MINUTES FOR THE REGULAR MEETING
OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK
HELD ON TUESDAY, MAY 9, 2023 AT 7:30 PM
Mayor Giordano called the meeting to order and read the Statement of Compliance.
Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Ms. Cericola, Mr. Ritchie, Mr.
Schatz, Mr. Sciolaro and Mrs. Weber. Mrs. Sherman was absent.
Also present: Kelley Halewicz, Interim Borough Administrator/Municipal Clerk; Matthew Guilder, Grants
Administrator/QPA and Craig Bossong, Municipal Attorney.
Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of
silence honoring our Veterans and to remain standing for the prayer.
PROCLAMATIONS & PRESENTATIONS
a. Recognition of Retirement for William Schmidt
Mayor Giordano presented Billy Schmidt with a recognition for his retirement from the Borough after
43 years of service in the DPW.
b. Recognition of Retirement for Barry Ackerman
Mayor Giordano presented Barry Ackerman with a recognition for his retirement from the Borough
after 41 years of loyal service in the DPW.
c. Recognition for 50 Years of Service as a Waldwick Firefighter Thomas Pinkham
Mayor Giordano was honored on behalf of the Council to honor a dedicated and devoted member of
the Waldwick Volunteer Fire Department who is celebrating 50 years of service to our community.
d. Public Hearing on the Submission of a 2023 Bergen County Open Space Trust Fund Municipal Program
for Park Development Funding Application - Lions Club Memorial Playground at Borough Park • Block
154 Lot 34 • 217 Pine St. Waldwick, NJ 07463
Mr. Guilder reported that the Lions Club Playground is at the end of useful life and renovations are
needed. We have applied for and received $70,000 from NJBCA grant. The engineer’s estimate to
completely renovation the playground with new equipment, make it ADA compliant is $570,000. This
seems like a large number but when you break it down, there is $30,000 in fencing costs and another
$40,000 is optional costs that bring the number down if we choose to scale that back. We are applying
to Bergen County Open Space for $285,000 and if received, the $70,000 that the Borough already
received would go toward the 50% match, making the Borough’s portion $215,000.
Depending on the award from this grant, the Borough could apply for a second grant next year like
we did for Ted Bell Park. This playground definitely needs to be renovated as it is over 30 years old
and in dire need of replacement. Definitely need of renovate over 30 years old grant in place. Mr.
Guilder looks forward to hearing and taking questions from the Council and public on this grant
application.

e. Resolution 2023-179 Endorsement of the Submission of the Bergen County Open Space Trust Fund
Grant Application for Park Development at the Lions Club Memorial Playground at Borough Park
Mayor Giordano commented that he was there on Saturday and the playground is in need of replacement.
With regards to the fencing, being that it is near the stream, the fencing would need to be done. Fencing
was an issue initially when the playground went in as a way to keep the children from going to the stream.
RESOLUTION NO. 2023-179
Endorsement of the Submission of the Bergen County Open Space Trust Fund Grant Application for
Park Development at the Lions Club Memorial Playground at Borough Park
WHEREAS, the Bergen County Open Space, Recreation, Floodplain Protection, Farmland & Historic
Preservation Trust Fund (“County Trust Fund”), provides matching grants to municipal governments and
to nonprofit organizations for assistance in the development or redevelopment of outdoor municipal
recreation facilities; and,
WHEREAS, the Borough of Waldwick desires to further the public interest by obtaining a matching grant
of $285,000.00 from the County Trust Fund to fund the following project: Improvements to Lions Park
Memorial Playground at Borough Park; and,
WHEREAS, the governing body/board has reviewed the County Trust Fund Program Statement, and the
Trust Fund Municipal Program Park Improvement application and instructions, and desires to make an
application for such a matching grant and provide application information and furnish such documents as
may be required; and,
WHEREAS, as part of the application process, the governing body/board received held the required Public
Hearing to receive public comments on the proposed park improvements in the application on (insert
date); and,
WHEREAS, the County of Bergen shall determine whether the application is complete and in conformance
with the scope and intent of the County Trust Fund; and,
WHEREAS, the applicant is willing to use the County Trust Fund in accordance with such rules, regulations
and applicable statutes, and is willing to enter into an agreement with the County of Bergen for the above-
named project and ensure its completion on or about the project contract expiration date.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick:
1. That it is hereby authorized to submit the above completed project application to the County by
the deadline of May 12, 2023, as established by the County; and,
2. That, in the event of a County Trust Fund award that may be less than the grant amount requested
above, the Borough of Waldwick has, or will secure, the balance of funding necessary to complete
the project, or modify the project as necessary; and,
3. That the Borough of Waldwick is committed to providing a dollar-for-dollar cash match for the
project; and,

