MINUTES FOR THE REGULAR MEETING
OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK
HELD ON TUESDAY, JUNE 20, 2023 AT 7:30 PM
Mayor Giordano called the meeting to order and read the Statement of Compliance.
Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Ms. Cericola, Mr. Ritchie, Mr.
Schatz and Mrs. Sherman. Mr. Sciolaro and Mrs. Weber were absent.
Also present: Kelley Halewicz, Interim Administrator/Clerk Kelley Halewicz; Matthew Guilder, Grants
Administrator; and William Hutchenson for Borough Attorney Craig Bossong.
Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of
silence honoring our Veterans and to remain standing for the prayer.
MAYOR’S REPORT AND REPORTS OF COMMITTEES
Mayor’s Report. Mayor Giordano reported that Ashley Greco was named Miss NJ Teen 2023. She will
represent the State at the Miss America Teen in January. We congratulate Ashley and wish her the best
in January.
The Municipal Pool is open and we already have a save by Joey Convertini. We will recognize Joey at our
July meeting. Mayor Giordano met with an Eagle Scout candidate for a project. They will install benches
at Borough Hall in the grass area. Mayor Giordano attended the Middle School graduation on Friday
morning as well as the Waldwick High School graduation that evening. The Junior Police Academy started
with our first responders providing demonstrations and discussion. Later that day, the group came in to
discuss government and my role as Mayor. The Mayor attended the Girl Scout Bridging Ceremony.
Mayor Giordano reported that the Borough has hired a new Administrator Steven Neale who will start
July 10. We received 14 applications; interviewed 8, paired it down to 2 candidates and at our Special
Meeting we decided to hire Steven Neale.
Financial & Administrative Committee. No report.
Fire & Police Protection Committee. Ms. Cericola reported that the Police Department has seen a slight
uptick in DWI arrests over the last month or so. Something to be concerned with, so they are keeping an
eye on it. Another two catalytic converters stolen. There are certain cars that are targeted more
frequently than others. Chief Messner will have the Detective Bureau put something out about it. In one
instance a neighbor witnessed the theft but didn’t bother to call the Police Department.
In addition, a couple of other cars rummaged were broken in to. The Police Department would like to
remind residents not to leave anything of value in their cars overnight, even loose change. It makes the
vehicle a more likely target. Vehicles should also be locked, especially overnight.
Pete Bernhard graduated from the Police Academy on the 14th and is currently going through his FTO
(Field Training Officer) Program. This process normally takes about two months.
Interviews for Police Sergeant were completed with a recommendation to Kelley.

The Junior Police Academy class started yesterday and there will be a graduation ceremony on Friday.
Ms. Cericola reported on the calls so far for the month of June. The department also conducting the
annual Grad Ball walkthrough. The department along with police department participated in Traphagen
Field Day including a tug of war against the 5th graders. On May 31 the department participated in the
Memorial Day Parade & Ceremony. June 1 members participated in a mental health day program. June
6 members attended the Career Fair at the High School. June 19 the department participate in hands-on
activities and vehicle extrication for the Junior Police Academy. Members attended WHS Graduation as
two junior members graduated. Finally, on June 17 the department celebrated Tom Pinkham’s 50 years
of service with a picnic.
Public Safety Committee. Mrs. Sherman reported that WALVAC had 47 calls, handled by 18 members.
One member answered 30 of those calls; another member answered 18 of those calls. They had 5 calls
to The Bristol, with 181 calls to date.
At their Business Meeting, it was reported that they participated in a mutual aid drill with other
municipalities. WALVAC awarded two scholarships for students going into the medical field.
The Corps conducted a hand-ons CPR class at the library where 22 residents attended. They will conduct
this class again in September.
The Corps thanks the Borough for the purchase of the Lucas machine. They now have one in each rig.
The Corps also participated in the Junior Police Academy on Monday, introducing the recruits to basic first
aid.
The Corps is grateful for the donation to purchase supplies as well as the new members. They will attend
the Allendale Fireworks on the 4th.
Mrs. Sherman congratulated Ashley Greco on her accomplishment as well as the WHS graduates. Thank
you also to all the parents who continued the tradition of the Grad Ball.
Recreational & Health Committee. No report.
Public Works Committee. Mr. Ritchie reported that DPW is getting the roads ready for the road program
and are upgrading ramps. They are watering the new plants at Borough Hall until the irrigation system is
installed. They are also doing wellhouse rehabilitation.
Buildings & Grounds Committee. Mr. Schatz reported that he attended the Planning Board meeting of
June 7 where they had one new application. The Environmental Committee is looking into working with
Ridgewood for disposal of our Styrofoam. It should save us time and money. Also, the Committee is
putting together a flyer to conserve water this summer.
Mrs. Sherman asked how much it was going to cost to go with Ridgewood. Mr. Schatz explained that they
are working on that now to see if it makes sense.
DEPARTMENT HEAD REPORTS
Interim Administrator/Municipal Clerk. Mrs. Halewicz reported that Resolution 2023-220 the RFP is a
blanket RFP to seek proposals from any developer that is interested in developing any lot or lots in the
area that the Borough recently determined to be an Area in Need of Redevelopment. This doesn’t
obligate the Borough to accept any proposals, but this is to allow potential redevelopers to submit their

