Village of Walden Board of Trustees Regular Meeting December 2, 2025 Mayor Pearson called the regular meeting of the Village of Walden Board of Trustees to order at 6:30pm. On roll call the following were: Mayor: Becky Pearson Present: Deputy Mayor Lynn Thompson Trustees Gerald Mishk Cheryl Baker Absent: Ralph Garrison Liz Kyle Bill Taylor Also Present: Marisa Kraus, Village Clerk John Revella, Village Manager John Cappello, Village Attorney Public Hearing – Local Law 5 of 2025 – E-Bikes and Scooters Deputy Mayor Thompson made a motion to open the hearing for Local Law 5 of 25 E-Bikes and Scooters. Seconded by Trustee Mishk. All ayes. Motion carried. Trustee Baker: I don't have any comments of my understanding and I could have been wrong is that the New York State ADA law would take into effect so this doesn't outlaw a brand people that are mobility impaired from using scooters. Attorney Cappello: 98% of the law is existing law under New York State Vehicle and Traffic law. The only thing that is different, in this law than vehicle and traffic law, is the helmet standard for everyone, which you are allowed to do beyond the vehicle and traffic provision. Right now, I believe and I would want to double check that vehicle and traffic prohibits operation in any public land. So, providing that it's allowable on designated trails within the public land is also actually expansion upon what is permitted under vehicle and traffic law. Mayor Pearson: The board really did not change anything from vehicle and traffic. We were going underneath of all of that law to begin with and it was really just adding helmets, which we thought was a safety issue to begin with. And if the ADA is accessible through the state and that's allowed on sidewalks then that’s what we're doing. John, you did say that that is what is allowed? [Correct] It's really not anything to do with the handicap that is already in the law, that they're allowed to be on the sidewalks. We were talking about basically the electric bikes. I just saw a scooter today running up the sidewalk with snow. There were no people there, but I can remember 30 - 40 years ago, when the skateboard law came into effect. When I was sitting out in the public and there were a lot of kids with skateboards. They were headed to the park. They did not care who was walking down the street and there are people who care that people are walking down the street and take the time to get out of their way, but there are others that will never. So, I think the bad few will make up the difference for the people who are carrying. That's part of the issue. Not that we're not going to deal with this, but I also agree to hold the public hearing open so we have a full board as well, to discuss it again. That's a very good thing. 1 Trustee Mishk: The definitions are here for e-bike and bicycles in the law and that's the way I remember when we talked about it. Maybe I misunderstood you Sir, but you said we need a definition and then the definitions are clearly here. *inaudible from the audience* Mayor Pearson: John, will you check that out for us? I know it's still when you have electric scooter when you're handicapped. Do you have to have some type of placard like a handicap parking sticker or something. Does that have to show or no? Attorney Cappello: That I don't know. I guess this definition, to be honest with you, talking about the electric. Mayor Pearson: Like if I broke my leg and I'm getting out of the car and my husband gets the scooter out and I'm riding on the scooter to come into the Village Hall, something like that. I know about the handicapped part of it. I don't know whether they legally have a sticker or something. Trustee Baker: No, because they would go under some speed limit, so you don't register them with DMV. You don't get a license for that, because it will be over certain RPM. Mayor Pearson: Maybe we just list handicapped scooters or something of that effect to change. Attorney Cappello: I’ll take a look at ADA. *inaudible from audience* Mayor Pearson: Thank you for all your comments. Thank you for coming out tonight. I know it was a difficult night, but we get paid to do this job to service you and missing a meeting to me is not something I like to do. It's publicized anyway and probably holding the public hearing open is fine. We are here to serve the public as well, but we can at least move forward. Deputy Mayor Thompson made a motion to adjourn to December 16, 2025. Seconded by Trustee Mishk. All ayes. Motion carried. Public Hearing – Local Law 6 of 2025 – Yard Sales Brenda Adams: I don't know what's on Facebook, because I don't follow it. This is a law that's been on the books for a long time am I correct? [correct. 