MINUTES FOR THE REGULAR MEETING
OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK
HELD ON TUESDAY, MARCH 14, 2023 AT 7:30 PM
Mayor Giordano called the meeting to order and read the Statement of Compliance.
Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Ms. Cericola, Mr. Ritchie, Mr.
Schatz, Mr. Sciolaro and Mrs. Sherman. Mrs. Weber was absent.
Also present: Patrick Wherry, Borough Administrator; Matthew Guilder, Grants Administrator; Kelley
Halewicz, Municipal Clerk and Craig Bossong, Municipal Attorney.
Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of
silence honoring our Veterans and to remain standing for the prayer.
PROCLAMATIONS & PRESENTATIONS
a. Recognition of Waldwick Police Officers – Mayor Giordano thanked the police officers involved in
the November 30 incident and the January 3 incident.
b. Eagle Scout Presentation – Liam Vime Olive of Troop 88 is planning to continue the trail from the
Saddle River to Malcolm Street, which would now provide two trails. Liam will use volunteers
from his troop to clear the path and use logs to line the pathway. It will be beneficial to have two
new trails in this area.
c. Proclamation Recognizing Developmental Disabilities Awareness Month – Mayor Giordano read
the proclamation.
MAYOR’S REPORT AND REPORTS OF COMMITTEES
Mayor’s Report. Mayor Giordano spoke to the issue of Dan Wagnes resigning from the Planning Board.
Mayor Giordano appointed Stan Kowalski as a Class IV Member to fill Mr. Wagnes’ unexpired term
through December 31, 2023; John Vervoort appointed as Alternate #1 Member to fill Mr. Kowalski’s
unexpired term through December 31, 2024 and appointed John Cabibo as Alternate #2 Member to fill
Mr. Vervoort’s unexpired term through December 31, 2023.
Financial & Administrative Committee. Mr. Sciolaro’s report will be during the budget introduction.
Fire & Police Protection Committee. Ms. Cericola had no report for the Police Department. On the Fire
Department side, so far this month the Fire Department had 18 total emergency calls with five mutual aid
runs. The Assistant Chief also let me know on Saturday night that they were responding to a basement
fire and no one was injured.
Members are still heavily involved in the schooling I mentioned last month as well. We also have a
member in state Fire 1 class, to become a senior member and interior qualified, you need this class that
runs for almost one year twice a week. Other than that maintenance has been happening every week as
well as interior drills and refreshers.

Public Safety Committee. Mrs. Sherman reported that WALVAC had 25 calls, handled by 16 members and
one mutual aid call. 23 of the calls were responded to within less than five minutes and there were three
calls to the Bristal (10 times since January 2023). Mrs. Sherman will attend their meeting next Tuesday
and have a report.
Mrs. Sherman reported that at the Board of Education meeting last night the DECA team won first place
and now qualifies them for the national competition in Orlando, Florida. Congratulations to all those who
participated. The Board of Education also discussed the progress on the referendum and several of the
labs are open now; everyone seems happy with the progress.
Finally, there was a large turnout from the Lions Club as their carnival is in limbo waiting for approval from
the Board of Education.
Recreational & Health Committee. Mrs. Weber was absent.
Public Works Committee. Mr. Ritchie attended a meeting with the fire department as Councilwoman
Cericola as out of town, to discuss the potential new fire truck and a presentation on bids they received.
Mr. Ritchie asked for additional information. The Mayor, Ms. Cericola, Mr. Ritchie and Borough
Administrator met with company doing the traffic study. A more detailed report is coming out which they
will provide recommendations on.
Buildings & Grounds Committee. Mr. Schatz reported that the tiling is ongoing at Borough Hall. The
handicap door has been fixed. Administrator is interviewing for a new custodian to take the place of Mike
who is retiring.
With regards to Environmental Committee meeting there will be a Styrofoam Collection on April 15, 9:00
am – 1:00 pm at the Recycling Center. Shred Day is May 6. Hazardous Waste Collection schedule was
provided.
With regards to the Planning Board, there were two resolutions and two applications at the March 1
meeting.
DEPARTMENT HEAD REPORTS
Administrator. Mr. Wherry provided an update to the water treatment for PFAS project. We are having
monthly meetings with NJDEP and I Bank since 2021. They should approve our project for financing this
month and timeline. Provided that happens, we will advertise by end of March and award the project at
the May 23 meeting. The project will be completed early 2024. Biggest effect on timeline is obtaining the
vessels and we need two at each site. There is a 40-week timeline for these vessels.
With regards to the traffic study north of prospect street, franklin turnpike and Route 17, the Borough has
hired Michael Baker who conducted the study. They will provide a more detailed preliminary report to
the full Council, and make a presentation at a public meeting.
There is a resolution approving Waldwick’s Home Improvement Policies and Procedures Manual. This
program is part of our rehabilitation obligation under Fair Sharing Housing. Owner occupied or rental
properties in Waldwick with substandard living conditions can apply for these funds to bring their property
up to code. The loan can be up to $23,000 for owners and $17,000 for rentals. If you live at the property
for 10 years and then move, the loan is forgiven. If you do not stay for the full 10 years, the balance is
due at closing.

