Chairwoman Theresa Bachmann, Michael Cheselka, Julie Kyllo, Stephen Kenney, and Craig Burns were present. Also in attendance and representing town staff were Town Deputy Director of Planning & Zoning, Kelly O’Brien, and Clerk to the Board, Jennifer Murphy. Roll Call All members are present. Approval of the Minutes: There being no edits the October 12, 2022, meeting minutes were approved. WHBR - October 12, 2022 Meeting Minutes Regular Business 1. Request for a Certificate of Appropriateness for exterior modifications to existing dwelling located at 220 Lawyers Rd. NW, per Sec. 18-280.4., Docket No. PF-923578-WHBR, in the RS-16, single-family detached residential zoning district; filed by Anwar Maharmeh, of MTES Engineering Service, on behalf of Kemal Atam, property owner. Deputy Director of Planning & Zoning, Kelly O’Brien provided staff’s report, stating that the applicant is seeking a certificate of appropriateness to construct an addition off the back of the existing home and a front foyer addition. Although the property is situated facing Lawyers Rd NW the driveway extends on to Lovers Ln NW, which is unimproved right of way. Photos of the property were presented. Past renovation projects include a second story addition reviewed and approved by the board in 1997 and a revised approval in 2003. Anwar Maharmeh, of MTES Engineering Service & Kemal Atam, property owner, were present representing the application. Materials and color samples were passed around for review, with a discussion that the trim, shutters, and trim detail will be white. New windows will include mullions. The applicant intends to match up all improvements. Members of the board were unclear about proposed design elements on both the rear addition and foyer addition. There was a brief discussion on suggested design elements suitable for the project that included a reverse gable to keep the look of Town of Vienna Page 1 Printed on 4/25/2023 Windover Heights Board of Review Meeting Minutes February 7, 2023 the old home and centering the bathroom to limit altering the roofline and to not further the non-conformity of the house footprint. The applicant was encouraged to consider a higher quality paint and to include the footprint of the patio along with mullions in the doors to match on their resubmission. There being no further discussion, a motion was in order. Mr. Kenney motioned that the request for a Certificate of Appropriateness for exterior modifications to existing dwelling located at 220 Lawyers Rd. NW, per Sec. 18-280.4., Docket No. PF-923578-WHBR, in the RS-16, single-family detached residential zoning district be deferred. Motion: Kenney Second: Cheselka Carried: 5-0 2. Meet with the Town Attorney to Discuss FOIA Requirements Mr. Burns asked for clarification on email communications between board members as it relates to FOIA requirements. Town Attorney, Steve Briglia explained that all communications amongst staff and members of the board are public communications. Any communications relating to public matters is subject to FOIA. Emails can be sent but no online meetings, such as online discussions of board business, can occur. Contemporaneous discussion with more than two members is a meeting. Mr. Briglia stated that email information can be sent but members of the board should be mindful that they cannot hold back and forth discussions. They should treat emails as though they are sending a letter with no expectation of a response. Additional discussion followed regarding the board’s purview relating to Town Code §18-280.1 Windover Heights Historic District - Purpose, and tree canopy restrictions.