4. That only those park improvements identified and approved in the project application, its Trust
Fund contract, or other documentation will be considered eligible for reimbursement; and
5. That the Borough of Waldwick agrees to comply with all applicable federal, state, and local laws,
rules, and regulations in its performance of the project; and,
6. That this resolution shall take effect immediately.

MAYOR’S REPORT AND REPORTS OF COMMITTEES
Mayor’s Report. Mayor Giordano congratulated Stan Kowalski and the 5K Committee on a successful race
day on Sunday. Many walkers and runners, they broke the record on attendance. He also thanked the
Beautification Committee, Environmental Committee and Green Team on a successful rescheduled Earth
Day event as well as John Vervoort the Bee Man.
On Saturday, the Mayor will attend the Bergen County Mayor Association meeting where the Director of
shared service with the county will attend to discuss shared service options.
Mayor Giordano congratulated Tristan Tacconi who qualified to compete at the USA
Gymnastics National Championships that will be held in Oklahoma City starting tonight through the 14.
Only 12 athletes qualified in the state and they will be competing against others from all 50 states for a
chance to compete on the US Level 10 Junior National Team.
Financial & Administrative Committee. Mr. Sciolaro commented on the great weekend for the Borough,
great 5K race, Earth Day with lots of great volunteers and information.
Fire & Police Protection Committee. Ms. Cericola had no report for the Police Department. On the Fire
Department side, for the month of April, the fire department responded to 25 calls for service, 6 of those
being mutual aid runs. To date the fire department has responded to 75 calls for service for the year.
On April 25, the department responded to a small fire inside of a cargo container being pulled by a train,
and operated for 1 hour 30 minutes on scene until county hazmat and NJ transit released us.
With the warmer months, the department took the time to be outside and had member’s practicing their
skills of roof venting from the bucket of Truck 641, with fire department made props. The junior members
were given a refresher on the proper way to attach to a fire hydrant to establish city water. Members took
a Thursday night to review the new airbag system for R642 and a new hose pack for our “extended pack”
bundles. These bundles are for our larger buildings (the Bristol, the station etc).
The department had the honor of attending the 5K run this past Sunday and flying the American flag over
the runners and walkers as they competed in the event.

The department held its first membership drive at Waldwick High School on April 20th to try to get
students to join the Waldwick Fire Department.
Earlier tonight, Ex-Chief Thomas Pinkham celebrates 50 years of dedicated service to the department and
the Borough of Waldwick and was honored for this accomplishment.
Public Safety Committee. Mayor Giordano read Mrs. Sherman’s report. WALVAC very excited and
grateful that the two Lucas machines have arrived. The members of WALVAC participated in a practical
training session that was presented by Stryker. They plan on training often so that everyone is proficient
to the point of it being second nature. The members provided stand-by services for the Waldwick 5k.
The calls for the month of April: 36 total calls answered by 22 members. One member responded to 13
of those calls. 35 calls were 911 and 1 was stand by. 28 calls were responded to in less than 5 minutes.
Calls ranged in age from under 1 to 99 years. 3 calls were to the Bristol in the month of April. Total calls
for the first four months of year to Bristol is 20. Transports to the following hospitals: Holy Name Hospital
2; New Bridge Medical Center (Bergen) 2; and Valley Hospital 27.
Councilwoman Sherman extends her continued thanks and gratitude to the members of WALVAC for their
dedicated service to the Borough.
Recreational & Health Committee. Mrs. Weber thanked the committees who work on Earth Day and the
Chamber of Commerce 5K. Baseball and softball are in full swing and the beloved snack stand is open so
thank you to the parents who make it so successful. Pool registration is ongoing. The pool painting is
completed and the W is being painted by Waldwick High School Art department. There are library
programs available for all ages. Swim Club registration is open until June 9. The Memorial Day Parade
and Ceremony start promptly at 10:00 am on Monday, May 29. The 15th Annual WCA Car Show is June 7
at the train station.
For the Health Department, May is Mental Health Awareness Month and Mrs. Weber attended a Stigma-
Free symposium.
Mrs. Weber also attended the Waldwick Board of Education Committee meeting for Mr. Ritchie where
teachers of the year were announced. Ms. Carey, Kindergarten; Ms. Clapp at Traphagen, Mrs. Magner,
Waldwick Middle School and Margaret Kabojian, Waldwick High School.
The $40 million budget passed. The carnival matter still has no resolution.
Public Works Committee. Mr. Ritchie thanked Mrs. Weber for attending the Board of Education meeting
for him. The water main repair went well and phase two will take place this week which is a shorten,
easier repair. All hands-on deck for the pool right now as it continues repairs and prep for the season.
DPW is doing spring cleaning on equipment and in the parks.
Buildings & Grounds Committee. Mr. Schatz stopped by the pool over the weekend and it looks great.
The W will be painted this week. The Borough Parking lot project is just about finished. The additional
trees went in and we are awaiting pricing on the sprinkler system and seal coat/striping of the lot. The
PSEG lighting project continues are Fire Company #2 and WALVAC. Boswell is underway with the bridge
over HCA project.
At the Planning Board Special Meeting, the Board approved the redevelopment plan. Prior to that
meeting, the Regular Planning Board meeting there were two resolutions approved.

