REGULAR MEETING MINUTES: 1 MARCH 12, 2024 MINUTES FOR THE REGULAR MEETING OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK HELD ON TUESDAY, MARCH 12, 2024 AT 7:30 PM Mayor Giordano called the meeting to order and read the Statement of Compliance. Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Mr. Brennecke, Mr. Martinello, Mr. Ramundo, Mr. Ritchie and Mrs. Weber. Ms. Cericola was absent. Also present: Steven J. Neale, Borough Administrator; Colleen Ennis, CFO/Treasurer, Matthew Guilder, Grants Administrator; Kelley Halewicz, Municipal Clerk and Craig Bossong, Municipal Attorney. Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of silence honoring our Veterans and to remain standing for the prayer. PROCLAMATIONS & PRESENTATIONS – None. MAYOR’S REPORT AND REPORTS OF COMMITTEES Mayor’s Report. Mayor Giordano attended meetings regarding the 2024 Municipal Budget and thanks the Committee, Administrator, CFO and Grants Administrator for a job well done. Mayor Giordano reminded the Council and public of the 1st Annual Ramadan Ceremony on Thursday, March 14, 5:30 pm by the library. Financial & Administrative Committee. Mr. Ritchie had no report but will speak to the budget at the appropriate time. Fire & Police Protection Committee. Mr. Brennecke reported that Jeff Stevens resigned as President of the Waldwick Fire Department. The Vice President Christina Agugliaro will step up as President and has appointed Keith Hockenbeck to be Vice President. Mr. Brennecke wished them luck in their positions. Public Safety Committee. Mayor Giordano explained that Ms. Cericola was unable to be at the meeting tonight due to a work commitment. Mayor Giordano provided report from President Papendick for WALVAC. On Saturday, WALVAC responded to a call for an elderly male party fall victim with heavy breathing. Officers Wanamaker, Ritondale, Seifert, and Sanchez were on scene. The WALVAC members on the call were Loucas Nestoros and Ashley Statuto. Valley Hospital ALS responded as well and the patient is being treated at the hospital. Recreational & Health Committee. Mr. Martinello reported on Baseball registration still open for Pre-K- 8th grade. There are over 400 kids registered and 80 volunteers. Opening Day is April 27. On March 16, the Baseball Association will have annual clean-up day with the Waldwick High School baseball and softball teams assisting on that day. Mr. Martinello reported that Junior Football registration will open soon. Waldwick Football Club is having try outs for teams April 22-26. There is also a program for youth clinics. Midland Park Community School Junior Panthers Summer Camp registration is open. REGULAR MEETING MINUTES: 2 MARCH 12, 2024 Public Works Committee. Mr. Ramundo reported that the Ambulance Corps kitchen is complete as well as the nurse’s station in the clinic. The break room at DPW was painted. DPW is conducting truck maintenance for the next two weeks. They have started catch basin work, starting with streets that will be paved this year. On the water side, the Water Department replaced at valve at well #2 and are checking valves at this point. They have also started lead copper inventory. Buildings & Grounds Committee. Mrs. Weber reported that the renovations are moving along at the ambulance corps building and thanked DPW for their efforts in getting the work done. The charging stations are being installed and will take another two weeks to complete. With regards to the pistol range, the Police Department is obtaining estimates for the HVAC and roof. DEPARTMENT HEAD REPORTS Administrator. Mr. Neale reported that the water treatment systems major construction work continued through HCA. Things have slowed down a bit due to all the rain but they have been moving along as best they can. They are almost inside the playground area at the park. The vessels are ahead of schedule and will arrive in April on a staggered schedule. On the agenda is a resolution to hire a police officer and he is set to begin the academy on Friday. Also, a resolution to hire a full-time dispatcher to replace Luke. We will advertise for per diem dispatchers as well. We have been working on the new website and should be ready to launch later this week officially. Municipal Clerk. Mrs. Halewicz mentioned the following resolutions: 2024-102, 2024-103 and 2024-104 for approval tonight and that all paperwork for each has been received. Mrs. Halewicz reported that dog licensing is ongoing. Late fees go went into effect on March 1. We have issued 630 licenses to date. Under New Business, she wanted to discuss a new ordinance for dog licensing late fees. Mrs. Halewicz reported that the deadline to change political party affiliation is April 10. The last day to register to vote in the June Primary is May 14. Grants Administrator. Mr. Guilder reported that the charging stations will take a couple more weeks to be installed. The Borough will receive $75,000 from NJDEP and $25,000 from PSEG to put toward the $25,000 the Borough utilized to pay for the charging stations. Mr. Guilder will discuss fees under New Business. Mr. Guilder thanked WFD for their assistance with documentation for him to submit the ARP for which the Borough received $55,000 for 2024, which doubled what we received last year. This will offset cost of gear