1973] and if I remember correctly at 1 time it was to be enforced because some people in the village were doing yard sales every weekend and during the week. They were actually making a small business. And having litter all over their yard every weekend. Are you suggesting any changes to the current law or are you looking at… because you haven't been enforcing it. People's been having yard sales, their signs all over town. That would be what I'd want to see enforced. If it isn't being enforced why bother doing it? That's my issue. If you haven't been enforcing it and you don't have anyone who's abusing it at this point, what's the point? Mayor Pearson: This law came up, because the person who brought it up was concerned about the amount of fines that were being associated with this. When we're listening to the public, we try to talk about things that are concerning the public. There was a $250 fine or imprisonment and we will be talking about fines. We will talk about the whole law and see if they need to have any changes done to it, at all. We did change it a little bit because there are 2 yard sales now, with the bulk pickup. There's 2 yard sales now that are out in the law. It says 2 but I thought it was 4. So, 4 more in the village for the whole year and it's really just going to the clerk and just saying I would like to 2 notice that I'm going to have a yard sale. I'm going to have her for 2 days and just filling out a permit, I'm not going to say a permit. You're not paying for anything, just letting the public know. If that happens we can at least come back and enforce it if you have not cleaned up and done your thing. The village will know it's not really penalizing people, it's not making you pay something. It's up to 6 yard sales for the year total. Brenda Adams: There's no fee when they come to see Marisa and she fills out a form? Mayor Pearson: There's no fee correct. We changed the fines, so that you're not fined. The first offense is no fee, no payment and then after that, if you keep having them and you don't have your permit, then you're going to get fined $75. We changed that from $250. We're actually making it better. I do remember why, in the 70s, why it was that. It was everywhere. People had yard sales all the time to make money. It wasn't just one house. Brenda Adams: Right, it wasn't somebody just moving or somebody trying to make a couple of bucks or cleaning out their seller. It became a small business at that point. Mayor Pearson: Correct. So, that's really just how it happened and again why we're here is because of you guys and that's what we're looking at. Changing things and making things hopefully better and if people want to complain about that, please come and complain and have your say that's what we're here for. Brenda Adams: There's no fee. Mayor Pearson: There's no fee, correct. Faith Moore: I totally respect and love the idea that you guys are going through all the local laws and taking a look at them. It's been a long time coming. So, thank you for clarifying, because when I read this, it said only 2 more right? I had thought too that that's what you guys were saying. So, thanks for clarifying that. Where it says that when we have to come and tell the clerk what we are selling. Again, it's an enforcement thing. So, I'm cleaning out my basement. I'm putting stuff out and basically, I'm going to say it's shoes and clothes and then what happens if I decide I'm putting out dishes? Is somebody going to come and say that I'm out of… Mayor Pearson: No, you're gonna say housewares, you're gonna say it’s just whatever. You're not going to be selling oil and parts like that. That shouldn't. Faith Moore: That was my big question about the 2. Mayor Pearson: We’re actually trying to make things better. We're not trying to make things worse. Nobody's ever going to be happy with what you do. We're happy you came out to ask your questions. Thank you, we appreciate it. Mike McNamee: So, full disclaimer. I have zero interest in hosting the yard sale but the reason I'm here today is because I watched the exchange on Facebook between a number of members of the public and 2 of the members of the board. I thought it was extremely inappropriate the way the members were essentially attacking people for not coming to meetings. Which is why we are not a true democracy. We elect people to represent us and make those decisions. There were people asking legitimate questions that have still been unanswered, 2 weeks later. So, while members of the Board of Trustees were on there saying, you guys should come to meeting, you guys should do all this. Nobody corrected the people who were making inaccurate statements. There's still some impact. There was a lot of back and forth that you should come. But then there's legitimate people 3 asking questions about what was changed, that are still just unanswered. I think the clerk is who posts on there, but if we're gonna sit there and post and allow comments to be open, which I'm fully supportive of, I think there's probably someone to monitor, to answer these types of questions. Obviously, there's people that got very agitated on there, but there were seemingly random people asking legitimate questions that just got unanswered. So, I said I got nothing going on on Tuesday so let me go up there. Again, I have no interest in hosting yard sale. I went through the E-code to find the old one. If you wanted to find the current copy of what's proposed tonight while the public notice shows up on the first page of the website. You have to dig to find where the proposed legislation. Sits under the government tab somewhere else. I think if you're going to post the public notice there, on the website or on the Facebook, if you can post the link to what's proposed, possibly the link to what is current. I made my own red line green line version so I can compare them back and forth, because