MINUTES OF REGULAR COUNCIL MEETING
TOWN HALL MEETING ROOM

VIVIAN, LOUISIANA
MONDAY, AUGUST 12, 2019
6:00 PM
CALL TO ORDER – Mayor Festavan called the meeting to order at 6:00
p.m.
INVOCATION – Alderman Raymond Williams opened the meeting in
prayer.
PLEDGE – Mayor Festavan led all present in the Pledge of Allegiance.
VERIFICATION OF QUORUM – Board of Aldermen present for Roll Call
were James Martin, Denise Alexander, Michael Guthrie, and Raymond
Williams; absent was Alderman Angela Channell. Following Roll Call the
Deputy Clerk verified that a quorum was present.
Also present were other elected officials/staff members: Ronnie Festavan -
Mayor, Ryan Nelson - Chief of Police, Douglas Dominick - Town Attorney,
David Jones, Jr. - Deputy Clerk, Kevin Hartzo - Public Works Director,
Annette Lewis - Environmental Services Coordinator, and Perry Hart -
Deputy Police Chief; absent was Kellie Morris - Town Clerk, and Bobby
Smith - Zoning & Condemnation Officer.
APPROVE AGENDA – Motion made by Raymond Williams; second by
Michael Guthrie; all approved.
1. PUBLIC COMMENTS – The following individual made public
comments:
Gladys Broomsey – Inquired about the policy for over-time with
building rental.
2. MONTHLY FINANCIAL REPORT – Financial report was presented by
Mayor Festavan. D.C. Greer with Government Capital Corporation was
present and spoke about the refinancing that was on the meeting’s agenda
at that time.

3. APPROVAL OF MINUTES FOR JULY 8th REGULAR MONTHLY
MEETING – Motion was made by Raymond Williams, second by James
Martin; all approved.
4. PUBLIC HEARING ON ORDINANCE # 725 OF 2019 OF THE TOWN
OF VIVIAN, LOUISIANA – AN ORDINANCE FOR THE CODE OF
ORDINANCE, TOWN OF VIVIAN, LOUISIANA, TO AMEND AND
SUPPLEMENT CHAPTER 2 - ADMINISTRATION - ARTICLE III.
OFFICERS AND EMPLOYEES - DIVISION 3. POLICE DEPARTMENT TO
ADD Section 2-89 – Mandatory Employment Contract with all newly hired
non post certified police officers (This will require all newly hired police
officers who are not Post Certified to reimburse the Town of Vivian the cost
of the academy and basic firearms training program on a prorated basis if
they accept employment as a police officer with another government entity
within 2 years). Mayor Festavan opened the public hearing for comments
FOR or AGAINST the Ordinance; none were made. Mayor Festavan then
declared the public hearing closed.
5. THE BOARD OF ALDERMEN WILL CONSIDER THE FINAL
ADOPTION OF ORDINANCE # 725 – AN ORDINANCE FOR THE CODE
OF ORDINANCE, TOWN OF VIVIAN, LOUISIANA, TO AMEND AND
SUPPLEMENT CHAPTER 2 - ADMINISTRATION - ARTICLE III.
OFFICERS AND EMPLOYEES - DIVISION 3. POLICE DEPARTMENT TO

6. RE-INTRODUCTION OF ORDINANCE # 726 OF 2019 OF THE TOWN
OF VIVIAN, LOUISIANA – TO SALE AND OR TRANSFER THE TOWN’S
WORKING INTEREST BEING 0.00482635 % WORKING INTEREST IN
MCGINNIS #1 (THE SOUTH HALF OF SOUTHEAST QUARTER OF
SECTION 14, TOWNSHIP 20 NORTH, RANGE 16 WEST, CADDO
PARISH, LOUISIANA BEING IN WHAT IS COMMONLY KNOWN AS THE
VIVIAN SAND UNIT), CADDO PARISH, LOUISIANA FOR THE REASONS
FOR SAID SALE, TO FIX THE MINIMUM PRICE OF SAID SALE AND
THE TERMS OF THE SALE. This ordinance will declare said property
surplus property, no longer needed for a public purpose and to be sold unto
the successful highest bidder. There will be a public hearing prior to the

