my backyard” effect. Mayor Colbert requested an email and assured a response. 7. Reports/Presentations A. 21-2589 Recognition of Life Saving Actions. Mayor Colbert recognized Chief Jim Morris who introduced George Hunt. Mr. Hunt presented the Life Saving Valor award to MPO Kenny Smith and Officer Dale (Chip) McElhatten. 8. Closed Session Report It was moved that the members of the Vienna Town Council be polled to affirm that a Closed Session was held on November 1, 2021 virtually, via ZOOM, and in-person, in accordance with Virginia Code, Section 2.2-3711.A.(1), and the Town of Vienna’s Continuity of Government ordinance, for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. It was further moved that the Certification Resolution be adopted in accordance with State Statutes, and that the Town Clerk is authorized to execute the Certification Resolution. And it was further moved that the Closed Session be continued to Monday November 15, 2021 at 7:15 PM in accordance with Virginia Code, Section 2.2-3711.A.(1), and the Town of Vienna’s Continuity of Government ordinance, for discussion or consideration of personnel matters, specifically the interviewing of individuals for consideration of appointment and/or reappointment to Town Boards and Commissions. Consent Agenda 10. Regular Business A. 21-2631 Purchase workstations/tables for new police facility Mayor Colbert introduced Chief Morris to present the Item for discussion. It was moved to approve the purchase of workstations and tables for the new police facility utilizing Fairfax County Public Schools contract 4400010039 with Interiors by Guernsey at a cost not to exceed $162,188. Motion, Council Member Springsteen; second, Council Member Potter. Motion carried unanimously. A motion was made by Council Member Springsteen, seconded by Council Member Potter, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert B. 21-2683 Consideration to Initiate Engineering Design Reports of Robinson Sidewalk Projects Mayor Colbert called on Mike Gallagher, Director of Public Works to present the item for consideration. It was recommended to authorize the Town Manager to apply to the Maud Robinson Trust to prepare engineering design reports for Robinson Sidewalk Projects listed: • DeSale Street, SW from Moore Avenue to Tapawingo Road • DeSale Street, SW from Tapawingo Road to the end • Melody Lane, SW from DeSale Street to Lullaby Lane • Tazewell Road, NW from Lawyers Road to Holmes Drive • Delano Drive, SE from Echols Street to the end • Orrin Street, SE from Delano Drive to Follin Lane Motion, Council Member Somers; second, Council Member Potter. Motion carried unanimously. A motion was made by Council Member Somers, seconded by Council Member Potter, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert C. 21-2689 Request to set a public hearing to receive public comment on proposed amendments to Part 1 of the Town Charter, Chapter 3, Elections, related to the General Assembly’s recent legislation to set all local elections in November; and, to also consider modifications to terms of office to accommodate the November election Town of Vienna Page 3 Printed on 11/16/2021 Town Council Meeting Meeting Minutes November 1, 2021 date, and consideration of possible longer or un-staggered terms of office. Mayor Colbert recognized Steve Briglia, Town Attorney to present the Item for consideration. The following points summarize Council discussion; • Consider a Council of three two-year term members and four (including Mayor) four-year term members; five seats would be voted on every other year; request information on viability of this option; • Public should be provided options (clearly identified as A, B, C, etc.) for review prior to Public Hearing; • Suggested options for public consideration include: • Two-year/no staggering (odd year); • Four-year/no staggering (odd year); • Combination of two-year/four-year (as above); • No change, other than required by State Statute • Include short preamble explaining why this change is required. • Prepare visual outlining suggested options for use at Public Hearing. • Must pass resolution for submission to General Assembly; already drafted using broad language; It was moved to set a public hearing for November 15, 2021, at the regular meeting of the Town Council, to receive public input on proposed amendments to Part 1 of the Town Charter, Chapter 3, Elections, to consider the General Assembly’s recent legislation to set all local elections in November; and, to also consider modifications to terms of office to accommodate the November election date, and consideration of possible longer or un-staggered terms of office. Motion, Council Member Potter; second, Council Member Somers. Motion carried unanimously. A motion was made by Council Member Potter, seconded by Council Member Anderson, that the Action Item be approved. The motion carried by the following vote: Aye: 7- Council Member Anderson, Council Member Brill, Council Member Patel, Council Member Potter, Council Member Somers, Council Member Springsteen and Mayor Colbert D. 21-2691 Request to set a public hearing for Nov. 15, 2021 regarding the Town of Vienna 2022 legislative agenda Mayor Colbert called on Attorney Briglia to review the Item. Council was asked to submit their prioritized list by November 8, 2021. It was moved to set a public hearing for November 15, 2021 regarding the proposed 2022 Town of Vienna legislative agenda. Motion, Council Member Patel; second, Council Member Springsteen. Motion carried unanimously. A motion was made by Council Member Patel, seconded by Council Member Springsteen, that the Action Item be approved. Attorney Briglia recommended that Council follow Roberts Rules of Order. Virginia Municipal League has prepared a brochure which includes information on this issue that would prove informative to residents. Mayor Colbert called for a motion to adjourn.