Municipal Clerk. Mrs. Halewicz reported on late notices for dog registrations being sent out; tenant
registrations are due back April 7. Weekly yard waste collection begins April 11 and Shred Day is May 6.
Grants Administrator. Mr. Guilder reported on the AARP Community Challenge Grant with emphasis on
seniors. The project will be lighting along the pathways in Borough Park.
Attorney. Mr. Bossong had no report.

Discussion. Mr. Sciolaro spoke to the issue of Resolution 2023-120 which is a lease extension with AT&T.
The Borough owns cell towers throughout town and we lease space to the carrier which brings in revenue.

Mrs. Sherman spoke to the issue of Resolution 2023-125 as a tree donation from the Waldwick Lions Club
and the Beautification Committee will be assisting the Lions Club in the planting of these trees.

PUBLIC HEARING & ADOPTION OF ORDINANCE(S)
Mayor Giordano asked the Clerk to read Ordinance No. 2023-#05 by title.
Ordinance No. 2023-#05 - AN ORDINANCE AMENDING CHAPTER 48 FEES, SECTION 64-4.1 PARKS – TENNIS
TAGS & FEES, ADDING SECTION 64-4.3 PARKS – VETERANS FIELD, AMENDING SECTION 10.4 FEE SCHEDULE
FOR USE OF THE SECOND FLOOR OF THE AMBULANCE CORPS BUILDING, AND AMENDING CHAPTER 64
PARKS, SECTION 4 PERMITS FOR SPECIAL EVENTS
Council comments. Mrs. Sherman spoke to the issue of not charging fees to use pavilion but we are
renting out our tennis courts, displacing our residents.
Mr. Sciolaro spoke to the issue of the revision in the policy that Waldwick residents would not pay to use
the courts but outside residents would. In addition, we discussed a limit of two courts and not during
peak times.
Public comment. Mr. Rogoff spoke to the issue of there being a sign at the tennis courts that prohibits
tennis lessons. Mr. Wherry explained that prior to this ordinance being adopted that an organization or
business could not give tennis lessons or any other commercial business at any of our parks. This
ordinance now permits the private organizations to request use of the tennis courts and other spaces in
our parks, a fee is set and the Mayor and Council consider each request.
Mayor Giordano closed the Public comment. Ordinance No. 2023-#05 was advertised and on second
reading is adopted. This ordinance will go into effect immediately after approval and publication according
to law.

