MINUTES FOR THE REGULAR MEETING
OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK
HELD ON TUESDAY, DECEMBER 12, 2023 AT 7:30 PM
Mayor Giordano called the meeting to order and read the Statement of Compliance.
Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Ms. Cericola, Mr. Schatz and
Mrs. Sherman. Mr. Ritchie and Mrs. Weber were absent. Mr. Sciolaro provided the Borough Clerk with
notice of his resignation effective December 5, 2023.
Also present: Steven J. Neale, Borough Administrator; Kelley Halewicz, Municipal Clerk and Craig Bossong,
Municipal Attorney.
Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of
silence honoring our Veterans and to remain standing for the prayer.
PROCLAMATIONS & PRESENTATIONS – None.
MAYOR’S REPORT AND REPORTS OF COMMITTEES
Mayor’s Report. Mayor Giordano thanked all the residents who attended the Annual Christmas Tree
Lighting on Friday. The Mayor also thanked the Administrator, Kelley and Tatiana for their hard work to
make this event even better than last year. He thanked Councilwoman Sherman and Council-Elect
Brennecke for attending.
Mayor Giordano also attended the Menorah Lighting. The event was well attended.
Mayor Giordano announced that with deep regret he announces the resignation of Councilman Don
Sciolaro from the Council. Mr. Sciolaro sent a letter to Clerk as per law and he cannot give 100% of his
time to the Council due to work obligations.
County Committee of the party the Councilman was a part of selects three names and he provides them
the Clerk. The Council then has 30 days from the vacancy to appoint a replacement from the three names
to fill the vacancy until the next General Election.
RESOLUTION NO. 2023-348
Authorize Special Meeting, Tuesday, December 19, 2023
WHEREAS, Councilman Don Sciolaro provided a letter of resignation from the Borough Council to the
Borough Clerk on Tuesday, December 5, 2023; and,
WHEREAS, the Borough Clerk contacted the Waldwick Bergen County Republican Chair to inform him of
the resignation; and,
WHEREAS, the Republican County Committee has 15 days from the date of the resignation to provide
three names to the Mayor and Council for consideration; and,

WHEREAS, the Republican County Committee met and submitted three names to the Borough Clerk on
Monday, December 11, 2023; and,
WHEREAS, the Mayor and Council have 30 days from the date of the vacancy to appoint from the list
provided by the Republican County Committee.
WHEREAS, the Mayor and Council are desirous of holding a Special Meeting via Zoom on Tuesday,
December 19, 2023, 6:30 pm for the purpose of temporarily filling the Council vacancy until 2024 General
Election.
NOW, THEREFORE, BE IT RESOLVED that the Municipal Council of the Borough of Waldwick hereby call a
Special Meeting via Zoom on Tuesday, December 19, 2023, 6:30 pm for the purpose of temporarily filling
the Council vacancy until 2024 General Election and authorize the Clerk to notice same as required by law.

Financial & Administrative Committee. No report.
Fire & Police Protection Committee. Ms. Cericola reported since the last meeting the WFD has responded
to 21 calls for service. 10 of those calls have been since December 1st. The calls ranged from Fire Alarms,
Carbon Monoxide Alarms, Odors of Gas, Motor Vehicle Accidents, and Mutual Aid Requests.
Last Friday night members assisted in the town tree lighting ceremony. The ceremony was beautiful and
one of the best in years. Thank you to all those that made the tree lighting event possible.
Last weekend members assisted the Lions Club by escorting Santa around town. This week kicks off our
annual Operation Santa event. Residents can drop off gifts for their family members on Tuesday and
Wednesday evenings at Co#1 between 6PM-9PM. Santa will deliver all the gifts on Saturday 12/15.
The officers and members of the WFD would like to thank the mayor, council, and town employees for all
that they do for the WFD, especially for the purchase of the new tower ladder.
Lastly, we would like to wish everyone a safe, healthy, and happy holidays and new year!
Ms. Cericola reported that for the Police Department on December 1 the department completed
mandatory Domestic Violence Training (mandated by the NJ State Attorney General and Bergen County
Prosecutors Office).
On December 3 attended the “Holiday for Heroes” ceremony at the Paramus Veteran’s Home, sponsored
by the Bergen County Police Chiefs Foundation. Following the ceremony each town is presented with
a wreath for outdoor display.