thoughts and proposals for the Borough to consider. This is a continuous process and all proposals are
accepted on a rolling basis and considered one by one as they come in.
Resolutions 223-221, 222 and 223 authorize the Borough to sign agreements with individuals who have
applied and been qualified to participate in the Affordable Housing Improvement Program. The Borough
established this program to benefit low-income individuals in the Borough and hired a consultant to
administer the program. The consultant has reviewed these applications and indicated that these
individuals do qualify for the program. Money will be provided to these individuals in the form of loans
that could potentially be forgiven, from the Borough’s affordable housing trust fund. None of this is
taxpayers’ dollars.
Resolution 2023-230 are the remaining 2023-2024 liquor license renewals. All requirements have been
met.
Grants Administrator. Mr. Guilder reported on two projects that were awarded last year through NJDOT
Hudson Avenue. This year the Borough applied for a CDBG grant for Bohnert Place. These are road paving
projects. There is ADA curb work that is required. At the pre-construction meeting, the projects should
be combined to reduce costs.
Mr. Guilder applied for a rolling grant for spotted lanternflies. This is a reimbursable grant; no resolution
is required.
Mr. Guilder reported that the three AEDs budgeted for were purchased and installed. Officer LoPrinzi
and Captain John Papendick will provide training to Borough employees.
Attorney. No report.

Discussion. Mr. Ritchie expressed concern over meeting with HCA in order to better improve the park and
make it useful for residents. HCA requested autonomy and view HCA as an extension of their backyards.
In light of the Committee’s discussion with HCA, Mr. Ritchie considers HCA theirs and like a private home
and therefore the Borough should not permit use of Borough owned property for this purpose.

Mrs. Sherman asked about Resolution No. 2023-231 and was concerned that they were not paying for the
permit. Normally the refund is just for the escrow. Mrs. Halewicz explained that a permit was not needed
as the installation of the sewer line did not require a road opening permit.

RESOLUTION NO. 2023-231
Authorizing Refund of Permit Fee and Road Opening Escrow
WHEREAS, Finne Building & Investment Inc. paid a permit fee of $600 for a Road Opening Permit at 54 W.
Prospect Avenue; and,
WHEREAS, the Borough of Waldwick’s Superintendent of Public Works has advised that the installation of
a new sewer line did not require a Road Opening Permit; and,
WHEREAS, the Superintendent of Public Works has recommended that the permit fee be refunded along
with the escrow deposit.
NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the Borough of Waldwick that the CFO is
authorized to issue a refund for Road Opening Permit #2023-03 from the Current fund in the amount of
$600.00 and an escrow deposit refund of $1,500.00 from the Trust Account to:

PUBLIC HEARING & ADOPTION OF ORDINANCE(S)
Mayor Giordano asked the Clerk to read Ordinance No. 2023-#14 by title.
Ordinance No. 2023-#14 - AN ORDINANCE AMENDING CHAPTER 91 VEHICLES AND TRAFFIC, SECTION 13 -
RESIDENTIAL PERMIT PARKING; OF THE CODE OF THE BOROUGH OF WALDWICK
Council comments. Mayor Giordano reminded the Council that this is dead end street where commuters
are parking, making it difficult for large vehicles including garbage truck and delivery trucks from getting
through as well as limiting parking for residents.
Ms. Cericola asked about the hours. Mrs. Halewicz explained that this is Monday – Friday from 8:00 am –
12:00 pm. During that time, residential parking only is permitted with a permit from the Police
Department. All other times, parking is available to anyone.
Public comment. No one from the public came forward.
Mayor Giordano closed the Public comment. Ordinance No. 2023-14 was advertised and on second
reading is adopted. This ordinance will go into effect immediately after approval and publication according
to law.

Council Comments. Mrs. Halewicz explained that this is just a change to coincide with when my office
collects Tenant Registrations.

it be advertised in the official newspaper of the municipality as required by law, setting a public hearing
for Tuesday, July 18, 2023 at 7:30 pm or as soon thereafter as the matter may be heard.