REGULAR MEETING MINUTES: 5 MARCH 14, 2023
Policy Vote d – Super Star Tennis request
Mr. Wherry explained the request is for three times a week, for three months, 3.5 hours a day, during
peak times.
After much Council discussion, the approval is to select two days a week (Monday – Thursday) and not a
peak time. On Council voice vote, the Policy Vote passed 4-1.
INTRODUCTION OF ORDINANCE(S)

Ordinance No. 2023-#06 - BOROUGH OF WALDWICK BERGEN COUNTY, NEW JERSEY CALENDAR YEAR 2023
ORDINANCE TO EXCEED THE MUNICIPAL BUDGET COST OF LIVING ALLOWANCE AND TO ESTABLISH A CAP
BANK (N.J.S.A. 40A:4-45.14)
Council Comments. Mr. Sciolaro spoke to the issue of the increases we had this year. In NJ there are
maximum amounts established on how much we can increase appropriations and tax – 2½ % CAP now.
The Borough is requesting the ability to exceed that CAP by an additional percentage to meet our
obligations and we are finding it necessary to do that this year.
Mayor Giordano stated that a motion is in order to move and pass the ordinance on first reading and that
it be advertised in the official newspaper of the municipality as required by law, setting a public hearing
for Tuesday, March 28, 2023 at 7:30 pm or as soon thereafter as the matter may be heard.

Introduction to the 2023 Municipal Budget
RESOLUTION NO. 2023-127
Introduction of the 2023 Municipal Budget
BE IT RESOLVED, that the following statements of revenues and appropriations attached hereto constitute
the local Budget of the Borough of Waldwick, Bergen County, New Jersey for the year 2023.
BE IT FURTHER RESOLVED, that the said budget be published in The Bergen Record in the issue of Monday,
March 20, 2023, and that a hearing on the Budget will be held at the Municipal Building, 63 Franklin Turnpike,
Waldwick, NJ 07463 on Tuesday, April 11, 2023 at 7:30 pm or as soon thereafter as the matter may be
reached.

Discussion. Mayor Giordano thanked the Administrator, CFO, Clerk, Deputy Clerk, Grants Administrator and
the department heads for all the work they put in to this budget. Mayor Giordano also thanked the Council
for their hard work as this was not an easy budget.
This was a little different for us this year; we looked more closely at items in the budget. When the
information is available, when we talk about the Borough’s budget, we are talking about the operating
budget and capital budget and these are broken out in the budget. The operating budget is also called the
current fund and cover the day-to-day operations of the Borough. The capital budget is how we invest in
the community, vehicles and infrastructure. Our water utility is also broken down the same way but is a
separate budget.
Challenges in 2023 that are different are items or two that we saw significant increases and it was often
offset by other items, that we have control over. This year for the first time we saw a number of significant
increases that saw double digit increases at the same time. We had no control over them. Typically, we talk
about contractual obligations and this year we needed to focus on the caps and what the increases meant
to us. Things like employee health benefits, increased 22%; solid waste renewal which you are seeing the
effects of increased about 60%. We made changes to collection days, bulk collection. Disposal went up
11%, Insurance 10%; Pension funds 8% and 10%. These are things that are not negotiable and we need to
provide and support. We have to meet all these obligations and the cost of fuel, electricity and other things
we need to function to provide services to our residents.
There was some relief from the State. We made cuts where we had some flexibility to control costs. The
bottom line, we were able to meet a lot of our goals and even though we received a waiver to the CAP on a
number of these, we still made enough significant cuts to budget that we met our obligations to the CAP.
For the first time in a long time, we foresee a tax increase of 2½% for the Borough’s portion of your tax bill,
which on the averaged assessed home $424,000 is $56.00 for the year.
The budget made some changes to solid waste collection, we are continuing to provide roads, parks,
infrastructure, no program cuts. New in the budget is police accreditation. This provides our police
department with resources and training, which will decrease our risk and liability costs going forward. We
will spend $900,000 in road repaving some of which is matching grants as well as EV charging station. On
the water side, there are some areas in town experiencing water discoloration and we are moving forward
on maintenance and repair in those areas.
Residents should look for the budget brochure, 2023 introduced budget and budget advertisement on our
website and links to this information will also be included in the Friday email blast.
Mr. Ritchie commented on the municipal budget and thanks the Administration and Mayor and Council for
their hard work on this budget. The Borough has not raised taxes in 10 years, while the school and county
taxes have increased each year. There were line items and non-negotiable double-digit increases which put
the Borough at a huge disadvantage. We all worked long and hard, weekend and nights and cut several
items out completely, leaving us with a budget that not everyone is happy about but is a needs budget while
still maintaining services for our residents.

