MINUTES FOR THE REGULAR MEETING
OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK
HELD ON TUESDAY, JANUARY 10, 2023 AT 7:30 PM
Mayor Giordano called the meeting to order and read the Statement of Compliance.
Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Ms. Cericola, Mr. Ritchie, Mr.
Schatz, Mr. Sciolaro, and Mrs. Sherman. Mrs. Weber was absent.
Also present: Patrick Wherry, Borough Administrator; Matthew Guilder, Grants Administrator; Kelley
Halewicz, Municipal Clerk and Craig Bossong, Municipal Attorney.
Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of
silence honoring our Veterans and to remain standing for the prayer.
PROCLAMATIONS & PRESENTATIONS – None.
MAYOR’S REPORT AND REPORTS OF COMMITTEES
Mayor’s Report. Mayor Giordano reported that the Environmental Committee Styrofoam Collection was
a great success on Saturday. Mayor attended the Veterans Holiday Party at the VFW. The Mayor and
Clerk are working on Veteran banners which will be installed Memorial Day to Labor Day. Mayor
commented on hosting the North West Bergen Mayors’ Association breakfast on Saturday. The group
meets and works together to discuss issues and has guest speakers relevant to municipal business of the
towns.
Financial & Administrative Committee. Mr. Sciolaro discussed the budget meeting schedule for the year.
The goal is to conclude discussions at the end of February and introduce the budget in March, adopt in
April.
Fire & Police Protection Committee. Ms. Cericola reported for the Police Department that at 7:38 am on
January 3rd, Waldwick Police responded to a report of a male party peering into a home on Wanamaker
Avenue. Officers responded and set up a perimeter. A Police K-9 was requested and local schools were
requested to shelter in place. The male party was located and apprehended a short time later after a brief
foot pursuit by officers from Waldwick, Saddle River, Midland Park and Wyckoff. The male party was
identified as Justinian Rocco, age 26 whose last known address was in Allendale. Mr. Rocco was wanted
by New Jersey State Parole after absconding from a facility on December 29. He is also a suspect in several
area burglaries over the last several days and has been incarcerated for burglary in the past. Mr. Rocco
was transferred to the custody of NJ State Parole and remanded to the Bergen County Jail. He is facing
charges out of Waldwick for CDS, resisting arrest, criminal trespassing, and receiving stolen property and
has pending charges in Allendale and Ho-Ho-Kus and Saddle River for Burglary. Responding officers from
this morning were Det. Sgt. Dave Passaretti, Detective TJ Palaia, P.O. Chris Cron, P.O. Tom Zachmann and
P.O. Connor Walsh. Waldwick Police were assisted by Saddle River PD, Midland Park PD, Wyckoff PD,
Allendale PD and Ho-Ho-Kus PD. The Waldwick Police would like to thank area police departments for
their assistance.
Ms. Cericola reported for the Fire Department that for the month of December, the WFD responded to
19 calls for service, 2 of them being mutual aid calls for reported fires that turned out to be minor in
nature. As far as drills, members attended the second night of bloodborne pathogens, a hands-on review