they're 2 very different documents and which again I think if something like that had been posted with the Facebook post, I think 75% of those comments would have disappeared. People were reading or listening to the conversion from the streaming, about what was in there. and it's very easy to get discombobulated as you're watching those videos. There's no bookmarks, there isn’t anything, they move from section to section with no visual indicators of what's changing. I think some of the people in there that were engaged with, think that some of the old stuff is what's being proposed. Because it's not very easy to see what is there versus what is proposed, to me it's easier for people to understand it when they can see and read it. I did do that. I do see that you guys are actually making it much easier to have yard sales. You took out the permit requirement, you took out the daytime requirements and everything. I think only having 6 yard sales a year is a little restrictive. Someone's grandma dies and got to go clean out the house. Let's do an estate sale type of thing similar to what she said. You don’t know what you going to find in a basement. So, as long as you tell the clerk, we're going to have yard sale, does it really matter whether it's tools or baby clothes? I don't think so. The notice is made, but at the same time they probably don't know until they go through the stuff. Maybe they're here for 2-3 weeks, they're trying to get it out and everything. The schedule of the village wide yard sales, don't work for them. I could see 100 yard sales a year being extremely excessive, but to only have 2 yard sales at 2 days a piece. It is 4 yard sales, not 4 Saturdays in a row. It's a Saturday Sunday or a Friday Saturday. It's got to be consecutive. It is 4 yard sales, but it's only twice a year the way it's currently written. Mayor Pearson: Yes, that's changing. It's 6 total. Mike McNamee: It's written now, 6 total. The 2 village wide yard sales and then 2 yard sales twice. Attorney Cappello: It’s 4 plus 2. Mike McNamee: Yes, that’s what’s written in there now. I saw you moved it from 8 hours. The signs and everything to 12. I think that works. I would think that something similar what we do with the garbage can law of saying that a certain time the day before and instead of us there going, we're going to start at 10 so 12 hours before that's 10 o'clock at night. If the signs can't go up before 7 o'clock the day before, similar to how the garbage cans. I think it's just a little bit easier for people to schedule it, especially if it's an afternoon yard sale. They got to run around and do it in the morning. Stuff like that. I was a little perturbed as to why they took out. The number signs on utility poles, no signs obstructing streets and sidewalks. No advertisement, that can disturb the peace or create a nuisance. If anything that's probably the best thing of the old law. You couldn't have nuisance signs and taking those all out kind of confused me a little. Mayor Pearson: I'm going to agree with you about the public notice. Mike McNamee: About how like the like the notice was published. 4 Mayor Pearson: Yes, I’m agreeing. We are looking at doing our website over, as well, because it's long overdue. I was complaining that every time I go on, I can't find what I'm looking for either. It's really what we need to do. Where are we with that, John? Manager Revella: We are talking to this new group from Civic Plus and have Rod Freeman revamping what we already have. Mayor Pearson: Yeah I'm going to agree with you on that totally because every time I flip in I go somewhere different. Mike McNamee: No problem. Just so you know, on the website now on the main page only the public hearing for the yard sale shows. I'd imagine that you guys don't lock them so enough things were posted that you can no longer find. The public notice for the first public hearing today it got bumped down the list. I know there's a way to lock those until the public hearing Shows up because I'd imagine as soon as you post that the snow emergencies lifted, you're not going to find anything regarding this one. In the events section none of the meetings and nothing populates, but the one they put on the other day for the election’s in March, that's on there. It's not really conducive for people to actually see what's going on if you go to the website. Mayor Pearson: Agreed. Thank you. I'm not disagreeing with you on that. And when I made that comment on Facebook. Attorney Cappello: Just wanted to clarify one thing for you though. When this law is written the way this law is written it only lists what portion of the existing law are being changed so the item about the posting of signs and everything, that is not being changed. That remains in the law. If it was being changed, it would say that section is being deleted. Mike McNamee: I believe the way it's written and for that section it says that, I think 228-4(B), shall read is that how it says. So, if it says B shall read, it doesn't say Manager Revella: Amendment to read as follows. Mike McNamee: Which means you're replacing the entire section B with what follows. Attorney Cappello: Okay, I'll look. You're right. I'm sorry. Deputy Treasurer Thompson made a motion to adjourn to December 16, 2025. Seconded by Trustee Baker. All ayes. Motion carried. Village Manager’s Report • We had few exciting things happen including the tree getting put up in the square, the village being decorated and looking forward to the event this Thursday in the square starting at 6:15, concluding it around 7:30 • Had a few different meetings with the DPW Super. We had a meeting with a couple of property owners regarding some drainage issues. Met the Zoning Board Chair regarding some protocols. • Went over some issues with Zoning and Planning with the Building Department • Just want to thank the Rec Coordinator, the DPW and the police for helping to bring the tree into the square. Joint effort. Very successful. 