Acequia SPECIAL MEETING ROLL CALL Present: Mayor Brian Poochigian, Vice Mayor Brett Taylor, Council Member Steve Nelsen, and Council Member Liz Wynn Absent: Council Member Emmanuel Hernandez Soto Government Code Section 54953(b) provides the rules for teleconferencing for City Council meetings. Council Member Emmanuel Hernandez Soto will participate in the April 23, 2024 Special City Council meeting via teleconference. The location is Highway 50 at Stateline Ave., Lake Tahoe, NV 89449, Business Center, 2nd Floor. The public can attend, participate and provide public comment from the teleconference location and at the Council meeting . For the record: Council Member Hernandez Soto did not appear at the Special Meeting via teleconference. CALL TO ORDER SPECIAL SESSION - 5:15 PM (Unless otherwise noted) The meeting was called to order at 5:15 p.m. Page 1 of 2 Visalia City Council Meeting Minutes - Final April 23, 2024 1. Urgency Ordinance - Public Hearing and adoption of an interim 24-0151 Ordinance No. 2024-05 adopted as emergency measures to regulate the location and operational requirements for massage establishments pursuant to Government Code section 65858(b), Citywide. (4/5’s approval of the City Council is required for passage.) Paul Bernal, Community Development Director, explained the reason for the special meeting to adopt Ordinance 2024-05 adopted as emergency measures to regulate the location and operational requirements for massage establishments pursuant to Government Code section 65858(b), Citywide. On March 4, 2024, the City Council adopted Ordinance No. 2024-03. The interim urgency ordinance was adopted to establish additional regulations for massage establishments, in the interim, while more specific regulatory changes to the Visalia Municipal Code are being further considered. The interim emergency ordinance was considered under Visalia City Charter Article VI, Section 7, and Government Code section 65858, which permit the adoption of an interim emergency ordinance, as an urgency measure upon findings that the proposed ordinance is needed due to alleviate a current and immediate threat to the public health, safety, or welfare. The ordinance was approved and went into effect immediately. However, under section 65858, an interim ordinance is only valid for 45 days unless it is readopted after a publicly noticed hearing to extend the ordinance for a longer period. City staff were not able to publish the required public notice within the initial 45-day period. A motion was made by Council Member Steve Nelsen, seconded by Vice Mayor Brett Taylor, to approve as recommended. The motion carried by the following vote: Aye: Brian Poochigian, Brett Taylor, Steve Nelsen, Liz Wynn Absent: Emmanuel Hernandez Soto PUBLIC COMMENT Citizens are now invited to comment on issues within the jurisdiction of the Visalia City Council. The Council asks that you keep your comments concise and positive. Creative criticism, presented with appropriate courtesy, is welcome. Each speaker will be allowed three minutes, and a timer will notify you when your time is expired. Please begin your comments by stating and spelling your name and providing your city of residence.