BCUA Household Hazardous Waste Collection is this weekend in Mahwah.
DEPARTMENT HEAD REPORTS
Attorney. Mr. Bossong reported that the Tax Assessor provided him with the County Tax Appeal. There
are very few appeals and he will work with her to get some of them resolved. Hearings are later this
month.
Municipal Clerk. Mrs. Halewicz explained final emails sent to members of boards that did not complete
their Financial Disclosure form. State will begin to levy personal fines for those who did not comply.
Mrs. Halewicz reported that she and Tatiana attended boardworkers training last Friday and municipal
clerk training yesterday for the upcoming June Primary election where the new voting machines will be
used. All new equipment. Each polling location will now also have a Super Boardworker with additional
training and responsibilities to assist.
May 16 last day to register to vote in the June Primary. Clerk’s office open until 8:00 pm.
June 2 – 4 Early Voting Period (Friday & Saturday 10 am – 8 pm and Sunday 10 am – 6 pm)
Mail-in Ballot drop box is open just behind the Public Safety Complex, 15 E. Prospect. There are signs
directing voters to the box.
To assist in the voter check-in in process, we are urging voters to bring their sample ballot to the polls.
Save the date for the Memorial Day Parade & Ceremony – Monday, May 29 at 10:00 am.
Online Pool registration is open as well as online swim team and swim lessons

Discussion.
Mayor Giordano discussed Resolution 2023-182 which is a redevelopment program that the town is going
to start. It is a non-condemnation area. We looked at certain areas where there is a need. A Special
Planning Board meeting was held April 24, where residents in the area attended along with our Planner.
The residents were in favor as long as they know their homes were not going to be taken from in and they
could opt out of the program
Mr. Sciolaro reiterated that the items being purchased this evening have been thoroughly vetted in the
budget process. It starts with the Administration and Department Heads, then the Mayor and Council
review the requests, they are included in the budget. The purchases either come from competitive
bidding process or through a purchase list, co-op or state contract to which the Borough belong to a
number of. None of this is new spending. The resolution is the final step in funding these approved items
from the budget.
Mr. Sciolaro commented on Resolution 2023-195 that this grant was not anticipated in the 2023 budget
as the grant was not awarded until after the budget was adopted. This amount will be inserted into the
stormwater line to be used for that purpose.
REGULAR MEETING MINUTES: 7 MAY 9, 2023
Ms. Cericola commented on Resolution 2023-184 that commend the fire department for their hard work
in researching and selecting a tower ladder for our Borough to replace our 2001 American LaFrance. With
lead times 2-3 years out on fire trucks, it is the responsible time to purchase a new one.
The Tower Ladder Committee worked tirelessly over the last year or so creating a detailed list of
requirements for the Borough, meeting with 3 major manufacturers of which myself and Patrick
participated, and finally bringing the selection process to a close by meeting with the Fire and Police
Protection subcommittee a few weeks ago to present their research and analysis.
I am proud of the work that went into this important decision and know that this is the right tower ladder
that will ensure our fire department is properly equipped to keep our residents safe.

