Acequia Visalia, CA 93291 City Council Meeting Minutes - Final Mayor Steve Nelsen Vice Mayor Brian Poochigian Council Member Greg Collins Council Member Brett Taylor Council Member Liz Wynn Monday, April 18, 2022 7:00 PM City Council Chambers ROLL CALL Present: Mayor Steve Nelsen, Vice Mayor Brian Poochigian, Council Member Greg Collins, Council Member Brett Taylor, and Council Member Liz Wynn CALL TO ORDER WORK SESSION - START TIME: 5:30 PM The meeting was called to order at 5:30 PM PUBLIC COMMENTS Citizens are now invited to comment on issues within the jurisdiction of the Visalia City Council. The Council asks that you keep your comments concise and positive. Creative criticism, presented with appropriate courtesy, is welcome. Each speaker will be allowed three minutes and a timer will notify you when your time is expired. Please begin your comments by stating and spelling your name and providing your city of residence. WORK SESSION AND ACTION ITEMS (as described) 1. California Water Service Presentation On Water Conservation 22-0117 and Rebates. Tammy Myers, California Water Service, provided the presentation for the Water Conservation rebates. Rebates are available for high efficiency toilets, clothes washers, and turf. No action required. 2. Presentation by the Arts Consortium of the activities undertaken 22-0162 in 2021 as part of a contract for services with the City of Visalia and approval of a contract for services for 2022-2023, effective as of January 1, 2022. Ampelio Mejia Perez, Arts Consortium, Project Manager, provided the Arts Consortium presentation. A motion was made by Vice Mayor Brian Poochigian, seconded by Council Member Greg Collins, to approve as recommended. The Council asks that you keep your comments brief and positive. Creative criticism, presented with appropriate courtesy, is welcome. This is also the time for citizens to request an item from the Consent Calendar be pulled for discussion purposes. Public comments related to all pulled Consent Calendar items and Regular or Public Hearing items listed on the agenda will be heard at the time that item is discussed or when the Public Hearing is opened. Gino Caggiano spoke regarding the parking of a commercial vehicle in a residential zone. He was informed by the previous Community Development Director that he is allowed to park his large Snap On tool truck at his home. He requested for the current Director to issue him a TCUP for the vehicle. Don Celillo also spoke in support of the code being updated to allow the parking of certain vehicles of heavy weights in a residential zone. CONSENT CALENDAR Consent Calendar items are considered routine and will be enacted in one motion. There will be no separate discussion of these matters unless a request is made and then the item will be removed from the Consent Calendar to be discussed and voted upon by a separate motion . A motion was made by Vice Mayor Poochigian, seconded by Council Member Taylor, to approve the Consent Calendar. Items 2 and 8 pulled for separate discussion and vote. Authorization to read ordinances by title only. 22-0143 2. Request by Councilmember Greg Collins for the Council to 22-0156 approve adding an agenda item to a future City Council meeting to discuss an aquatic center complex. A motion was made by Council Member Greg Collins, seconded by Council Member Liz Wynn, to approve as recommended. The motion failed by the following vote: Aye: Greg Collins, and Liz Wynn No: Steve Nelsen, Brian Poochigian, and Brett Taylor 3. Request authorization to record the final map for Lance Lane 22-0137 Estates, Phase 1, a subdivision located on the south side of East Houston Avenue between North Dunworth Court and North Lovers Lane (38 lots); and request authorization for the formation of Landscape and Lighting Assessment District No. 22-03 "Lance Lane Estates"; and, ordering the improvements and levying the annual assessments for Landscape and Lighting Assessment District No. 22-03 "Lance Lane Estates"; and, the intention and formation of Open Space District No. 22-01 "Lance Lane Estates" (Resolution Nos. 2022-23, 2022-24, 2022-25, and 2022-26 required). 4. Adoption Resolution No. 2022-27 certifying Mitigated Negative 22-0022 Declaration No. 2022-16 prepared for California Environmental Quality Act (CEQA) compliance as part of the Highway Improvement Program (HIP) funding for the construction of the “Riggin Avenue Widening Project” from North Mooney Boulevard to North Conyer Street (State Clearinghouse No. 2022030456) (Resolution No. 2022-27 required). 5. Request authorization to file a Notice of Completion for “Shannon 22-0136 Ranch 3, Units No. 9 & 12” subdivision containing 59 single-family residential lots located north side of West Shannon Parkway between North Giddings Street and North Divisadero Street. 6. Authorization for the City Manager to utilize the California 22-0141 statewide contract for zero-emission transit buses to enter into a contract in the amount of $2,213,667 with New Flyer of North America Inc. for the purchase of two 35' Battery Electric Buses (BEB) for fixed route service, including the purchase and installation of bus chargers. Adoption of the second reading of Ordinance No. 2022-06 22-0142 pertaining to the approval of Zoning Text Amendment No. 2021-09: A request by the City of Visalia to amend portions of Visalia Municipal Code Title 17 (Zoning Ordinance) to implement a program contained in the City of Visalia 2020-2023 Housing Element pertaining to regulations for emergency shelters and low barrier navigation centers. The project area is contained within the City of Visalia’s Urban Development Boundaries that are illustrated in the Visalia General Plan, Citywide. 8. Request authorization to record the final map for Highland Park, 22-0149 Unit No. 2 subdivision, located at the northwest corner of West Riggin Avenue and North Giddings Street. Council Member Greg Collins, asked about the lot size. Paul Bernal, Community Development Director, answered Council questions. A motion was made by Council Member Liz Wynn, seconded by Vice Mayor Brian Poochigian, to approve as recommended. The motion carried by the following vote: Aye: Steve Nelsen, Brian Poochigian, Greg Collins, Brett Taylor, and Liz Wynn 9. Authorization for staff to accept Congestion Mitigation and Air 22-0163 Quality (CMAQ) in the amount of $1,750,000 from Tulare Council Association of Governments TCAG to purchase electric buses. 10. 1) Award RFP-21-22-26 to AmeriNational Community Services, 21-0639 LLC (dba: AmeriNat), and 2) Authorize the City Manager, or their designee, to negotiate and execute a 3-year contract agreement to manage the City of Visalia Housing Loan Portfolio from Fiscal year (FY) 2022-2023 through FY 2024-2025, not to exceed Eighty-Five Thousand Two Hundred Dollars ($85,200). REGULAR ITEMS AND PUBLIC HEARINGS Comments related to regular Items and Public Hearing Items are limited to three minutes per speaker, for a maximum of 30 minutes per item. The Mayor may reasonably limit or extend the public comment period to preserve the Council's interest in conducting efficient, orderly meetings. Margie Perez, Housing Specialist, requested for Council to conduct a second public hearing for the 2022 Annual Action Plan and 2021 Action Plan Amendment including the HOME-ARP Allocation Plan for the U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG), HOME Investment Partnership Program (HOME), and HOME Investment Partnership American Rescue Plan Program (HOME-ARP) activities and projects. The public hearing was opened at 7:30 p.m. and closed. There were no public comments. A motion was made by Council Member Liz Wynn, seconded by Council Member Brett Taylor, to approve as recommended.
