MINUTES FOR THE REGULAR MEETING
OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK
HELD ON TUESDAY, APRIL 11, 2023 AT 7:30 PM
Mayor Giordano called the meeting to order and read the Statement of Compliance.
Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Ms. Cericola, Mr. Ritchie, Mr.
Sciolaro, Mrs. Sherman and Mrs. Weber. Mr. Schatz was absent.
Also present: Patrick Wherry, Borough Administrator; Matthew Guilder, Grants Administrator; Kelley
Halewicz, Municipal Clerk and Craig Bossong, Municipal Attorney.
Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of
silence honoring our Veterans and to remain standing for the prayer.
PROCLAMATIONS & PRESENTATIONS
Mayor Giordano commented that Peter Bernhard was born and raised in the Borough of Waldwick. He
graduated from Waldwick High School in 2015 and attended Stockton University, graduating in May 2019,
receiving a Bachelor’s degree in Criminal Justice. After graduating Stockton University, Pete joined the
Waldwick Police Department as a communications officer in June of 2019.
Pete was accepted into the Basic Police Training Class at the Bergen County Police Academy as an
Alternate Route candidate in January of this year. Pete will graduate in June as a Certified Police Officer.
We wish you much success in your training class at the Academy and we look forward to having you be a
member of our dedicated Police Department whose main goal is to protect our community and residents.
You are becoming a member of the best Police Department that any borough can ask for. Good luck; Be
safe and always happy at what you are dedicating your life to.

RESOLUTION NO. 2023-153
Appointment of Temporary Police Officer - Peter Bernhard
WHEREAS, as per N.J.S.A. 11A:4-1.3(a), the Civil Service Commission exempts from the requirement to
take an examination for an entry-level law enforcement officer position a person who successfully
completes a full Basic Course for Police Officers training course at an approved school authorized by the
New Jersey Police Training Commission within nine months from the date of hire as a temporary Police
Officer; and,
WHEREAS, the Civil Service Commission requires that municipalities utilizing this exemption have an
ordinance or resolution authorizing the examination exemption, a conflict-of-interest policy, and a
nepotism policy; and,
WHEREAS, the Borough has satisfied these requirements with Resolution 2022-208; Employee Handbook
IV. Conduct of Employees, A. Ethical Conduct; and Personnel Policies Manual, Personnel Rules and
Regulations, Nepotism Policy; respectively; and,

WHEREAS, Mr. Bernhard is currently enrolled in a Basic Course for Police Officers training course at the
Bergen County Police Academy.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick hereby
approve the appointment of Peter Bernhard for the position of Temporary Police Officer beginning April
11, 2023; and,
BE IT FURTHER RESOLVED that upon successful completion of the Basic Course for Police Officers, Mr.
Bernhard’s employment status will become permanent, entry-level Police Officer; and,
BE IT FURTHER RESOLVED that Peter Bernhard is required to meet the conditions contained in the
Employee Handbook and Policy and Procedures Manual, and Police Academy Requirements, including,
but not limited to a background check, a medical screening exam, a physical exam, a psychological exam,
a physical fitness test, and a drug test; and,
BE IT FURTHER RESOLVED that he shall serve at a salary of $40,496.00.

MAYOR’S REPORT AND REPORTS OF COMMITTEES
Mayor’s Report. No further report.
Financial & Administrative Committee. Mr. Sciolaro commented that his report will follow along with the
public hearing and adoption of the 2023 Municipal Budget.
Fire & Police Protection Committee. Ms. Cericola congratulated Mr. Bernard on his swearing in tonight
and wish him the best of luck in his career.
Ms. Cericola reported on the Fire Department that for the month of March the Waldwick Fire Department
responded to 15 calls of service, 4 of which were mutual aid. As stated in her last report, we had a small
basement fire in town, the resident was able to put out a majority of it. Fire Department finished fire
extinguishment, overhaul, investigation. Unfortunately, that fire did displace 2 tenants of the two-family
home.