of our department saws: how to start, properly operate, and clean, as well as using them cutting.
Members attended on a Saturday a lecture hosted by our Mutual Aid Association focusing on the Black
Sunday fires in NYC and the importance of self-rescue.
Public Safety Committee. Mrs. Sherman met with two members of the Ambulance Corps. John Papendick
and Loucas Nestoros to learn about the Corps, what their needs are and how she can assist them in her
role as liaison.
The members showed Mrs. Sherman the beautiful ambulance that the Corps members purchased. It is
absolutely beautiful and she congratulated them on their work in raising enough funds to purchase this
vehicle that will serve not only our residents but potentially residents in other communities when our
members go on a mutual aid call.
In the month of December, they responded to 56 calls which were covered by 17 volunteer members.
The members provided Mrs. Sherman with the 2022 annual report. She was amazed to say that in 2022
four members went on over100 calls and one member went on a record 225 calls. In total there were 34
members who responded to 547 calls for assistance in the year 2022. While members of our community
slept, celebrated, visited, vacationed, these members gave up their time for our community and they
should be commended. They never stopped, even during COVID. They are heroes.
Waldwick Volunteer Ambulance Corps members were on Standby which means they wait at different
events (sporting events, parades, etc.) a total of 17 times in Waldwick.
Members responded to 36 mutual aid calls in towns near us including Allendale, Paramus, Saddle River,
Franklin Lakes, Hackensack, Mahwah, Midland Park, Township of Washington, Upper Saddle River and
Wyckoff. They answered 67 calls to the Bristol in town. They also had one medical transport and all OF
these calls total up to 547 calls.
Members have assisted people from the ages of less than 1 to up to 120 years old. They have had calls
for 85 falls, 78 breathing problems, 58 weakness, 35 altered mental status, 28 unconscious, 27 abdominal
pain, 23 traumatic injury, 21 motor vehicle crash and 20 chest pain. They have never billed for emergency
services and rely on donations to offer these services.
They have made runs to Hackensack Meridian Health Pascack, Hackensack University Medical Center, Holy
Name Hospital, New Bridge Medical Center, St. Joseph’s Regional Medical Center and the Valley Hospital.
They also provide ambulatory items such as wheelchairs, crutches, walkers and canes to our residents at
no cost.
Mrs. Sherman will attend their general meeting in two weeks and will have more to report at that time.
One of the take-away’s she left with is we are blessed in our Borough for these wonderful volunteers who
are there for us in our time of need. She is excited to be the liaison for them.
Recreational & Health Committee. Mayor Giordano reported that Mrs. Weber is working with Kelley on
the 2023 Summer Concerts. Six concerts are booked and they are adding two more concerts. Mrs. Weber
will attend the Board of Health meeting in two weeks.

Public Works Committee. Mr. Ritchie reported that DPW has ended leaf collection and ready for any snow
removal. Parks are continuing to be cleaned up, patch work is taking place throughout town and
preventative maintenance on vehicles. For the Water Department, they are turning valves and continuing
with assessments. The Water Department had a major repair on Wyckoff Avenue last week. Mr. Ritchie
as worked with Superintendent Mike La Torre on his wish list items for the budget this year. As a reminder,
the DPW is collective Christmas trees but will not take yours if it has lights, decorations or the stand still
on it.
Buildings & Grounds Committee. Mr. Schatz has no report but will be meeting with Patrick soon. Mr.
Schatz was sworn in at the Planning Board meeting. The Environmental Committee Styrofoam Collection
with Allendale had a large turnout and the filled a 40-yard dumpster as well as collected plastic for the
Trek program. Congratulated the Mayor on being named President of the North West Bergen Mayors
Association.
DEPARTMENT HEAD REPORTS
Administrator. No report.
Municipal Clerk. Mrs. Halewicz discussed Resolution 2023-52, commenting that all the paperwork has
been received and is complete. The final document that is transmitted to NJABC is the approved
resolution for your consideration.
Mrs. Halewicz reported that a 2023 Municipal calendar is being mailed to every home and business
starting today. A Digital version available on our website if you need additional copies.
Mrs. Halewicz reported that dog licensing ongoing and due by Monday, January 31. Late fees go into
effect on March 1. Dog & Cat Rabies Clinics in the area, February 15, 6:00 pm – 7:00 pm, HHK School
Parking Lot, 70 Lloyd Road.
Grants Administrator. Mr. Guilder referenced the 15 open ended contracts on the agenda. When the
borough spends over 17, 500 with a vendor, it required Pay-to-Play documentation and a resolution. By
taking care of these at the beginning of the year, it allows the Borough to spend up to the amount of the
contract as needed. This does not mean that the Borough is spending these amounts tonight, it is there
should we need services from these vendors.

