MINUTES OF REGULAR COUNCIL MEETING
TOWN HALL MEETING ROOM
112 W. ALABAMA AVE.
VIVIAN, LOUISIANA
MONDAY, JULY 12, 2021
6:00 PM
CALL TO ORDER - Mayor Festavan called the meeting to order at 6:00 p.m.
INVOCATION - Alderman Raymond Williams opened the meeting in prayer.
PLEDGE - Mayor Festavan led all present in the Pledge of Allegiance.
ROLL CALL - VERIFICATION OF QUORUM - Board of Aldermen present for Roll Call
were James Martin, Denise Alexander, Michael Guthrie, Raymond Williams and Angela
Channell. Following Roll Call the Town Clerk verified that a quorum was present.
Also, present were other elected officials and/or staff members: Ronnie Festavan - Mayor,
Ryan Nelson - Chief of Police, Kellie Morris - Town Clerk and Douglas Dominick - Town
Attorney.
APPROVE AGENDA - Motion to approve the Agenda as presented was made by
Raymond Williams, second by James Martin; all approved.
1. PUBLIC COMMENTS - Mr. Jay Paulette of 418 E. Texas St. in Vivian was present to
ask about Ordinances, particularly those in regard to horses and loud music.
2. MONTHLY FINANCIAL REPORT - Financial report including budget-to-actual
comparisons was presented by Mayor Festavan. Following the report and
discussion, motion to accept as presented was made by Michael Guthrie, second
by Angela Channell; all approved.
3. APPROVAL OF MINUTES - Motion to approve the minutes together in globo, as a unit,
for 1) June 14, 2021 regular meeting, and 2) June 28, 2021 special called meeting was
made by Raymond Williams, second by James Martin; all approved.
4. PUBLIC HEARING ON ORDINANCE # 759 OF 2021 OF THE TOWN OF VIVIAN,
LOUISIANA - AN ORDINANCE TO LEASE IMMOVABLE PROPERTY, being described
as follows: The North 12 feet of the South 50 feet of the North 90 feet of LOT 15 & the
North 12 feet of the South 50 feet of the North 90 feet of the West 40 feet of LOT 14, BLK
53, Vivian, Caddo Parish, Louisiana. 221626-54-32 - This will be a lease for 10 years unto
Timothy Luke Dodge and Lou Ann Stanley Dodge at an annual payment of $100.00 for
additional space to allow access to the drive-in window of the premises.

Mayor Festavan opened the public hearing for comments FOR or AGAINST the
Ordinance. One individual came forward and asked if the leasing price was an appraised
price, stating he thinks that it should be appraised. Discussion including Town Attorney
Dominick followed the question, and with no other speakers for or against the Ordinance
Mayor Festavan then declared the public hearing closed.
5. THE BOARD OF ALDERMEN WILL CONSIDER THE FINAL ADOPTION OF
ORDINANCE # 759 OF 2021 OF THE TOWN OF VIVIAN, LOUISIANA - SEE
AGENDA ITEM # 4.
Following discussion in response to the question and/or comment(s) made during the
Public Hearing, motion to table any action on the Ordinance at that time was made by
Michael Guthrie, second by Raymond Williams; all approved.
6. PUBLIC HEARING ON ORDINANCE # 760 OF 2021 OF THE TOWN OF VIVIAN,
LOUISIANA - AN ORDINANCE TO LEASE IMMOVABLE PROPERTY, being described
as follows: That portion of property being the East 120 feet of the South 27 feet of the
property as described in that certain road dedication as was recorded in book 1800 page
19 instrument number 856570 into the public records of Caddo Parish, Louisiana on
January 19, 1981 (being that unpaved portion lying South of the Road Right of Way). This
will be a lease unto Jerry Younce Jr. and Shannon Adele Loper Younce for the sum of
$100.00 a year and additional consideration to be made in the form of enhancement to the
property in the amount of $2,500.00 to be made by the Lessee.