As far drills and training, the department still has one member currently enrolled in FF 1 at the Bergen
County Fire Academy, with another starting this summer. With the warm weather starting to approach
they held an annual pump refresher. Members who are certified to drive a pumper for the department
came out and refreshed on what they call a change-over operation. As the weather gets nicer, pump
refreshers will continue, as well as outside training.
Public Safety Committee. Mrs. Sherman commented that the Waldwick volunteer ambulance Corps had
30 calls in the month of March which were answered by 17 members one member went on 12 calls. They
responded to 27 of the calls in under five minutes. The ages ranged from under 10 to 99. They responded
to seven calls at the Bristol, which puts them at 17 for the first three months of the year. Two patients
were taken to Hackensack; two patients to Newbridge; 18 patients to Valley and eight were not recorded.
Mrs. Sherman thanked the Mayor and Council and WALVAC is pleased to see Resolution No. 2023-144 on
the agenda for the Lucas machines, which will help save lives in Waldwick.
Recreational & Health Committee. Mrs. Weber commented registration are open for various programs
at the Library, Midland Park Summer Camps, Waldwick Chamber of Commerce 5K, WEF Townwide Garage
Sale April 22 & April 23; Community Meals on Wheels; Earth Day celebration, April 29, 9:00 am in Borough
Park; Municipal pool online registration May 1. Waldwick Soccer registration.
NWBRHC this month is Alcohol Awareness Month on their Facebook page. Valley Hospital and Mahwah
Municipal Alliance seminar on, Wednesday April 19 regarding body image issues.
Public Works Committee. Mr. Ritchie commented that winter is behind us with a minimal use of salt and
snow plowing this season. Hydrant flushing is ongoing with the schedule posted on our website and in
the 2023 municipal calendar. Yard Waste collection started today and must be curbside by 6:00 am on
day of pickup, four containers maximum, no plastic bags and nothing on the street. If you miss the
collection, you can bring to recycling center. April 20 is bulk collection.
Buildings & Grounds Committee. Mr. Schatz was absent.
DEPARTMENT HEAD REPORTS
Administrator. No report.
Municipal Clerk. Mrs. Halewicz commented that there are a number of resolutions pertaining to the
Summer Concerts that we discussed during the budget. These were the ones that were approved and
these resolutions are for those contracts.

Attorney. No report; but there are a couple of items for Closed Session.

Waiver of Reading in Full of the 2023 Municipal Budget
WHEREAS, N.J.S.A. 40A:4-8 permits that the Budget as advertised may be read by its title providing that
at least one week prior to the date of the hearing a complete copy of the approved budget shall:
a) be posted in a public place where public notices are customarily posted including the Borough
website, and
b) is made available to each person requesting the same during said week and during the public
hearing, and
WHEREAS, the Borough of Waldwick has complied with the aforesaid requirements.
NOW, THEREFORE, BE IT RESOLVED, the Borough is hereby permitted to waive the reading in full, of the
Municipal Budget for the year ending December 31, 2023.
Discussion. Mr. Sciolaro commented that the budget is a large document and we are waiving reading it
in full.

b. Resolution Number 2023-158 Self-Examination of 2023 Municipal Budget
RESOLUTION NO. 2023-158
Self-Examination of 2023 Municipal Budget
WHEREAS, N.J.S.A. 40A:4-78b has authorized the Local Finance Board to adopt rules that permit
municipalities in sound fiscal condition to assume the responsibility, normally granted to the Director of
the Division of Local Government Services, of conducting the annual budget examination; and,
WHEREAS, N.J.A.C. 5:30-7 was adopted by the Local Finance Board on February 11, 1997; and,
WHEREAS, pursuant to N.J.A.C. 5:30-7.2 thru 7.5 the Borough of Waldwick has been declared eligible to
participate in the program by the Division of Local Government Services, and the Chief Financial Officer has
determined that the Borough meets the necessary conditions to participate in the program for the 2023
budget year.

NOW, THEREFORE, BE IT RESOLVED, by the governing body of the Borough of Waldwick that in accordance
with N.J.A.C. 5:30-7.6a & b and based upon the Chief Financial Officer’s certification, the governing body has
found the budget has met the following requirements:
1. That with reference to the following items, the amounts have been calculated pursuant to law and
appropriated as such in the budget.
a. Payment of interest and debt redemption charges
b. Deferred charges and statutory expenditures
c. Cash deficit of preceding year
d. Reserve for uncollected taxes
e. Other reserves and non-disbursement items
f. Any inclusions of amounts required for school purposes.
2. That the provisions relating to limitation on increases of appropriations pursuant to N.J.S.A. 40A:4-45.2
and appropriations for exceptions to limits on appropriations found at N.J.S.A. 40A:4-45.3 et seq. are
fully met. (Complies with the “CAP” law).
3. That the budget is in such form, arrangement, and content as required by the Local Budget Law and
N.J.A.C. 5:30-4 and 5:30-5.
4. That pursuant to the Local Budget Law:
a. All estimates of revenue are reasonable, accurate, and correctly stated;
b. Items of appropriations are properly set forth
c. In itemization, form, arrangement, and content the budget will permit the exercise of the
comptroller function within the municipality.
5. The budget and associated amendments have been introduced and publicly advertised in accordance
with the relevant provisions of the Local Budget Law, except that failure to meet the deadlines of
N.J.S.A. 40A:4-5 shall not prevent such certification.
6. That all other applicable statutory requirements have been fulfilled.
BE IT FURTHER RESOLVED, that a copy of this resolution will be forwarded to the Director of the Division
of Local Government Services upon adoption.
Discussion. Mr. Sciolaro stated that each year, the State reviews Municipal budgets before we are allowed
to act on them. However, they cannot review all of municipalities’ budgets every year. Since Waldwick is
in good financial standing with the State, we can bypass it and do a self-examination.

