Village of Walden Board of Trustees Regular Meeting April 15, 2025 Mayor Pearson called the regular meeting of the Village of Walden Board of Trustees to order at 6:30pm. Public Hearing – Village Budget 2025-2026 Trustee Baker made a motion to open public hearing for Village Budget 2025-2026. Seconded by Deputy Mayor Thompson. All ayes. Motion carried. Brenda Adams: I went to all of your meetings except for the one last night. Your Department Heads gave you lots of things to think about. I don't think they asked for anything unreasonable, but I don't know how much you can fit in the budget for them. My concern is that there's enough money in the budget for the finances to do whatever it takes after the end of this year. I know you've got to start going forward with getting the finances in order, so I'm sure it's going to go on into June to have enough money in to bring the finances up to date for the reports to save the grant. For dollars for our training on Edmunds, the program training for the trainer and for the overtime staff for them to learn it. I'm hoping those items have gotten into your, I know you're not ready yet for the final budget, but that's my wish list. Not that I'm a Department Head, but that's my wish list. 1 Manager Revella: Just so the public's aware, the board did increase the line, they doubled the budget to make sure it's covered and also agreed to terms that we're finalizing the attorney with RBT to complete the AFRs by June so that we're well ahead of the July deadline that that state gave us. Mayor Pearson: We also hired a consultant part time for the Finance Department to make sure things are going to be running more smoothly and where they need to be. Jerry Hanen: With seeing I was at all the meetings, it was so exciting. Seeing all the money that is put out for uniforms for, it looks like all of the employees outside of the offices anyway. I just want to make sure that it is required that they wear those when they're working because working at Ace and seeing the employees come in and purchasing things for the village that are not wearing uniform shirts, we don't know if they're there on their own time or on village time. I think it just needs to be since we're spending all this money. They need to be required to wear them whenever they're working for the village. Very simple. Manager Revella: So, the public's aware. I'm sure the board will talk about it as well in due time that the process is ongoing. They've already approved another meeting on the 28th at 6pm here to continue discussing the budget. I believe they're gonna leave the public hearing open. That's the goal, I believe anyway. There's a lot to still go through. They did approve the law to go over the tax cap, but the goal is to not pierce the tax cap, if we can help it by making sure we adjust the budget accordingly with revenue and expenses to make it work and balance. Mayor Pearson: We may need another special meeting in between now and the 28th and we can call that when needed. If we get some more numbers up and running from the Treasurer and possibly our part time person. So, we may have 1 or 2 more before the 28th. We'll e-mail. Marisa can also post it. It would be a quick special meeting so keep an eye on Facebook and the village website. We'll put it there. We're going to just hold it open to at least the 28th of April. We have to pass a budget by May 1st, so 28th is our due date. Thank you very much for your comments everyone. We appreciate that. Village Manager’s Report • Had conferences with special counsel and PBA for negotiation purposes. We also had an actual negotiation meeting with the committee from the village and the PBA. I'm trying to make some progress there • Had a conference with the Police Chief to review the canvas list for police officers • Went over the consultant selections, Planning/Zoning Board members with the Village Clerk to make sure all that's up to date for the schedules and for the chair people • Covered for time off for different departments • Had we had some budget sessions, which were wonderful. • Met with the mayor and the Finance department to go over some office concerns and office protocol. Sure, we'll have some more going forward. • I had a conference RBT and the Treasurer regarding audits and a AFR • Had a meeting with the Village Engineer, the FCC and the DEC for grant funding and conditions • Attended the wonderful event at Wooster’s Grove with the Walden Elementary School and Eden’s Greens for the trout release in the brook. Wonderful program • Rec Department’s been moving along. Teen Center, after school, pickleball, basketball's finished. Tennis is now open. Summer camp is actually almost full. The Easter Egg Hunt was moved to this coming Saturday due to the weather 2  • Clerk's been updating 207c issues and workers comp, working on FOILs, Facebook and website. Working with IT and the new e-mail service that everyone should have now and minutes • Finance Department, working on issues that RBT, Edmunds vouchers, billing and payroll • Public Works been pressing sludge at the plant, working on stations. Water Department conducted 31 mark-outs, replaced 39 meters, 7 endpoints and had also done inspection. They also had 2 large water main breaks, 1 on Coldenham Rd, 1 on Pine St. They've been following up with a couple of residences that have water leaks on their service line and trying to enforce that repair quickly. 