REGULAR MEETING MINUTES: 1 JANUARY 24, 2023 MINUTES FOR THE REGULAR MEETING OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK HELD ON TUESDAY, JANUARY 24, 2023 AT 7:30 PM Mayor Giordano called the meeting to order and read the Statement of Compliance. Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Ms. Cericola, Mr. Ritchie, Mr. Sciolaro, Mrs. Sherman and Mrs. Weber. Mr. Schatz was absent. Mrs. Weber was on the phone. Also present: Patrick Wherry, Borough Administrator; Matthew Guilder, Grants Administrator; Kelley Halewicz, Municipal Clerk and Craig Bossong, Municipal Attorney. Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of silence honoring our Veterans and to remain standing for the prayer. PROCLAMATIONS & PRESENTATIONS a. Recognition of William Schmidt Mayor Giordano presented Billy Schmidt with a Certificate of Recognition and gift certificate for his 40 years of service to the Borough of Waldwick as an employee in the Department of Public Works. Mr. Schmidt commented that he will miss all of his co-workers and thanked the Mayor and Council for the recognition. Mr. Schmidt also commented that he was born and raised in Waldwick and now after 57 years, there will no longer be a Schmidt working for the Borough. He is staying town. Mayor Giordano then presented Ray Schmidt with a Certificate of Recognition for his 13 years on the Planning Board. MAYOR’S REPORT AND REPORTS OF COMMITTEES Mayor’s Report. Mayor Giordano discussed the Chamber of Commerce meeting where they discussed the 5K Run, the new slate of officers and while they have some new members, they are always looking for new members. Mayor Giordano, Councilwoman Cericola and Mrs. Halewicz attended the ribbon cutting at the new nail salon that opened next to Red Bowl, owned by the same person. Financial & Administrative Committee. Mr. Sciolaro discussed the scheduling of the Council Special Budget Meetings. The budget will need to be wrapped up in early March for introduction on March 14. Mr. Sciolaro reported that Heather Del Piano was appointed as the Superintendent’s Liaison and Mr. Sciolaro was appointed as the Mayor’s Liaison to the Library Board. The Library Board also swore in the new Board and adopted the 2023 Library Budget. Fire & Police Protection Committee. Ms. Cericola reported for the Police Department that on 1/17 at approximately 10:00 PM, Officer LoPrinzi observed a 2018 Honda CRV commit several motor vehicle violations on Wyckoff Avenue. A Ramsey resident was stopped and placed under arrest for DWI. In addition to DWI, the driver was issued summons for failure to maintain lane and open containers in a motor vehicle. Sgt. Sinclair and Officer Chaney assisted. REGULAR MEETING MINUTES: 2 JANUARY 24, 2023 Approximately 12 hours later, Waldwick Police received a report of motor vehicle that struck a pole on Harrison Avenue and left the scene. Responding officers identified a witness to the crash and collected evidence left at the scene that allowed Waldwick Police Officers Sanchez, Freeman and Van Dyke to track the vehicle to the driveway of an Allendale residence. The Allendale woman was placed under arrest for DWI. She was also charged with leaving the scene of an accident with property damage, failure to report an accident, reckless driving and failure to maintain lane. On January 21st at 1:56 AM, Officer Walsh made a motor vehicle stop after observing that a motor vehicle failed to stop at a stop sign at the intersection of Walter Hammond Place and Wyckoff Avenue. Following field sobriety tests the driver, a Waldwick resident, was placed under arrest and transported to police headquarters. The driver subsequently submitted breath samples and was charged with Disregard of a Stop Sign, DWI and Careless Driving. Also, on January 21st at 11:43 PM, P.O. Wanamaker stopped a motor vehicle for failing to come to a complete stop at the intersection of Harrison Avenue and Wyckoff Avenue. The driver, a Fort Lee resident, was processed at police headquarters and issued summonses for DWI, Open Container of Alcohol or Unsealed Cannabis in a Motor Vehicle, Disregard of a Stop Sign and Reckless and Careless Driving. Ms. Cericola reported for the Fire Department that so far for January, the Department has responded to 11 calls for service, 3 of them being mutual aid. The Department had two drills so far; one was the inventory and inspection of the entire department’s rope and equipment. This inspection happens at minimum once a year to ensure all rope is safely in working order. Their second drill focused on the year FAST team refresher. The department responds as a FAST team to multiple agencies in our mutual aid as a FAST team, so this yearly refresher allows members to review the tools and equipment needed. Hands on training also happens every year. While doing all of that, members are performing their annual mask fit testing. This is a New Jersey State requirement that MUST be fulfilled by any member who responds to Fire calls. Public Safety Committee. Mrs. Sherman reported that she attended the Ambulance Corps meeting and was able to meet more of the members. The members took the time to explain details to her and welcomed her as their liaison. President of WALVAC, Dave Barthold announced his appointments. At the meeting, they discussed training and recertification opportunities for members. Members are required to take so many classes and recerts per year. Their scholarship opportunity for HS students has been posted. WALVAC has their ongoing fundraising