MINUTES OF REGULAR MEETING TOWN HALL MEETING ROOM 112 W ALABAMA AVE. VIVIAN, LOUISIANA MONDAY, March 11, 2019 6:00 PM CALL TO ORDER – Mayor Festavan called the meeting to order at 6:00 p.m. INVOCATION – Mayor Festavan led the prayer. PLEDGE – Mayor Festavan led all present in the Pledge of Allegiance. VERIFICATION OF QUORUM – The Town Clerk verified that a quorum was present. Those present were: Ronnie Festavan - Mayor; James Martin, Denise Alexander, Michael Guthrie, Raymond Williams and Angela Channell - Board of Aldermen. Also present were staff members/other officials: Ryan Nelson - Chief of Police, Douglas Dominick - Town Attorney, Kellie Morris - Town Clerk and David Jones, Jr. - Deputy Clerk. APPROVE AGENDA – Motion made by Raymond Williams; second by James Martin; all approved. 1. SCHOOL ANNOUNCEMENTS – Mrs. Cherry, North Caddo Magnet HIGH School Principal presented the High School Star Students of the Month and Alderman-At-Large Angela Channell presented the Star Students of the Month from North Caddo Elementary-Middle School. 2. PUBLIC COMMENTS – The following individual(s) made public comments: Jim Slagle – Mr. Slagle stated that the Town’s elected officials Page 1 of 5 and employees must take the Louisiana Board of Ethics test yearly. He also commented on the Audit and on the cost paid to outside accountants and CPAs hired before and during the Audit process. Mr. Slagle also opined that elected officials and employees that could not do their job should be fired and/or charged with malfeasance. 3. MONTHLY FINANCIAL REPORT – Financial report was presented by Mayor Festavan. 4. 2017-18 AUDIT PRESENTATION – The Mayor introduced Travis Morehart with Cook & Morehart, Certified Public Accountants of Shreveport and asked him several questions prior to Audit presentation concerning the reason(s) for the audit and his/his firm’s qualifications to do said audit. Mr. Morehart then presented the Audit to the Council. There were no questions and/or comments from the Council upon conclusion of the presentation. 5. APPROVAL OF MINUTES FOR February 11, 2019 REGULAR MONTHLY MEETING – Motion was made by Raymond Williams; second by Michael Guthrie to approve minutes presented; all approved. 6. PUBLIC HEARING ON ORDINANCE #715 OF 2019 OF THE TOWN OF VIVIAN, LOUISIANA – TO AMEND AND SUPPLEMENT ARTICLE II; STREET REGULATIONS OF CHAPTER 17 TRAFFIC AND VEHICLES - Section 17–27; to declare that the intersection of West Atlanta Street and North Cypress Street be a four way stop. Mayor Festavan opened the public hearing for public comments FOR or AGAINST; none were made. Mayor Festavan then declared the public hearing closed. 7. CONSIDER ADOPTING ORDINANCE #715 OF 2019 OF THE TOWN OF VIVIAN, LOUISIANA – TO AMEND AND SUPPLEMENT ARTICLE II; STREET REGULATIONS OF CHAPTER 17 TRAFFIC AND VEHICLES - Section 17–27; to declare that the intersection of West Atlanta Street and North Page 2 of 5 Cypress Street be a four way stop. A motion was made by Denise Alexander; second by James Martin to adopt Ordinance # 715 of 2019; all approved. 8. PUBLIC HEARING ON ORDINANCE # 716 OF 2019 OF THE TOWN OF VIVIAN, LOUISIANA - TO AMEND AND SUPPLEMENT SECTION 17– 48; HANDICAPPED PARKING OF CHAPTER 17 – TRAFFIC AND VEHICLES OF ARTICLE III – STOPPING, STANDING AND PARKING OF THE CODE OF ORDINANCE OF THE TOWN OF VIVIAN, SEC. 17-48; PARKING SPACES FOR CERTAIN PERSONS WITH DISABILITIES - an ordinance to the town’s handicapped parking ordinance to include regulations and increase the fines and penalties in accordance with Louisiana Law. Mayor Festavan opened the public hearing for public comments FOR or AGAINST; none were made. Mayor Festavan then declared the public hearing closed. 9. CONSIDER ADOPTING ORDINANCE # 716 OF 2019 OF THE TOWN OF VIVIAN, LOUISIANA - TO AMEND AND SUPPLEMENT SECTION 17– 48; HANDICAPPED PARKING OF CHAPTER 17 – TRAFFIC AND VEHICLES OF ARTICLE III – STOPPING, STANDING AND PARKING OF THE CODE OF ORDINANCE OF THE TOWN OF VIVIAN, SEC. 17-48; PARKING SPACES FOR CERTAIN PERSONS WITH DISABILITIES - an ordinance to the town’s handicapped parking ordinance to include regulations and increase the fines and penalties in accordance with Louisiana Law. A motion was made by Angela Channell; second by Denise Alexander to adopt Ordinance # 716 of 2019; all approved. 10. PUBLIC HEARING ON ORDINANCE # 717 OF 2019 OF THE TOWN OF VIVIAN, LOUISIANA – REMOVAL/DISPOSAL OF DEAD ANIMALS. This will be an ordinance to allow the removal/disposal of dead animals by Town employees if said animals are in the street or on other public property within the city limits. Mayor Festavan opened the public hearing for public comments FOR or AGAINST; none were made. Mayor Festavan then declared the public hearing closed. 11. CONSIDER ADOPTING ORDINANCE # 717 OF 2019 OF THE TOWN OF VIVIAN, LOUISIANA – REMOVAL/DISPOSAL OF DEAD ANIMALS. This will be an ordinance to allow the Page 3 of 5 removal/disposal of dead animals by Town employees if said animals are in the street or on other public property within the city limits. A motion was made by Denise Alexander, second by Michael Guthrie to adopt Ordinance # 717 of 2019; all approved. 12. INTRODUCTION OF ORDINANCE # 718 OF 2019 TO AMEND AND SUPPLEMENT THE TOWN OF VIVIAN’S BUDGET ORDINANCE #708 OF 2018 - TO REFLECT THE APPROPRIATE REVENUES AND EXPENDITURES. There will be a public hearing prior to the adoption of Ordinance # 718 at the regular Town Council Meeting at 6:00 p.m. on April 8, 2019 at the Vivian Town Hall, located at 112 W. Alabama Ave. in Vivian, Louisiana. 13. TO CONSIDER A RESOLUTION – Authorizing the Mayor to execute an Agreement with the Louisiana Department of Transportation and Development (LA DOTD) for improvements at the Vivian Airport by the Board of Aldermen. Motion was made by Raymond Williams; seconded by Denise Alexander; all approved. MAYOR’S REPORT – Mayor’s Report contained the following: 1) the reading of a Proclamation proclaiming Monday, March, 11 2019 as Bauer Hardware Day in honor of its 75 years in business; 2) the new Employee Documentation of Work Schedule for Public Works Director Tommie Brian’s employees; and 3) the Ordinance concerning booths setting up shop outside of the designated Festival area during the Redbud Festival on March 16. 14. ANNOUNCEMENTS MADE BY BOARD OF ALDERMEN – Angela Channell announced that there would be a testing workshop held at North Caddo Magnet High School from 6 to 8 p.m. on March 19. Denise Alexander reported on the Redbud Festival that would be running throughout the week and culminating on Saturday, the 16th. 10. ADJOURN – Motion was made by Raymond Williams; seconded by Denise Alexander; all approved.
