MINUTES FOR THE REGULAR MEETING
OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK
HELD ON TUESDAY, FEBRUARY 14, 2023 AT 7:30 PM
Mayor Giordano called the meeting to order and read the Statement of Compliance.
Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Mr. Ritchie, Mr. Schatz, Mr.
Sciolaro, Mrs. Sherman and Mrs. Weber. Ms. Cericola arrived at 7:33 pm.
Also present: Patrick Wherry, Borough Administrator; Matthew Guilder, Grants Administrator; Kelley
Halewicz, Municipal Clerk and Craig Bossong, Municipal Attorney.
Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of
silence honoring our Veterans and to remain standing for the prayer.
MAYOR’S REPORT AND REPORTS OF COMMITTEES
Mayor’s Report. Mayor Giordano attending the NWBMA meeting with the County Executive Jim Tedesco.
They discussed garbage, water and shared services. At their March meeting, they will further discuss
shared services to see what opportunities there may be to further share services.
Mayor Giordano attended the Chamber of Commerce meeting with the Clerk. Mayor Giordano discussed
the proposed ordinance eliminating the need to businesses to go before the Planning Board for tenant
review. There will be very limited reasons why a business would need to go before the Board. The Mayor
believes this makes the Borough more business friendly.
Mayor Giordano discussed the Veterans banners the Borough would like to do this year. The banners will
be on a first come, first serve basis. Clerk Halewicz explained the two types of banners and a rough cost
with the Chamber members.
Mayor Giordano will have the Ambulance Corps and Police department personnel attend the March 14
Council meeting so the Mayor and Council can recognize them.
Financial & Administrative Committee. Mr. Sciolaro commented that the Mayor and Council worked hard
on the budget and now starts the budget prep by our professionals. We had two budget meetings and
reviewed every detail of the 2023 municipal budget. We are looking to introduce on March 14 but a lot
has to happen before that.
Fire & Police Protection Committee. Ms. Cericola reported that the Fire Department ended January with
11 calls for service; 3 of those were mutual aid requests, including 1 house fire. Drills consisted of: annual
mask fit testing, in house FAST team refresher, annual rope inventory and inspection, as well as equipment
maintenance night.
Public Safety Committee. Mrs. Sherman reported that WALVAC answered 43 calls by 20 members. Mrs.
Sherman will attend their meeting on February 20 and have more to report at the next Council meeting.
Recreational & Health Committee. Mrs. Weber reported that the parks are clean and tidy thanks to the
warm weather. There will be a Board of Health meeting on March 16. Just a reminder Ho-Ho-Kus is having

a free Rabies Clinic on Thursday. NWBRHC uses social media to get important information out. February
is heart health month and they have quite a bit of information to share.
Public Works Committee. Mr. Ritchie reported that with the warmer weather DPW has been twist valves
as well as replace them. They are starting spring truck maintenance. The EJIF had an inspection and it
went well. There is also catch basin work being done now.
Buildings & Grounds Committee. Mr. Schatz reported that the parking lot project is done for now.
Landscaping will be installed in the spring as well as the top coat of asphalt in the parking lot. With regards
to Borough Hall, the sheet rock is back in place and the project should be completed by the end of March.
The Environmental Committee will put a compost seminar on at the Library on March 9. The Planning
Board meeting of February 1 there were no resolutions and two site tenant applications.
DEPARTMENT HEAD REPORTS
Administrator. No report.
Municipal Clerk. Mrs. Halewicz reported that Elected Officials training has been rescheduled for Tuesday,
April 11, 6 pm. The Borough receives a $250 credit per Council Member in attendance; please let her
know if you cannot attend.
Mrs. Halewicz reported that she and Tatiana will be attending the Bergen County Elections training. We
will find out the latest and what machines will be in use this year.
Mrs. Halewicz will be attending the MCANJ Conference, March 20 – 23 in Atlantic City. Classes include
Daniel’s Law, 1st Amendment Audits, Records Management, OPRA, NJLM Legislative Update as well as our
Annual Meeting.

Discussion. Mr. Schatz will recuse himself from the minutes of January 24, 2023 as he was not in
attendance.
Mr. Sciolaro commented on 2023-98 as the Ted Bell Park Rehabilitation project was award with a grant
and matching funds from Borough. The project came in under budget so they will take that rest of the
money that was not needed and return to the capital fund.
Mr. Wherry commented that Midland Park has a request for an additional day this year to use the
Waldwick Pool for campers.

