MINUTES OF REGULAR COUNCIL MEETING TOWN HALL MEETING ROOM 112 W. ALABAMA AVE. VIVIAN, LOUISIANA MONDAY, JUNE 14, 2021 6:00 PM CALL TO ORDER - Mayor Festavan called the meeting to order at 6:00 p.m. INVOCATION - Alderman Michael Guthrie opened the meeting in prayer. PLEDGE- Mayor Festavan led all present in the Pledge of Allegiance. ROLL CALL - VERIFICATION OF QUORUM - Board of Aldermen present for Roll Call were James Martin, Denise Alexander, Michael Guthrie and Raymond Williams; absent was Angela Channell. Following Roll Call the Town Clerk verified that a quorum was present. Also, present were other elected officials and/or staff members: Ronnie Festavan - Mayor, Kellie Morris - Town Clerk and Douglas Dominick - Town Attorney. AMEND AGENDA - Agenda item # 9, Introduction of Ordinance # 761 of 2021, needed to be removed from the Agenda at the request of Mayor Festavan. Motion to amend the Agenda as requested was made by Michael Guthrie, second by James Martin; all present approved. APPROVE AGENDA - Motion to approve the Agenda as amended was made by Denise Alexander, second by Raymond Williams; all present approved. 1. PUBLIC COMMENTS - There were none. 2. MONTHLY FINANCIAL REPORT - Financial report including budget-to-actual comparisons was presented by Mayor Festavan. Following the report and discussion, motion to accept as presented was made by James Martin, second by Denise Alexander; all present approved. 3. APPROVAL OF MINUTES - Motion to approve the minutes together in globo, as a unit, for 1) May 10 regular meeting, 2) May 17 special called meeting and 3) June 9 special called meeting was made by Denise Alexander, second by James Martin; all present approved. 4. REMINDER - SPECIAL CALLED TOWN COUNCIL MEETING FOR PUBLIC HEARING & CONSIDERATION OF FINAL ADOPTION FOR ORDINANCE # 757 OF 2021 OF THE TOWN OF VIVIAN, LOUISIANA - AN ORDINANCE TO AMEND AND SUPPLEMENT THE TOWN OF VIVIAN’S BUDGET ORDINANCE # 742 OF 2020 - To Page 1 of 3 reflect the appropriate revenues and expenditures. Special Called Town Council Meeting at 4:30 p.m. on Monday, June 28, 2021 at the Vivian Town Hall, located at 112 W. Alabama Ave. in Vivian, Louisiana. 5. REMINDER - SPECIAL CALLED TOWN COUNCIL MEETING FOR PUBLIC HEARING & CONSIDERATION OF FINAL ADOPTION FOR ORDINANCE # 758 OF 2021 OF THE TOWN OF VIVIAN, LOUISIANA - AN ORDINANCE TO ADOPT THE TOWN OF VIVIAN’S 2020-2021 BUDGET OF REVENUES AND EXPENDITURES. Special Called Town Council Meeting at 4:30 p.m. on Monday, June 28, 2021 at the Vivian Town Hall, located at 112 W. Alabama Ave. in Vivian, Louisiana. 6. INTRODUCTION OF ORDINANCE # 759 OF 2021 OF THE TOWN OF VIVIAN, LOUISIANA - AN ORDINANCE TO LEASE IMMOVABLE PROPERTY, being described as follows: The North 12 feet of the South 50 feet of the North 90 feet of LOT 15 & the North 12 feet of the South 50 feet of the North 90 feet of the West 40 feet of LOT 14, BLK 53, Vivian, Caddo Parish, Louisiana. 221626-54-32. This will be a lease for 10 years unto Timothy Luke Dodge and Lou Ann Stanley Dodge at an annual payment of $100.00 for additional space to allow access to the drive-in window of the premises. There will be a public hearing prior to the adoption of Ordinance # 759 at the regular Town Council Meeting at 6:00 p.m. on Monday, July 12, 2021 at the Vivian Town Hall, located at 112 W. Alabama Ave. in Vivian, Louisiana. 7. INTRODUCTION OF ORDINANCE # 760 OF 2021 OF THE TOWN OF VIVIAN, LOUISIANA - AN ORDINANCE TO LEASE IMMOVABLE PROPERTY, being described as follows: That portion of property being the East 120 feet of the South 27 feet of the property as described in that certain road dedication as was recorded in book 1800 page 19 instrument number 856570 into the public records of Caddo Parish, Louisiana on January 19, 1981 (being that unpaved portion lying South of the Road Right of Way). This will be a lease unto Jerry Younce Jr. and Shannon Adele Loper Younce for the sum of $100.00 a year and additional consideration to be made in the form of enhancement to the property in the amount of $2,500.00 to be made by the Lessee. There will be a public hearing prior to the adoption of Ordinance # 760 at the regular Town Council Meeting at 6:00 p.m. on Monday, July 12, 2021 at the Vivian Town Hall, located at 112 W. Alabama Ave. in Vivian, Louisiana. 8. GUEST SPEAKER - DAVID RYALS OF LRWA (Louisiana Rural Water Assoc.) Due to the removal of Agenda item #9 Mr. Ryals did not attend. 9. INTRODUCTION OF ORDINANCE # 761 OF 2021 OF THE TOWN OF VIVIAN, LOUISIANA - AN ORDINANCE TO AMEND SECTION 18-191 ESTABLISHED OF DIVISION 3. RATES OF ARTICLE III. WATER OF CHAPTER 18 - UTILITIES. This will be an increase in water rates and set an annual adjustment/increase of the rates based upon the Consumer Price Index (CPI) as defined by the U. S. Bureau of Labor Statics. This item was removed from the Agenda. 10. THE BOARD OF ALDERMEN WILL CONSIDER THE MAYOR’S RECOMMENDATION - TO APPOINT TONI KENDRICK TO FILL THE TOWN OF Page 2 of 3 VIVIAN’S VACANCY ON THE CADDO PARISH FIRE DISTRICT #8 BOARD OF COMMISSIONERS. (To replace Krysten Jackson) - Motion to approved the Mayor’s recommendation was made by Denise Alexander, second by Raymond Williams; all present approved. ZONING/CONDEMNATION REPORT - Zoning/Condemnation Officer Bobby Smith gave a report on the following properties: 1) 316 Lowland St., 2) 1220 Chickasaw St., 3) 440 W. Georgia Ave., and 4) 525 W. Tennessee Ave. Report was also given on 4 (four) additional properties that the Council voted to begin condemnation process on. Said properties are as follows: A) 730 N. Spruce St. - Motion to begin condemnation process was made by Denise Alexander, second by Raymond Williams; all present approved. B) 1504 S. Pardue St. - Motion to begin condemnation process was made by Raymond Williams, second by Denise Alexander; all present approved. C) 420 E. Alabama Ave. - Motion to begin condemnation process was made by Denise Alexander, second by James Martin; all present approved. D) 412 S. Pardue St. - Motion to begin the condemnation process was made by Raymond Williams, second by Denise Alexander; all present approved. CODE ENFORCEMENT REPORT - No report given. MAYOR’S REPORT - Mayor Festavan gave a report on the following: 1) O’Reilly Auto Parts store is scheduled for opening on August 16, 2) Lease of large hangar at the Airport, 3) LMA District Meeting that would be held on Monday, June 21 in Springhill, 4) LRWA Annual Convention Awards Luncheon Banquet that will be held on July 19 in Lafayette and 5) LMA Annual Convention that will be held July 29-30 in Baton Rouge.
