MINUTES OF REGULAR COUNCIL MEETING TOWN HALL MEETING ROOM 112 W. ALABAMA AVE. VIVIAN, LOUISIANA MONDAY, MARCH 8, 2021 6:00 PM CALL TO ORDER - Mayor Festavan called the meeting to order at 6:00 p.m. INVOCATION - Alderman Raymond Williams opened the meeting in prayer. PLEDGE - Mayor Festavan led all present in the Pledge of Allegiance. ROLL CALL - VERIFICATION OF QUORUM - Board of Aldermen present for Roll Call were James Martin, Denise Alexander, Michael Guthrie and Raymond Williams; absent was Angela Channell. Following Roll Call the Town Clerk verified that a quorum was present. Also present were other elected officials and/or staff members: Ronnie Festavan - Mayor, Ryan Nelson - Chief of Police, Kellie Morris - Town Clerk and Douglas Dominick - Town Attorney. APPROVE AGENDA - Motion to approve the Agenda as presented was made by Raymond Williams, second by Denise Alexander; all approved. 1. PUBLIC COMMENTS - There were none. 2. MONTHLY FINANCIAL REPORT - Financial report including budget-to-actual comparisons was presented by Mayor Festavan. Following the report and discussion, motion to accept as presented was made by Raymond Williams, second by James Martin; all approved. 3. APPROVAL OF MINUTES - for February 8, 2021 regular meeting. Motion to approve the minutes of the February 8, 2021 regular meeting was made by Denise Alexander, second by Raymond Williams; all approved. 4. PUBLIC HEARING ON ORDINANCE # 753 OF 2021 OF THE TOWN OF VIVIAN, LOUISIANA - AN ORDINANCE AMENDING ORDINANCE #742 OF 2020, AN OPERATING BUDGET OF REVENUES AND EXPENDITURES FOR THE FISCAL YEAR BEGINNING JULY 1, 2020 THROUGH JUNE 30, 2021. (To amend the Police Budget for the purpose of buying a new vehicle.) Mayor Festavan opened the public hearing for comments FOR or AGAINST the Ordinance; none were made. He then declared the public hearing closed. Page 1 of 3 5. THE BOARD OF ALDERMEN WILL CONSIDER THE FINAL ADOPTION OF ORDINANCE # 753 OF 2021 OF THE TOWN OF VIVIAN, LOUISIANA - SEE AGENDA ITEM # 4. Motion to adopt Ordinance # 753 of 2021 of the Town of Vivian, Louisiana was made by Denise Alexander, second by James Martin; all approved. 6. PUBLIC HEARING ON ORDINANCE # 754 OF 2021 OF THE TOWN OF VIVIAN, LOUISIANA - AN ORDINANCE FOR THE CODE OF ORDINANCE, TOWN OF VIVIAN, LOUISIANA, TO AMEND AND SUPPLEMENT ARTICLE III STOPPING, STANDING, AND PARKING OF CHAPTER 17 TRAFFIC AND VEHICLES TO INCLUDE SECTION 17-49, PARKING OF TRUCKS, TRAILERS, ETC., IN RESIDENTIAL AREAS (TO BE PROHIBITED). Mayor Festavan opened the public hearing for comments FOR or AGAINST the Ordinance; none were made. He then declared the public hearing closed. 7. THE BOARD OF ALDERMEN WILL CONSIDER THE FINAL ADOPTION OF ORDINANCE # 754 OF 2021 OF THE TOWN OF VIVIAN, LOUISIANA - SEE AGENDA ITEM # 6. Motion to amend the Ordinance to include 1) $300 for first offense, 2) $500 for the second and subsequent offense within three years of the first offense, and 3) to make the Ordinance effective retroactively was made by Denise Alexander, second by Raymond Williams; all approved. An additional motion to amend the original amendment to the Ordinance to include ‘each and every / per vehicle’ was made by Denise Alexander, second by Raymond Williams; all approved. Motion was then made to adopt Ordinance # 754 of 2021 as amended by Denise Alexander, second by Raymond Williams; all approved. 8. THE BOARD OF ALDERMEN WILL CONSIDER THE ADOPTION OF RESOLUTION # 8 OF 2021 - A RESOLUTION AUTHORIZING MAYOR FESTAVAN TO ENTER INTO AN AGREEMENT WITH THE UNITED STATES OF AMERICA (acting through the Federal Aviation Administration, herein called the ‘FAA’) AND SIGN THE CRRSA (Coronavirus Response and Relief Supplement Appropriations) ACT AIRPORT GRANT AGREEMENT. Motion to adopt Resolution # 8 of 2021 was made by Raymond Williams, second by Denise Alexander; all approved. 9. THE BOARD OF ALDERMEN WILL CONSIDER THE ADOPTION OF RESOLUTION # 9 OF 2021 - A RESOLUTION AUTHORIZING MAYOR FESTAVAN TO ACQUIRE PROPERTY THROUGH THE REMOVE OBSTRUCTIONS - PHASE II GRANT FOR FUTURE USE/EXPANSION OF THE VIVIAN MUNICIPAL AIRPORT. Motion to adopt Resolution # 9 of 2021 was made by Raymond Williams, second by James Martin; all approved. Page 2 of 3 ZONING/CONDEMNATION REPORT - Zoning/Condemnation Officer Bobby Smith gave a report on the following: 1) 220 S. Bird St, 2) 207 S. Bird St., 3) 120 Mary Ann St., 4) one property located on the corner of Carson St. and Mary Ann St., 5) 1006 NW Front St., and 6) 1220 N. Carson St. CODE ENFORCEMENT REPORT - No report given. MAYOR’S REPORT - Mayor Festavan gave a report on the following: 1) Connie ‘Melissa’ Crowson is the new Code Enforcement Officer and will be working a total of 24 hours per week, 2) up-date on the Monterey Hills project, 3) a prospect is looking at the Dairy Queen and 4) the LED lighting project made possible by a grant from the Public Service Commission has been completed. ANNOUNCEMENTS BY BOARD OF ALDERMEN - Alderman Denise Alexander thanked the Police Department and the Town workers for an outstanding job during the winter storm. Job well done she said!