PUBLIC HEARING & ADOPTION OF ORDINANCE(S)
Mayor Giordano asked the Clerk to read Ordinance No. 2023-#01 by title.
Ordinance No. 2023-#01 - AN ORDINANCE TO CREATE CHAPTER 35 BUSINESS INSURANCE REGISTRY AND
REQUIRING LIABILITY INSURANCE AND ANNUAL REGISTRATION REQUIREMENTS FOR BUSINESSES AND
OWNERS OF A RENTAL UNIT OR UNITS IN THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF
WALDWICK
Council comments. Mr. Sciolaro commented that this is being driven by the State to require businesses
and owners of rental unit(s) to provide liability insurance and annually register with the Borough.
Public comment. None.
Mayor Giordano closed the Public comment. Ordinance No. 2023-#01 was advertised and on second
reading is adopted. This ordinance will go into effect immediately after approval and publication according
to law.

Mayor Giordano asked the Clerk to read Ordinance No. 2023-#02 by title.
Ordinance No. 2023-#02 - AN ORDINANCE AMENDING CHAPTER 29 ALCOHOLIC BEVERAGES, SECTION 29-
12 HOURS OF OPERATION RESTRICTED TO CLARIFY RESTRICTED HOURS, SEVEN (7) DAYS A WEEK
Council comments. Mayor Giordano commented that this ordinance is to make the hours of operation
consistent for our bars and restaurants.
Public comment. Eric LaPorta, 3 Van Dan Place commented that the ordinance was not advertised
correctly and should be readvertised because the public does not know what the changes were that were
made.
The Council through voice vote, voted to readvertise this ordinance and hold the public hearing on
February 28, 2023.

Council Comments. Mr. Wherry explained this ordinance is to make changes to the code for 40 on-street
metered parking spaces. The physical meters have been removed and we have gone to a pay by phone
format. No change to the number of spaces or the price.
Mayor Giordano stated that a motion is in order to move and pass the ordinance on first reading and that
it be advertised in the official newspaper of the municipality as required by law, setting a public hearing
for Tuesday, February 28, 2023 at 7:30 pm or as soon thereafter as the matter may be heard.

Mayor Giordano asked the Clerk to read Ordinance No. 2023-#04 by title.
Ordinance No. 2023-#04 - AN ORDINANCE AMENDING CHAPTER 97 ZONING, ARTICLE IX SITE PLAN
REVIEW, SECTION 70 SITE PLAN APPROVAL REQUIRED, AND SECTION 71 SITE PLAN APPROVAL NOT
REQUIRED
Council Comments. Mayor Giordano explained that this is for Site Tenant Review by the Planning Board
which the Mayor and Mr. Schatz sit on. Businesses are currently required to go through this process which
can delay them a month or two before they can open their business. This is costly for a business just
trying to open up as well as having to hire an attorney to be at the meeting. In order to be business
friendly, Joe Mysliwiec will handle the majority of these administratively as he is most times involved with
new businesses opening in Waldwick for other approvals. The Mayor announced this proposed ordinance
at the Planning Board meeting last week.
Mr. Sciolaro commented that when someone is opening a business, they have to do a site review and
there is a cost to that business but if the same type of business is going in, it is redundant.
Mr. Bossong commented that it adds a lot of time for a business to come in. Leases are entered into, by
the time they send in their application, they could lose one or two months to go before the Board.