1 is on West Main Street and there's 1 on Maple St. • Police Department staffing and personnel updates and working on those. Parking enforcements out on patrol. Since last meeting there was 529 blotters, 9 arrests, 175 traffic stops, 61 traffic tickets issued, 7 car accidents and 19 parking summonses issued Trustee Taylor: I think the public has probably noticed there is a rise in the police presence, on Route 52, the commuter 500, that has been from Dunkin' Donuts to the dollar store has kind of been minimized. It's a pleasure to see and I think they're doing everything they can do to address the issues that we've expressed, not only from the public but from this board as far as a high profile of the police presence. Much appreciated. I'm sure the public appreciates it and sees it. If there's something that we're not addressing and they're not addressing, please feel free to bring it to our attention or the Police Department's attention. Trustee Garrison: Mr. Revella, on the West Main Street water break, do we have any updates on that? I know you said they met with them. I've had a couple people ask me about it. Do we have a timeline? Manager Revella: I talked to our attorney about what we can force the people to do. We're trying to work with them so that they can get good pricing if we force them, maybe they want the best price. We're trying to be compassionate about that. They know they have to fix it. We've done mark outs and correlations to show them exactly where the break is. So they're not wasting money, digging everything up if they can make the repair. Hopefully, it's cheaper for them, but that's a cost on that homeowner and it's significant. Mayor Pearson: Did we give them a timeline? Manager Revella: I do not think that he gave him a timeline because we don't have that ability. It's either we work with them and they're being reasonable. If they're not being reasonable, I already had the law firm check to see what kind of time frame we can give, if we did a demand. That's next. If they're not complying reasonably, then we'll do a demand. We try to work the residents without doing that. Deputy Mayor Thompson: I wrote a note to myself, but I don't understand my note, so I'm hoping you can explain my note to me. The home that volunteers worked on up on Ulster Ave. Did we contribute funding to that? I wrote some sort of a note. Manager Revella: No, the village did not contribute funding to that. I don't know if the church did that. Some village employees helped volunteer, but that's beside the point. That was really coordinated through the church. Trustee Baker: Police canvassing, how many more positions are we looking to fill? 3 Manager Revella: Right now, 1 full time. Trustee Baker: In regard to the bridge by Hannaford's, who's responsible for it? There's a lot of trees that are piling up. Who is responsible for removing those? Is that us? Manager Revella: No, the county. That's a county bridge. If you’re talking about the bridge. If it's the dam, that's a private dam. Trustee Baker: What's the process when we post events online as far as like the flyers for Easter Egg? I did have feedback from a few individuals in the community that were a little upset because it said the 13th. Manager Revella: It was supposed to be the 13th. It got postponed because of the snow, to the following day. But then, because the snow was lingering, it got postponed to this coming Saturday. Deputy Mayor Thompson: But it was still incorrect, the flyer. I notified the Clerk. Do we notify the Clerk or do we call the Parks Department? Manager Revella: The Clerk is in charge of the website and Facebook to make updates. If something's wrong, she can correct it. If it's a flyer issue, she'll make sure the department that gave her flyer will correct it. Deputy Mayor Thompson: I think that's where the problem was. It wasn't with Marisa. It was whoever generated the flyer. Public Comment Mary Ellen Matise: I was going to make a comment about code review. Maybe before you do code review you have a Tri-Board meeting, but this very minute I was told that I'm not on the Zoning Board anymore. I was never given a notice. I was never sent a letter saying thank you for your service. All of a sudden 5 minutes ago, I'm not on the Zoning Board anymore. Manager Revella: You should have a letter coming. 4 Mary Ellen Matise: It would be nice to know. Mayor Pearson: Was her 5 years up? Manager Revella: Yes. Mary Ellen Matise: Yes, but I never even received a notice saying that my term was coming up. It's a little surprising. Mayor Pearson: Sorry to hear that, Mary Ellen. Ray Lustig: It's my understanding that the Walker St issue was going to be on the agenda today. Did I get ahead of myself? Mayor Pearson: That's the next one, but I'll address that right now for you. We have a new attorney that we have not had at our regular meeting, yet. We need to bring him up to speed on your issue that's there. I did have Marisa send the new board members everything that was happening. They can read the minutes. They did get your information. I was going to say the first meeting in May, put you on the agenda because we don't have our regular attorney here. I want to make sure we have him here before we move any further with you. Ray Lustig: No, that works for me. Actually, I'm going to be out of town until May 2nd, so it might just work very well. Manager Revella: May 6th. Motion carried. 