(the “Redevelopment Law”) authorizes municipali�es to determine whether certain parcels of land in the municipality cons�tute areas in need of redevelopment in accordance with the Redevelopment Law; and, WHEREAS, the Borough of Waldwick (“Borough”) wishes to u�lize the Planning Board’s knowledge and exper�se in exploring whether the parcels located at Block 107, Lots 1, 3, 5, 7, 8, 9, 10, 11, 13 and 17; the proposed Study Area shown on the map atached hereto as Exhibit A, meets the criteria established by the Redevelopment Law as a “Condemna�on Redevelopment Area”; and, WHEREAS, pursuant to the required redevelopment procedures, specifically set forth in N.J.S.A. 40A:12A-6, no area of a municipality shall be deemed an area in need of redevelopment unless the governing body of the municipality shall, by resolu�on, authorize the Planning Board to undertaken a preliminary inves�ga�on to determine whether a proposed area is a redevelopment area mee�ng the criteria set forth in N.J.S.A. 40A:12A-5 and N.J.S.A. 40A:12A-6; and, WHEREAS, the New Jersey Legislature adopted and the Governor signed P.L. 2013, Chapter 159, which amended the Redevelopment Law, including the procedural requirements aforemen�oned above; and, WHEREAS, pursuant to P.L. 2013, Chapter 149, the resolu�on authorizing the Planning Board to undertake a preliminary inves�ga�on shall state whether the redevelopment area shall authorize the municipality to use the powers of eminent domain; and, WHEREAS, the Council finds it to be in the best interest of the Borough and its residents to authorize the Planning Board to undertake such a preliminary inves�ga�on and to authorize the Borough to use all powers provided by the Legislature for use in a redevelopment area, including the power of eminent domain, in this study as a Condemna�on Redevelopment Area. NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Waldwick in the County of Bergen, and State of New Jersey as follows:  MAYOR AND COUNCIL OF THE BOROUGH OF WALDWICK Bergen County, New Jersey RESOLUTION NO. 2024-113 (Page 2 of 3) I. INVESTIGATION OF STUDY AREA AUTHORIZED The Planning Board is hereby authorized and directed to conduct an inves�ga�on pursuant to N.J.S.A. 40A:12A-6 to determine whether all or a por�on of the Study Area in the map atached as Exhibit A sa�sfies the criteria set forth in the Redevelopment Law to be designated a Condemna�on Redevelopment Area. II. MAP TO BE PREPARED As part of its inves�ga�on, a map showing the boundaries of the proposed redevelopment areas and the loca�on of various parcels contained therein has been prepared and is atached as Exhibit A. III. PUBLIC HEARING REQUIRED The Planning Board shall conduct a public hearing, a�er giving due no�ce of the proposed boundaries of the Study Area and the date of the hearing to any person who are interested in or would be affected by a determina�on that all or a por�on of the Study Area is a Condemna�on Redevelopment Area. At the hearing, the Planning Board shall hear from all persons who are interested in or would be affected by a determina�on that all or a por�on of the Study Area is a Condemna�on Redevelopment Area. All objec�ons to a determina�on that all or a por�on of the Study Area is in need of redevelopment and evidence in support of those objec�ons shall be received and considered by the Planning Board and made part of the public record. IV. PLANNING BOARD TO MAKE RECOMMENDATIONS A�er conduc�ng its inves�ga�on, preparing a map of the proposed Condemna�on Study Area, and conduc�ng a public hearing at which all objec�ons to the designa�on are received and considered, the Planning Board shall make a recommenda�on to the Borough Council in the form of a resolu�on as to whether the Borough Council should designate all or part of the Study Area as a Condemna�on Redevelopment Area. V. SEVERABILITY If any part of this Resolu�on shall be deemed invalid, such parts shall be severed and the invalidity thereby shall not affect the remaining part of the Resolu�on.  