Council comments. Mayor Giordano explained that these two titles were inadvertently left off the
previous salary ordinance.

RESOLUTION NO. 2023-198
Authorize Salaries for 2023
WHEREAS, the Mayor and Council adopted Ordinances which sets the salary ranges for certain Borough
Employees effective January 1, 2023.
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Waldwick that, in
accordance with previously adopted Ordinances the annual base salary or hourly rate of each Borough
Official and Employee is listed on the schedule annexed hereto and made a part hereof; and,
BE IT FURTHER RESOLVED, that the rates set forth on the annexed schedule shall take effect January 1,
2023 except as otherwise stated in said schedule; and,
BE IT FURTHER RESOLVED, that the rate or compensation of any other Borough Official or Employee
heretofore fixed but not mentioned herein shall be deemed to be unaffected by the adoption of this
resolution and shall continue as heretofore fixed or established.

INTRODUCTION OF ORDINANCE(S) – None.
UNFINISHED BUSINESS
Mr. Bossong commented on the redevelopment resolution that is will formally designate the area as an
area in need and he will prepare a memo to the Council on the next steps.
Mr. Schatz thanked the Environmental Committee and Beautification Committee for Earth Day. The group
is working on many other tasks.
NEW BUSINESS
Mr. Guilder reported the State has recently passed legislation that eliminates the need for window
contracts (contracts between $17,500 and $44,000, the bid threshold) to be passed by the governing
body. The authority to issue these contracts can now solely be done by a Qualified Purchasing Agent. Mr.
Guilder will continue to ensure compliance by collecting the necessary pay-to-play paperwork, state
contract or Co-Op information as needed, and will retain written documentation for all window contracts
that are issued. For example, the computer that we keep having issues with here could have already been
replaced were it not for a resolution that now needs to be pass for a purchase of this type.
PUBLIC COMMENT
Mayor Giordano asked if any member of the public wished to come forward and to discuss anything and
if so, please state your name and address for the record.
Mr. McHugh spoke to the issue of the Traffic Study and learning that Mr. Wherry is no longer with the
Borough, very concerned the project is on hold.
Mrs. Halewicz assured him that she has been in touch with Thomas but because he was traveling in India
communication was difficult. Trying to schedule a meeting with the Committee on the draft memo before
it is finalized and there is a public hearing.
Stan Kowalski, President Waldwick Chamber of Commerce, and 5K Race Director thanked the Mayor and
Council for their support of the 5K for the past 15 years. Also thanked WALVAC, Marcus Rutkowski, Jean
Paras and Officer Sinclair. It was a great day and they raised $3,000. Congratulations to Councilwoman

Cericola who finished first in her age group and Councilman Sciolaro for finishing. The 2024 race will be
May 5.
Ted Sanzo complemented Councilwoman Sherman on mentioning Andres that passed away. Mr. Sanzo
suggested a second dumpster behind the police department for cardboard/mixed paper. He appreciated
the progress on the water. He is concerned about medical consequences for firefighters who are
subjected to the foam. He is hoping we can have a fire prevention department to do something more
than just buy a $1.9 million truck.

Endorsement of the Submission of the Bergen County Open Space Trust Fund Grant Application for
Park Development at the Lions Club Memorial Playground at Borough Park
WHEREAS, the Bergen County Open Space, Recreation, Floodplain Protection, Farmland & Historic
Preservation Trust Fund (“County Trust Fund”), provides matching grants to municipal governments and
to nonprofit organizations for assistance in the development or redevelopment of outdoor municipal
recreation facilities; and,
WHEREAS, the Borough of Waldwick desires to further the public interest by obtaining a matching grant
of $285,000.00 from the County Trust Fund to fund the following project: Improvements to Lions Park
Memorial Playground at Borough Park; and,
WHEREAS, the governing body/board has reviewed the County Trust Fund Program Statement, and the
Trust Fund Municipal Program Park Improvement application and instructions, and desires to make an
application for such a matching grant and provide application information and furnish such documents as
may be required; and,
WHEREAS, as part of the application process, the governing body/board received held the required Public
Hearing to receive public comments on the proposed park improvements in the application on (insert
date); and,
WHEREAS, the County of Bergen shall determine whether the application is complete and in conformance
with the scope and intent of the County Trust Fund; and,
WHEREAS, the applicant is willing to use the County Trust Fund in accordance with such rules, regulations
and applicable statutes, and is willing to enter into an agreement with the County of Bergen for the above-
named project and ensure its completion on or about the project contract expiration date.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick:
1. That it is hereby authorized to submit the above completed project application to the County by
the deadline of May 12, 2023, as established by the County; and,
2. That, in the event of a County Trust Fund award that may be less than the grant amount requested
above, the Borough of Waldwick has, or will secure, the balance of funding necessary to complete
the project, or modify the project as necessary; and,
3. That the Borough of Waldwick is committed to providing a dollar-for-dollar cash match for the
project; and,