III. UNFINISHED BUSINESS
Mrs. Sherman received a call from the Waldwick Band requesting to be included in the summer concerts
and to have their concert earlier in the season. Mrs. Halewicz will work with Patrick on this as he has
been the contact in the past.
IV. NEW BUSINESS
a. Fee schedule for use of all Borough facilities
Mr. Wherry discussed the proposed fees for use of Borough facilities, which would help offset the
maintenance of these facilities. This would apply to all facility reservations, including the senior center,
the field at Veteran’s Park, and the pavilions. It is important to note that fees are not proposed to be
charged to Borough of Waldwick non-profits, this is really targeted at commercial use, like the recent
request we received to reserve a pavilion in Borough Park for exercise classes.
Also, how are reserved spaces versus non reserved spaces treated. For example, pavilions may be used
without a reservation if there are no other functions using the space; should this non-reserved use be
prohibited? It is easy to enforce such use in areas like the senior center but not in park areas.
Mr. Wherry proposed an ordinance change below, for the purpose of providing a starting point for the
conversation.
Fee schedule for use of all Borough facilities
48:1-10.4 Fee schedule for use of the second floor of the ambulance corps building all Borough
facilities.
There shall be charged a $150 usage fee for each time a day the second-floor meeting area of the
Ambulance Corps building Borough facility is reserved. The usage fee shall be as follows: $200 for each
one-half day, $750 for intermittent use each month, $1,500 for intermittent use each season, or $3,000
for intermittent use each year. This usage fee shall be non-refundable and shall be in addition to the $100
per event security and cleaning deposit. This deposit will be refunded to the applicant upon verification
that the room facility has been left clean and no damage to the facility has occurred. Neither the usage
fee nor security deposit shall be charged to non-profit organizations based in the Borough of Waldwick
for utilization of the meeting area facility or for members of the Waldwick Fire Department or Waldwick
Ambulance Corps.

Council Members discussed the issue at length with most not in favor of charging Waldwick residents and
charging non-residents a reasonable fee, $100.00 as well as charging for commercial activity.
b. Authorize Application to 2023 DCA Local Recreation Improvement Grant
RESOLUTION NO. 2023-75
Authorize Application to 2023 DCA Local Recreation Improvement Grant
WHEREAS, the Borough of Waldwick desires to apply for and obtain a grant from the New Jersey
Department of Community Affairs for approximately $100,000 to carry out a project to renovate the Lions
Park playground in Borough Park.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick does hereby
authorize the application for such a grant; and,
BE IT FURTHER RESOLVED, The Borough of Waldwick recognizes and accepts that the Department may
offer a lesser or greater amount and therefore, upon receipt of the grant agreement from the New Jersey
Department of Community Affairs, does further authorize the execution of any such grant agreement;
and also, upon receipt of the fully executed agreement from the Department, does further authorize the
expenditure of funds pursuant to the terms of the agreement between the Borough of Waldwick and the
New Jersey Department of Community Affairs; and,
BE IT FURTHER RESOLVED, that the persons whose names and titles appear below are authorized to sign
the application, and that they or their successors in said titles are authorized to sign the agreement and
any other documents necessary in connection therewith:

Discussion. Mr. Guilder explained that the DCA set aside $25 million to be distributed for recreational
improvements. Lions Club Playground has just past 30 years of use and while in good shape is nearing the
end of its lifespan. This would be a good fit and we can apply for up to $100,000. This grant does not
require a match but the Borough will most likely apply for this along with a grant for Bergen County Open
Space. The Engineer’s estimate is similar to Ted Bell Park, $400,000-$5000,00. This is in the early stage
and would not be constructed for another year or two. It is a great opportunity.
Mr. Sciolaro requested that the Lions Club be kept in the loop with the plans.