UNFINISHED BUSINESS
2023 Municipal Budget Discussion
Mr. Sciolaro discussed the work the Mayor and Council has put into this year’s budget. It seems as though
the capital budget portion of the budget is a little more, clear cut with just two items up in the air still.
First the acquisition of a park which is still in the budget although it is yet to be determined if this will
move forward. Second is the fire truck which the Council has requested additional information on but is
also still in the capital budget.
Each department submits requests and the Administrator and CFO review the requests, knocking out
some items prior to putting the preliminary budget for the Mayor and Council to start working on.
Additionally, there were presentations by the Police department and Fire department. The final decisions
depend on what information is provided but they are still in the capital budget.
Mr. Wherry explained that he has reached out to HCA Park last week and will follow up.
Mr. Sciolaro discussed on the operating budget side, there were challenges the Mayor and Council faced.
There were certain items that saw significant increases and resulting in increases in the overall budget.
There are rules that the State provides for the two caps (tax and appropriations). The Borough’s budget
was $153,000 over the State mandated cap and if we added in all the items, we were $232,000 over cap.
The DLGS provided some relief as the moved some of those items that saw significant increases out of
cap. This amounts to $450,000 in relief and we can approve the budget as presented and still be under
cap.
However, the Council still wanted to make cuts. The Council Members discussed the proposed scanning
and storage of records $40,000. A straw poll indicated that this item should remain in the budget along
with Police accreditation and partial payment of the high visibility jackets.

• Community TV - Eliminate contribution $1,000
• PD - Remove retrofit for extra rifle $2,300
• FD - Reduce for end of year spending $1,500
Reductions from Savings
• Salt - Reduce from $100,000 $50,000
• DPW OT $40,000
• Leaf disposal $25,000
• Grass disposal $10,000
• Electricity $10,000
• Medical $30,000
• Legal appeals $17,500
• Reserve for tax appeals $15,000
For a total of $245,000 in cuts.
The Mayor and Council requested the spreadsheets be updated and sent out to them by the end of the
week. Also, the roads to be paved should be sent to the Mayor and Council. Those who wish to take a
look at the roads to be paved and any other road that you may believe is a higher priority. There are
$900,000 in capital for roads some of which is with matching grants.
NEW BUSINESS
Hiring of Building Maintenance employee
Mr. Wherry explained that the our building maintenance employee is retiring and he would like to
advertise for the position. The Mayor and Council were in agreement on advertising for the position.
Mrs. Sherman discussed being invited to the Girl Scout Pinewood Derby on February 4 as a judge. When
she arrived the Boy Scout Pinewood Derby was in progress. Mrs. Sherman wanted to congratulate the
Girl Scouts and their parents on the very decorative cars. The high school Girl Scouts as well as Boy Scouts
and Eagle Scouts assisted with the race.
Facility fees
Mr. Wherry discussed the facility fees that the Council was interested in and if we an agree on these fees,
he will draw up an ordinance. Council Members discussed the various fees for facilities. On straw poll,
the Council will not charge Waldwick residents a fee to use the pavilions. On straw poll, the Council will
charge for the use of the tennis courts, maximum of two.

PUBLIC COMMENT
Mayor Giordano asked if any member of the public wished to come forward and to discuss anything and
if so, please state your name and address for the record.
Al Coldon, 34 Dante Place wanted to know if he could have chickens to save some money. He is also
looking for somewhere to donate closed in Bergen County.
Janet Hascup, 98 Longview Drive spoke to the issue of the garbage increase. Mr. Wherry explained that
if the Borough did not take the measures we did to save money, the increase would have been 80%.
Eric LaPorta, 3 Van Dan Place spoke to the issue of the fire in Midland Park and the family is in need of
clothing. Nellie’s is handling the collection. Also, a reminder that it is National Donor Week and there are
93,000 people in need of a kidney.
Colleen Ennis, CFO/Tax Collector spoke to the issue of the Senior Tax Freeze that the books are being
mailed. The Homestead Rebate is no more and has been replaced by the ANCHOR program. These checks
are mailed directly to the owner as it provides flexibility. Qualified recipients can receive up to $1,500
and the applications are due by February 28.
Greg Doctor, 56 Richard Drive spoke to the issue of the water and not happy with the 2023/2024 timeline
in the last letter to residents.
Coral Weber, 42 Zazzetti Street, rear house spoke to the issue of the water crisis that she does not feel
anyone is taking seriously.

