MINUTES OF REGULAR COUNCIL MEETING
TOWN HALL MEETING ROOM
112 W. ALABAMA AVE.
VIVIAN, LOUISIANA
MONDAY, SEPTEMBER 9, 2019
6:00 PM
CALL TO ORDER – Mayor Festavan called the meeting to order at 6:00
p.m.
INVOCATION – Alderman Michael Guthrie opened the meeting in
prayer.
PLEDGE – Mayor Festavan led all present in the Pledge of Allegiance
following the posting of the Colors by North Caddo Magnet High School
Color Guard.
VERIFICATION OF QUORUM – Board of Aldermen present for Roll Call
were James Martin, Denise Alexander, Michael Guthrie, Raymond
Williams and Angela Channell. Following Roll Call the Town Clerk
verified that a quorum was present.
Also present were other elected officials/staff members: Ronnie
Festavan - Mayor, Ryan Nelson - Chief of Police, Douglas Dominick -
Town Attorney, Kevin Hartzo - Public Works Director, Annette Lewis -
Environmental Services Coordinator, and Perry Hart - Deputy Police
Chief; absent was Bobby Smith - Zoning & Condemnation Officer.
APPROVE AGENDA – An amendment to the Agenda was needed as
one (1) item, agenda item # 11 which related to Agenda items # 5 and 6
(the sale of Oilwell interest to highest bidder) needed to be added to the
Agenda which required a unanimous vote of the Board of Aldermen
present. The Mayor asked for the votes to amend, to add item # 11 to
the Agenda; motion was made by Denise Alexander, second by
Raymond Williams; all approved.
Following the vote to approve adding item # 11 to the Agenda the motion
was made by Michael Guthrie, second by Raymond Williams to accept
the amended Agenda; all approved.
1. SCHOOL ANNOUNCEMENTS – (1) The North Caddo Elementary-
Middle School Ambassador Club made a special presentation to Mayor
Festavan naming him as an ‘Honorary Wolfpack Ambassador’; (2) Mrs.
Willoughby presented the North Caddo Elementary-Middle School
Students of the Month – 3rd grader Bethany Mize and 6th grader Nevaeh
Fisk; (3) Mrs. Cherry was presented the North Caddo Magnet High
School Students of the Month – 9th grader Maggie Reger, 10th grader
Traymond Thomas, 11th grader Katherine Green and Over-all 12th grader
Jaden Dickey.
2. PUBLIC COMMENTS – There were none.
3. MONTHLY RINANCIAL REPORT – Financial report was presented
by Mayor Festavan.
4. APPROVAL OF MINUTES FOR August 12th REGULAR MONTHLY
MEETING – Motion was made by Raymond Williams, second by James
Martin; all approved.
5. PUBLIC HEARING ON ORDINANCE # 726 OF 2019 OF THE TOWN
OF VIVIAN, LOUISIANA - TO SALE AND OR TRANSFER THE
TOWN’S WORKING INTEREST BEING 0.00482635 % WORKING
INTEREST IN MCGINNIS #1 (THE SOUTH HALF OF SOUTHEAST
QUARTER OF SECTION 14, TOWNSHIP 20 NORTH, RANGE 16
WEST, CADDO PARISH, LOUISIANA BEING IN WHAT IS COMMONLY
KNOWN AS THE VIVIAN SAND UNIT), CADDO PARISH, LOUISIANA
FOR THE REASONS FOR SAID SALE, TO FIX THE MINIMUM PRICE
OF SAID SALE AND THE TERMS OF THE SALE. This ordinance will
declare said property surplus property, no longer needed for a public
purpose and to be sold unto the successful highest bidder. Mayor
Festavan opened the public hearing for comments FOR or AGAINST the
Ordinance; none were made. Mayor Festavan then declared the public
hearing closed.
6. THE BOARD OF ALDERMEN WILL CONSIDER THE FINAL
ADOPTION OF ORDINANCE # 726 - TO SALE AND OR TRANSFER
THE TOWN’S 0.00482635% WORKING INTEREST IN MCGINNIS #1,
CADDO PARISH, LOUISIANA TO THE SUCCESSFUL HIGHEST
BIDDER. Motion to adopt was made by Michael Guthrie, second by
James Martin; all approved.