c. Budget meeting dates
Mr. Sciolaro commented that we will need to devote more time to the discussion this year and therefore
believe we need to have special meetings to have these discussions. Thinking two weeknights or two
Saturdays. This would need to happen between February 6 and February 20.
A lengthy Council discussion ensued with all Council Members to send their preferences to Matt to then
come up with a schedule of meetings.
Ms. Cericola asked about the garbage pickup rules and finds it confusing. Mrs. Halewicz explained that
she is happy to put the information out in some other way but it has already been posted on our website,
included in Friday email blasts since late November, and mailed to every home and business as part of the
water mailing in early December.
V. PUBLIC COMMENT
Al Coldon, 34 Dante Place spoke to the issue of commending the Ambulance Corps for acting so quickly
for an emergency at his home. Mr. Coldon is not in favor of charging people to use the Borough parks as
costs just keep going up everywhere. He suggested waiting six months to a year to discuss. Also, please
speak into your microphones, we cannot hear you in the audience.
Janet Hascup, 98 Longview Drive spoke to the issue of having her neighbor put a garbage can at her home
after a party because they could only have two cans and needed to get rid of household garbage.
Ted Sanzo, 9 Kennedy Drive spoke to the issue of a resident around the corner cleaning out, not knowing
about the new rules and suggested using the schools as leverage to get the information out. Also, when
streets are not wide enough, having all this extra bulk in the roadway makes it impossible to get through.
It is similar to his complaint during leaf season in his neighborhood.
Mr. Sanzo suggested the recycling of #6 and using the Chamber to ask its members to reject packaging
and become environmentally friendly when it comes to shipping items out.
Al Coldon, 34 Dante Place spoke to the issue of residents taking the time and reading the information
provided by the Borough. He did just that and it worked out fine for him.

WHEREAS, an application has been filed for a Place-to-Place Transfer of Plenary Retail Consumption
License 0264-33-003-009, heretofore issued to ALMA BNC LLC for the premises located at 71 Crescent
Avenue, Waldwick, NJ; and,
WHEREAS, the submitted application form is complete in all respects, the transfer fees have been paid,
and the license has been properly renewed for the current license term; and,
WHEREAS, the applicant, C DUBB INVESTMENTS, INC., 34 Glenair Avenue, Waldwick, NJ 07463, (the
“Applicant”) is qualified to be licensed according to all standard established by Title 33 of the New Jersey
Statutes, regulations promulgated thereunder, as well as pertinent local ordinances and conditions
consistent with Title 33; and,
WHEREAS, the Applicant has disclosed and the issuing authority reviewed the source of all funds used in
the purchase of the license and the licensed business and all additional financing obtained in the
connection with the licensed business.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick as follows:
1. The Borough of Waldwick does hereby approve effective January 16, 2023 the Person-to-
Person Transfer of the aforesaid Plenary Retail Consumption License to C DUBB
INVESTMENTS, INC., and does hereby direct the Municipal Clerk to endorse the license
certificate to the new ownership as follows: “This license, subject to all its terms and
conditions, is hereby transferred to C DUBB INVESTMENTS, INC., located at 71 Crescent
Avenue, Waldwick, NJ, effective January 16, 2023.”

Insurance Associates
WHEREAS, the Borough of Waldwick has resolved to join both the Bergen County Municipal Joint
Insurance Fund and the Municipal Excess Liability Joint Insurance Fund, following a detailed analysis; and,
WHEREAS, the bylaws of said Funds require that each Municipality appoint a RISK MANAGEMENT
CONSULTANT to perform various professional services as detailed in the bylaws; and,
WHEREAS, the bylaws indicate a minimum fee equal to six percent (6%) of the Municipal assessment
which expenditure represents reasonable compensation for the services required and was included in the
cost considered by the Mayor and Council; and,
WHEREAS, the judgmental nature of the Risk Management Consultant's duties renders comparative
bidding impractical; and,
WHEREAS, this contract has been awarded to Frank Covelli of Professional Insurance Associates based on
the merits and abilities of the firm to provide the services as described herein. This contract was not
awarded through a “fair and open process” pursuant to N.J.S.A. 19:44A-20.4 et seq. As such, the
undersigned does hereby attest that the Risk Management Consultant, its subsidiaries, assigns or
principals controlling in excess of 10% of the company has neither made a contribution that is reportable
pursuant to the Election Law Enforcement Commission pursuant to N.J.S.A. 19:44A-8 or 19:44A-16, in the
one (1) year period preceding the award of the contract that would, pursuant to P.L. 2004, C.19, affect its
eligibility to perform this contract, or will it make a reportable contribution during the term of the contract
to any political party committee in the municipality if a member of that political party is serving in an
elective public office of that municipality when the contract is awarded, or to any candidate committee
of any person serving in an elective public office of that municipality when the contract is awarded.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Borough Clerk are hereby authorized and directed
to execute the Risk Management Consultant's Agreement with Frank Covelli of Professional Insurance
Associates, 429 Hackensack Street, Carlstadt, NJ 07072 as annexed hereto and made a part thereof.