UNFINISHED BUSINESS
Mayor Giordano spoke to the issue of speaking to all Council Members regarding the Waldwick High
School Soccer Team sign will be placed near the entrance of town off Route 17 going north. In addition,
there is to be an ordinance written that reserves the honor at the discretion of the Mayor and Council to
put up a sign in the Borough only to those who win at the highest level.
Mrs. Sherman spoke to the issue of the other Boys’ Soccer team that won that was never recognized with
a sign.
NEW BUSINESS
Mrs. Sherman spoke to the issues of the PBA Egg Hunt will be held on April 1 at 10:00 am sharp, bring
your baskets. Also, a very Happy St. Patrick’s Day.
Ms. Cericola commented on the email sent out by the Clerk last week regarding May as being Mental
Health Awareness Month and that a proclamation be written. Mayor Giordano explained that the
proclamation has been done and will be read at a meeting.
PUBLIC COMMENT
Mayor Giordano asked if any member of the public wished to come forward and to discuss anything and
if so, please state your name and address for the record.
Chris Roger spoke to the issue of the tennis courts and as a fiscal conservative, was a benchmarking done
looking at the private side as these are public courts. Mr. Wherry explained that is it difficult from the
private side as they charge a percentage. For public court, it was not as clear.
Mr. Roger spoke to the issue of the traffic study survey and has noticed more traffic on Bergen Avenue
which he attributes to the traffic apps.
Mr. Roger spoke to the issue of affordable home loan program and recouping of the funds. Mr. Wherry
explained that there is a mechanism in place, a deed restriction on the mortgage and if they leave prior
to 10 years, the monies are recouped. The same holds true on rental properties that qualify, set maximum
they can rent out for.
Mr. Roger asked if the gun range is public or private club. Mr. Wherry explained that it is a private club
that someone can apply for membership.
Mark Ramundo spoke to the issue of the tennis courts and that they organization running the program is
making a lot of money on the backs of the town.

Jeff Rogoff spoke to the issue of setting limits as to the time the courts can be used as 3:30 pm – 7:00 pm
is prime time for residents when they come home from work to play. Have this program run earlier in the
day so as not to interfere with residents. Pleased to see the increased use of the tennis courts.
Mr. Rogoff spoke to the issue of the road study and how it will affect Prospect Street and concerned that
will be the roadway they are directed on to steer away from the other side streets.
Mr. Rogoff would like the Council to consider eliminating the late fee for dog licensing as his dog is not
due for rabies vaccine until September, so this year he will incur a late fee based on the licensing
requirements.
CLOSED SESSION - Any matter permitted to be discussed in Closed Session pursuant N.J.S.A. 10:4-12
RESOLUTION NO. 2023-128
Authorize Closed Session
WHEREAS, Section 8 of the Open Public Meetings Act (N.J.S.A. 10:4-12(b)(1-9) permits the exclusion of
the public from a meeting in certain circumstances; and,
WHEREAS, the Mayor and Council is of the opinion that such circumstances exist.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick, County of
Bergen, State of New Jersey, as follows:
The public shall be excluded from discussions of the Closed Session.
The general nature of the subject matter to be discussed is as follows:

It is anticipated at this time that the above stated subject matter will be made public within 60 days or as
soon thereafter as it is deemed to be in the public interest to do so based on the conclusion of the matter.