5 • Had a good meeting with our workers comp reps to talk about our recent audit and open cases and our rate that has gone down from 1.52 to 0.97. Which means we get a discount up front for our workers comp • Met with Assemblyman Maher before he left to go over some current events and signs and things he was trying to things he was trying to help the village with. His assistant Megan is going to follow up with those going forward • Had a good meeting with the new town grant writer and the town supervisor going over grant processes for the villages. It's covered in the a fund. I don't know if people noticed, we did go over some parking areas. The guy that does the paint for village streets, the contractor didn't have a lot of time to get to everything. He got to a lot of things. The DPW went out and helped paint some curbs along North Montgomery St near Wait St. Where we are having some problems with people parking. It's now yellow curbed • Also, went over recent claims of the insurance council, making sure we were covered. Nothing outstanding • Went over with labor council and PBA some other updates. Trying to get the PBA negotiations back online • Did have a conference with the planner regarding the comp plan updates, especially the ones were discussed at last meeting • And did have a couple days off for the Thanksgiving holiday. Hopefully everyone had a good time • Recreation and Parks Department - teen center still going, indoor pickle ball is now every day, Monday through Thursday. 2 sessions at Wooster Grove. Programming for Community Center still going on, cornhole, fitness programs etcetera. They have a family movie night set for December 19th at 6:30 in the Community Center. The senior trip is set for the Paramount Theater December 6th. Indoor soccer's going well, basketball registration is open. All the outdoor facilities are winterized • Building Department - still working on updating permits, COs and following up for maintenance issues. They're also sending out the fire and safety inspection list updates for people to make sure those are getting scheduled • Clerk's been following up Facebook, website, workers comp things, going over foils, handicap requests, billing, permits and process new hires • Finance been working on the bank recs with the financial consultant. They're making progress, slow and steady, but it's steady progress. Good retirement deductions, going through those as they come up. The retirement payment was made. If you saw the bill. Going over an assisting residents, billing concerns, accounts receivable, payroll, Edmunds programming and vouchers • Public Works continue to do vehicle maintenance, continuing to press sludge to the sewer plant. They did follow up with that green light contractor that's doing all the digging for the fiber optic lines and let them know that they had to finish this week. We don't want him digging through the winter just in case something happens. Water Department. They installed 2 new meters, 5 endpoints, 10 markets and 1 inspection. I know some of the board members have been asking, we’re less than 200 meters to get replaced out of the whole village. We're making good progress. Some of those for different plumbing reasons but they're getting going and they're still post carding. All the banners were changed for the holidays, patching potholes, cutting back the routes, cleaning the streets, repairing catch basins, flushing jetting and today obviously plowing • Police Department does have a new part time dispatcher hire. Hopefully, they'll come visit us at the next meeting. Since last meeting there was 259 blotters, 2 arrests, 35 traffic stops, 15 tickets issued, 1 mva and 6 parking tickets 6 Trustee Mishk: John on the fiber optics that are being installed in the village. I watched him on Wait St doing something today where they were actually driving with the person up in the air in the bucket with 2 flagman stopping and starting traffic. It's a hill there, in today's storm, I'm surprised the guy didn't get hit because the cars were sliding trying to stop. Is there any control that we have? Manager Revella: Today? That's crazy. I wasn't aware. Trustee Mishk: They're working down the corner. Manager Revella: That's nuts. I don't know. That's an OSHA standard issue. That's probably a violation of OSHA and if you do something like that. Let us know. We'll get a hold of the proper NYS authorities to make sure they're watching them. That's a public safety issue for sure. I would have the police respond. Definitely dangerous. Trustee Mishk: If you can answer, the updated 207c with the retirement has been approved. Why is the IME an issue? Who asked for the IME? Manager Revella: The state retirement. Trustee Mishk: But if they approved the retirement then why would they be looking for an IME. Manager Revella: It’s pending as far as I know. There's no response yet on them from that. We've been asking about that state. We were told it was approved, we're waiting. I guess it's because there was 2 retirement applications made for that person. 