c. Public Hearing on the 2023 Municipal Budget
Council Comments. Mayor Giordano thanked the department heads for putting this budget together.
Especially the Borough Administrator, CFO, Grants Administrator, Clerk and Deputy Clerk for their hard
work.
Mr. Sciolaro commented that we talk about this for a third of the year. We are actually talking about four
budgets. Operating budget & Capital budget for the Borough and Operating budget & Capital budget for
the Water utility.
We spend a lot of time Advertising and talking about our operating budget for the borough.
We have for years done a budget brochure. It is a concise 5-page document that explained the $16 million
budget. Mr. Sciolaro pointed out that the first page pie chart shows where 100% of resident’s taxes are
spent. While the Borough collects 100% of the taxes, the Borough does not keep all the taxes. Municipal
and Library are 20%, County 10% and School district 70% taxes. We are talking about the 20% that the
Borough controls. The Governing Body does not know the overall tax rate for the community, as both the
school and the county tax requirements have not yet been finalized. The Mayor and Council only have the
authority to approve the "Local Municipal Operating Budget."
When the budget was introduced, we discussed some of the challenges we face this year. We spent a lot
more time on reviewing the budget and working on it in a long time. There were some unusual challenges.
Typically, we talk about contractual obligations and this year we needed to focus on the caps and what the
increases meant to us. Things like employee health benefits, increased 22%; solid waste renewal which you
are seeing the effects of increased about 60%. We made changes to collection days, bulk collection. Disposal
went up 11%, Insurance 10%; Pension funds 8% and 10%. These are things that are not negotiable and we
need to provide and support. We have to meet all these obligations and the cost of fuel, electricity and
other things we need to function to provide services to our residents.
There was some relief from the State. We made cuts where we had some flexibility to control costs. The
bottom line, we were able to meet a lot of our goals and even though we received a waiver to the CAP on a
number of these, we still made enough significant cuts to budget that we met our obligations to the CAP.
The budget made some changes to solid waste collection, we are continuing to provide roads, parks,
infrastructure, no program cuts. New in the budget is police accreditation. This provides our police
department with resources and training, which will decrease our risk and liability costs going forward. We
will spend $900,000 in road repaving some of which is matching grants as well as EV charging station.
On the water side, there are some areas in town experiencing water discoloration and we are moving
forward on maintenance and repair in those areas. Plan maintenance of our water tanks. We cannot ignore
our infrastructure. Water infrastructure is being partially funded by I-Bank with partial loans forgiveness
and low interest loans.
Residents should look for the budget brochure, 2023 introduced budget and budget advertisement on our
website and links to this information will also be included in the Friday email blast.
The projected 2023 municipal operating budget tax rate will increase 2.5% when compared to the 2022
municipal operating budget tax rate. This increase will result in a $56.00 annual tax increase on the
average assed home value of $424,368.

Council comments. Mr. Wherry explained that this ordinance is in response to a state law passed in 2021
for homes that are rented. It does not apply to single family homes. It sets forth inspections, fees and
violations for non-compliance. Our Construction Code department is seeking an inspector at this time.

Council comments. Mr. Sciolaro commented that these are items that are included in capital budget but
are being paid through our capital improvement fund which is money we have on hand to pay for these
items, incurring no debt.

Authorize Salaries for 2023
WHEREAS, the Mayor and Council adopted Ordinances which sets the salary ranges for certain Borough
Employees effective January 1, 2023.
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Waldwick that, in
accordance with previously adopted Ordinances the annual base salary or hourly rate of each Borough
Official and Employee is listed on the schedule annexed hereto and made a part hereof; and,
BE IT FURTHER RESOLVED, that the rates set forth on the annexed schedule shall take effect January 1,
2023 except as otherwise stated in said schedule; and,
BE IT FURTHER RESOLVED, that the rate or compensation of any other Borough Official or Employee
heretofore fixed but not mentioned herein shall be deemed to be unaffected by the adoption of this
resolution and shall continue as heretofore fixed or established.

UNFINISHED BUSINESS
Mrs. Sherman commented that she attended the PBA Easter Egg Hunt which was well attended held on
Sunday. The children were very happy and went home with eggs and prizes. Wanted to congratulate the
PBA. Congratulations and best wishes to Peter Bernhard as he pursues his career goal as police office
protecting us.
The Beautification Committee met at the Christopher Goodell Public Safety Complex and filled two large
bags of weeds and dead growth. Some plants were dug up and transplanted. We will go back and thin
out some more plants and plant in Veterans Park. We will be planting blue and white seeds in Veterans
Park, which bloom in March and will display warrior colors. Beautification Committee will also take part
in Earth Day with a seed bomb project for all ages. They are a mixture of wildflower seeds, clay and dirt
that you can put in your yard.
Mayor Giordano commented remind everyone that there are a lot of events going on including the
Waldwick Chamber of Commerce 5K, WCA Car Show, and Memorial Day Parade.