Award Non-Fair and Open Contract to Seal Master Municipal for a Tar Pot Sealing Unit $21,958.00
WHEREAS, a tar pot was damaged due to a falling tree and needs to be replaced; and,
WHEREAS, the Borough solicited multiple quotes and found Seal Master Municipal’s proposal dated
January 19, 2023 in the amount of $21,958.00 to be the most advantageous to the Borough, cost and
other factors considered; and,
WHEREAS, Seal Master Municipal’s total aggregate awards, including this award, will exceed the Pay-to-
Play limit of $17,500 over a one-year period; and,
WHEREAS, this contract is being awarded as a non-fair and open and is in conformance with the provisions
of N.J.S.A. 19:44A-20.4 et seq.; and,
WHEREAS, Seal Master Municipal has completed and submitted a Business Entity Disclosure Certification
which certifies Seal Master Municipal has not made any reportable contributions to a political or
candidate committee in the Borough of Waldwick in the previous one year, and that the contract will
prohibit Seal Master Municipal from making any reportable contributions through the term of the
contract; and,
WHEREAS, the Chief Financial Officer of the Borough of Waldwick has certified that $21,958.00 is available
in the following appropriation 3-01-23-211-002, and has further certified that this commitment together
with all previous commitments and payments does not exceed the funds available in said appropriation;
and,
WHEREAS, reimbursement will be provided through the Borough’s Insurance carrier.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick authorize
Seal Master Municipal, 685 Ruppsville Road, Allentown, PA 18106 to provide a replacement tar pot sealing
unit in the amount of $21,958.00.

Bus Stop, $5,600.00
WHEREAS, a bollard at the Route 17 South bus stop was struck by a vehicle and is in need of repair; and,
WHEREAS, the Borough will seek reimbursement for expenses from the vehicle’s insurance company; and,
WHEREAS, LaForza Construction, LLC, proposal dated February 8, 2023 in the amount of $1,800 is the
most advantageous to the Borough, cost and other factors considered; and,
WHEREAS, LaForza Construction LLC, total aggregate awards, including this award, will exceed the Pay-to-
Play limit of $17,500 over a one-year period; and,
WHEREAS, this contract is being awarded as a non-fair and open and is in conformance with the provisions

Services, ADA Curb Ramp Upgrades, $9,800.00
WHEREAS, the Borough requires engineering and construction inspection of ADA Curb ramp upgrades as
part of the 2023 Road Resurfacing Program; and,
WHEREAS, Boswell Engineering submitted the attached proposal for Task I Engineering Design and Task II
Construction Administration dated March 9, 2023 in the amount of Task I - $5,300.00; Task II - $4,500.00
for total amount of $9,800.00; and,
WHEREAS, Boswell Engineering total aggregate awards, including this award, will exceed the Pay-to-Play
limit of $17,500 over a one-year period; and,
WHEREAS, Boswell Engineering, has completed and submitted a Business Entity Disclosure Certification
which certifies Boswell Engineering has not made any reportable contributions to a political or candidate
committee in the Borough of Waldwick in the previous one year, and that the contract will prohibit
Boswell Engineering from making any reportable contributions through the term of the contract; and,
WHEREAS, Chief Financial Officer, has certified that $9,800.00 is available in the following appropriation:
G-04-56-482-602, and has further certified that this commitment together with all previously made
commitments and payments does not exceed the funds available in said appropriation; and has further
certified that the funds available in the said appropriation are intended for the purpose herein committed.
NOW, THEREFORE, BE IT RESOLVED, that the Borough Council hereby award a contract to Boswell

Authorize BCUA Solid Waste Cooperative Marketing Program Agreement for Solid Waste Disposal
WHEREAS, the Bergen County Utilities Authority (BCUA) Solid Waste Cooperative Marketing Program
Agreement for Solid Waste Disposal terminates on May 31, 2023; and,
WHEREAS, the BCUA awarded a contract to Waste Management of New Jersey (Waste Management) for
solid waste processing and disposal services on December 22, 2022; and,
WHEREAS the contract runs from June 1, 2023 through May 31, 2024 with the per ton cost for the Program
of $84.45 per ton for the year of service inclusive of the $3.00 per ton recycling tax, with Waste
Management transfer station facility, Fairview Transfer Station, 61 Broad Street, Fairview, NJ, available as
part of the Program.
NOW, THEREFORE, BE IT RESOLVED that the Municipal Council of the Borough of Waldwick hereby
authorize participation in the BCUA Solid Waste Cooperative Marketing Program and the execution of the
BCUA Solid Waste Service Agreement by the appropriate Borough officials.