Mayor Giordano asked the Clerk to read Ordinance No. 2023-#16 by title.
Ordinance No. 2023-#16 - AN ORDINANCE AMENDING CHAPTER 48 FEES, SECTION 1-10.3 ESCROW FOR
OFF-DUTY AND OUTSIDE EMPLOYMENT BY POLICE OFFICERS
Council Comments. Mr. Guilder explained that this ordinance authorizes a secondary service to handle
scheduling for police outside duty. Currently scheduling for police outside duty is done in-house. The
Police Department supports moving outside duty to a vendor as they feel it will simplify scheduling as well
as open our officers up to more opportunities to receive outside duty work. The Borough is in contact with
Jobs 4 Blue to handle outside duty scheduling. Jobs 4 Blue is a vendor the Borough currently works with,
and they schedule outside duty shifts for many other municipalities. Should the Borough move to have
outside duty handled by Jobs 4 Blue or any other vendor in the future, the Borough will not lose its 6%
administrative fee. Any fees the outside vendor collects for themselves will be in addition to what the
Borough currently receives.

Dave Fytelson thanked the Council for expediting the approval for the Lions Club Carnival.
Jeff Stevens, President Waldwick Fire Department thanked the Council for the approval to paint the back
room at Fire Company No. 1.
Peter thanked the Council for approving the Ordinance for parking on Chopek Lane.
Al Coldon welcomed Steve to our town. Mr. Coldon is pleased with everyone speaking clearly into the
microphones. Mr. Coldon is having issues with his cell service. He cannot receive or make calls from his
home.
Mike McHugh as for an update on the traffic study as this issue came up a year and a half ago. There was
another issue last week that he happened to be outside for and at least 50 cars he counted cutting through
to Route 17.
Mrs. Halewicz explained that she was unable to put a meeting together with the Committee and
Consultant.

Authorizing the Borough to Issue a Request for Redevelopment Proposals
WHEREAS, pursuant to N.J.S.A. 40A:12A-6, by Resolution No. 2022-266 adopted on August 16, 2022 the
Governing Body of the Borough of Waldwick (the “Borough”) authorized and requested the Planning
Board to undertake a preliminary investigation (the “Investigation”) to determine whether Block 114, Lots
1, 7, 9, 11, 15, 16, 24, 25 and 26; Block 115, Lots 1, 2, 3, 4 and 26; and Block 116, Lots 1, 4, 9, 16, 29 and
36 (the “Area of Investigation”) constitutes an area in need of redevelopment according to the criteria set
forth under the Local Redevelopment and Housing Law (“LRHL”), specifically N.J.S.A. 40A:12A-5 and
N.J.S.A. 40A:12A-3; and
WHEREAS, the Planning Board held a hearing on April 24, 2023, and transmitted their recommendation
to the Borough; and
WHEREAS, the Borough via Resolution 2023-182 adopted on May 9, 2023 accepted the Planning Board’s
recommendation and formally declared the identified parcels as a Non-condemnation Area in Need of
Redevelopment according to the criteria set forth in the Local Redevelopment and Housing Law (“LRHL”),
specifically N.J.S.A. 40A:12A-5 and N.J.S.A. 40A:12A-3; and
WHEREAS, the Borough now wishes to solicit proposals from interested redevelopers who are interested
in acquiring properties and presenting a proposed redevelopment plan to the Borough for redevelopment
of a single or multiple parcels identified above.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick in the County
of Bergen, State of New Jersey that it hereby authorizes the Interim Borough Administrator to advertise
the attached Request for Proposals; and
BE IT FURTHER RESOLVED, that Requests for Proposals shall begin to be accepted on August 1, 2023 and
shall continue to be received on a rolling basis and considered by the Governing Body as they are received.

Award Fair and Open Contract to Pierce Eagle Equipment for Sewer Truck Rehabilitation, $245,795.55
WHEREAS, the Department of Public Works Department requires the rehabilitation of a sewer truck; and,
WHEREAS, the Department of Public Works worked with Pierce Eagle Equipment to determine what was
needed for the department, which resulted in the attached quote from Pierce Eagle Equipment dated
March 15, 2023; and,
WHEREAS, N.J.S.A. 40A:11-10 and N.J.S.A. 40A:11-12 permit municipalities to award public contracts
without public bidding when the vendor is an approved state contractor or part of an approved national
cooperative; and,
WHEREAS, Pierce Eagle Equipment’s proposal is covered under NJ State Contract #XXX; and,
WHEREAS, the contracts were awarded through a fair and open process, pursuant to N.J.S.A. 19:44A-20.4
et seq.; and,

§ 91-13 Residential permit parking.
No person shall park a vehicle on streets or parts of streets as described within the following sections
unless an appropriate and current parking permit as issued by the Borough of Waldwick Police
Department is displayed on said vehicle for those streets or parts of streets as described or listed within
the following sections.
In order to obtain a parking permit the applicant must provide proof of residency on one of the streets
for which parking is restricted under this section and the vehicle for which the permit is to be displayed
must be registered to the resident who is applying for the permit at that street location.