On December 7, presented the 2024 PD Operating Budget requests to the borough administrator and the
CFO.
On December 8, assisted Saddle River PD with a roll over and car fire on Route 17 North. Utility poles and
wires were affected as was morning rush hour traffic.
On December 8, Ms. Cericola attended the tree lighting in Borough Park. The weather was good and a
very nice event was well attended. The only negative of the night was the Grinch stole the extension cord
to the tree after it was lit. He was quickly apprehended by Waldwick PD and escorted from the
scene. (Video on Instagram)
On December 9, Sergeant Garcia conducted a DWI roving patrol (as opposed to a DWI checkpoint), no
arrests.
In January 2024, Lt. Seifert will be attending the NJSACOP Command & Leadership Academy starting in
January. The curriculum was developed through the United States Military Academy at West Point in
collaboration with highly experienced law enforcement practitioners and specialists. The class meets
once a week for 13 weeks at the Morris County Public Safety Training Academy in Morris Plains.
Public Safety Committee. Mrs. Sherman reported that for the month of November WALVAC has 43 calls,
answered by 18 members and one member went on 32 of those calls. There were 10 calls to the Bristal,
80 calls year to date, 4 of those calls in the middle of the night.
Mrs. Sherman reported that WALVAC was on standby at the Christmas Tree Lighting. There is an ongoing
electrical issue, they are trying to pinpoint exactly what is going on.
WALVAC mailed their fundraising letter and in this season of giving are hoping residents donate to them.
These funds are needed to purchase ambulances, training and medical supplies.
Mrs. Sherman reported that WALVAC is awaiting the renovations of the bathroom and kitchen. WALVAC
is hopeful that they will receive their Sprint car in 2024.
Recreational & Health Committee. No report.
Public Works Committee. No report.
Buildings & Grounds Committee. Mr. Schatz reported that the Planning Board meeting of December 6,
there was one application. With regards to the water, Mr. Schatz reported that pipe is being installed
now around the Malcolm St. pump station. We will start the long run towards HCA Park soon. PFAS
Public Notice was approved, mailed and posted online.
Mr. Schatz reported on Hudson/Bohnert bids and that project is scheduled to be awarded tonight. The
NWBRHC office project is moving along and bids are being finalized. Schuyler Road improvements will
be included in capital budget.
DEPARTMENT HEAD REPORTS
Administrator. Mr. Neale reported that any PFOS questions or concerns, residents should reach out to
him. There are a couple of engineering projects on the agenda. Mr. Neale thanked the Mayor and Council,
Kelley and Tatiana for a wonderful Christmas Tree Lighting event.

Municipal Clerk. Mrs. Halewicz commented on Resolution 2023-340 a place-to place transfer of liquor
license. Everything is in order to transfer the license with the transfer date set for December 29, 2023.
Mrs. Halewicz thanked residents who donated toys for the Allendale/Waldwick PBA 217 Toys for Tots
drive. The 2024 calendar is at the printers. This calendar will run January 2024 through January 2025.
Mrs. Halewicz thanked the Mayor and Council and our Administrator for their support again this year for
the Annual Christmas Tree Lighting at Borough Park. We do try to do something new each year and the
horse drawn carriage was awesome. We have been receiving ideas from people and we have our own
ideas for next year. Wishing everyone a Happy Holiday Season and a Safe, Healthy and Happy New Year!
Grants Administrator. No report.
Attorney. Mr. Bossong reported on a hearing in South Carolina for the PFOS settlement. He will speak
with the attorneys next week. Hopefully the court will provide some type of direction as to how the
monies will be split. There is one item for Closed Session this evening.

Discussion. Mrs. Sherman is concerned about the project on Evergreen and Hemlock as those streets
were just paved. Mr. Neale explained that this work must be done and we will look at our options and
possibly do the work in the grass area if we can. Mrs. Sherman expected if the project is in the roadway
that it be repaved curb to curb.

UNFINISHED BUSINESS
Mrs. Sherman attended the Menorah Lighting ceremony that celebrated Jewish heritage. The women
were great with the explanation of the holiday and songs. Congratulations on the Tree Lighting at Borough
Park; it was a homerun. The lit walking path was so beautiful. Thank you for all your efforts.
Congratulations to the Lions Club on the Santa drive around town. It is always fun to see Santa waving at
all the kids. Also, for the Lions Club Christmas Party where every child received a toy from Santa.