4. That only those park improvements identified and approved in the project application, its Trust

6. That this resolution shall take effect immediately.

Concurring with Planning Board’s Redevelopment Investigation Findings Regarding Block 114, Lots 1, 7,
9, 11, 15, 16, 24, 25 And 26; Block 115, Lots 1, 2, 3, 4 And 26; and Block 116, Lots 1, 4, 9, 16, 29 and 36
and Designating them as an Area in Need Of Redevelopment for Noncondemnation Purposes
WHEREAS, pursuant to N.J.S.A. 40A:12A-6, by Resolution No. 2022-266 adopted on August 16,
2022 the governing body of the Borough of Waldwick (the “Borough”) authorized and requested the
Planning Board to undertake a preliminary investigation (the “Investigation”) to determine whether Block
114, Lots 1, 7, 9, 11, 15, 16, 24, 25 and 26; Block 115, Lots 1, 2, 3, 4 and 26; and Block 116, Lots 1, 4, 9, 16,
29 and 36 (the “Area of Investigation”) constitutes an area in need of redevelopment according to the
criteria set forth under the Local Redevelopment and Housing Law (“LRHL”), specifically N.J.S.A. 40A:12A-
5 and N.J.S.A. 40A:12A-3; and,
WHEREAS, consistent with the requirements set forth in N.J.S.A. 40A:12A-6, the Planning Board
specified and gave notice that on April 24, 2023, a hearing would be held for the purpose of hearing
persons who are interested in or would be affected by a determination that the properties in the Area of
Investigation constitute an area in need of redevelopment as that term is defined under the LRHL for non-
condemnation purposes; and,
WHEREAS, Paul Grygiel, PP of Phillips Preiss publicly presented a “Report of Preliminary
Investigation for Determination of an Area in Need of Redevelopment” for the designated Area of
Investigation dated January, 2023 (the “Investigation Report”), which is attached hereto and made part
hereof as Exhibit A; and,
WHEREAS, the Investigation Report opines that the Area of Investigation evidences conditions
and characteristics that qualify the Area of Investigation as an “area in need of redevelopment” because
it collectively satisfies the following statutory criteria of the LRHL under N.J.S.A. 40A:12A-5; and,
WHEREAS, in its entirety, the Investigation Report demonstrates that the cumulative effects of
the negative conditions existing upon the property located within the Area of Investigation is having a
decadent effect on the surrounding properties, which is demonstrated through the pictures, narrative,
Borough records and uncontested testimony of Mr. Grygiel, showing that many of the properties in the
immediate vicinity are in visual need of repair, vacant and/or have already been declared as areas in need
of redevelopment and rehabilitation too for these reasons; and,