BE IT ORDAINED that the Municipal Council of the Borough of Waldwick hereby amends Chapter 35
Business Insurance Registry, Section 35-1 Businesses and Owners of a Rental Unit of Units Registration
Required. The changes to Code of the Borough of Waldwick below shows deletions to the code in
strikethrough and additions in underline as follows:

35-1 Businesses and Owners of a Rental Unit or Units Registration Required.
The owner of a business, owner of a rental unit or units, and the owner of a multifamily home of four or
fewer units, one of which is owner occupied, shall annually register a certificate of insurance with the
Borough Clerk, on or before February 1st April 1st of each year or within thirty (30) days of obtaining
ownership of the property.
All provisions of this ordinance are severable. If for any reason, any provision of this ordinance is held to
be invalid, the validity of the remainder of the ordinance shall not be affected.
This ordinance shall take effect upon final passage and publication thereof required by law.

Ordinance No. 2023-#16 AN ORDINANCE AMENDING CHAPTER 48 FEES, SECTION
1-10.3 ESCROW FOR OFF-DUTY AND OUTSIDE
EMPLOYMENT BY POLICE OFFICERS
BE IT ORDAINED that the Municipal Council of the Borough of Waldwick hereby amends Chapter 48 Fees,
Section 1-10.3 Escrow for off-duty and outside employment by police officers. The changes to Code of the
Borough of Waldwick below shows deletions to the code in strikethrough and additions in underline as
follows:
Chapter 48 Fees
§48:1-10.3 Escrow for off-duty and outside employment by police officers.
Escrow for off-duty and outside employment by police officers. The fees paid by the private persons or
entities for off-duty police officers shall be paid in advance and to the police officer Off-Duty Escrow Fund,
administered jointly by the Chief of Police and the Chief Financial Officer.
1. No off-duty services shall be provided on behalf of any private person or entity until an advance
escrow is deposited with the Chief of Police. In the event of an emergency circumstance as solely
determined by the Chief of Police advance deposit may be waived provided that all costs for hours
worked are paid within five business days of the request for services.
2. Off-duty services shall be provided to non-profit and other governmental entities without
advance.deposit provided that payment shall be made within 30 days of being invoiced for services.
3. The initial deposit into the escrow fund for each private person or entity shall be estimated on the
basis of number of hours needed times the overtime rate for the most senior patrol officer.
Additionally costs for fringe benefits, administrative fees and costs for a patrol car will be added to
that amount.
4. On completion of the services, the private person or entity, non-profit and other governmental entity
for which the off-duty patrol officer services are provided, shall be given with an itemization of
disbursements from the escrow account which will include the actual overtime rate paid to each
officer the fringe benefit costs of that officer while on duty. There shall also be assessed a charge for
the use of the vehicle in accordance with § 48:1-10-2 and an administrative fee of 6% will be levied on
the personnel costs (salary and fringe benefits). If there is any balance remaining in the escrow
account it shall be returned to the posting entity in accordance with Borough payment policy without
interest.
5. The rate for off-duty and outside employment by police officers shall be a minimum flat rate of $85
per hour or the police officer's overtime rate, whichever is higher. Non-profits and Borough approved
events are not subject to the minimum flat rate and will be billed according to the police officer's
overtime rate at the time of the detail worked.
6. The Borough may choose to utilize a secondary service to administrate and perform the above actions
related to the off-duty and outside employment process. These actions include but are not limited to:
Communicating with said person or company to schedule off-duty “jobs”, Scheduling the Officers for
the said jobs, Invoicing person or company and receiving escrow and or payments from person or
company in a manner set forth by the secondary service provider. The secondary service provider may
charge an additional fee for services that is above and in addition to the fee structure stated above and
utilize business type collection rules as set forth in the contract between the Borough and the
secondary service provider.
The secondary service provider will reimburse the Borough via ACH or other funds transfer methods,
according to the fees set forth above, in a timely manner, usually coinciding with payroll periods for
“jobs” that the officers have performed or were scheduled for, in accordance with the above listed
rules of employment between the Borough and person(s) or company seeking services.
BE IT FURTHER RESOLVED that the ordinance shall take effect upon publication and adoption as required
by law.