NEW BUSINESS
Mr. Neale commented that this was originally on the agenda but was pulled. We determined that there
are funds and that we need to move forward with this award.
RESOLUTION NO. 2023-347
Award Non-Fair and Open Professional Services Contract to Boswell Engineering for Design Services for
the Rehabilitation of the Malcolm Street Pump Station, $85,000.00
WHEREAS, the Borough requires engineering services for the replacement of the existing pumps at
Malcolm Street Pump Station, including the installation of two (2) submersible pumps, pump bases,
associated piping, permanent bypass to station, valve chamber, including check valve, appurtenances,
variable frequency drives and railing; and,
WHEREAS, Boswell Engineering submitted the attached proposal dated November 3, 2023 for Task I Data
Collection/Preliminary Design and Task II Final Design at a total cost of $85,000.00 and,
WHEREAS, the New Jersey Local Public Contracts Law authorizes the award of contract for "Professional
Services" without competitive bids; and,
WHEREAS, Boswell Engineering total aggregate awards, including this award, will exceed the Pay-to-Play
limit of $17,500 over a one-year period; and,
WHEREAS, Boswell Engineering, has completed and submitted a Business Entity Disclosure Certification
which certifies Boswell Engineering has not made any reportable contributions to a political or candidate
committee in the Borough of Waldwick in the previous one year, and that the contract will prohibit
Boswell Engineering from making any reportable contributions through the term of the contract; and,
WHEREAS, Chief Financial Officer, has certified that $85,000.00 is available in the following appropriation:
G-04-23-485-241, and has further certified that this commitment together with all previously made
commitments and payments does not exceed the funds available in said appropriation; and has further
certified that the funds available in the said appropriation are intended for the purpose herein committed.
NOW, THEREFORE, BE IT RESOLVED, that the Borough Council hereby award a contract to Boswell
Engineering, 300 Phillips Avenue, P. O. Box 3152, South Hackensack, NJ 07606, for Design Services for the
Rehabilitation of the Malcolm Street Pump Station, in the total amount of $85,000.00.

PUBLIC COMMENT
Mayor Giordano asked if any member of the public wished to come forward and to discuss anything and
if so, please state your name and address for the record.
John Vervoort questioned the 80 calls to The Bristal year to date. In their approval, weren’t they going to
have their own ambulance service in place. Mayor Giordano has reached out to the Director of the facility
to have a meeting regarding this matter.
Al Coldon thanked the Mayor and Council for a really great year and stay healthy. Mr. Coldon
congratulated the DPW on a fantastic job with leave collection again this year and thanked them for their
efforts.
Ted Sanzo expressed concern for the rollover on 17 and asked for advice to keep our citizen safe. Mayor
Giordano will obtain a statement from the Police department and provide.
Eric LaPorta commented that the American flag is backwards, the stars go to the left.
CLOSED SESSION - Any matter permitted to be discussed in Closed Session pursuant N.J.S.A. 10:4-12
RESOLUTION NO. 2023-346
Authorize Closed Session
WHEREAS, Section 8 of the Open Public Meetings Act (N.J.S.A. 10:4-12(b)(1-9) permits the exclusion of
the public from a meeting in certain circumstances; and,
WHEREAS, the Mayor and Council is of the opinion that such circumstances exist.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick, County of
Bergen, State of New Jersey, as follows:
The public shall be excluded from discussions of the Closed Session.
The general nature of the subject matter to be discussed is as follows:
Possible Acquisition of Real Property
It is anticipated at this time that the above stated subject matter will be made public within 60 days or as
soon thereafter as it is deemed to be in the public interest to do so based on the conclusion of the matter.

Award Non-Fair and Open Professional Services Contract to Boswell Engineering for Evergreen Street
to Hemlock Street and Bergen Avenue to Sheridan Avenue Water Main Improvements, $28,000.00
WHEREAS, the Borough requires engineering services for the installation of water mains to eliminate dead
end lines in our water system, particularly the installation of water main from Evergreen Street to Hemlock
Street and water main to connect Bergen Avenue to Sheridan Avenue; and,
WHEREAS, Boswell Engineering submitted the attached proposal dated November 3, 2023 for Task I Water
Main Evaluation, Task II Data Collection, and Task III Final Design at a total cost of $28,000.00 and,
WHEREAS, the New Jersey Local Public Contracts Law authorizes the award of contract for "Professional
Services" without competitive bids; and,
WHEREAS, Boswell Engineering total aggregate awards, including this award, will exceed the Pay-to-Play
limit of $17,500 over a one-year period; and,
WHEREAS, Boswell Engineering, has completed and submitted a Business Entity Disclosure Certification
which certifies Boswell Engineering has not made any reportable contributions to a political or candidate
committee in the Borough of Waldwick in the previous one year, and that the contract will prohibit
Boswell Engineering from making any reportable contributions through the term of the contract; and,
WHEREAS, Chief Financial Officer, has certified that $28,000.00 is available in the following appropriation:
W-06-23-596-103, and has further certified that this commitment together with all previously made
commitments and payments does not exceed the funds available in said appropriation; and has further
certified that the funds available in the said appropriation are intended for the purpose herein committed.
NOW, THEREFORE, BE IT RESOLVED, that the Borough Council hereby award a contract to Boswell
Engineering, 300 Phillips Avenue, P. O. Box 3152, South Hackensack, NJ 07606, for Evergreen Street to

