NOW THEREFORE BE IT RESOLVED, that the Mayor and Council of the Borough of Waldwick hereby grants approval to the Bergen County Mosquito Control division to conduct aerial spraying for mosquito larvae as needed. Giordano, Mayor I hereby certify that the above Resolution was adopted by the Mayor and Council of the Borough of Waldwick at its Regular Meeting of February 28, 2023. _________________________________ Kelley Halewicz, RMC/CMC Municipal Clerk  MAYOR AND COUNCIL OF THE BOROUGH OF WALDWICK Bergen County, New Jersey RESOLUTION NO. 2023-107 (Page 1 of 2) Award Non-Fair and Open Contract to Heuer & Company for Pool Repairs $39,000.00 WHEREAS, the Waldwick Municipal pool is need of repairs; and, WHEREAS, the Borough solicited multiple quotes and found Heuer and Company’s proposal dated February 24, 2023 in the amount of $39,000 to be the most advantageous to the Borough, cost and other factors considered; and, WHEREAS, Heuer and Company’s total aggregate awards, including this award, will exceed the Pay-to-Play limit of $17,500 over a one-year period; and, WHEREAS, this contract is being awarded as a non-fair and open and is in conformance with the provisions of N.J.S.A. 19:44A-20.4 et seq.; and, WHEREAS Heuer and Company has completed and submitted a Business Entity Disclosure Certification which certifies Heuer and Company has not made any reportable contributions to a political or candidate committee in the Borough of Waldwick in the previous one year, and that the contract will prohibit Heuer and Company from making any reportable contributions through the term of the contract; and, WHEREAS, the Chief Financial Officer of the Borough of Waldwick has certified that $39,000.00 is available in the following appropriation XXXXX, and has further certified that this commitment together with all previous commitments and payments does not exceed the funds available in said appropriation. The changes to Code of the Borough of Waldwick below shows deletions to the code in strikethrough and additions in underline as follows: § 29-12 Hours of operation restricted. A. The areas adjacent to curb lines and within the following described streets or portions of streets are hereby designated as paid parking meter zones. No person shall park a vehicle in a paid parking meter zone except parallel with the curb and fully within a delineated paid parking meter space. Between the hours listed (except Saturday, Sunday and public holidays), no person shall park a vehicle within a paid parking meter zone without depositing the appropriate coin(s) in the parking meter adjacent thereto nor allow a vehicle to remain parked when such meter indicates illegal parking. paying the appropriate fees. A. Paid pParking meter spaces shall be delineated in paid parking meter zones as herein established, and parking signs meters shall be installed near adjacent to such paid parking meter spaces. Upon payment, the parking vendor shall indicate on its mobile application the maximum uninterrupted time a vehicle may remain parked within the paid parking space. Paid fees will be in the following increments. Each parking meter shall be set to indicate, upon deposit of a twenty-five cent ($0.25) coin of the United States of America, lawful parking for a period of consecutive hours from the time of such deposit as follows: (1) $0.50: two hours. (2) $1: four hours. (3) $1.50: six hours. (4) $2.50: 12 hours. B. Each parking transactions will be subject to a $.30 service charge. The changes to Code of the Borough of Waldwick below shows deletions to the code in strikethrough and additions in underline as follows: Chapter 48 Fees § 48:64-4.1 Parks – Tennis Courts tags and fees. Each person entering upon or using one of the tennis courts within any Borough park shall be required to display a tag or permit. Each resident of the Borough shall be entitled to purchase a nontransferable tennis tag or permit valid for one calendar year, the fee for which shall be $20. (1) There will be no fee to rent the Waldwick tennis courts for a Waldwick based non-profit. (2) Non-Waldwick based non-profits, and all for profit entities shall pay the following fees to rent Waldwick tennis courts: Fee Per Hour $50 Four Hour Period $150 Intermittent use each season $1,000 Intermittent use each year $1,500 (3) At no time shall more than two tennis courts be allowed to be rented out simultaneously. § 48:64-4.3 Parks – Veterans Field (1.) There shall be no fee for Waldwick Based non-profits to rent Veterans Field. (2.) Non-Waldwick based non-profits and all for profits entities shall pay the following fees to rent Veterans Field:  Fee Each Use $250 Intermittent use each month $700 Intermittent use each season $1,500 Intermittent use each year $3,000 § 48:1-10.4 Fee schedule for use of the second floor of the ambulance corps building Senior Center. (1.) Waldwick Residents shall pay a $150 fee for each rental of the Waldwick Senior Center. (2.) There shall be no fee for Waldwick Based non-profits to rent the Waldwick Senior Center. (3.) There shall be no fee for members of the Waldwick Fire Department or Waldwick Ambulance Corps. (4.) Non-Waldwick based non-profits and all for profits entities shall pay the following fees to rent the Waldwick Senior Center: Fee Each Use $250 Intermittent use each month $700 Intermittent use each season $1,500 Intermittent use each year $3,000 (4.) There shall be charged a $150 usage fee for each day the second floor meeting area of the Ambulance Corps building is reserved. This usage fee shall be non-refundable and iIn addition to the fees above, all users of the Senior Center except Waldwick based non-profits or members of the Waldwick Fire Department or Waldwick Ambulance Corps shall pay a $100 per event security and cleaning deposit. This deposit will be refunded to the applicant upon verification that the room has been left clean and no damage to the facility has occurred. Neither the usage fee nor security deposit shall be charged to non- profit organizations based in the Borough of Waldwick for utilization of the meeting area or for members of the Waldwick Fire Department or Waldwick Ambulance Corps. § 64-4 Permits for Special Events 9. There shall be a two hundred dollar ($200) per event security and cleaning deposit. This deposit will be refunded to the applicant upon verification that the park area has been left clean and no damage to the facility has occurred. The security deposit shall be posted by a resident of the Borough who is supervising the special event. The security deposit shall not be charged to non-profit organizations based in the Borough of Waldwick or for members of the Waldwick Fire Department or Waldwick Ambulance Corps. See Chapter 48:65-4.4 for Special event fees. 6. That the proposed activity or use will be supervised by or be under the immediate direction and control of responsible residents of the Borough § 48:64-4.4 Parks – Special events (1.) There will be no fee to rent a Waldwick pavilion for a special event for a Waldwick resident or Waldwick based non-profit. (2.) Non-residents shall pay a fee of $100 for each use of a Waldwick pavilion for a special event. (3.) There shall be no fee for members of the Waldwick Fire Department or Waldwick Ambulance Corps (4) Non-Waldwick based non-profits and all for profit entities shall pay the following fees to rent a Waldwick pavilion for a special event: Fee Each Use $250 Intermittent use each month $700 Intermittent use each season $1,500 Intermittent use each year $3,000 (5). In addition to the above fees, Tthere shall be a two hundred dollar ($200) per event security and cleaning deposit. This deposit will be refunded to the applicant upon verification that the park area has been left clean and no damage to the facility has occurred.