Mayor Festavan opened the public hearing for comments FOR or AGAINST the
Ordinance. The same individual that came forward during the Public Hearing on the
previous Ordinance again came forward to follow-up on his previous remarks and
questioned the value set for this lease. Discussion including Town Attorney Dominick
again followed and with no other speakers for or against the Ordinance Mayor Festavan
then declared the public hearing closed.
7. THE BOARD OF ALDERMEN WILL CONSIDER THE FINAL ADOPTION OF
ORDINANCE # 760 OF 2021 OF THE TOWN OF VIVIAN, LOUISIANA - SEE
AGENDA ITEM # 6.
Following discussion in response to the comment(s) made during the Public Hearing,
motion to table any action on the Ordinance at that time was made by Angela Channell,
second by James Martin; all approved.
8. INTRODUCTION OF ORDINANCE # 762 OF 2021 OF THE TOWN OF VIVIAN,
LOUISIANA - AN ORDINANCE TO AMEND AND RE-NUMBER ORDINANCES
FOR THE CODE OF ORDINANCES, TOWN OF VIVIAN, LOUISIANA, TO
REDESIGNATE AND RENUMBER ORDINANCE NUMBERS 17–1201,
ORDINANCE NUMBER 18–0101, AND ORDINANCE NUMBER 18–0201 AND TO
DECLARE ORDINANCE NUMBER 704 TO BE NULL AND VOID.
There will be a public hearing prior to the adoption of Ordinance # 762 at the regular Town
Council Meeting at 6:00 p.m. on Monday, August 9, 2021 at the Vivian Town Hall, located
at 112 W. Alabama Ave. in Vivian, Louisiana.

9. THE BOARD OF ALDERMEN WILL CONSIDER A REQUEST BY MAYOR
FESTAVAN TO APPOINT THE FOLLOWING INDIVIDUALS TO SERVE AS
MEMBERS OF THE VIVIAN ZONING COMMISSION - 1) Rev. Ricky Jeane, 2)
Martha McDurmond and 3) Randy Slagle.
Motion to approve the Mayor’s recommendation was made by Raymond Williams, second
by Denise Alexander; all approved. (Council action was previously taken and recorded on
this matter at the January 11, 2021 Regular Council Meeting.)
10. THE BOARD OF ALDERMEN WILL CONSIDER THE CONFIRMATION OF
SELECTION OF THE CADDO CITIZEN AS THE TOWN’S OFFICIAL JOURNAL -
For period ending June 30, 2022.
Motion to confirm the selection was made by Raymond Williams, second by James
Martin; all approved.
ZONING/CONDEMNATION REPORT - Zoning/Condemnation Officer Bobby Smith
gave a report on the following properties: 1) 314 W. Tennessee Ave., 2) 415 W.
Kentucky Ave. and he also gave an up-date on the condemnations that were begun
earlier. Motion to begin condemnation proceedings on 211 W. Mississippi Ave. was made
by Denise Alexander, second by Raymond Williams; all approving. Mayor Festavan also
reported that he contacted the property owners of an overgrown lot located on W. Moore
St. and stated that it would be cut soon.
CODE ENFORCEMENT REPORT - No report given.
MAYOR’S REPORT - Mayor Festavan gave a report on the following: 1) water issue
is being worked on, and 2) the American Rescue Plan monies allocated, and the
census numbers (3,482) recorded in the allocation. He further stated that these
monies would be spent on severity of need, mainly sewer, water and streets.
ANNOUNCEMENTS BY BOARD OF ALDERMEN - Alderman Michael Guthrie gave a
report to the remaining Council Members on a meeting that he had attended concerning
the Burn Ordinance, stating that they, the Council, might consider altering the times for
burning.
ADJOURN - Motion to adjourn was made by Denise Alexander, second by Raymond
Williams; all present approved. Meeting adjourned at 6:43 p.m.