MAYOR AND COUNCIL OF THE BOROUGH OF WALDWICK Bergen County, New Jersey RESOLUTION NO. 2024-113 (Page 3 of 3) VI. BE IT FURTHER RESOLVED that pursuant to New Jersey P.L. 2013, Chapter 159, the redevelopment area determina�on shall authorize the Borough to use all those powers provided by the Legislature for use in a Condemna�on Redevelopment Area, including the power of eminent domain; and, BE IT FURTHER RESOLVED that a cer�fied copy of this Resolu�on is to the be forwarded to the Planning Board of the Borough of Waldwick; and, BE IT FURTHER RESOLVED, that this resolu�on shall take effect immediately. Motion: __________ Seconded: __________ Roll Call: Council Members: _____ _____ _____ _____ _____ _____ _____ Brennecke Cericola Martinello Ramundo Ritchie Weber Giordano Ordinance No. 2024-#04 BOROUGH OF WALDWICK BERGEN COUNTY, NEW JERSEY CALENDAR YEAR 2024 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET COST OF LIVING ALLOWANCE AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A:4-45.14) WHEREAS, the Local Government Cap Law, N.J.S. 40A:4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 2.5% or the cost-of-living adjustment, whichever is less, unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and, WHEREAS, the cost-of-living adjustment for calendar year 2024 budgets is calculated at 2.5% pursuant to N.J.S.A. 40A:4-45.2; and amounts to $261,989; and, WHEREAS, N.J.S.A. 40A:4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and, WHEREAS, the Borough Council of the Borough of Waldwick in the County of Bergen finds it advisable and necessary to increase its CY 2024 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and, WHEREAS, the Borough Council hereby determines that a 1.0% increase in the budget of said year, amounting to $104,796 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and, WHEREAS, the Borough Council hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years. Annual Salary for Mayor: payment periods. A salary of Two Thousand Five Hundred Dollars ($2,500) per year, payable in equal quarterly installments with the first payroll in March, June, September and last payroll in November shall be paid to the Mayor of the Borough of Waldwick. Section 2. Annual Salary for Members of Council: payment periods. (7) The fee for a permit for the removal of a building or structure from one lot to another or to a new location on the same lot shall be $22 $25 per $1,000 of the sum of the estimated costs for moving, for new foundations and for placement in a completed condition in the new location, provided that the minimum fee shall be $65 $75. (8) The fee for a permit to construct a sign shall be a flat fee of $30 $40 plus $1 per square foot of the surface area of the sign. In the case of a double-faced sign, the area of the surface of only one side shall be used for purposes of the fee computation. (10) Special Inspections - Special overtime inspections: a permit holder may request special inspections outside of the normal business workday. The fee for these inspections shall be $100. for the first hour and $25 for each additional hour. When inspection is not continuous with the business workday, the fees shall be $150 for the first hour, and $50 for each additional hour. (11) Certificates of occupancy. (a) The fee for an inspection for a certificate of continued occupancy shall be $55 $75 for one- and two-family residential structures and $75 $90 for all other structures. 1. Reinspection Fee - $15 (sidewalks excluded). The fee for an inspection for a certificate of continued occupancy if requested more than 10 days after date of application shall be $75. (b) A temporary certificate of occupancy may be issued for a period of three months and extended for an additional three months upon payment of a $30 fee. (c) The fee for a certificate of occupancy granted pursuant to a change of use shall be $100. (d) The fee for a multiple certificate of occupancy shall be $55; in addition, each tenant shall be required to apply for a certificate of continued use. B. The Construction official shall, with the advice of the subcode officials, prepare and submit to the Mayor and Council, biannually, a report recommending a fee schedule based on the operating expenses of the agency and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act. C. Surcharge fee. (1) In order to provide for the training certification and technical support programs required by the Uniform Construction Code Act and its regulations, the enforcing agency shall collect, in addition to the fees specified above, a surcharge fee equal to that promulgated under Chapter 23, § 5.23-4.19(b) of the New Jersey Administrative Code. Said surcharge fee shall be remitted to the Bureau of Housing Inspection, Department of Community Affairs, on a quarterly basis for the fiscal quarters ending September 30, December 31, March 31 and June 30, and not later than one month next succeeding the end of the quarter for which it is due. (2) The enforcing agency shall report to the Bureau of Housing Inspection, annually, at the end of each fiscal year and not later than July 31, the total amount of the surcharge fee collected in the fiscal year. D. Waiver of construction permit fees with regard to barrier free accessibility.