76-80 West Main Update Andrew Concolino: Just wanted to say hi, congratulations on the new board members. We're starting work tomorrow. I don't know what else to update you. Manager Revella: You have a demo permit now, is what you’re saying? Andrew Concolino: I've had it. I started back in January. 5 Manager Revella: You're starting tomorrow. Andrew Concolino: We're restarting. I started in January. Mayor Pearson: You mean you're demolishing it tomorrow? Andrew Concolino: We're going to start tomorrow. It's going to be done by hand, we're not going to bring machines in, so it's not going to be done overnight, but I have guys coming. Mayor Pearson: Are you doing it from the front or the back? Andrew Concolino: We're going to start from the back to the front and we're probably going to drop a dumpster on the sidewalk area and the parking spaces, probably Thursday. Just try to stockpile some garbage so we have the dumpster in and out. Mayor Pearson: Is it sidewalk or road? Manager Revella: We'll see where they can fit it. Andrew Concolino: It can fit in the parking spot. They're like 7 1/2 feet wide, I’ll put cones and stuff, but they should fit. I'm just going to stockpile up some garbage and just get one box at a time. Mayor Pearson: What do you think your time frame is for that dumpster? Andrew Concolino: Hopefully not long, if we have enough garbage stacked up, we can just assembly line it in. Get it full, make a phone call and have it scurried off. I wouldn't want to keep it there overnight. Mayor Pearson: The dumpster is only going to be there for 1 day? Andrew Concolino: It's going to be like multiple dumpsters. Manager Revella: The plan is they're going to start. They already have done a lot of demo. They have a lot of garbage accumulated. They'll bring the dumpster, fill it up. Get a hold out. Work again to get enough garbage together to fill a dumpster, then call back in. Mayor Pearson: Are we talking months to finish this or are we talking weeks to finish? Andrew Concolino: Probably like 2 weeks. I think the board gave me till the 29th at the last meeting, so try I would just try to aim for the 29th and if there was a step back or something, I would just be in touch with someone to let you know. Trustee Baker: Are you are you planning to rebuild there? Is the property sold? Andrew Concolino: I would have to cover it with dirt right now and kind of fence it off and regroup and just have a solid plan drawn up and get it approved. Another process to start after the building gets knocked down. Mayor Pearson: Will you be able to build from the back or are you going to have to build from the front? 6 Andrew Concolino: I don't really know as of right now. Hopefully, it would be easier to get a delivery through the back if you’re getting a bunch of supplies dropped off. Anything could happen. There's enough property there. When a building started to get built, you can kind of stockpile it. But yeah, there's that issue. It's like something that we'd have to get to once the building's knocked down. Trustee Taylor: I think we alluded to the fact that that's a hard fast date for us. The 29th. Granted, I can agree that things pop up. Andrew Concolino: If it's not, it should be mostly done by then. Maybe the clean up afterwards, like filling in the hole. There's some concrete there that has to get dug up and then refilled over. Mayor Pearson: There is a basement there. Andrew Concolino: Like a mini, but I wouldn't really call it a basement, like a crawl space. I could stand and duck my head. Maybe like 10 by 12 feet in the back, but that's going to be a hole once the floors are removed. I have to take the concrete out and then get truckloads of dirt or rock or something to fill in the hole so there’s not a giant hole in the ground. Trustee Taylor: You can anticipate, from my point of view, that once that's all done, we've got this big void on Main St. We are going to be intimately interested in the timetable for filling that. Andrew Concolino: I’d have to regroup and find out what I can't build, what I can build. Trustee Taylor: I understand that. But that's the kind of update going forward that we're going to be looking to enthusiastically see where you're at as well. Code Review - Discussion Mayor Pearson: I put this on because we basically stopped code review. Mary Ellen, I got your point with Tri-Board, but I have a little different vision. I'm thinking I am going to meet with the Planning Board and Zoning Board, the Building Inspector, the manager and myself as a small committee to talk about zoning codes, which are different than our everyday codes. Our everyday codes are like sidewalks and skateboards and that kind of stuff. That's what we'll be looking at as a whole. We did get up to and I didn't pull it out. Marisa gave that to me. We got up