WHEREAS, on April 24, 2023, the Planning Board held a properly noticed public hearing pursuant
to the requirements of N.J.S.A. 40A:12A-6 concerning the Area of Investigation, with Clifford Singer, Esq.
representing the Planning Board and Borough Redevelopment Counsel Matthew E. Gilson, Esq. being
present; and,
WHEREAS, the hearing was opened to all persons from the public who were generally interested
in or would be affected by a finding that the property within the Area of Investigation constitutes an area
in need of redevelopment under N.J.S.A. 40A:12A-5 and N.J.S.A. 40A:12A-3; and,
WHEREAS, on April 24, 2023, the Planning Board received uncontested testimony from Mr.
Grygiel providing a first-hand account of the conditions that he observed during his exhaustive
examination of the property within the Area of Investigation, which confirmed the description of the
conditions and his findings contained in the Investigation Report; and,
WHEREAS, on April 24, 2023, the Planning Board unanimously recommended that the governing
body of the Borough designate the Area of Investigation as a non-condemnation area in need of
redevelopment due to the substantial evidence that the Area of Investigation meets the criteria
enumerated in the Investigation Report, pursuant to N.J.S.A. 40A:12A-5.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick in the
County of Bergen, State of New Jersey that it hereby adopts the above recitals, findings of the Planning
Board and the Investigation Report attached hereto as Exhibit A prepared by Phillips Preiss as if set forth
fully herein, therefore, determining and hereby declaring that the Area of Investigation consisting of Block
114, Lots 1, 7, 9, 11, 15, 16, 24, 25 and 26; Block 115, Lots 1, 2, 3, 4 and 26; and Block 116, Lots 1, 4, 9, 16,
29 and 36 are hereby determined to be a non-condemnation area in need of redevelopment according to
the criteria set forth under N.J.S.A. 40A:12A-5; and,
BE IT FURTHER RESOLVED that pursuant to N.J.S.A. 40A:12A-6(b)(5)(c), the Borough Clerk is
hereby authorized and directed to transmit a certified copy of this Resolution to the Commissioner of the
Department of Community Affairs for review; and,
BE IT FURTHER RESOLVED that pursuant to N.J.S.A. 40A:12A-6(b)(5)(d), the Borough Clerk is
hereby authorized and directed to transmit a certified copy of this Resolution upon all record owners of
the properties located within the delineated Area of Investigation as those names are listed within the
official Tax Assessor’s records within ten (10) days of the adoption hereof; and,

WHEREAS, the Borough of Waldwick is a member of the Northwest Bergen County Shared Services
Consortium; and,
WHEREAS, the Consortium has publicly bid for repaving of various roads in member municipalities and
the contract meets the fair and open requirements of pay to play; and,
WHEREAS, the low bidder was J.A. Alexander, Inc. 130-158 John F. Kennedy Dr. N, Bloomfield, NJ 07003
and the Borough of Ramsey, the lead agency awarded the contract; and,
WHEREAS, member municipalities must pass resolutions concurring to this award and authorize individual
contracts to be signed by the member municipalities with J.A. Alexander, Inc.; and,
WHEREAS, the Borough of Waldwick estimates costs to be $342,716.19 under this contract based upon

previously made commitments and payments does not exceed the funds available in said appropriation;

Award Fair and Open Contract to Fire & Safety Services LTD. for the Procurement of a Custom Chassis
100FT Mid Mount Ladder Tower Fire Apparatus $1,878,411.11
WHEREAS, the Borough of Waldwick is a member of the Houston-Galveston Area of Governments (HGAC)
purchasing program, a national purchasing cooperative; and,
WHEREAS, HGAC awarded a contract (FS12-19) to Fire & Safety Services LTD. for fire apparatus for the
period of December 1, 2019 through May 30, 2023; and,
WHEREAS, P.L. 2011 c139 (the “Law” or “Chapter 139”) allows local contracting units to utilize national
cooperative contracts as a method of procurement; and,
WHEREAS, the New Jersey Department of Community Affairs, Division of Local Government Services
(DLGS) has published LFN 2012-10, a Local Finance Notice detailing guidance to contracting units desiring
to purchase under the Law; and,
WHEREAS, the Interim Borough Administrator and Qualified Purchasing Agent are satisfied that the
procurement conducted by HGAC and the contract awarded to Fire & Safety Services LTD. with the
associated documentation submitted by both HGAC and Fire & Safety Services LTD. are compliant with
the guidance in LFN 2012-10; and,
WHEREAS, the Borough of Waldwick published a notice in the April 17, 2023 edition of The Bergen Record
and posted a notice on www.waldwicknj.org of its intent to award a contract to Fire & Safety Services LTD.
for a new Custom Chassis 100FT Mid Mount Ladder Tower Fire Apparatus; and,
WHEREAS, the Borough of Waldwick intends to pay the optional chassis and aerial prepay, approximately
120 days before the unit is ready for inspection at Pierce Manufacturing. As a result, the total cost will be
decreased from $1,913,039.22 to $1,878,411.11 resulting in savings of $34,628.11; and,
WHEREAS, a cost savings determination in accordance with LFN 2012-10 demonstrates that purchasing
this equipment through the HGAC Co-Op will save the Borough $12,800 compared to other methods of
procurement. When the prepayment terms are applied the cost savings rise to $47,428.11; and
WHEREAS, the Chief Financial Officer of the Borough of Waldwick has certified that $1,878,411.11 is
available in the following appropriation G-04-23-485-310, and has further certified that this commitment
together with all previous commitments and payments does not exceed the funds available in said
appropriation; and,

Contract.