Approval of the Home Improvement Program Policies and Procedures Manual Created by Community
Grants, Planning & Housing, dated February 2, 2023
WHEREAS, the Borough of Waldwick has a constitutional obligation to provide for its fair share of low-
and moderate-income housing; and,
WHEREAS, the Borough adopted Affordable Housing Controls, a requirement of which, detailed in Ch 97-
120(D)(1)(a), is the creation and administration of a rehabilitation program designed to renovate deficient
housing units occupied by low- and moderate-income households such that, after rehabilitation, these
units will comply with the New Jersey State Housing Code pursuant to N.J.A.C. 5:28; and,
WHEREAS, to meet this requirement, the Borough awarded a contract to Community Grants, Planning &
Housing (CGP&H) for Housing Rehabilitation Administrations Services, including the creation of a Home
Improvement Program Policies and Procedures Manual; and,
WHEREAS, CGP&H created the attached Policies and Procedures Manual, dated February 2, 2023, with
input from the Borough Administrator, Borough Attorney, and Borough Planner; and,
WHEREAS, Borough code 97-120D(1)(e) requires the Policies and Procedures Manual be adopted by
resolution of the Mayor and Council.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of Waldwick hereby
approve the Home Improvement Program Policies and Procedures Manual, created by Community Grants,
Planning & Housing, dated February 2, 2023.

RESOLUTION NO. 2023-120
Authorize Lease Extension for Monopole Tower Lease at Block 110, Lot 4 with AT&T
WHEREAS, the Borough entered into a Lease Agreement with AT&T and/or its predecessors in interest at
the above Borough’s Site at Wyckoff Avenue in November 2004 at level 123’; and,
WHEREAS, the Lease term expires on or about October 27, 2023; and,
WHEREAS, the Borough Attorney and AT&T have negotiated the attached term sheet for an extension of
the lease agreement and are recommending the same.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Waldwick that Governing
Body hereby authorizes the lease extension on the terms set forth in the attached term sheet; and,
BE IT FURTHER RESOLVED, that the Borough Attorney is hereby authorized to draft a lease amendment
agreement according to said term sheet; and,
BE IT FURTHER RESOLVED, that the Mayor and Borough Clerk are hereby authorized to execute the Lease
Agreement Amendment with AT&T for the tower located at Block 110, Lot 4 at site level 123’.

Authorize Borough Auction
WHEREAS, pursuant to the provisions of N.J.S.A. 40A:11-36 the Borough of Waldwick may sell any
personal property; and,
WHEREAS, the Mayor and Council of the Borough of Waldwick have determined that said property is not
needed for public purposes and wishes to divest same; and,
WHEREAS, this sale will be in “as is” condition without express or implied warranties.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Waldwick, as follows:
1. The surplus property to be sold, as identified in Schedule A, shall be sold in an “as is” condition
without express or implied warranties.
2. The successful bidder will be required to pay in cash or certified check made out to the Borough
of Waldwick at the time of pick-up of the item. The Borough will not deliver any items to the
successful bidder.
3. The items must be taken off our site within (72) hours after the conclusion of the sale.

