REGULAR MEETING MINUTES: 1 APRIL 9, 2024 MINUTES FOR THE REGULAR MEETING OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK HELD ON TUESDAY, APRIL 9, 2024 AT 7:30 PM Mayor Giordano called the meeting to order and read the Statement of Compliance. Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Mr. Brennecke, Ms. Cericola, Mr. Martinello, Mr. Ramundo, Mr. Ritchie via phone and Mrs. Weber. Also present: Steven J. Neale, Borough Administrator; Matthew Guilder, Grants Administrator; Colleen Ennis, CFO/Tax Collector, Kelley Halewicz, Municipal Clerk and Craig Bossong, Municipal Attorney. Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of silence honoring our Veterans and to remain standing for the prayer. PROCLAMATIONS & PRESENTATIONS - None. MAYOR’S REPORT AND REPORTS OF COMMITTEES Mayor’s Report. Mayor Giordano commented on ongoing events throughout town by our clubs and organizations and that everyone should support those hosting events. Mayor will attend the North West Bergen Mayor’s Meeting on Saturday and report back on their discussion regarding budgets. Financial & Administrative Committee. Mr. Ritchie will hold his comments for the Budget section of the meeting. Fire & Police Protection Committee. Mr. Brennecke reported that the Fire Department had 7 calls so far in April. Mr. Brennecke congratulated the three young firefighters who completed FF1 Course. Public Safety Committee. Ms. Cericola reported that the Ambulance Corps for the month of March that the top responding crew members in order are Ashley Statuto, Jake Scro and Madelin Benitez. The majority of runs occurred on Saturdays with the second-place day being Friday and third being Sunday. Eleven of the runs were breathing problems, 7 were falls and the remainder were mixed between a number of other incidents. There were 2 Waldwick Mutual Aid runs to Allendale in March as well. Recreational & Health Committee. Mr. Martinello reported that the pool registration is open. Baseball opening day is April 27 with a lot of new sponsors as well as over 430 players, 100 volunteers. Waldwick Soccer Football Club accepting travel soccer sign up. Also, football registration is open and cheerleading is in high demand. Public Works Committee. Mr. Ramundo reported that DPW completed the storm draining on the streets that are to be paved this year. They are prepping for the pool season. The pool has been drained and aid washed. Weekly yard waste collection has started this week. On the Water side, District 3 hydrant flushing is complete. District 5 started mid-week last week and is ongoing. A fire hydrant was put out of services as it was leaking. Valves at well 4 & 5 and a valve at Gateway were repaired. REGULAR MEETING MINUTES: 2 APRIL 9, 2024 Buildings & Grounds Committee. Mrs. Weber reported that the EV stations are ready and waiting for PSEG to turn them on. The WALVAC bathroom renovation has started and should be completed in three to four weeks. There are quotes ready to award a contract to replace the HVAC system at WALVAC and we will award shortly. DEPARTMENT HEAD REPORTS Administrator. Mr. Neale had no report but will speak later in the meeting regarding the Budget and various ordinances on the agenda. Municipal Clerk. Mrs. Halewicz reported that tomorrow is the deadline to change political party affiliation; May 14 is the last day to register to vote in the June Primary; May 22 sample ballots will start to be mailed; May 28 deadline to apply for a mail-in ballot by mail for the June Primary Election. This is also the deadline for unaffiliated voters to submit political party affiliation declaration forms for Primary Election to Bergen County Commissioner of Registration to receive mail in ballot by mail. Grants Administrator. Mr. Guilder reiterated that the pool registration is open. Attorney. Mr. Bossong had no report and there will be no need to go into Closed Session this evening. CFO. Mrs. Ennis reminded residents that the May tax bill is on the old revaluation. The 3rd and 4th quarter bills will reflect the new assessment. Also, the Senior Tax Freeze books are available for those seniors who qualify. For non-Seniors there is the ANCHOR program and the state directly sends an application. Also, reminder you can pay your tax and water bills online as the post office has a very slow turnaround time. Mayor Giordano asked the Clerk to read Ordinance No. 2024-#15 by title. Ordinance No. 2024-#15 - AN ORDINANCE CONTINUING THE “MUNICIPAL OPEN SPACE, RECREATION, FARMLAND AND HISTORIC PRESERVATION TRUST FUND” IN THE AMOUNT OF $.005 PER $100 OF ASSESSED VALUE UNTIL CHANGED Council Comments. Mr. Bossong commented back in 2003 the Borough went