costs. CFO. Mrs. Ennis reminded the seniors about the senior freeze blue booklets that are coming out by mail. Mrs. Ennis sent out 500 water and 200 tax delinquent notices, some of which she attributes to the faulty mail system. Attorney. Mr. Bossong reported on the final long standing tax appeal which is Resolution 2024-98. This appeal goes back 2015-2023 and was favorable to the Borough in the end. Mr. Bossong has two closed session matters this evening, with no action being taken. Ordinance No. 2024-#02 - BOND ORDINANCE TO AUTHORIZE THE ACQUISITION OF REAL PROPERTY FOR OPEN SPACE AND RECREATION PURPOSES IN, BY AND FOR THE BOROUGH OF WALDWICK, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY, TO APPROPRIATE THE SUM OF $2,575,000 TO PAY THE COST THEREOF, TO MAKE A DOWN PAYMENT, TO AUTHORIZE THE ISSUANCE OF BONDS TO FINANCE SUCH APPROPRIATION AND TO PROVIDE FOR THE ISSUANCE OF BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE OF SUCH BONDS Council comments. Mr. Neale reported this is the three-acre parcel and this puts the funding in place for the purchase of the property. The Borough has not set plans yet but plans to keep it open space. Ordinance No. 2024-#04 - BOROUGH OF WALDWICK BERGEN COUNTY, NEW JERSEY CALENDAR YEAR 2024 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET COST OF LIVING ALLOWANCE AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A:4-45.14) Council Comments. Mrs. Ennis reported that in NJ there are maximum amounts established on how much the Borough can increase appropriations and tax to 2 1/2 %. The Borough is requesting the ability to exceed that CAP by an additional percentage which is an insurance policy so to speak. It’s there in case the Borough needs it and if not, it can be banked for two years. Mayor Giordano stated that a motion is in order to move and pass the ordinance on first reading and that it be advertised in the official newspaper of the municipality as required by law, setting a public hearing for March 26, 2024 at 7:30 pm or as soon thereafter as the matter may be heard. Council Member Motion Second Ayes Nays Abstain Absent Brennecke X Cericola X Martinello X Ramundo X Ritchie X X Weber X X Mayor Giordano ********** REGULAR MEETING MINUTES: 6 MARCH 12, 2024 RESOLUTION NO. 2024-109 Introduction of 2024 Budget BE IT RESOLVED, that the following statements of revenues and appropriations attached hereto constitute the local Budget of the Borough of Waldwick, Bergen County, New Jersey for the year 2024; and, BE IT FURTHER RESOLVED, that the said budget be published in The Bergen Record in the issue of March 18, 2024, and that a hearing on the Budget will be held at the Municipal Building on April 9, 2024 at 7:30 o’clock (PM) or as soon thereafter as the matter may be reached. Discussion. Mayor Giordano thanked the Council Committee for their work on the budget. Mr. Ritchie reported that the budget should be online tomorrow. The Committee met and took a deep dive into this budget, needs v wants. With regards to capital, it was cut in half before it was presented to the Council. We are focused on our five-to ten-year plan. With regards to operating, this is already a bare bones budget. A few things that effected this last year was the new garbage contract, insurance and pension which were all extremely large increases. We did not see those extreme increases for this year; although there were increases. We used $50,000 more in surplus than we did last year. This is a 1% budget increase which is roughly $40.00 for the averaged assessed home. Ordinance No. 2024-#05 - AN ORDINANCE AMENDING ORDINANCE NO. 2023-#11, FIXING THE COMPENSATION, SALARIES AND WAGES OF OFFICIALS AND EMPLOYEES OF THE BOROUGH OF WALDWICK Council Comments. Mayor Giordano explained this is updating the minimum and maximum ranges for non-union employees. Mayor Giordano stated that a motion is in order to move and pass the ordinance on first reading and that it be advertised in the official newspaper of the municipality as required by law, setting a public hearing for March 26, 2024 at 7:30 pm or as soon thereafter as the matter may be heard. NEW BUSINESS a. Waldwick Municipal Pool – hours and fees. Mr. Neale explained that with regards to the pool hours, it is the recommendation of our pool manager to close the pool at 7:00 pm due to not having lights at the pool. Further he recommended opening the pool at 10:00 am daily once school it out. This is as a result of the survey conducted at the end of last year where young families asked for hours in the morning. We will put this on the agenda for introduction next meeting. b. Fees. Mr. Neale and Mr. Guilder reported that fees in general are low in the Borough. The building department is ready with their fee increases and this will be on the agenda for next meeting. Other areas pool fees – pool membership types, courts and field should also be reviewed to make sure the Borough is in the middle of fees in the surrounding town. The Council agreed that they could take a deep dive into fees for courts and fields. There was a caution on pool fees not going higher for Waldwick seniors. Mrs. Halewicz reported that reviewing the dog licensing laws, it was determined the Borough could issue licenses without a penalty through June 30. Mrs. Halewicz would like to exercise that