1 was accidental. 1 was regular. One is approved. I'm not sure how that works. Trustee Mishk: It seems like a contradiction there. Manager Revella: I don't disagree with you. As long as they stay on 207c, it's our burden and cost. Once it's off, it's the states. So, the state is slow and getting that process moving. Deputy Mayor Thompson: I'd like to go back about the signs. Are we getting the signs has it been approved where are we with the signs? Manager Revella: He didn't say we were approved, we gave him all the information, we were waiting for a response. I know that Megan's following up on it. Deputy Mayor Thompson: Can we just stay on top of that? I feel like it's better if we give people time limits that we would like replies back, otherwise it's sort of just disappears. I would like to talk about the grant writer. You had a physical meeting with them or this was all over the telephone? Manager Revella: Physically, in person with Anna. Deputy Mayor Thompson: I did ask Steve a few questions about when they are finished with their contract with the current grant writer and how it's going to work transitioning to the new grant writer what the fees are going to be. I really didn't get clear answers about that. I asked if it was necessary for us to draw up an IMA. Which I don't know how you feel about that. I feel like we should have something to protect us for Manager Revella: Because they're paying her out of the a fund, we're entitled to that service. I was told she would be working on grants in general, about 20 hours a week and whatever we need to send to her, send to her, but that was his response. Deputy Mayor Thompson: There's an opportunity right now. I've talked to Mike Bliss several 7 times about it. I feel like always with grants with us, we get late notice and then it's a scramble to get the proper paperwork submitted. If we do get the paperwork together, there's not enough time to really do a nice strong application and we lose opportunities. I like maybe a sit down meeting is in order with some sort of an outline, a plan drawn out. So, we get the service that we're going to be paying for. Manager Revella: Agree. Deputy Mayor Thompson: So, I'm happy to get involved in that, if you'd like me to, but I had a lengthy conversation with Mike again today. He's scrambling because the application has to be in by the 17th and you need a board resolution. We don't have another board meeting until the 16th, so it's just once again, I feel like we're behind the 8 ball. I think we can do better for the community with the grants I think we can do better. Manager Revella: The one thing, I do need assistance with from the board. If they want to help is the wish list. I have some things, but I'd like to go over that with the board as well. She did ask for a wish list. Deputy Mayor Thompson: Okay, I'm game for a wish list. I did that with you once. Let’s get the wish list ready. Mayor Pearson: To tag onto that, I got a phone call from Millennium again today and I also got a text from the Mayor of Maybrook asking about Millennium. Where do we stand, they're done at the end of December, but you said we have a grant with them for this. Is what you were saying the grant that's with Millennium? [Yes] And it's also in with the Town of Montgomery? Manager Revella: Which one? Mayor Pearson: The knot weed, the whole invasive species. Manager Revella: The town is doing a joint application for the whole town. Millenium was doing an application just for our request. Mayor Pearson: Dave something is who called me. I don't know if he's the owner or not. Whatever he is. So, they want to know whether we were interested in being part of Millennium. I'm guessing that this board does not want to be. That we're going to just be going with the Town of Montgomery grant writer. I know Dennis was asked because we were going to get a discounted rate from Millennium to work with Millennium Deputy Mayor Thompson: That's why I'm asking that we have a more formal meeting and get some of these questions answered. Mayor Pearson: I thought we asked that last time and John was supposed to get back to us with what we were doing and that was part of the conversation last time was to come back to us tonight, say because Millennium is asking and that's done at the end of the month. Manager Revella: I don't know why you'd want to spend money on a grant writer when we already are paying for grant writer and is more than happy to help us. The wish list is the only thing she's asking for because then she will look to see what's coming out to see what's our interest. Say you want a grant for fixing this building, that's on our wish list, so when she sees a grant comes out and may be conforming, she'll alert us right away so we don't we don’t have this last minute issue. 