Authorize the Renewal of the Group Dental Benefits Program for Eligible Employees and Their Covered
Dependents Through Delta Dental of New Jersey, Inc.
WHEREAS, the Borough of Waldwick, hereinafter referred to as the Borough, provides a comprehensive
dental benefits program for eligible employees and their covered dependents as part of the
comprehensive Employee Health Benefits Program; and,
WHEREAS, the Borough’s Health Benefits Consultant, as a matter of due diligence, reviewed the plan
usage, claims data and network utilization and further, engaged in active negotiations for the renewal of
the Borough’s Dental Program, which currently consists of the Premier/Advantage, administered by Delta
Dental of NJ, Inc. and,
WHEREAS, the Consultant was successful through negotiation in securing a renewal for the
Premier/Advantage Plan, that:
• Provides a rate increase of 2.5% for a 24-month period; and
• Maintains the existing level of benefit.
NOW, THEREFORE BE IT RESOLVED, the Mayor and Council of the Borough of Waldwick, County of Bergen,
State of New Jersey, hereby authorize the renewal of the dental benefits contract with Delta Dental of
New Jersey for a 24-month period, January 1, 2023 through December 31, 2024; and,
BE IT FURTHER RESOLVED, the Governing Body does hereby authorize and affirm the implementation of
this renewal, which maintains the current plan design of benefits; thereby ensuring the moral and
contractual obligation of the Borough; and,
BE IT FURTHER RESOLVED, the Borough Administrator is hereby authorized and directed to execute the
renewal documents in accordance with the existing terms and conditions of the Agreement with the
renewal rate provisions, as promulgated herewith; and,
BE IT FURTHER RESOLVED, the contract award is to a duly licensed and admitted Insurance Company
within the State of NJ and therefore, such award is exempt from the requirements set forth by P.L. 2004,
Chapter 19 (as amended by P.L. 2005, c.51) N.J.S.A.19:44A-20.5 et seq.
BE IT FURTHER RESOLVED, a certified copy of this Resolution shall be forwarded to PIA Security Programs,
A Division of World Insurance Associates, LLC, 429 Hackensack Street, P.O. Box 818 Carlstadt NJ, Health
Benefits Consultant to the Borough, the Borough Chief Financial Officer and Municipal Auditor.

WHEREAS, the Water Department requires hydrogeological and drinking water compliance advisory
services; and,
WHEREAS, H2M Architects & Engineers submitted the attached proposal with labor rates; and,
WHEREAS, the New Jersey Local Public Contracts Law authorizes the award of contract for "Professional
Services" without competitive bids; and,
WHEREAS, H2M Architects & Engineers total aggregate awards, including this award, will exceed the Pay-
to-Play limit of $17,500 over a one-year period; and,

WHEREAS, the Waldwick Volunteer Fire Department needs to purchase bail out systems; and,
WHEREAS, the Borough solicited multiple quotes and found CMS Rescue Inc., LLC quote dated January 19,
2023 in the amount of $18,000 to be the most advantageous to the Borough, cost and other factors
considered; and,
WHEREAS, CMS Rescue Inc., total aggregate awards, including this award, will exceed the Pay-to-Play limit
of $17,500 over a one-year period; and,
WHEREAS, this contract is being awarded as a non-fair and open and is in conformance with the provisions
of N.J.S.A. 19:44A-20.4 et seq.; and,
WHEREAS, CMS Rescue Inc., has completed and submitted a Business Entity Disclosure Certification which
certifies CMS Rescue Inc., has not made any reportable contributions to a political or candidate committee
in the Borough of Waldwick in the previous one year, and that the contract will prohibit CMS Rescue Inc.,
from making any reportable contributions through the term of the contract; and,
WHEREAS, the Chief Financial Officer of the Borough of Waldwick has certified that $18,000.00 is available
in the following appropriation: G-04-56-479-553, and has further certified that this commitment together
with all previous commitments and payments does not exceed the funds available in said appropriation.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick authorize
CMS Rescue Inc., 6740 Cortona Drive, Goleta, CA 93117 for firefighter bail out systems in the amount of
$18,000.00.