option and to fill the gap from July 1 – October 31, she recommends A $10 per dog late fee shall be assessed on July 1 to owners of dog(s) whose rabies vaccination(s) expired between January 1 and June 30 of the licensing year and failed to obtain a license for the current year. For those dog(s) whose rabies vaccination(s) expire between July 1 and October 31, a late fee of $10 per dog shall be assessed to the owner for failure to provide proof of rabies vaccination by the end of the month the rabies vaccination(s) is due in the licensing year. Council Members agreed to put on agenda for next meeting. Mr. Ramundo spoke about the Environmental Committee issuing a quarterly newsletter, sending out a survey to resident on what needs they think the town needs with regards to the environment. Next week is the meet and greet with the Environmental Committee and the Beautification Committee. PUBLIC COMMENT Mayor Giordano asked if any member of the public wished to come forward and to discuss anything and if so, please state your name only for the record. Eric LaPorta spoke to the issue of the veteran banners and if there are still applications. Mayor Giordano explained that the banners will go back up in the next month or so through Veterans Day. REGULAR MEETING MINUTES: 8 MARCH 12, 2024 Lori Gillen spoke to the issue of no one following up with her on the trees to be planted along her property or the plan for the tanks so she doesn’t have to look at them. Both Mayor Giordano and Mr. Neale explained that when they met with her that there is no further update or action to be taken until the project is completed and a landscape plan is put together for this fall. CLOSED SESSION - Any matter permitted to be discussed in Closed Session pursuant N.J.S.A. 10:4-12 RESOLUTION NO. 2024-110 Authorize Closed Session WHEREAS, Section 8 of the Open Public Meetings Act (N.J.S.A. 10:4-12(b)(1-9) permits the exclusion of the public from a meeting in certain circumstances; and, WHEREAS, the Mayor and Council is of the opinion that such circumstances exist. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick, County of Bergen, State of New Jersey, as follows: The public shall be excluded from discussions of the Closed Session. The general nature of the subject matter to be discussed is as follows: Acquisition of Real Property Contract Negotiations It is anticipated at this time that the above stated subject matter will be made public within 60 days or as soon thereafter as it is deemed to be in the public interest to do so based on the conclusion of the matter. This resolution shall take effect immediately. Said improvement shall include real estate transaction expenses, demolition of the existing garage, environmental studies and testing, and all work, materials and appurtenances necessary and suitable therefor. Said property to be acquired consists of the following parcels described by their street address and designation on the Tax Map of the Borough: (i) 197 Wyckoff Avenue (Block 136, Lot 6.02) and (ii) 9 Brady Street (Block 136, Lot 6.08). Section 2. The sum of $2,575,000 is hereby appropriated to the payment of the cost of making the -2- improvement described in Section 1 hereof (hereinafter referred to as "purpose"). Said appropriation shall be met from the proceeds of the sale of the bonds authorized and the down payment appropriated by this ordinance. Said improvement shall be made as a general improvement and no part of the cost thereof shall be assessed against property specially benefited. Section 3. It is hereby determined and stated that (1) said purpose is not a current expense of said Borough, and (2) it is necessary to finance said purpose by the issuance of obligations of said Borough pursuant to the Local Bond Law (Chapter 2 of Title 40A of the New Jersey Statutes Annotated, as amended; the "Local Bond Law"), and (3) the estimated cost of said purpose is $2,575,000, and (4) $123,000 of said sum is to be provided by the down payment hereinafter appropriated to finance said purpose, and (5) the estimated maximum amount of bonds or notes necessary to be issued for said purpose is $2,452,000, and (6) the cost of such purpose, as hereinbefore stated, includes the aggregate amount of $75,000 which is estimated to be necessary to finance the cost of such purpose, including architect's fees, accounting, engineering and inspection costs, legal expenses and other expenses, including interest on such obligations to the extent permitted by Section 20 of the Local Bond Law. -3- Section 4. It is hereby determined and stated that the aggregate sum of $123,000 consisting of (A) $48,000 in the Borough's Capital Improvement Fund and (B) $75,000 in the Borough's Open Space Trust Fund, are now available to serve as a down payment for said purpose. The sum of $123,000 is hereby appropriated from such moneys to the payment of the cost of said purpose. Section 5. To finance said purpose, bonds of said Borough of an aggregate principal amount not exceeding $2,452,000 are hereby authorized to be issued pursuant to the Local Bond Law. Said bonds shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law. All matters with respect to said bonds not determined by this ordinance shall be determined by resolutions to be hereafter adopted. Section 6. To finance