to the end was December 23rd, we did 135-1 to 149-13. I have a big code file that we've done so I will pull that back out. But I would like to start up again. I think if we dedicate like 1/2 an hour at the beginning of the meeting from 6:30 to 7:00 and then do the meeting after that instead of coming in early. I just think it might be beneficial just for 1/2 an hour and we would get to the code, start again. What I'll do is I'll go through my code file and see exactly where we were. I don't know if Dave, we gave it to Dave and he was finalizing all of those. I don't think we got those back to finish them. Attorney Wilson: Okay, we'll follow up. Mayor Pearson: He might have all of them there. We were talking back and forth and we were going to wait for a group to get done and then we were going to go over that group. Maybe we want to see what's done first, do that group and then move on after that. Let's see what Dave has done for us and I’ll check my file. We’ll let you know next meeting. Motion carried. 7 Public Comment Brenda Adams: Thank you for Flag Day. I hope you all show up and have a good time. Ann Marie Sullivan: When we left off at the last meeting, I know that you had said that you were going to help speak to government officials to try to solve the issue and that John was going to reach out and I was expecting an e-mail, but instead, yesterday, the day before the meeting, I got an e-mail from Brian Maher, who I asked not to have included because he wasn't helpful and his e- mail stated how he had been out to my house twice and got the village involved and got the state over there and how they all were going to be working for me. He's so surprised that they didn't work together to solve the problem. None of that was true, which is why I don't want him involved. He came to my house once. I had the village over. I had the state over. I had everyone come. He didn't do anything for me, which is why I wanted a different government official to try to get something done. I was also under the impression that the village was helping me, kind of by speaking to that government official by helping me get information rather than sending them to me. I don't know if I misunderstood that. Were you just going to have somebody contact me? Or were you going to talk to them about what was going on? Mayor Pearson: I was a Trustee last time, I wasn't there. I was sitting here. What I remember from the last time is that we did direct John to talk to Rollison and Brian again to see if they knew anything because we keep getting from our attorney is that it’s not a village issue. Ann Marie Sullivan: But does he say why it's not? There has to be a reason why, because all the laws point to it. All the plans point to it. I know you said you couldn't locate those and I understand that. But I know that the village has to have contacts with the Department of Transportation because they run roads through here all the time. You have to have conversations with them. You couldn't find the plans here, but there has to be someone you know who could locate the plans there. I'm looking for you to be that contact to help me and get information for me that I can't get myself. That's kind of what I was asking of the board of the village. I'm a good citizen of the village and I don't deserve this. It is contaminated water. It's contaminated with petroleum. I had the Department of Health come out. I'm getting a report from them. It is a swamp. There's mosquitoes, there's ticks. It is a health hazard. It's my home and I get oil inside my basement when I don't have an oil tank. Where is it coming from? It's run off from this ditch that nobody is taking care of. And if it's not you, the state is pointing out they have paperwork. They have things in writing saying it's the village, it's the village, it's the village. When the village says it's not me. I need to know why. Manager Revella: Just so you know, so the board is aware, I think I forwarded you, I did do what the board said. I reached out to Brian Maher and Rob Rollison. I got auto-responses so far. Ann Marie Sullivan: Yes, and I did rip into John a little bit in that e-mail. I do apologize because he said that he just found out, again another lie, in his e-mail like you just called him yesterday right before the meeting and that was not true. John did reach out to him before and he forwarded the e- mail to me. Manager Revella: The only other option I have and I just need the board permission, I could reach out to Sandra Jobson. She's our regional director. She would maybe be able to find the paperwork she's talking about. Because what the resident here is talking about, there's paperwork allegedly filed by the state that the board adopted to take on the responsibility of maintenance of this particular drain. We don't have anything that shows that. So, if the state has something that shows that and the board adopted at that time, that's on us. Mayor Pearson: What year was that? 8 Ann Marie Sullivan: ‘96 Attorney Wilson: 1989, I think. Manager Revella: The first time, I don't know. Ann Marie Sullivan: I asked that question last week. Do they propose something to the board and the board approves it and it takes 2 years or 3 