RESOLUTION NO. 2023-93
Approving the Transfer of Junk Title to All Points Automotive & Towing Inc.
WHEREAS, on April 25, 2022, the Borough came in to possession of a 1997 Ford F-150 due to the motor
vehicle being abandoned, at which time the vehicle was impounded to All Points Automotive & Towing,
Inc.; and,
WHEREAS, the Borough followed the procedures described in N.J.S.A.39:4-56.5A et seq, to notify the
registered owner of the abandoned vehicle so they could make arrangements to collect the vehicle; and,
WHEREAS, the registered owner of the abandoned vehicle did not respond or collect their vehicle, so the
Borough applied to the New Jersey motor Vehicle Commission for title to the vehicle; and,
WHEREAS, the motor vehicle is incapable of being operated safely or of being put in safe operational
conditional except at a cost in excess of the value of the vehicle, so a junk title was obtained, which
restricts the use of the vehicle to only parts or scrap; and,
WHEREAS, the value of the parts or scrap is less than the tow fees owed on the vehicle, $8,524.32; and,
WHEREAS, it is recommended that the junk title for the vehicle be signed over to All Points Automotive
and Towing Inc., to settle the outstanding tow fees.
NOW, THEREFORE, BE IT RESOLVED that the Municipal Council of the Borough of Waldwick hereby
approve the junk title for the above-mentioned vehicle be signed over to All Points Automotive and
Towing Inc., and authorize the Administrator to sign over title.

RESOLUTION NO. 2023-94
Authorize Midland Park Continuing Education Summer Camp to Use the Waldwick Municipal Pool for
their Campers
WHEREAS, the Midland Park Continuing Education Summer Camp, run by the Midland Park Board of
Education, requested the use of the Waldwick Municipal Pool for their campers; and,
WHEREAS, approximately 15-30 campers, ages 5-11, will be give admission two days per week; and,
WHEREAS, the dates are June 26 – August 11, from 1:15 pm to 3:15 pm; and,
WHEREAS, the fee will be set at $5.00 per camper per day; and,
WHEREAS, there will be a ratio of one counselor for every five (5) campers; and,
WHEREAS, the campers will follow the rules and regulations on the Waldwick Municipal Pool; and,
WHEREAS, a certificate of insurance and hold harmless will be provided by Midland Park Board of
Education.
NOW, THEREFORE, BE IT RESOLVED that the Municipal Council of the Borough of Waldwick hereby
authorize Midland Park Continuing Education Summer Camp to use the Waldwick Municipal Pool for their
campers in accordance with the terms stated above.

RESOLUTION NO. 2023-95
Approval of Termination and Retirement of William Schmidt
WHEREAS, the Department of Public Works employee William Schmidt has provided written notice to the
Borough of Waldwick that he intends to terminate his employment with the Borough of Waldwick
effective January 31, 2023; and,
WHEREAS, at the time of termination William Schmidt had accumulated 17 days and 7 hours of vacation
time and 152 days and 4.5 hours of sick time (of which a maximum of 130 days can be used toward
terminal leave); and,
WHEREAS, per the Public Works Association’s union agreement, William Schmidt will exhaust his
accumulated sick days which will result in an effective retirement date of August 1, 2023; and,
WHEREAS, William Schmidt will be paid a lump sum of $8,265.38 for his 17 days and 7 hours of unused
vacation time.
NOW, THEREFORE, IT BE RESOLVED that the Mayor and Council of the Borough of Waldwick hereby
approves Williams Schmidt’s termination date of January 31, 2023; and,
BE IT FURTHER RESOLVED the Mayor and Council of the Borough of Waldwick hereby approves the use of
William Schmidt’s 130 unused sick days as terminal leave resulting in an effective retirement, date of
August 1, 2023; and,
BE IT FURTHER RESOLVED the Mayor and Council of the Borough of Waldwick hereby approves the lump
sum payout of $8,265.38 for William Schmidt’s unused 17 days and 7 hours of vacation time.

Cancellation and Refund of Taxes, Block 35/Lot 77
WHEREAS, Richard W. Meyersburg, who resides at Block 35 Lot 77, 89 Bergen Avenue, is a 100% Disabled
Veteran as so stated by the Department of Veterans Affairs, and,
WHEREAS, this parcel becomes eligible for this exemption as of January 12, 2023.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of Waldwick hereby
authorize the Tax Collector to cancel taxes from January 12, 2023 through March 31, 2023 in the amount
of $1,991.69 and furthermore authorize the Tax Collector to cancel the taxes for the second quarter taxes
for Tax Year 2023; and,
BE IT FURTHER RESOLVED, that said property shall remain exempt as long as it qualifies for the 100%
Disabled Veterans exemption pursuant to law.