campaign and want to remind residents that they are always available and could use some financial assistance from residents to purchase medical supplies, water and training sessions. They need to replace several epi-pens and they cost hundreds of dollars each. WALVAC would like to know of any upcoming standby needs so they can schedule the volunteers. They are hoping to have a schedule of events, perhaps for the year, as soon as possible so they can plan accordingly. There are several problems with the building: push bar is not working on the door; light by the back door is out and the Ladies Room door is cracked and broken. These may have already been brought to Patrick Wherry by the President. The Wednesday night crew chief, Ben Hymson, gave a report that they had a CPR save and helped deliver a baby in route to the hospital. Mrs. Sherman wanted to know if we can bring the four members of the crew to a council meeting to honor them and perhaps present them with a certificate or something. REGULAR MEETING MINUTES: 3 JANUARY 24, 2023 They discussed that the Bathrooms and the Kitchens are budgeted to be renovated. Mrs. Sherman was unsure if this is from last year’s budget. On February 23, there will be a library presentation and they were asked to come and discuss the Corps with the children and show the ambulance. Members were happy with this opportunity. Mrs. Sherman wanted to acknowledge how dedicated the members of WALVAC are and applaud them for all the work they do for our residents. She looks forward to their next General Meeting. Recreational & Health Committee. Mrs. Weber reported that the Board of Health meeting was. Mrs. weber was unable to attend but was provided a summary of the meeting. The Board reappointed Kathy Hillringhouse as President and Donna Palladino as Vice President for 2023. The Board discussed various health education programs they would like to present to the community this year. Members of the Board, Health Officer Namitha Reddy and our new local health outreach coordinator Alexandra Fox, MPH, CHES® will meet with the Golden Club to ask them what types of programs they would like to see this year. Other topics include suicide prevention, anxiety and depression. The next meeting is March 16 and she will be able to attend that meeting. Mrs. Weber reported on the Recreation side that the summer concert series is moving along nicely with bands being scheduled. There are 122 days until the pool opens. The clerk’s office will start working on setting up the programs for online registration soon. Public Works Committee. Mr. Ritchie reported that the first monthly Bulk Collection went smoothly. The next pickup is February 16 and residents must call the Clerk’s office to schedule the pickup. It is snow season and there may be snow tomorrow, please refer to the back of your calendar for the snow removal rules. Mr. Ritchie attended the Board of Education meeting last night where a new trustee was sworn in, ongoing budget discussions and they are moving to phase 3 at the high school in February. Also, Waldwick High School hockey is new to Waldwick and the puck from the first goal scored was put on display and will be preserved as part of the school’s history. Buildings & Grounds Committee. Mr. Schatz was absent but Mayor Giordano reported that the Building Rehabilitation will begin in the next 30 days, the parking lot lighting upgrades were done this week. The remainder will be completed in the Spring once the trees and flowers are planted. Also, Mr. Schatz has discussed with Mr. Wherry the administration needs for the 2023 budget. PSE&G lighting upgrade will take place at the end of February. DEPARTMENT HEAD REPORTS Administrator. Mr. Wherry had no report. Municipal Clerk. Mrs. Halewicz had no report. Grants Administrator. Mr. Wherry discussed Resolution No. 2023-81 and explained that this is a contract amendment with Boswell for the Design, Construction Administration, and Inspection Services for Water Treatment at Various Wells. There is additional work that is required and therefore, the contract needs to be amended. Mr. Sciolaro discussed Resolution No. 2023-84 to explain that these are from our 2022 budget and the Borough is just balancing our line items. This is not new money. Mrs. Sherman asked about check #18687 for $500 to Cantor Ellen Tilem for the Menorah Lighting. She asked if other religious organizations charge for services? Mayor Giordano responded he knew about the charge. The others are local and therefore typically do not charge. The Borough no longer has a Rabbi in town and last year Cantor Tilem performed that service for free. This year there was a charge for the blessing of the new menorah and the service. INTRODUCTION OF ORDINANCE(S) Mayor Giordano asked the Clerk to read Ordinance No. 2023-#01 by title. Ordinance No. 2023-#01 - AN ORDINANCE TO CREATE CHAPTER 35 BUSINESS INSURANCE REGISTRY AND REQUIRING LIABILITY INSURANCE AND ANNUAL REGISTRATION REQUIREMENTS FOR BUSINESSES AND OWNERS OF A RENTAL UNIT OR UNITS IN THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF WALDWICK Council Comments. Mr. Sciolaro commented that this is a new state law for businesses and multi-family rental units to provide proof of a certain level of insurance coverage to the Borough on a yearly basis and for the Borough to maintain those records. We are merely complying with the law. Mayor Giordano stated that a motion is in order to move and pass the ordinance on first reading and that it be advertised in the