Award Fair and Open Contract to Gentilini Motors for the Purchase of One Emergency Management
Vehicle, $55,888.04
WHEREAS, the Office of Emergency Management t is in need of one new vehicle to assist with providing
emergency services; and,
WHEREAS, the attached quote was from Gentilini Motors to purchase one (1) Chevy Tahoe vehicle; and,
WHEREAS, N.J.S.A. 40A:11-10 and N.J.S.A. 40A:11-12 permit municipalities to award public contracts
without public bidding when the vendor is an approved state contractor or part of an approved national
cooperative; and,
WHEREAS, the vehicle is on NJ State Contract 17-FLEET-00758; and,
WHEREAS, the contracts were awarded through a fair and open process, pursuant to N.J.S.A. 19:44A-20.4
et seq.; and,
WHEREAS, Colleen Ennis, Chief Financial Officer, has certified that $55,888.04 is available in the following
appropriation: G-04-23-485-411 and has further certified that this commitment together with all
previously made commitments and payments does not exceed the funds available in said appropriation;
and has further certified that the funds available in the said appropriation are intended for the purpose
herein committed.
NOW, THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of Waldwick that the
Borough Administrator is hereby authorized to utilize the Cranford Cooperative Contract with Gentilini
Motors, 2703 Fire Road, Egg Harbor Township, NJ 08234 to purchase one (1) Chevy Tahoe vehicle in the
amount of $55,888.04.

Award Non-Fair and Open Contract to Koch 33 Ford for a F-150 Police Responder Vehicle, $43,478.00
WHEREAS, the Police Department is in need of one new vehicle to replace one vehicle in their fleet that
is past its useful life; and,
WHEREAS, the Borough solicited multiple quotes and determined Koch 33 Ford’s proposal dated March
23, 2023 is the most advantageous, price and other factors considered; and,
WHEREAS, Koch 33 Ford’s total aggregate awards, including this award, will exceed the Pay-to-Play limit
of $17,500 over a one-year period; and,
WHEREAS, this contract is being awarded as a non-fair and open and is in conformance with the provisions
of N.J.S.A. 19:44A-20.4 et seq.; and,
WHEREAS, Koch 33 Ford has completed and submitted a Business Entity Disclosure Certification which
certifies Koch 33 Ford has not made any reportable contributions to a political or candidate committee in
the Borough of Waldwick in the previous one year, and that the contract will prohibit Koch 33 Ford from
making any reportable contributions through the term of the contract; and,
WHEREAS, the Chief Financial Officer of the Borough of Waldwick has certified that $43,478.00 is available
in the following appropriation G-04-23-485-411, and has further certified that this commitment together
with all previous commitments and payments does not exceed the funds available in said appropriation.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick authorize
Koch 33 Ford, 3810 Hecktown Road, Easton PA, 18045-2354 to provide a F-150 Police Responder Vehicle

WHEREAS, Notice to Bidders to Lease/Operate Vegetative Waste Transfer Station, was advertised in
accordance with Local Public Contracts Law; and,
WHEREAS, two (2) bids were received, opened and read on April 27, 2023 and were reviewed by the
Borough Administrator Patrick Wherry; and,
WHEREAS, the bid results were as follows:

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick that the bid of
Environmental Renewal LLC, 27 Andrews Drive, Woodland Park, NJ 07424 is hereby accepted and the
Mayor and Borough Clerk are hereby authorized to execute a contract with Environmental Renewal LLC
for the lease of the leaf composting site located at Lot 4, Block 110 for a period of 3 years commencing on
August 1, 2023.