Authorize the Colleen Ennis, CFO to Maintain a Petty Cash Fund in the Amount of $400.00
WHEREAS, N.J.S.A. 40A:5-21 authorizes the establishment of a Petty Cash Fund for the Finance Office of
the Borough of Waldwick; and,
WHEREAS, said Petty Cash Fund was established by resolution dated February 10, 2004 by the Municipal
Council of the Borough of Waldwick; and,
WHEREAS, said Petty Cash Fund received approval from the Director of Local Government Services on
May 17, 2004; and,
WHEREAS, it is the desire of the Municipal Council that said fund be established and be allowed to
continue under the control of the CFO.
NOW THEREFORE, BE IT RESOLVED, by the Municipal Council of the Borough of Waldwick, County of
Bergen, State of New Jersey as follows:
1. Colleen Ennis, CFO, be and is hereby appointed custodian of petty cash and is authorized and
permitted to establish a Petty Cash Fund in the amount not to exceed $400.00 pursuant to the
provisions of N.J.S.A. 40A:5-21. Said Petty Cash Fund will be used by such office or department to
pay claims for small miscellaneous expenses not to exceed $50.00.
2. Colleen Ennis, CFO, having custody of the Fund be bonded in an amount not less than $1,000.00
and will maintain said Fund in accordance with the laws and regulations governing its operation.

WHEREAS, Tax Sale Certificate #22-00629 was sold to Christiana T C/F CE1/Firstrust for delinquent taxes
assessed on Block 148/Lot 42, known as 24 Schuler Avenue at a Tax Sale held on November 17, 2022; and,
WHEREAS, Tax Certificate #22-00629 should not have been issued because funds were received prior to
the sale on November 16, 2022 from PHH Mortgage Services in the amount to Stay out of Sale.
NOW, THEREFORE, BE IT RESOLVED that the Municipal Council of the Borough of Waldwick hereby direct
the following:

Ordinance No. 2023-#01 AN ORDINANCE TO CREATE CHAPTER 35 BUSINESS INSURANCE
REGISTRY AND REQUIRING LIABILITY INSURANCE AND ANNUAL
REGISTRATION REQUIREMENTS FOR BUSINESSES AND OWNERS
OF A RENTAL UNIT OR UNITS IN THE REVISED GENERAL
ORDINANCES OF THE BOROUGH OF WALDWICK
WHEREAS, Governor Murphy signed into law S-1368 requiring all business owners and owners of
multifamily rental units to maintain certain levels of liability insurance; and
WHEREAS, S-1368 also requires all business owners and owners of multifamily rental units to annually
register a certificate of insurance with the municipality where the business or rental unit is located; and
WHEREAS, S-1368 authorizes municipalities to charge a reasonable administrative fee for the certificate
of registration and provides for the collection of a fine for the failure to file the certificate of insurance
annually.
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Council of the Borough of Waldwick, County of
Bergen, State of New Jersey, the following section is added as follows:
Chapter 35 BUSINESS INSURANCE REGISTRY.
35-1 Businesses and Owners of a Rental Unit or Units Registration Required.
The owner of a business, owner of a rental unit or units, and the owner of a multifamily home of four or
fewer units, one of which is owner occupied, shall annually register a certificate of insurance with the
Borough Clerk, on or before February 1st of each year or within thirty (30) days of obtaining ownership
of the property.
35-2 Registration Fee.
There shall be an annual administrative fee in the amount of $25.00.
35-3 Liability Insurance Requirements for Registration.
Except as provided in subsection b. of this section, the owner of a business or the owner of a rental unit
or units shall maintain liability insurance for negligent acts and omissions in an amount of no less than
$500,000 for combined property damage and bodily injury to or death of one or more persons in any
one accident or occurrence.
The owner of a multifamily home which is four or fewer units, one of which is owner occupied, shall
maintain liability insurance for negligent acts and omissions in an amount of no less than $300,000 for
combined property damage and bodily injury to or death of one or more persons in any one accident or
occurrence.
35-4 Penalty
Failure to annually register a certificate of insurance on or before February 1st of each year, of within
thirty (30) days of obtaining ownership of the property, shall result in a fine of $500.00 which shall be
collected through a summary proceeding pursuant to the “Penalty Enforcement Law of 1999”, P.L. 1999,
c. 274 (C.2A-58-10, et seq.)
All provisions of this ordinance are severable. If for any reason, any provision of this ordinance is held to
be invalid, the validity of the remainder of the ordinance shall not be affected.
This ordinance shall take effect upon final passage and publication thereof required by law.