WHEREAS, the Borough requires desires to develop an Open Space and Recreation Plan; and,
WHEREAS, The Land Conservancy of New Jersey submitted the attached proposal for services with Scope
of Work detailed in Exhibit A at a total cost not to exceed $15,000.00 and,
WHEREAS, the New Jersey Local Public Contracts Law authorizes the award of contract for "Professional
Services" without competitive bids; and,
WHEREAS, this contract is being awarded as a non-fair and open and is in conformance with the provisions
of N.J.S.A. 19:44A-20.4 et seq.; and,
WHEREAS, The Land Conservancy of New Jersey shall maintain all documentation related to products,
transactions or services under this contract for a period of five years from the date of final payment. Such
records shall be made available to the New Jersey Office of the State Comptroller upon request; and,

WHEREAS, a Bergen County HOME Investment Partnerships applica�on of $1,272,000.00 has been
proposed by Bergen County United Way Madeline Housing Partners, LLC for Waldwick Suppor�ve Housing
in the municipality of Waldwick; and,
WHEREAS, pursuant to the State Interlocal Services Act, HOME funds may not be spent in a municipality
without authoriza�on by the Mayor and Council; and,
WHEREAS, aforesaid funding applica�on for this project is in the best interest of the people of Waldwick;
and,
WHEREAS, this resolu�on does not obligate the financial resources of the municipality and is intended
solely to expedite expenditure of the aforesaid HOME applica�on.
NOW, THEREFORE, BE IT RESOLVED that the Governing Body of Waldwick hereby confirms endorsement
of the aforesaid funding applica�on for this project; and,

Authorize Shared Services Agreement with Northwest Bergen County Utilities Authority (NBCUA) for
Pump Station Inspection Services 2024-2025
WHEREAS, the Uniform Shared Services Act, N.J.S.A. 40A:65 et seq., the Borough of Waldwick has a need
to promote the broad use of shared services as a method to reduce local expenses funded by property
taxpayers; and,
WHEREAS, the Uniform Shared Services Act allows for any local unit to enter into an agreement with any
other local unit or units to provide or receive any services that each local unit participating in the
agreement is empowered to provide or receive within its own jurisdiction; and,
WHEREAS, the Borough of Waldwick is in need of Pump Station Inspection Services of the wastewater
pump stations for the years 2024 and 2025; and,
WHEREAS, the NBCUA will provide Pump Station Inspection Services of the wastewater pump stations for
the Borough of Waldwick once per week on Wednesdays and perform repairs and correction action as
directed by the Borough; clean each of the pumping stations twice annually at no additional costs with
the Borough providing support staff and water connections required for cleaning; and support the
Borough’s catch basin cleaning activities when requested. The Borough is obligated to order, accept or
pay for services except when it orders them pursuant to a Shared Service Agreement; and,
WHEREAS, the Borough of Waldwick shall pay NBCUA four (4) equal installments of $2,703.75 on or before
March 1, June 1, September 1 and December 1 of each year, for a total of $10,815.00. The rate of
compensation paid for repairs, corrective actions and other requested activities will be $99.47 per man-
hour for business hours and $124.33 per man-hour for non-business hours with an increase in January 1,
2025 consistent with the annual percentage given to collective bargaining unit, if any. A minimum of two
(2) hours shall be billed by the NBCUA for each request for services.
NOW, THEREFORE, BE IT RESOLVED by the Municipal Council of the Borough of Waldwick that it does
hereby authorize the execution of a Shared Services Agreement and payment for Pump Station Inspection
Services with NBCUA, 30 Wyckoff Avenue at Authority Drive, Waldwick, NJ 07463 as detailed in the
attached agreement and available for public inspection.

WHEREAS, an application has been filed for a Place-to-Place Transfer of Plenary Retail Consumption
License 0264-44-002-003, heretofore issued to RVK NJ, Inc., d/b/a Liquorland, for the premises located at
8 Franklin Turnpike, Waldwick, NJ, and,
WHEREAS, the submitted application form is complete in all respects, the transfer fees have been paid,
and the license has been properly renewed for the current license term; and,

Chapter 48 Fees
§48:91-12.2 Vehicles and traffic - paid parking fees
A. Paid parking spaces shall be delineated in paid parking zones as herein established, and parking signs
shall be installed near such paid parking spaces. Upon payment, the parking vendor shall indicate on its
mobile application the maximum uninterrupted time a vehicle may remain parked within the paid
parking space. Paid fees will be in the following increments:
(1) $0.50: two hours.
(2) $1: four hours.
(3) $1.50: six hours.
(4) $2.50: 12 hours.
B. Each parking transaction will be subject to a $0.3040 service charge