years or 5 years to happen? I don't know what the process looks like. I think it was ‘96 or ‘98 the work was done. The plans have dates on them. Manager Revella: It probably started in ‘89 and it probably took them to ‘96 to do it. That's typical DOT. Ann Marie Sullivan: We don't even know when we be looking, they might have that information if you could get that for me because I haven't been able to get that. I did get the plans, I did get the table of maintenance saying it's the village. Everything points to the village. Mayor Pearson made a motion to authorize Village Manager to contact who he needs to contact. Seconded by Deputy Mayor Thompson. All ayes. Motion carried. Trustee Taylor: I find it completely disturbing that the people that she has been in touch with, the local reps that she's been steered to are not responding. For me personally, that's just as detrimental as what she's going through. I find that unacceptable. This is not a photo op. This is an opportunity to address a situation by a resident that has repeatedly come in front of this board and the people that she's contacting, the local officials, are not responding. I find that disturbing. Deputy Mayor Thompson: Can we have some sort of a timeline on this because things sort of fall by the wayside. Manager Revella: I'll e-mail her after the meeting. I have their direct contact. Mayor Pearson: We'd like a response by the next meeting. Manager Revella: I can give you an update of what I've done, I can't guarantee anybody will respond. I'll see them in person as well. Ann Marie Sullivan: That's what I was hoping, that it wasn't just an e-mail. That you have a personal contact. There has to be someone if you're gonna get the roads done, you're not giving emails and waiting for responses, you're calling someone. They're picking up and you have a relationship with them. I would expect that person to be the one that you're reaching out to or I would like to request that. I'm being a little pushy, but that's what I'm looking for. I'm looking for that more personal contact rather than just emails, and no one's answering. If you could do that and use your contacts here at the village to help me, I would appreciate that. Mayor Pearson: We'll do our best. Manager Revella: Next meeting is May 6th, but you'll have an update before then. Payment of Audited Bills Trustee Taylor made a motion to approve payment of audited bills. Seconded by Trustee Baker. All ayes. Motion carried. 9 Miscellaneous Comments from the Board of Trustees Trustee Mishk: It's been an eye opener going over the budget. I hope that we can resolve it amicable for the taxpayers. There's still a lot of work to be done. I appreciate the work that the previous board has done towards it and that the board collectively has been doing on it since we started. Deputy Mayor Thompson: I'm very excited that we're moving forward with the protection of our wells with the Town of Montgomery. It was disappointing that we couldn't get a better law the last time we were working on this, but we're having a second chance to revisit that. Hopefully, we'll put together a good group and we will get what we need this time around. Trustee Garrison: See a lot of police presence. I think they're doing a great job. Hats off to them. DPW guys, out there doing what they need to do. Sometimes you don't see them doing all the work, but they're doing other things. There's drivers training going on. There's a lot of training going on down there. I look forward to getting the budget completed, like Jerry said, and moving forward on that and really want the village to understand how hard everybody up here has been working on this budget and trying to figure out what we can do to be the most cost effective, but also maintain the village and the integrity of the village. I just want to let you guys know we are working on it. Trustee Taylor: It's a pleasure to see the communications on this board as we sit here. That's refreshing. I look forward to a continuation of that. Relevant to the budget, just so the public knows, your comments of both in emails and at meetings has not gone unnoticed. Those issues have been on the forefront relevant to the to the budget. Do we have all of the answers? Not yet. Is there much more work to do? Absolutely. But those things that have been expressed by the residents of this village have been taken very seriously and they have been on the top of the list relevant to reviewing the budget as we speak. I'm confident that that's going to continue to be the method of operation here. Mayor Pearson: I did write a letter to the DOT for a notice of defect on Route 52 between Stewarts and Dollar General. The potholes are disasters there. You're going to take out a whole car on some of them. They did write back that they will have people in the area, so hopefully that means something. I don't know. Just so the public knows that we're trying to do something. Manager Revella: Just so you know, by doing what you did, Madam Mayor, anyone that has issues because of those potholes is now covered, which is good. I know some people did call about tire issues, so thank you. Mayor Pearson: Notice of defect. If you don't have a Notice of Defect to