8 Mayor Pearson: How many grants do you have in with Millennium now? Manager Revella: Right now, they're not doing the T-Mobile one. That’s with T-Mobile alone. Right now, it's just this one, the ones already approved. We don't have any outstanding grants except for this one. Mayor Pearson: And what will happen after the end of the month. Manager Revella: The application order will be in. It will be done. Their service will be finished. Mayor Pearson: So actually we're going for this grant for 2 completely different entities. Manager Revella: Correct. Mayor Pearson: The board I guess I need to ask you your thoughts on Millennium versus the Town of Montgomery. I just want to be able to tell this guy what the board decided. Trustee Baker: I don't see the point of paying twice for a grant. I know Anna, she's quite efficient. If we have someone through the town, I don't see the need to double pay for service that we're already getting. Deputy Mayor Thompson: I’m okay with going with the town, but I just want to know the difference in cost. Is it still going to be the same amount of money coming out of the a fund? If we go with Anna. Manager Revella: Even if we don't go with Anna, there's still have that budget in the a fund from us. Mayor Pearson: How much are we allowed to spend with them? Manager Revella: It's about $10,000. That's what Steve said for us. It's the town's money that they're allocating for us. I don't think they'll change what the allocated is in their budget, it’s already done and approved with their 9% increase. *Discussion about how much to work with between Millenium and Town of Montgomery* Deputy Mayor Thompson: I just think we need to have a formal meeting. That's what I would like to do, mayor. Mayor Pearson: Okay. Set it up John. Thank you. Deputy Mayor Thompson: We’re up to date or doing well with our permitting process? I know we're down somebody. What are we going to do now with snow violations on top of all the other work that they're trying to stay on top of over there. How are we going to handle that? Manager Revella: We're not. We don't have staff for that right now. We have to talk about that an exect. Approval of Minutes – November 3, 2025 & November 18, 2025 Tabled 9 Payment of Audited Bills Trustee Mishk made a motion to approve payment of audited bills with exception of a bill. Seconded by Mayor Pearson. Trustee Mishk: There was a bill in there for a time clock system. Manager Revella: No. There's a bill in there for PD scheduling software and time clock. Which we've been paying for years for them. This is just a newer one, because the one that we had was not compatible with Edmunds, so it was a waste. Trustee Mishk: Not compatible with what? [Edmunds. They wouldn’t talk to them] So, this is going to upgrade the PD to work with Evans. Manager Revella: Correct. Mayor Pearson: Is his is a whole new system? Manager Revella: The PD had a system, it was a software system that did scheduling and it ran the time clock. We're up for renewal and we're not going to waste money on an old system that doesn't help us and doesn't talk to our payroll system. So, we got one close that does talk to payroll system. The price is close, as well. That's why it's a new company, close from what we're paying already. It's like a $1400 and something dollar difference. Deputy Mayor Thompson: So, if it didn't talk to the system, how have we been able to do payroll with it? Manager Revella: They print them out and bring them up. Mayor Pearson: We were just talking about payroll system other than this one [correct] That would have serviced the whole Village of Walden entity. Now we're buying something that's servicing this one and maybe something else is going to service something else. Why are we doing that? If everybody on this board wants to go with the payroll system in the future, why wouldn't we be getting one system that's going to work with everything that they want to do? Manager Revella: The board never made a decision about it either. [I know that]But this needed to happen, otherwise we're paying for a system that doesn't work. Why would we do that? Mayor Pearson: How long hasn't it worked? Manager Revella: Ever. Mayor Pearson: Why are we rushing right now? Why are we not deciding? Manager Revella: Because we had to pay for a renewal and I'm not gonna pay for renewal that's not compatible. You have to have the software system for scheduling. Treasurer Degon: Police Department always had time clocks and always had a scheduling system. Their scheduling system does more. It's supposed to speak to the time clocks, but theirs wasn't functioning. So, one of the dispatchers would have to actually take from the scheduling system and create the timesheet. It's creating work for the dispatcher to create those timesheets. The scheduling program, you might have to help me with this, but I believe what I've been told by the chief, it's kind of in control if someone can't make a shift, they have to be alerted right away to cover those 10 shifts. They've always had that. You can't be without that scheduling program, so they've made the broken system work for the time being, but now it's up for renewal and we haven't moved forward with the payroll system. We have to fix this. Their system is kind of independent of the payroll, but we've already confirmed that it would work with Recalibrate. It work would work with ADP and work with Paylocity.