adoption of Ordinance # 726 at the Regular Council Meeting at 6:00 p.m.
on September 9, 2019 at the Vivian Town Hall, located at 112 W. Alabama
Ave. in Vivian, Louisiana
7. THE BOARD OF ALDERMEN WILL CONSIDER THE ADOPTION OF
RESOLUTION NUMBER # 11 OF 2019 OF THE TOWN OF VIVIAN
LOUISIANA – AUTHORIZING THE TOWN OF VIVIAN TO ENTER INTO A
COOPERATIVE AGREEMENT WITH THE CADDO PARISH 911
COMMUNICATIONS DISTRICT NUMBER ONE AND AUTHORIZE
MAYOR RONNIE FESTAVAN TO SIGN AND EXECUTE SAID
AGREEMENT. Town Attorney Douglas Dominick explained the agreement
to those present before any action was taken. Motion to adopt was made
by James Martin, second by Michael Guthrie; all approved,
8. THE BOARD OF ALDERMEN WILL CONSIDER THE ADOPTION OF
RESOLUTION NUMBER # 12 OF 2019 OF THE TOWN OF VIVIAN
LOUISIANA – A RESOLUTION GIVING PRELIMINARY APPROVAL TO
THE ISSUANCE OF NOT EXCEEDING THREE MILLION ONE HUNDRED
FIVE THOUSAND DOLLARS ($3,105,000.00) OF CERTIFICATES OF
INDEBTEDNESS, SERIES 2019, OF THE TOWN OF VIVIAN, STATE OF
LOUISIANA; providing certain terms of said Certificates; making application
to the State Bond Commission for approval of said Certificates; and
providing for other matters in connection therewith. Motion to adopt was
made by Raymond Williams, second by James Martin; all approved.
9. THE BOARD OF ALDERMEN WILL CONSIDER THE FINAL
CONDEMNATION OF 525 N. SPRUCE STREET – Lots 59, 60 & 61,
Galloway & Beasley annex, Vivian, Caddo Parish, Louisiana. Geo
#221623-014-0083-00. Motion was made by Denise Alexander, second by
Raymond Williams; all approved.
10. THE BOARD OF ALDERMEN WILL CONSIDER THE MAYOR’S
RECOMMENDATION – TO APPOINT STEVE MCLAURIN TO THE
CADDO WARD II INDUSTRIAL CORPORATION. (To replace Mike
VanSchoick.) Motion was made by Raymond Williams, second by Michael
Guthrie; all approved.
PROPERTY CONDEMNATION REPORT – None was given.

CODE ENFORCEMENT REPORT - Deputy Police Chief Perry Hart
presented Report with Log Sheet for the period of July 10 to August 8,
2019. The report contained the following: 1) Total Properties Inspected =
9; 2) Properties Brought to Standard = 4; 3) Summons Issued/Pending = 1;
4) Properties Currently Awaiting Follow-up = 4; and 5) Properties Awaiting
Further Investigation = 13. (One property discussed with Council was a
home with a swimming pool which will allow the Town the ability to force
clean-up with due process.)
MAYOR’S REPORT – Mayor Festavan’s report contained the following: 1)
an update on the proposed Monterey Hill project; 2) update on the new
water park/swimming pool and that he attended a meeting with a pool
contractor in Baton Rouge; and 3) a new Taxicab service in Vivian and the
need to strengthen the Taxicab Ordinances in the future.
ANNOUNCEMENTS BY BOARD OF ALDERMEN – Raymond Williams
reported that the ‘Back-to-School’ Giveaway that was held at Legion Hills
was a great success, that every child received school supplies. He also
thanked everyone involved.
ADJOURN – Motion was made by Raymond Williams, second by Michael
Guthrie; all approved. Meeting adjourned at 6:38 p.m.