the people or to the entity, people can blow out all their tires and never get money for that. But once there's a Notice of Defect on that stretch of road, they will be covered. If you blow out your tire, you bring your rim, you send it to the state and they should reimburse you for that as long as they say it's okay. But you know how the state is. I did do that so if somebody has issues, please, you can always contact the manager. He might be able to work you through an issue that you might have with that. To the elementary school, George Heffner's program was awesome. It is a tribute to an excellent teacher. Teaching outside the classroom is so wonderful, it's necessary and to see what went on that day. It was wonderful. That was a great program and thank you, George. More of that is needed and that's showing the wonderful part of having the elementary school in Walden. I'm trying not to be too mean about that. There were dog complaints on Maple St. There was bunch of them. Do you know what that's about? Manager Revella: Yes, same house. 10 Mayor Pearson: They’re just barking, barking, barking? Manager Revella: Also loose. Mayor Pearson: Would like to talk about our Arbor Day, which is coming up on April 24th. Behind the elementary school at Mickey Millspaugh Waterfront Park. Will be planting 2 Sycamore trees that day. I meet with the elementary school and the arborist. We've been doing it for almost 20 years. The kids are always involved every year. It's the 3rd grade class. The classes come over or sometimes we walk to the park. Sometimes we do it in different parts of the village. And they do little projects for me and I get to pick out of the classes and it's just really great. Hopefully, you can join us. The budget has been challenging to say the least. Anybody that's sat at the budget hearings has heard what I have said about it and it is challenging. There are things that are not done in that budget that need to be updated that have been from years past, and so we need to really finalize it, get it done and move forward. That's where we're at. We don't know where we're going to be yet. The only reason why we did the tax cap law is in case we have to be over. We're not planning on that at all. We just need to make sure because if we do go over any of that money that's over that cap, we are not allowed to spend anyway. We need to stay under that cap. We will have other meetings. It will be posted on the website. Will be posted on Facebook. You can look at my page as well and we'll post the meetings if there's special meetings. Do we need to set them now? Should we? Manager Revella: I don’t think it’s prudent. We're not sure what will be ready by when. I know we have that meeting coming up on Friday, which we hope to get a lot more momentum. I'm meeting with the Treasurer again tomorrow to get a couple of updates on our percentages to see where we're at. I'll send the board an update on the gap, if we’re under the cap or over and by how much and maybe some ideas on where we can make that balance. Mayor Pearson: I hope we move a little bit more forward on that water main break, that person's break. If the attorney can do something for us as well to get us some information. Deputy Mayor Thompson: Talking about the pothole repairs, are we anywhere on a schedule to have that section of the state road resurfaced and fixed? Manager Revella: No, there's nothing for resurfacing. I don't have the schedule yet from the state because they are still working on their budget. We'll see if/when the new schedule comes out, I can ask the DOT if they have something updated, but I haven't seen an update yet on resurfacing. Patching? Yes, they're patching now all over. But we haven't done anything in a while anyway, but I'm going to start with that meeting. I don't know when John's going to call this comprehensive plan meeting. When you going to do that? Manager Revella: Kristen is finalizing the updates on the plan to give out to the committee members. Deputy Mayor Thompson: But I feel like, should this be addressed before we finalize our comp plan? Just seems to me these things will probably tie in together. Mayor Pearson: And it may not be changing any of the comp plan. I just know that Brenda had a list of issues between the Planning and Zoning Board that are not meshing between the 2 boards. That's not necessarily the whole comp plan either. We'll hold off on the comp plan until we have our first meeting and see what happens, because I think that 1 is just as important as the other. Which is going to happen soon. Building Inspector will be back Monday. So, we'll set something for the beginning of May. Brenda is around. Zac should be around. See how the first meeting goes and see where it ends up and if it's going to affect the comp plan or not. I just don't want to sit back and not do things so. Somehow we have to start and if we have to combine the 2, then we do it. But we're going to start and move forward. Just like the committee that I said Lynn, I wanted you on with the water. We're going to start that too. So let's just, we're just going to move forward. Can’t just sit still. That's my plan. It may get crazy at times, but we are crazy. Here we go.