out to non-binding referendum to get the sentiment of the voters and it passed overwhelmingly. This money is used to purchase parkland, upgrade playgrounds in our parks. It has been on the books since 2004 and this ordinance reaffirms this in perpetuity. Mayor Giordano stated that a motion is in order to move and pass the ordinance on first reading and that it be advertised in the official newspaper of the municipality as required by law, setting a public hearing for Tuesday, April 23, 2024 at 7:30 pm or as soon thereafter as the matter may be heard. The Borough accounts for about 20%, school 70% and county 10% of your tax bill. The approach we took was to first evaluate appropriations. This includes the statutory appropriations like pension funds and health insurance; those items out of our control. The operating budget was kept flat. The capital budget we looked at short term capital projects that we should prioritize but also five to ten years for various infrastructure projects. How can we generate new revenue streams in order to do this. Within the capital budget there are great initiatives to purchase 197 Wyckoff Avenue, which shows the commitment this Mayor and Council have on open space as we talk about redevelopment in parallel. Included road resurfacing, HVAC and roof Pistol Range which will bring in new revenue streams. We used $34,000 more from fund balance this year compared to last year. The net gain is a 1% tax increase, $47.00 on the averaged assessed home. We are doing everything we can to keep taxes low but be fiscally responsible for the future. Mr. Martinello thanked Mike for his work and leadership on the budget for his first year at handling this. Also, to the staff and department heads for their work on the budget. It was a tough process and had to cut any kind fat in the budget even though there wasn’t much before. Keep it as lean as possible and give us the capability to make the capital investment in our infrastructure and open space. We need to really look at what we can for the future because we cannot take our way out of it. We need to find new revenue streams. Look at sensible ways to increase our tax revenue. Mr. Neale commented that this was his first budget with the Borough and appreciated the process, insight and knowledge in putting the budget together. Mr. Neale thanked the Mayor and Council, Finance Committee and especially the staff for their work. We have some challenges with increase cost, we have a lot of projects to get done and have a lot on our plate. We should be proud of this budget and the process. Mr. Martinello commented that this portion of the ordinance deals with music and residents being able to have parties with music until 10:00 pm on weeknights and 11:00 pm on weekends and holidays. Public comment. Theresa Sherman spoke to the issue of this ordinance not benefitted the majority of residents in town. Having loud music until 10:00 pm on weeknights does nothing to benefit the people in Waldwick. Also seems that 11:00 pm on weekends/holidays is late to have loud outdoor noise. Rich Holsworth commented that this is only for night. Are there morning hours. If you live near the kennel like we do, that was approved by this body, dogs are barking up until 11:00 pm and before 7:00 am every day. I do not see the benefit to have noise longer. Mr. Guilder commented that this ordinance implements fees for level 3 and level 2 charges. The benefit of having a range is that the Council can increase by resolution. The ordinance also preemptively includes ranges for level 2 chargers if the Borough ever acquires them. The level 3 chargers are quick charging and therefore, there in order to not paving vehicles parked all day, there is a penalty if the vehicle is in the charging space after 45 minutes. Council Member Motion Second Ayes Nays Abstain Absent Brennecke X Cericola X Martinello X X Ramundo X X Ritchie X Weber X Mayor Giordano ********** RESOLUTION 2024-128 Authorizing Electric Vehicle Charging Rates WHEREAS, the Borough of Waldwick has installed level 3 DCFC charging stations; and, WHEREAS, Ordinance No. 2024-#12 requires that the electric vehicle charging rates be set by the Mayor and Council at least annually be resolution. REGULAR MEETING MINUTES: 10 APRIL 9, 2024 NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Waldwick hereby set the charging rates for level 3 DCFC charging stations at $0.40 per kWh; and, BE IT FURTHER RESOLVED that any vehicle that is parked in a Level 3 DCFC charging station for longer than forty-five (45) minutes will receive an additional charge of $0.25 per one-minute increment until the vehicle is removed. Mayor Giordano commented