WHEREAS, pursuant to the provisions of N.J.S.A. 40A:11-36 the Borough of Waldwick may sell any
personal property; and,
WHEREAS, the Mayor and Council of the Borough of Waldwick have determined that said property is not
needed for public purposes and wishes to divest same; and,
WHEREAS, this sale will be in “as is” condition without express or implied warranties.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Waldwick, as follows:
1. The surplus property to be sold, as identified in Schedule A, shall be sold in an “as is” condition

ADDITIONAL FEES
BE IT ORDAINED that the Municipal Council of the Borough of Waldwick hereby amends Chapter 48 FEES,
Section 97-87 Zoning Permits and Section 97-92.1 Zoning – Certificate of Compliance, to amend fees in
these sections and include additional fees. The changes to Code of the Borough of Waldwick below shows
deletions to the code in strikethrough and additions in underline as follows:
§48:97-87 Zoning Permits.
48:97-87. Zoning permits.
The fee to review for zoning compliance, the construction of a garden type utility sheds, and driveways
and similar structures that is one hundred square feet, or less in area is $40. 50.
The fee to review for zoning compliance a fence six feet or less in height that is not a barrier surrounding
a public or private swimming pool is $40. 50.
§48:97-92.1 Zoning - Certificate of compliance.

D. Fees. The following fees shall be charged for the issuance of a certificate of
compliance:
1.
Apartments in multifamily dwellings: fifty-five dollars ($50 55.) each unit.
2.
One and two-family dwellings: fifty-five dollars ($50 55.) each unit.
3.
Non -Residential dwellings: seventy- fifty-five dollars ($75. $55.) for each tenancy.
4.
Reinspection fee excluding sidewalks: fifteen dollars ($15.).
E. Smoke detectors in one- and two-family dwellings and remote water meters. No
certificate of occupancy or certificate of continuing occupancy shall be issued for
any dwelling, including one- or two-family dwellings, unless smoke detectors are
installed in such dwelling in accordance with Chapter 51 of the Code of the Borough
of Waldwick or a remote water meter has been installed in accordance with Chapter
94, entitled "Water Supply," of the Borough of Waldwick Code or a deposit of $35,
effective January 1, 2002, is made to the Borough for installation of the remote
water meter. The homeowner or occupant shall also sign a form provided by the
Borough, acknowledging that they will permit the Borough official access to the
dwelling for installation of the remote water meter.
BE IT FURTHER RESOLVED that the ordinance shall take effect upon publication and adoption as required
by law.

Please take notice that the foregoing Ordinance was introduced and passed on first reading by the Mayor
and Council of the Borough of Waldwick, Bergen County, New Jersey, at the Regular Meeting of said
Governing Body held on Tuesday, April 25, 2023 and will be further considered for final passage after a
public hearing to be held on Tuesday, May 9, 2023 at 7:30 pm in the Council Chambers, Administration
Building, 63 Franklin Turnpike, Waldwick, New Jersey, at which time and place those concerned or
affected thereby may be heard.
Copies of the foregoing Ordinance are available to interested persons at the office of the Municipal Clerk
and may be secured upon application to the Municipal Clerk during regular business hours.

THE COMPENSATION, SALARIES AND WAGES OF OFFICIALS AND

BE IT ORDAINED by the Mayor and Council of the Borough of Waldwick, in the County of Bergen and State
of New Jersey, as follows:
Section 2. Annual salaries for other officials and employees.
For the purpose of fixing salary ranges, the annual salary ranges for certain positions in the Borough are as
follows: payable in 24 installments, starting January 1, 2023 except as otherwise noted.

RESOLUTION NO. 2023-198
Authorize Salaries for 2023
WHEREAS, the Mayor and Council adopted Ordinances which sets the salary ranges for certain Borough
Employees effective January 1, 2023.
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Waldwick that, in
accordance with previously adopted Ordinances the annual base salary or hourly rate of each Borough
Official and Employee is listed on the schedule annexed hereto and made a part hereof; and,
BE IT FURTHER RESOLVED, that the rates set forth on the annexed schedule shall take effect January 1,
2023 except as otherwise stated in said schedule; and,
BE IT FURTHER RESOLVED, that the rate or compensation of any other Borough Official or Employee
heretofore fixed but not mentioned herein shall be deemed to be unaffected by the adoption of this
resolution and shall continue as heretofore fixed or established.