WHEREAS, the Borough wishes to retain Frank Covelli of Professional Insurance Associates (PIA) as
Insurance Advisor in an amount not to exceed $2,00.00; and,
WHEREAS, PIA will provide services by request only; the Borough is not obligated to order, accept, or pay
for services except when it orders them; and,
WHEREAS, pursuant to N.J.A.C. 5:30-5.5(b), a certification of funds is not required for this contract; and,
WHEREAS, this contract will terminate December 31, 2023; and,
WHEREAS, the New Jersey Local Public Contracts Law authorizes the award of contract for "Professional
Services" without competitive bids; and,
WHEREAS, PIA total aggregate awards, including this award, will exceed the Pay-to-Play limit of $17,500
over a one year period; and,
WHEREAS, Professional Insurance Associates has completed and submitted a Business Entity Disclosure
Certification which certifies Professional Insurance Associates has not made any reportable contributions
to a political or candidate committee in the Borough of Waldwick in the previous one year, and that the
contract will prohibit Professional Insurance Associates from making any reportable contributions through
the term of the contract.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Borough Clerk are hereby authorized and directed

Approving the Transfer of Junk Title to All Points Automotive & Towing Inc.
WHEREAS, on May 19, 2022, the Borough came in to possession of a 2002 Suzuki Aero from a motor
vehicle stop where the driver was operating with fictions plates, at which time the vehicle was impounded
to All Points Automotive & Towing, Inc.; and,
WHEREAS, the Borough followed the procedures described in N.J.S.A.39:10A-1 et seq, to notify the
registered owner of the abandoned vehicle so they could make arrangements to collect the vehicle; and,
WHEREAS, the registered owner of the abandoned vehicle did not respond or collect their vehicle, so the
Borough applied to the New Jersey motor Vehicle Commission for title to the vehicle; and,
WHEREAS, the motor vehicle is incapable of being operated safely or of being put in safe operational
conditional except at a cost in excess of the value of the vehicle, so a junk title was obtained, which
restricts the use of the vehicle to only parts or scrap; and,
WHEREAS, the value of the parts or scrap is less than the tow fees owed on the vehicle, $6,832.06; and,
WHEREAS, it is recommended that the junk title for the vehicle be signed over to All Points Automotive
and Towing Inc., to settle the outstanding tow fees.
NOW, THEREFORE, BE IT RESOLVED that the Municipal Council of the Borough of Waldwick hereby
approve the junk title for the above-mentioned vehicle be signed over to All Points Automotive and
Towing Inc., and authorize the Administrator to sign over title.

Award Non-Fair and Open, Open-Ended Contract with Agra Environmental & Lab Services in an Amount
Not to Exceed $40,000.00
WHEREAS, the Borough requires ongoing water sampling tests to ensure the safety and quality of the
Waldwick water system; and,
WHEREAS, Agra Environmental & Lab Services has been determined to be the most advantageous
provider of water sampling tests, cost and other factors considered; and,
WHEREAS, the Borough seeks to enter an open-ended contract with Agra Environmental & Lab Services
for an amount not to exceed $40,000.00; and,
WHEREAS, Agra Environmental & Lab Services will provide equipment and service by request only; the
Borough is not obligated to order, accept, or pay for services except when it orders them; and,
WHEREAS, pursuant to N.J.A.C. 5:30-5.5(b), a certification of funds is not required for this contract; and,
WHEREAS, this contract will terminate December 31, 2023; and,
WHEREAS, this contract is being awarded as a non-fair and open and is in conformance with the provisions
of N.J.S.A. 19:44A-20.4 et seq.; and,
WHEREAS, Agra Environmental & Lab Services has completed and submitted a Business Entity Disclosure
Certification which certifies Agra Environmental & Lab Services has not made any reportable contributions
to a political or candidate committee in the Borough of Waldwick in the previous one year, and that the
contract will prohibit Agra Environmental & Lab Services from making any reportable contributions
through the term of the contract.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick authorize
Agra Environmental & Lab Services, 90½ West Blackwell Street, Dover, NJ 07801 for ongoing water sampling
tests in an open-ended contract not to exceed $40,000.00; and,
BE IT FURTHER RESOLVED that the Municipal Clerk is hereby authorized to advertise notice of same in the
official newspaper of the municipality as provided by law.