§ 29-12 Hours of operation restricted.
A. No licensee shall sell, serve or deliver or allow, permit or suffer the sale, service or delivery of any
alcoholic beverage or allow the consumption of any alcoholic beverage on the licensed premises
on New Year's Day when it is a weekday between the hours of 5:00 a.m. 2:00 a.m. and 7:00 a.m.
110:00 a.m.; seven (7) days a week. ; on New Year's Day when it is a Sunday between the hours of
5:00 a.m. and 11:00 a.m.; on other weekdays between the hours of 2:00 a.m. and 11:00 a.m.; on

and Traffic – Parking Meter Fees The changes to Code of the Borough of Waldwick below shows deletions

Chapter 91 Vehicles and Traffic
§ 91 – 16 Paid Metered Parking.
a. The areas adjacent to curb lines and within the following described streets or portions of streets are
hereby designated as paid parking meter zones. No person shall park a vehicle in a paid parking meter
zone except parallel with the curb and fully within a delineated paid parking meter space. Between the
hours listed (except Saturday, Sunday and public holidays), no person shall park a vehicle within a paid
parking meter zone without depositing the appropriate coin(s) in the parking meter adjacent thereto
nor allow a vehicle to remain parked when such meter indicates illegal parking. paying the appropriate
fees. Additionally, no vehicle shall remained parked when the time allotment has expired.
b. The parking meter fees shall be as set forth on § 48:91-12.2.
c. No unauthorized person shall open, deface, tamper with, destroy, or impair the usefulness of any
parking meter installed in accordance herewith.
§48:91-12.2 Vehicles and traffic - parking meter paid parking fees.
A. Paid pParking meter spaces shall be delineated in paid parking meter zones as herein established,
and parking signs meters shall be installed near adjacent to such paid parking meter spaces. Upon
payment, the parking vendor shall indicate on its mobile application the maximum uninterrupted time a
vehicle may remain parked within the paid parking space. Paid fees will be in the following increments.
Each parking meter shall be set to indicate, upon deposit of a twenty-five cent ($0.25) coin of the United
States of America, lawful parking for a period of consecutive hours from the time of such deposit as
follows:
(1) $0.50: two hours.
(2) $1: four hours.
(3) $1.50: six hours.
(4) $2.50: 12 hours.
B. Each parking transactions will be subject to a $.30 service charge.
BE IT FURTHER RESOLVED that the ordinance shall take effect upon publication and adoption as required
by law.

Chapter 97 Zoning
§ 97-70 Site plan approval required.
Except as provided in §§ 97-71 and 97-72 below, no person shall construct a new building, add to an
existing building or make any alteration to any building or part thereof, or permit or participate in a change
in occupancy of an existing building or part thereof, or alter, increase or reduce parking facilities or
vehicular or pedestrian ways or areas or landscaping, or make any other change in the layout, design or
plan of any premises, nor shall any building permit or certificate of occupancy therefor be issued until a
site plan therefore shall first have been approved by the Planning Board, or, where applicable, the Board
of Adjustment.
§ 97-71 Site plan approval not required.
A. Site plan approval shall not be required for construction or alteration of a detached lawful single one-
family or two-family dwelling unit or any lawful accessory use thereto, provided that the same are not
part of an attached housing, multiple-dwelling, planned unit development or development involving the
construction of more than one single family or more than one two-family dwelling unit.
B. Site plan approval shall not be required for any interior construction or interior alteration of any
building provided that it:
1. Does not involve the construction of a new building or the extension of an existing building, or an
increase in the total square footage of the building.
2. Does not require additional parking.
3. Does not affect existing parking facilities, vehicular or pedestrian circulation, drainage, relationship of
buildings to each other, buffering, landscaping, or lighting.
C. Site plan approval shall not be required for changes in occupancy of an existing building or part thereof.
All businesses must obtain an approved Business Zoning Permit from the Zoning Offer before occupying
a business location. At the discretion of the Zoning Officer, additional review may be required from the
Planning or Zoning Board.
BE IT FURTHER RESOLVED that the ordinance shall take effect upon publication and adoption as required
by law.