7. INTRODUCTION OF ORDINANCE # 727 OF 2019 OF THE TOWN
OF VIVIAN, LOUISIANA - AN ORDINANCE FOR THE CODE OF
ORDINANCES, TOWN OF VIVIAN, TO REVOKE AND SET ASIDE TWO
(2) ALLEYS LOCATED WITHIN THE TOWN LIMITS OF THE TOWN OF
VIVIAN, CADDO PARISH, LOUISIANA, being located in Block 26, Town
of Vivian, Caddo Parish, Louisiana as per Plat Recorded in Book 17,
Page 273 of the Conveyance Records of Caddo Parish, Louisiana.
There will be a public hearing prior to the adoption of Ordinance # 727 at
the Regular Council Meeting at 6:00 p.m. on October 14, 2019 at the
Vivian Town Hall, located at 112 W. Alabama Ave. in Vivian, Louisiana
8. INTRODUCTION OF ORDINANCE # 728 OF 2019 OF THE TOWN
OF VIVIAN, LOUISIANA - AN ORDINANCE APPROVING THE
ISSUANCE OF NOT EXCEEDING THREE MILLION ONE HUNDRED FIVE
THOUSAND DOLLARS ($3,105,000.00) OF CERTIFICATES OF
INDEBTEDNESS, SERIES 2019, OF THE TOWN OF VIVIAN, STATE OF
LOUISIANA AND PROVIDING FOR TERMS AND OTHER MATTERS IN
CONNECTION THEREWITH. There will be a public hearing prior to the
adoption of Ordinance # 728 at the Regular Council Meeting at 6:00 p.m.
on October 14, 2019 at the Vivian Town Hall, located at 112 W. Alabama
Ave. in Vivian, Louisiana
9. THE BOARD OF ALDERMAN WILL CONSIDER ADOPTING
RESOLUTION # 13 OF THE TOWN OF VIVIAN, LOUISIANA - A
RESOLUTION APPROVING THE LOUISIANA COMPLIANCE
QUESTIONNAIRE AND AUTHORIZING THE MAYOR TO SIGN AND
EXECUTE THE LOUISIANA COMPLIANCE QUESTIONNAIRE; this
questionnaire is a required part of the financial audit of the State and
Local Government agencies. Motion to adopt was made by Raymond
Williams, second by Denise Alexander; all approved.
10. HIRING OF POLICE DISPATCHER - The Board of Aldermen will
consider the Chief of Police’s recommendation to hire TeAngela Green
as a part-time dispatcher for the Vivian Police Department at the pay rate
of $8.50 per hour. Motion was made by Raymond Williams, second by
Denise Alexander; all approved.
11. THE BOARD OF ALDERMEN WILL CONSIDER ADOPTING
RESOLUTION NUMBER # 14 OF 2019 OF THE TOWN OF VIVIAN
LOUISIANA – A RESOLUTION PURSUANT TO THE ADOPTION OF
ORDINANCE # 726 OF 2019 authorizing Mayor Ronnie Festavan to sign
and execute any and all assignments, bills of sale, and any other legal
documents necessary to consummate such act of sale of working
interest in the McGinnis #1 at this discretion as advisable and in the best
interest of the Town of Vivian. Motion was made by Raymond Williams,
second by James Martin; all approved.
PROPERTY CONDEMNATION REPORT – In the absence of Bobby Smith
the report was given by Mayor Festavan who reported that the demolition
and disposal was to begin on the burned home located at 525 N. Spruce
Street on September 19. Properties also reported on were 1) 512 S.
Cypress Street and 2) 520 S. Cypress Street.
CODE ENFORCEMENT REPORT – In the absence of Deputy Police
Chief Perry Hart a written Report with Log Sheet was distributed to Council
Members for the period of July 10 to August 8, 2019. The report contained
the following: 1) Total Properties Inspected = 13; 2) Properties Brought to
Standard = 8; 3) Summons Issued/Pending = 5; 4) Properties Currently
Awaiting Follow-up = 4; and 5) Properties Awaiting Further Investigation =
11. (A property located on the corner of N. Cypress and W. Mississippi
Streets was discussed by Council, Town Attorney Doug Dominick and
Police Chief Ryan Nelson concerning the possibility of pulling the water
meter until conditions at the location were addressed.)
MAYOR’S REPORT – Mayor Festavan’s report contained the following: 1)
a reminder and an invitation for all to attend National Night Out that will be
held on Tuesday, October 1st.
ANNOUNCEMENTS BY BOARD OF ALDERMEN – There were none.
ADJOURN – Motion was made by Raymond Williams, second by Denise
Alexander; all approved. Meeting adjourned at 6:48 p.m.