that after last season, a survey went out and residents asked that the pool be open earlier in the day. The pool manager requested it be closed at 7:00 pm for safety reasons. Ordinance No. 2024-#16 - AN ORDINANCE TO AMEND CHAPTER 32 – ANIMALS, TO ADD ARTICLE VI PET SHOPS OF THE REVISED ORDINANCES OF THE BOROUGH OF WALDWICK TO PROHIBIT THE SALE OF DOGS AND CATS BY RETAIL PET STORES IN WALDWICK Council Comments. Ms. Cericola commented that being an animal lover, she is extremely pleased that we are introducing this ordinance. This ordinance stops the sale of commercially raised puppies and currently, over 140 towns in NJ have passed this type of ordinance. This is a bi-partisan issue that stops the sale of puppies obtained from puppy mills and hopefully will reduce the animal cruelty associated with the pet store industry. Responsible breeders are not the targets of this ordinance. This ordinance simply seeks to prohibit the retail sale of cats, dogs and rabbits in pet shops. This is win-win legislation for animals and I am proud Waldwick is participating. NEW BUSINESS Mr. Ramundo commented on the first meeting of the Environmental Committee and Beautification Committee where they discussed the projects they wanted to work on this year. There is a Styrofoam Collection on Saturday, April 13 in conjunction with Allendale Environmental Committee. Finally, there will be an Townwide Clean Up Day at Borough Park and HCA Park. More details to come on this. PUBLIC COMMENT Mayor Giordano asked if any member of the public wished to come forward and to discuss anything and if so, please state your name only for the record. Chris Padilla presented the Council with a petition with 53 residents of Borough Park neighborhood signatures to stop the noise pollution from PSEG substation and implement residential permit parking on Alexander Avenue and the rest of the neighborhood. Mr. Neale commented that the Borough is aware of this issue and PSEG is in the engineering and design phase of installing permanent sound barriers. This will be a lengthy process as they need to advertise, go out to bid, award a contract and then construction will begin. Mr. Neale will provide update after his May 2 meeting with PSEG on the progress of the sound barriers. The BPU regulates PSEG and we have submitted a claim for this issue. Mr. Martinello commented that he went by there and you can hear the sound. Does PSEG say what the change was that caused the sound to increase. Mr. Neale responded that it is a new transformer to replace the one that broke. They had the BPU come in to inspect the transformer and they believe it is operating properly. The noise is higher than our noise ordinance allows they are looking to reduce it to acceptable levels. Mayor Giordano would like to see permit parking on all the streets in that area otherwise we are just pushing those cars to another street close by. That will take some time to introduce an ordinance, public hearing and then add signage. Rich Holsworth commented that he does not hear it on his side but is wondering if there are any environmental issues – is this safe, magnetic resonance. Debra Diaz commented that she is experiencing migraines and nausea that she never had before and she lives across the street from it. Eric La Porta commented that he is having issues with the sewer authority again. The trucks are arriving at 5:45 am or earlier and idling. Some Zuidema trucks are parking in the Giant Market parking lot. The nicer weather brings the smell back as well. It seems the procedure that was in place is not working as no one from PD is showing up. Trucks from out of state are here to dump and the Borough gets nothing for this. Kristina Deak commented on the noise at the PSEG substation. Ms. Deak reported that there is significant erosion problem at Borough Park behind the playground. The water just runs down and it is washed out. There are roots exposed as well. Ms. Deak also requested a traffic study in the area by the bend into Borough Park. REGULAR MEETING MINUTES: 13 APRIL 9, 2024 Theresa Sherman asked for a list of streets being paved this year. Mr. Neale will email to her tomorrow. There is work being done on East Prospect Street which was just paved; will the road be repaved as per our ordinance. Mr. Neale explained that the Borough is doing the work and will infrared and blend the asphalt. Mrs. Sherman commented about the sound barriers at the PSEG site and the sound bouncing elsewhere in town. Can they be fined for the constant noise. Mrs. Sherman provided a brief report on WALVAC. There will be a June 6 Friends & Family CPR Class at the Library which was very well attended last year.