official newspaper of the municipality as required by law, setting a public hearing for Tuesday, February 14, 2023 at 7:30 pm or as soon thereafter as the matter may be heard. Ordinance No. 2023-#02 - AN ORDINANCE AMENDING CHAPTER 29 ALCOHOLIC BEVERAGES, SECTION 29- 12 HOURS OF OPERATION RESTRICTED TO CLARIFY RESTRICTED HOURS, SEVEN (7) DAYS A WEEK Council Comments. Mr. Wherry commented that the Police Department requested that this Borough code be updated to make it consistent that for every day of the week, licensed premises in town cannot sell, serve, or deliver alcohol from 2:00 am – 11:00 am. The current code provides operating hour exceptions for New Year’s Day when it falls on a weekday and when it falls on a Sunday, and these exceptions were found by the Police Department to be confusing and unnecessary. Council Member Motion Second Ayes Nays Abstain Absent Cericola X X Ritchie X Schatz X Sciolaro X X Sherman X Weber X Mayor Giordano UNFINISHED BUSINESS Mayor Giordano spoke with an Eagle Scout candidate who was going to renumber doors and areas in Tamaron; however, he is now going to continue the trail his sister started as her Eagle Scout Project in Brookview Park. Once he provides the paperwork, he will come in for a presentation to the Council. NEW BUSINESS – None. PUBLIC COMMENT Mayor Giordano asked if any member of the public wished to come forward and to discuss anything and if so, please state your name and address for the record. Michael McHugh, 79 Bergen Avenue asked about the strips in street near his home and if they were part of the traffic study. Mr. McHugh wished the strips were left for a longer period of time to include the weekend. Mr. Wherry responded that they were and were there for a 24 hours period. Mr. McHugh reviewed the 4½ years of crash data he received from Lt. Seifert for the streets in high immediate area and presented that data to the Council for those cars coming onto or off Route 17. 55 accidents; 28 intersections and 27 onto or off Route 17. About a 50%-50% split and one fatal accident. On Bergen Avenue alone there were 9 incidents, 5 coming off and 4 going on Route 17 where accidents were caused. The property at 190 Summit has had house or property hit 8 times or more than once a year over the 4½ year period. 22 accidents resulted in property damage. Route 17 accidents were 91% were the fault of out-of-town individuals. Mr. McHugh will be reviewing his analysis with Lt. Seifert. Professional Services costs may be reimbursed from grant award’s unexpended balance, should there be a balance. Motion: ______ Seconded: ______ Roll Call: _____ _____ _____ _____ _____ _____ _____ Cericola Ritchie Schatz Sciolaro Sherman Weber Giordano Ordinance No. 2023-#01 AN ORDINANCE TO CREATE CHAPTER 35 BUSINESS INSURANCE REGISTRY AND REQUIRING LIABILITY INSURANCE AND ANNUAL REGISTRATION REQUIREMENTS FOR BUSINESSES AND OWNERS OF A RENTAL UNIT OR UNITS IN THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF WALDWICK WHEREAS, Governor Murphy signed into law S-1368 requiring all business owners and owners of multifamily rental units to maintain certain levels of liability insurance; and WHEREAS, S-1368 also requires all business owners and owners of multifamily rental units to annually register a certificate of insurance with the municipality where the business or rental unit is located; and WHEREAS, S-1368 authorizes municipalities to charge a reasonable administrative fee for the certificate of registration and provides for the collection of a fine for the failure to file the certificate of insurance annually. NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Council of the Borough of Waldwick, County of Bergen, State of New Jersey, the following section is added as follows: Chapter 35 BUSINESS INSURANCE REGISTRY. 35-1 Businesses and Owners of a Rental Unit or Units Registration Required. The owner of a business, owner of a rental unit or units, and the owner of a multifamily home of four or fewer units, one of which is owner occupied, shall annually register a certificate of insurance with the Borough Clerk, on or before February 1st of each year or within thirty (30) days of obtaining ownership of the property. 35-2 Registration Fee. There shall be an annual administrative fee in the amount of $25.00. 35-3 Liability Insurance Requirements for Registration. Except as provided in subsection b. of this section, the owner of a business or the owner of a rental unit or units shall maintain liability insurance for negligent acts and omissions in an amount of no less than $500,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence. The owner of a multifamily home which is four or fewer units, one of which is owner occupied, shall maintain liability insurance for negligent acts and omissions in an amount of no less than $300,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence. 35-4 Penalty Failure to annually register a certificate of insurance on or before February 1st of each year, of within thirty (30) days of obtaining ownership of the property, shall result in a fine of $500.00 which shall be collected through a summary proceeding pursuant to the “Penalty Enforcement Law of 1999”, P.L. 1999, c. 274 (C.2A-58-10, et seq.) All provisions of this ordinance are severable. If for any reason, any provision of this ordinance is held to be invalid, the validity of the remainder of the ordinance shall not be affected. This ordinance shall take effect upon final passage and publication thereof required by law.