WHEREAS, the Borough requires ongoing chemicals to ensure proper safety standards are met at the
Borough Pool; and,
WHEREAS, Miracle Chemical Company has been determined to be the most advantageous provider of
pool chemicals, cost and other factors considered; and,
WHEREAS, the Borough seeks to enter an open-ended contract with Miracle Chemical Company for an
amount not to exceed $40,000.00; and,

not to exceed $40,000.00; and,

Award Non-Fair and Open, Open-Ended Contract with Neal Systems Incorporated in an Amount Not to
Exceed $25,000.00
WHEREAS, the Borough periodically requires chlorine monitoring and pumps for the Borough pool and
water wells; and,
WHEREAS, Neal Systems Incorporated has been determined to be an advantageous provider of chlorine
monitoring and pumps, cost and other factors considered; and,
WHEREAS, the Borough seeks to enter an open-ended contract with Neal Systems Incorporated for an
amount not to exceed $25,000.00; and,
WHEREAS, Neal Systems Incorporated will provide equipment and service by request only; the Borough
is not obligated to order, accept, or pay for services except when it orders them; and,
WHEREAS, pursuant to N.J.A.C. 5:30-5.5(b), a certification of funds is not required for this contract; and,
WHEREAS, this contract will terminate December 31, 2023; and,
WHEREAS, this contract is being awarded as a non-fair and open and is in conformance with the provisions
of N.J.S.A. 19:44A-20.4 et seq.; and,
WHEREAS, Neal Systems Incorporated has completed and submitted a Business Entity Disclosure
Certification which certifies Neal Systems Incorporated has not made any reportable contributions to a
political or candidate committee in the Borough of Waldwick in the previous one year, and that the
contract will prohibit Neal Systems Incorporated from making any reportable contributions through the
term of the contract.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick authorize
Neal Systems Incorporated, 122 Terry Drive, Newtown, PA 18940 for chlorine monitoring and pumps in
an open-ended contract not to exceed $25,000.00.

Amount Not to Exceed $25,000.00
WHEREAS, the Borough vehicle maintenance to ensure its street sweepers can operate properly; and,
WHEREAS, Northeast Sweepers and Rentals, Inc., has been determined to be an advantageous provider
of sweeper maintenance, cost and other factors considered; and,
WHEREAS, the Borough seeks to enter an open-ended contract with Northeast Sweepers and Rentals,
Inc., for an amount not to exceed $25,000.00; and,
WHEREAS, Northeast Sweepers and Rentals, Inc., will provide equipment and service by request only; the
Borough is not obligated to order, accept, or pay for services except when it orders them; and,
WHEREAS, pursuant to N.J.A.C. 5:30-5.5(b), a certification of funds is not required for this contract; and,
WHEREAS, this contract will terminate December 31, 2023; and,
WHEREAS, this contract is being awarded as a non-fair and open and is in conformance with the provisions

WHEREAS, Northeast Sweepers & Rentals, Inc., total aggregate awards, including this award, will exceed
the Pay-to-Play limit of $17,500 over a one-year period; and,
WHEREAS, Northeast Sweepers and Rentals, Inc., has completed and submitted a Business Entity
Disclosure Certification which certifies Northeast Sweepers and Rentals, Inc., has not made any reportable
contributions to a political or candidate committee in the Borough of Waldwick in the previous one year,
and that the contract will prohibit Northeast Sweepers and Rentals, Inc., from making any reportable
contributions through the term of the contract.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick authorize
Northeast Sweepers and Rentals, Inc., 20 Montesano Road, Fairfield, NJ 07004 for vehicle maintenance in
an open-ended contract not to exceed $25,000.00.