SECTION 4 PERMITS FOR SPECIAL EVENTS, AND ADDING SECTION 64.4 PARKS – SPECIAL EVENTS
BE IT ORDAINED that the Municipal Council of the Borough of Waldwick hereby amends Chapter 48 Fees,
Section 64-4.1 Parks – Tennis Tags & Fees, adding Section 64-4.3 Parks – Veterans Field, amending Section
10.4 Fee Schedule for use of the Second Floor of the Ambulance Corps Building, amending Chapter 64
Parks, Section 4 Permits for Special Events., adding Section 64.4 Parks – Special Events. The changes to
Code of the Borough of Waldwick below shows deletions to the code in strikethrough and additions in
underline as follows:
Chapter 48 Fees
§ 48:64-4.1 Parks – Tennis Courts tags and fees.
Each person entering upon or using one of the tennis courts within any Borough park shall be required to
display a tag or permit. Each resident of the Borough shall be entitled to purchase a nontransferable tennis
tag or permit valid for one calendar year, the fee for which shall be $20.
(1) There will be no fee to rent the Waldwick tennis courts for a Waldwick based non-profit.
(2) Non-Waldwick based non-profits, and all for profit entities shall pay the following fees to rent
Waldwick tennis courts:

Four Hour Period $150
Intermittent use each season $1,000
Intermittent use each year $1,500
(3) At no time shall more than two tennis courts be allowed to be rented out simultaneously.
§ 48:64-4.3 Parks – Veterans Field
(1.) There shall be no fee for Waldwick Based non-profits to rent Veterans Field.
(2.) Non-Waldwick based non-profits and all for profits entities shall pay the following fees to rent
Veterans Field:

§ 48:1-10.4 Fee schedule for use of the second floor of the ambulance corps building Senior Center.
(1.) Waldwick Residents shall pay a $150 fee for each rental of the Waldwick Senior Center.
(2.) There shall be no fee for Waldwick Based non-profits to rent the Waldwick Senior Center.
(3.) There shall be no fee for members of the Waldwick Fire Department or Waldwick Ambulance Corps.
(4.) Non-Waldwick based non-profits and all for profits entities shall pay the following fees to rent the
Waldwick Senior Center:

Intermittent use each season $1,500
Intermittent use each year $3,000
(4.) There shall be charged a $150 usage fee for each day the second floor meeting area of the Ambulance
Corps building is reserved. This usage fee shall be non-refundable and iIn addition to the fees above, all
users of the Senior Center except Waldwick based non-profits or members of the Waldwick Fire
Department or Waldwick Ambulance Corps shall pay a $100 per event security and cleaning deposit. This
deposit will be refunded to the applicant upon verification that the room has been left clean and no
damage to the facility has occurred. Neither the usage fee nor security deposit shall be charged to non-
profit organizations based in the Borough of Waldwick for utilization of the meeting area or for members
of the Waldwick Fire Department or Waldwick Ambulance Corps.
§ 64-4 Permits for Special Events
9. There shall be a two hundred dollar ($200) per event security and cleaning deposit. This deposit will
be refunded to the applicant upon verification that the park area has been left clean and no damage to
the facility has occurred. The security deposit shall be posted by a resident of the Borough who is
supervising the special event. The security deposit shall not be charged to non-profit organizations
based in the Borough of Waldwick or for members of the Waldwick Fire Department or Waldwick
Ambulance Corps. See Chapter 48:65-4.4 for Special event fees.
6. That the proposed activity or use will be supervised by or be under the immediate direction and
control of responsible residents of the Borough
§ 48:64-4.4 Parks – Special events
(1.) There will be no fee to rent a Waldwick pavilion for a special event for a Waldwick resident or
Waldwick based non-profit.
(2.) Non-residents shall pay a fee of $100 for each use of a Waldwick pavilion for a special event.
(3.) There shall be no fee for members of the Waldwick Fire Department or Waldwick Ambulance Corps
(4) Non-Waldwick based non-profits and all for profit entities shall pay the following fees to rent a
Waldwick pavilion for a special event:

(5). In addition to the above fees, Tthere shall be a two hundred dollar ($200) per event security and
cleaning deposit. This deposit will be refunded to the applicant upon verification that the park area has
been left clean and no damage to the facility has occurred. The security deposit shall be posted by a
resident of the Borough who is supervising the special event. The security deposit shall not be charged
to non-profit organizations based in the Borough of Waldwick or for members of the Waldwick Fire
Department or Waldwick Ambulance Corps.
BE IT FURTHER RESOLVED that the ordinance shall take effect upon publication and adoption as required
by law.