PUBLIC COMMENT
Mayor Giordano asked if any member of the public wished to come forward and to discuss anything and
if so, please state your name and address for the record.
Mrs. Hascup spoke to the issue of emailing the Mayor regarding soccer banner for the 1985 team and did
not receive an email back from him.
Mayor Giordano commented that he did not receive the email from Mrs. Hascup or he would have
responded.
Ted Sanzo spoke to the issue of the water problem being fixed that the activated charcoal has a lifespan
and interested in that be included in any settlement agreed upon as the residents should not have to pay
the cost of the replacements.
Bianca Marosi spoke to the issue of the road resurfacing program in the capital budget, when the roads
would be paved and which ones.
Mr. Wherry commented that the contract would be awarded sometime next month. Then there is a pre-
construction meeting and as the roads are close to Traphagen, ideally, they should be done in August.
The schedule will not be provided until we are a few weeks before the project begins.
Ms. Marosi asked about the areas that are still having water issues.
Mr. Wherry explained that Hemlock/Evergreen is a dead-end water main that we want to loop but it
would go through Midland Park. We need to coordinate with Midland Park and Ridgewood Water. A
similar issue on the east side of Route 17, complaint of discolored water. We need to loop that section to
Bergen Avenue and West Saddle River Road. This would improve the water circulation in that area and
clarity.
CLOSED SESSION - Any matter permitted to be discussed in Closed Session pursuant N.J.S.A. 10:4-12
RESOLUTION NO. 2023-161
Authorize Closed Session
WHEREAS, Section 8 of the Open Public Meetings Act (N.J.S.A. 10:4-12(b)(1-9) permits the exclusion of
the public from a meeting in certain circumstances; and
WHEREAS, the Mayor and Council is of the opinion that such circumstances exist.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick, County of
Bergen, State of New Jersey, as follows:
The public shall be excluded from discussions of the Closed Session.
The general nature of the subject matter to be discussed is as follows:

the record of the Regular Meeting. Present on roll call: Mayor Giordano, Mr. Bjork, Ms. Cericola, Mr.
Ritchie, Mr. Sciolaro and Mrs. Sherman. Mr. Schatz was absent.

RESOLUTION NO. 2023-162
Authorize Execution of Separation and Release Agreement
WHEREAS, the Borough of Waldwick employed John Greco as a Police Dispatcher from August 19, 2003
to January 9, 2006; and,
WHEREAS, the Borough of Waldwick employed John Greco as a Police Officer for the Borough of
Waldwick beginning January 9, 2006: and,
WHEREAS, John Greco was promoted to the position of Police Sergeant (“Sergeant Greco”), effective
August 28, 2018; and,
WHEREAS, Sergeant Greco is an active member of the PFRS; and,
WHEREAS, Sergeant Greco has met the minimum service credit requirement of at least 4 years for PFRS
members; and,
WHEREAS, the Mayor and Council of the Borough of Waldwick are of the opinion that Sergeant Greco is
totally and permanently disabled and can no longer perform his assigned duties based on
documentation supplied by treating or examining health care professionals; and,
WHEREAS, the Borough of Waldwick is unable to provide an alternative to the PFRS-covered position
with duties capable of being performed by Sergeant Greco; and,
WHEREAS, the Mayor and Council of the Borough of Waldwick have consented to the processing of the
Involuntary Disability Retirement application; and,

WHEREAS, the Borough’s labor attorney recommends entering into a Separation and Release
Agreement with Sergeant Greco to effectuate the application of the involuntary disability retirement,
the terms of the separation of employment, and the release of claims.
NOW, THEREFORE, BE IT RESOLVED BY the Mayor and Council of the Borough of Waldwick that Borough
Administrator and Borough Staff process an Involuntary Disability Retirement application for Sergeant
Greco; and,
BE IT RESOLVED that the Municipal Council of the Borough of Waldwick hereby authorize the Borough
Administrator to execute a Separation and Release Agreement with Sergeant Greco; and,
BE IT FURTHER RESOLVED that the Municipal Council of the Borough of Waldwick hereby authorize Labor
Counsel to make de minimis changes to the Separation and Release Agreement that are in line with the
intent of the Municipal Council; and,
BE IT FURTHER RESOLVED that copies of this Resolution shall be forwarded to all parties involved in the
administration of this action.
