MINUTES OF REGULAR COUNCIL MEETING
TOWN HALL MEETING ROOM

6:00 PM
CALL TO ORDER - Mayor Festavan called the meeting to order at 6:00 p.m.
INVOCATION - Alderman Raymond Williams opened the meeting in prayer.
PLEDGE - Mayor Festavan led all present in the Pledge of Allegiance.
ROLL CALL - VERIFICATION OF QUORUM - Board of Aldermen present for
Roll Call were James Martin, Denise Alexander, Michael Guthrie, Raymond
Williams and Angela Channell. Following Roll Call the Town Clerk verified that a
quorum was present.
Also present were other elected officials and/or staff members: Ronnie Festavan
- Mayor, Kellie Morris - Town Clerk and Douglas Dominick - Town Attorney.
APPROVE AGENDA - Motion to approve the Agenda as presented was made by
Raymond Williams, second by James Martin; all approved.
1. PUBLIC COMMENTS - There were none.
2. MONTHLY FINANCIAL REPORT - Financial report including budget-to-actual
comparisons was presented by Mayor Festavan. Following the report and
discussion, motion to accept as presented was made by Raymond Williams,
second by Michael Guthrie; all approved.
3. APPROVAL OF MINUTES - for February 8, 2021 regular meeting. Motion to
approve the minutes of the February 8, 2021 regular meeting was made by
James Martin, second by Raymond Williams; all approved.
4. INTRODUCTION OF ORDINANCE # 755 OF 2021 OF THE TOWN OF
VIVIAN, LOUISIANA - AN ORDINANCE TO ADOPT THE MILLAGE RATES
FOR THE 2021 TAX YEAR IN AND FOR THE TOWN OF VIVIAN, LOUISIANA.
There will be a public hearing prior to the adoption of Ordinance # 755 at the
regular Town Council Meeting at 6:00 p.m. on Monday, May 10, 2021 at the
Vivian Town Hall, located at 112 W. Alabama Ave. in Vivian, Louisiana.
5. INTRODUCTION OF ORDINANCE # 756 OF 2021 OF THE TOWN OF
VIVIAN, LOUISIANA - AN ORDINANCE TO AMEND ORDNANCE # 748 OF

2020, AN ORDINANCE ESTABLISHING THE TOWN OF VIVIAN’S
ADMINISTRATIVE COURT FOR ADJUDICATION OF BLIGHTED PROPERTY,
ABANDONED PROPERTY, AND VIOLATIONS OF SUCH TOWN
ORDINANCES ADDRESSING THE PUBLIC HEALTH; GRASS, WEEDS AND
WILD GROWTH; LITTER; HOUSING AND PROPERTY STANDARDS; AND
JUNK, WRECKED AND ABANDONED PROPERTY INCLUDING
REGULATIONS AND PENALTIES ASSOCIATED WITH VIOLATIONS. This will
change the notification times to interested parties from 30 days to 15 days with
regards to being notified prior to any administrative hearing. There will be a
public hearing prior to the adoption of Ordinance # 756 at the regular Town
Council Meeting at 6:00 p.m. on Monday, May 10, 2021 at the Vivian Town Hall,
located at 112 W. Alabama Ave. in Vivian, Louisiana.
6. GUEST SPEAKER - DAVID GREEN OF REPUBLIC SERVICES - Mr. Green
spoke to the Council regarding the trash/waste service(s) that his company
provides at present and will continue to provide in the future to the Town of
Vivian’s customers.
7. THE BOARD OF ALDERMEN WILL CONSIDER THE ADOPTION OF
RESOLUTION # 10 OF 2021 - A RESOLUTION TO AUTHORIZE THE MAYOR
TO SIGN AND EXECUTE A RENEWAL OF THE MUNCIPAL CONTRACT FOR
RESIDENTIAL SOLID WASTE COLLECTION AND DISPOSAL WITH BFI
WASTE SERVICES, LLC DBA REPUBLIC SERVICES FOR A PERIOD OF 3
YEARS. Motion to adopt Resolution # 10 of 2021 was made by Angela Channell,
second by Denise Alexander; all approved.
8. THE BOARD OF ALDERMEN WILL CONSIDER THE ADOPTION OF
RESOLUTION # 11 OF 2021 - A RESOLUTION ACKNOWLEDGING THAT THE
BOARD OF ALDERMEN HAVE REVIEWED THE INTERNAL “MUNICIPAL
WATER POLLUTION PREVENTION REPORTS” CONCERNING THE TOWN
OF VIVIAN’S WASTEWATER TREATMENT FACILITY. Motion to adopt
Resolution # 11 of 2021 was made by Angela Channell, second by James Martin;
all approved.
ZONING/CONDEMNATION REPORT - Zoning/Condemnation Officer Bobby
Smith gave a report on the following: 1) he has been working on quite a few
permits; signs, building & fencing, 2) 1220 N. Carson St., 3) a burned home on
Lowland St., 4) 1222 Chickasaw St. and 5) horses on N. W. Front St. Alderman
Alexander asked Officer Smith about a) the burned house on Spruce St. behind
the Catholic Church, and b) the sign at Madie’s Treasures on N. Pine St.
CODE ENFORCEMENT REPORT - The following report was delivered by
Alderman Denise Alexander in Code Enforcement Officer Melysa Crowson’s
absence: a total of 17 written warnings have been issued. 11 have cleaned their

property up, 4 have not but are within their 10-day period, and 2 have been
issued summonses.
MAYOR’S REPORT - Mayor Festavan gave a report on the following: 1) the
Town’s possible purchase of the grocery store at 212 N. Pine St., 2) an alert call
system to notify citizens, 3) a digital sign for the Town, 4) missing street signs in
Town, 5) no deficiencies found in the State’s inspection of the water system, 6)
Employee raises during the present fiscal year, 7) the budget process beginning
this month, 8) the American Rescue Plan money estimated for the Town, 9) the
Chamber of Commerce will be hosting the Spring Fest on Saturday, May 1st, 10)
a cell tower lease that he will decline after much review and 11) increase in the
SWEPCO franchise agreement revenue.

ADJOURN - Motion to adjourn was made by Raymond Williams, seconded by
James Martin; all present approved. Meeting adjourned at 7:33 p.m.