Ordinance No. 2023-#06 BOROUGH OF WALDWICK BERGEN COUNTY, NEW
JERSEY CALENDAR YEAR 2023 ORDINANCE TO
EXCEED THE MUNICIPAL BUDGET COST OF LIVING
ALLOWANCE AND TO ESTABLISH A CAP BANK
(N.J.S.A. 40A:4-45.14)
WHEREAS, the Local Government Cap Law, N.J.S.A. 40A:4-45.1 et seq., provides that in the preparation of its
annual budget, a municipality shall limit any increase in said budget to 2.5% or the cost-of-living adjustment,
whichever is less, unless authorized by ordinance to increase it to 3.5% over the previous year’s final
appropriations, subject to certain exceptions; and,
WHEREAS, the cost-of-living adjustment for calendar year 2023 budgets is calculated at 2.5% pursuant to
N.J.S.A. 40A:4-45.2; and
WHEREAS, N.J.S.A. 40A:4-45.15a provides that a municipality may, when authorized by ordinance, appropriate
the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception
to its final appropriations in either of the next two succeeding years; and,
WHEREAS, the Borough Council of the Borough of Waldwick in the County of Bergen finds it advisable and
necessary to increase its CY 2023 budget by up to 3.5% over the previous year’s final appropriations, in the
interest of promoting the health, safety and welfare of the citizens; and,
WHEREAS, the Borough Council hereby determines that a 1.0% increase in the budget of said year, amounting
to $100,016 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap
Law, is advisable and necessary; and,
WHEREAS, the Borough Council hereby determines that any amount authorized hereinabove that is not
appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next
two succeeding years.
NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Waldwick, in the County
of Bergen, a majority of the full authorized membership of this governing body affirmatively concurring, that, in
the CY 2023 budget year, the final appropriations of the Borough of Waldwick shall, in accordance with this
ordinance and N.J.S.A. 40A:4-45.14, be increased by 3.5%, amounting to $350,055 and that the CY 2023
municipal budget for the Borough of Waldwick be approved and adopted in accordance with this ordinance; and,
BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the
final budget shall be retained as an exception to final appropriation in either of the next two succeeding years;
and,
BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of
the Division of Local Government Services within 5 days of introduction; and,
BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote
included thereon, be filed with said Director within 5 days after such adoption.

Introduction of the 2023 Municipal Budget
BE IT RESOLVED, that the following statements of revenues and appropriations attached hereto constitute
the local Budget of the Borough of Waldwick, Bergen County, New Jersey for the year 2023.
BE IT FURTHER RESOLVED, that the said budget be published in The Bergen Record in the issue of Monday,
March 20, 2023, and that a hearing on the Budget will be held at the Municipal Building, 63 Franklin Turnpike,
Waldwick, NJ 07463 on Tuesday, April 11, 2023 at 7:30 pm or as soon thereafter as the matter may be
reached.

Authorize Closed Session
WHEREAS, Section 8 of the Open Public Meetings Act (N.J.S.A. 10:4-12(b)(1-9) permits the exclusion of
the public from a meeting in certain circumstances; and,
WHEREAS, the Mayor and Council is of the opinion that such circumstances exist.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick, County of
Bergen, State of New Jersey, as follows:
The public shall be excluded from discussions of the Closed Session.
The general nature of the subject matter to be discussed is as follows:
Personnel Matters
It is anticipated at this time that the above stated subject matter will be made public within 60 days or as
soon thereafter as it is deemed to be in the public interest to do so based on the conclusion of the matter.
This resolution shall take effect immediately.
