MINUTES OF REGULAR COUNCIL MEETING
TOWN HALL MEETING ROOM
112 W ALABAMA AVE.
VIVIAN, LOUISIANA
MONDAY, APRIL 8, 2019
6:00 PM
CALL TO ORDER – Mayor Festavan called the meeting to order at 6:00
p.m.
INVOCATION – Alderman Raymond Williams led the prayer.
PLEDGE – Mayor Festavan led all present in the Pledge of
Allegiance.
VERIFICATION OF QUORUM – The Town Clerk verified that a
quorum was present. Those present were: Ronnie Festavan -
Mayor; James Martin, Denise Alexander, Michael Guthrie,
Raymond Williams and Angela Channell - Board of Aldermen.
Also present were staff members/other officials: Ryan Nelson -
Chief of Police, Douglas Dominick - Town Attorney,
Kellie Morris - Town Clerk and David Jones, Jr. - Deputy Clerk.
APPROVE AGENDA – Motion made by Denise Alexander; second
by James Martin; all approved.
1. SCHOOL ANNOUNCEMENTS – Mrs. Willoughby was in
attendance to present the Star Students of the Month from North
Caddo Elementary-Middle School and Mrs. Cherry presented the
North Caddo Magnet High School Star Students of the Month.
Alderman-At-Large Angela Channell also presented the North
Caddo Middle School Boys Basketball team and their Coaches
Wilson and Long as the 2018-19 City Champions, the first time in
history for the school.
2. PUBLIC COMMENTS – There were NO Public Comments.

3. MONTHLY FINANCIAL REPORT – Financial report was
presented by Mayor Festavan.
4. APPROVAL OF MINUTES FOR MARCH 11, 2019 REGULAR
MONTHLY MEETING – Motion was made by Denise Alexander;
second by James Martin to approve minutes presented; all
approved.
5. HIRING OF NEW POLICE OFFICER – Chief of Police Ryan
Nelson made the recommendation to hire and commission Gary
Roberts for Full-time Police Officer at the pay rate of $13.00 per
hour. Motion to accept Chief Nelson’s recommendation was made
by Denise Alexander, second by James Martin; all approved.
6. PUBLIC HEARING ON ORDINANCE # 718 OF 2019 OF THE
TOWN OF VIVIAN, LOUISIANA – TO AMEND AND
SUPPLEMENT THE TOWN OF VIVIAN’S BUDGET ORDINANCE
#708 OF 2018 - TO REFLECT THE APPROPRIATE REVENUES
AND EXPENDITURES. Mayor Festavan opened the public
hearing for public comments FOR or AGAINST; none were made.
Mayor Festavan then declared the public hearing closed.
7. CONSIDER THE ADOPTION OF ORDINANCE # 718 OF 2019
OF THE TOWN OF VIVIAN, LOUISIANA – TO AMEND AND
SUPPLEMENT THE TOWN OF VIVIAN’S BUDGET ORDINANCE
#708 OF 2018 - TO REFLECT THE APPROPRIATE REVENUES
AND EXPENDITURES. Mayor Festavan stated that after receiving
information that would affect the Budget Amendment in a positive
way that he would like to remove Agenda Item # 7 from the
Agenda for a vote at the present time. Motion was made by
Denise Alexander to remove Item # 7 from the Agenda; second by
Angela Channell; there being no discussion and/or questions all
voted to approve.
8. INTRODUCTION OF ORDINANCE # 719 OF 2019 OF THE TOWN OF
VIVIAN, LOUISIANA – THE SALE OF MOVABLE PROPERTY, THE
REASONS FOR SAID SALE, TO FIX THE MINIMUM PRICE OF SAID
SALE AND THE TERMS OF THE SALE. To declare said property

(antiquated voltage regulators) surplus property, no longer needed for a
public purpose and to be sold unto the Town of Arcadia. There will be a
public hearing prior to the adoption of Ordinance # 719 at the regular Town
Council Meeting at 6:00 p.m. on May 13, 2019 at the Vivian Town Hall,
located at 112 W. Alabama Ave. in Vivian, Louisiana.
9. TO CONSIDER RESOLUTION # 3 of 2019 – A RESOLUTION
BEING FY 2018 LOUISIANA COMMUNITY DEVELOPMENT
BLOCK GRANT (LCDBG) BLOCK GRANT for sewer
improvements, adoption of plan and policies, appointments and
authorization of individuals for compliance with the LCDBG
regulations. Motion was made by Raymond Williams, second by
Michael Guthrie; all approved.
10. CONSIDER MAYOR’S RECOMMENDATION – TO APPOINT
JAMES LACAZE TO THE CADDO WARD II INDUSTRIAL
CORPORATION. (To replace Dr. Stephen Taylor.) Motion was
made by James Martin, second by Raymond Williams; all
approved.
11. CONDEMNATION REPORT – Bobby Smith was present to
present the report to the Mayor and Council who also received a
written report. A number of properties were discussed during his
report;1) 329 W. Kentucky Ave., 2) 525 N. Spruce St., 3) 224 E.
Arkansas Ave., 4) 605 N. Spruce St. and 5) 203 E. Pennsylvania
Ave. Mr. Smith also reported that he had inspected Monterey Hills
Apartment Complex on Williamson Way and that it is being sold to
new owners.
12. CODE ENFORCEMENT REPORT – No report was given due
to the absence of Officer Perry Hart.
13. ANNOUUNCEMENT OF PUBLIC MEETING – NOTICE WAS GIVEN that at
its Regular Council Meeting to be held on Monday, May 13, 2019 at 6:00 p.m. at
the Town Hall Meeting Room, 112 W. Alabama, Avenue, Vivian, Louisiana, the
Mayor and Board of Aldermen of the Town of Vivian, State of Louisiana, plans to
consider adopting a resolution ordering and calling an election to be held in the
Town of Vivian to authorize the rededication of a sales and use tax.

MAYOR’S REPORT – Mayor Festavan reported on the following:
1) $30,00 National Recreation & Parks Association Walmart
Foundation Grant received, 2) $600,000 FY 18 Louisiana
Community Development Block Grant received for sewer
improvements, 3) the FY 2020-21 LCDGB Grant process was
about to begin, 4) Louisiana Rural Water Association had visited
Vivian and would be doing a study on Vivian’s water production
and sales, 5) The Town’s Group Insurance rates for employees
would be increasing, 6) the EPIC Boats loan had been restructured
by the State and a new contract drafted to freeze their monthly
payment to the town at $5,000 per month, 7) the deadline for water
payments being moved to the 15th of the month sometime in the
months to come, 8) ACLARA installing the new program to the
readers on the water meters would begin soon, 9) Raw sewerage
ordinance and the language in said ordinance to address this
matter within the town, and 10) the 2019-20 Budget would include
changes in facility rentals.
14. ANNOUNCEMENTS MADE BY BOARD OF ALDERMEN –
Angela Channell reported that North Caddo Magnet High School
Graduation would be held at 7:30 p.m. on Monday, May 13th, in
John Prudhomme Stadium on the Campus of North Caddo, which
is the same night as Council Meeting.
10. ADJOURN – Motion was made by Raymond Williams;
seconded by Denise Alexander; all approved. Meeting adjourned
at 7:56 p.m.