said purpose, bond anticipation notes of said Borough of an aggregate principal amount not exceeding $2,452,000 are hereby authorized to be issued pursuant to the Local Bond Law in anticipation of the issuance of said bonds. In the event that bonds are issued pursuant to this ordinance, the aggregate amount of notes hereby authorized to be issued shall be reduced by an amount equal to the principal amount of the bonds so issued. If the aggregate amount of -4- outstanding bonds and notes issued pursuant to this ordinance shall at any time exceed the sum first mentioned in this section, the moneys raised by the issuance of said bonds shall, to not less than the amount of such excess, be applied to the payment of such notes then outstanding. Section 7. Each bond anticipation note issued pursuant to this ordinance shall be dated on or about the date of its issuance and shall be payable not more than one year from its date, shall bear interest at a rate per annum as may be hereafter determined within the limitations prescribed by law and may be renewed from time to time pursuant to and within limitations prescribed by the Local Bond Law. Each of said bond anticipation notes shall be signed by the Mayor and by a financial officer and shall be under the seal of said Borough and attested by the Borough Clerk or Deputy Borough Clerk. Said officers are hereby authorized to execute said notes in such form as they may adopt in conformity with law. The power to determine any matters with respect to said notes not determined by this ordinance and also the power to sell said notes, is hereby delegated to the Chief Financial Officer who is hereby authorized to sell said notes either at one time or from time to time in the manner provided by law. -5- Section 8. It is hereby determined and declared that the period of usefulness of said purpose, according to its reasonable life, is a period of forty years computed from the date of said bonds. Section 9. It is hereby determined and stated that the Supplemental Debt Statement required by the Local Bond Law has been duly made and filed in the office of the Borough Clerk of said Borough, and that such statement so filed shows that the gross debt of said Borough, as defined in Section 43 of the Local Bond Law, is increased by this ordinance by $2,452,000 and that the issuance of the bonds and notes authorized by this ordinance will be within all debt limitations prescribed by said Local Bond Law. Section 10. Any funds received from private parties, the County of Bergen, the State of New Jersey or any of their agencies or any funds received from the United States of America or any of its agencies in aid of such purpose, shall be applied to the payment of the cost of such purpose, or, if bond anticipation notes have been issued, to the payment of the bond anticipation notes, and the amount of bonds authorized for such purpose shall be reduced accordingly. Section 11. The capital budget is hereby amended to conform with the provisions of this ordinance to the extent of -6- any inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, is on file with the Borough Clerk and is available for public inspection. Section 12. The Borough intends to issue the bonds or notes to finance the cost of the improvement described in Section 1 of this bond ordinance. If the Borough incurs such costs prior to the issuance of the bonds or notes, the Borough hereby states its reasonable expectation to reimburse itself for such expenditures with the proceeds of such bonds or notes in the maximum principal amount of bonds or notes authorized by this bond ordinance. Section 13. The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this ordinance. Said obligations shall be direct, unlimited and general obligations of the Borough, and the Borough shall levy ad valorem taxes upon all the taxable real property within the Borough for the payment of the principal of and interest on such bonds and notes, without limitation as to rate or amount. Section 14. Motion: ______ Seconded: ______ Roll Call: _____ _____ _____ _____ _____ _____ _____ Brennecke Cericola Martinello Ramundo Ritchie Weber Giordano Ordinance No. 2024-#04 BOROUGH OF WALDWICK BERGEN COUNTY, NEW JERSEY CALENDAR YEAR 2024 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET COST OF LIVING ALLOWANCE AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A:4-45.14) WHEREAS, the Local Government Cap Law, N.J.S. 40A:4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 2.5% or the cost-of-living adjustment, whichever is less, unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and, WHEREAS, the cost-of-living adjustment for calendar year 2024 budgets is calculated at 2.5% pursuant to N.J.S.A. 40A:4-45.2; and amounts to $261,989; and, WHEREAS, N.J.S.A. 40A:4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and, WHEREAS, the Borough Council of the Borough of Waldwick in the County of Bergen finds it advisable and necessary to increase its CY 2024 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and, WHEREAS, the Borough Council hereby determines that a 1.0% increase in the budget of said year, amounting to $104,796 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and, WHEREAS, the Borough Council hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.
