MINUTES FOR THE REGULAR MEETING
OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK
HELD ON TUESDAY, APRIL 23, 2024 AT 7:30 PM
Mayor Giordano called the meeting to order and read the Statement of Compliance.
Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Mr. Brennecke, Mr. Martinello,
Mr. Ramundo, Mr. Ritchie and Mrs. Weber. Ms. Cericola was absent.
Also present: Steven J. Neale, Borough Administrator; Kelley Halewicz, Municipal Clerk and Craig Bossong,
Municipal Attorney. Mr. Guilder was absent.
Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of
silence honoring our Veterans and to remain standing for the prayer.
PROCLAMATIONS & PRESENTATIONS – None.
MAYOR’S REPORT AND REPORTS OF COMMITTEES
Mayor’s Report. Mayor Giordano reported that he attended the Bergen County mayor’s meeting where
they discussed their budget process this year. Mayor Giordano attended the 5K meeting on Monday and
asked residents to come out and support the runners. The theme is Cinco de Mayo as the race takes place
on May 5. There are over 400 runners and 100 walkers.
Mayor Giordano commented on receiving resident’s calls. All calls are forwarded to the Administrator to
follow up. The Mayor sends an email out to each caller to let them know the Administrator will be in
contact with them on the issue.
Mayor Giordano commented that also at the Mayor’s meeting there was discussion regarding deer. There
is no support from the county or elected officials to deal with the issue. Mayor Giordano discussed with
Steve and Kelley earlier and will try to put together a game plan.
Financial & Administrative Committee. Mr. Ritchie had no report.
Fire & Police Protection Committee. Mr. Brennecke provided run calls for Fire Department – January-20;
February-15; March-29 and so far in April-6. Four of the calls were gas/heat related; 1 activated fire alarm;
1 motor vehicle pin. Also, three new firefighters passed Fire Fighter 1 training.
Public Safety Committee. Mayor Giordano read the following report submitted by Councilwoman
Cericola.
The Ambulance Corps will be covering the baseball parade this Saturday as well as the 5K race on May
5th. Allendale, Ho-Ho-Kus and Midland Park EMS will be assisting with coverage during the 5K.
So far for the month of April, there were 33 runs with 24% of runs on Saturdays. The large majority, 12,
of the runs were falls. For 27 of the 33 runs, a unit arrived on scene in under 5 minutes.
WAFA reported that a new ADA Compliance Suite called AccessiBe was added to the new Borough website
this month. This allows users to make various accessibility adjustments based on their needs so they can

have a much better user experience while interacting on our website. You can adjust things like font size,
use a screen reader, adjust the brightness, contrast, mute sounds, stop animations and more. I am proud
the Borough has enabled this great tool which will make the website more interactive for everyone.
Recreational & Health Committee. Mr. Martinello attended the Board of Health meeting. Our COVID
numbers are low as well as overall in NJ. We are looking forward to the walking program, called the
Mayor’s Challenge. Residents will walk with the Mayor in different areas of town. NWBRHC has
completed the audit of the schools for vaccination record, with everything up to date. Various inspections
are taking place for new businesses as well as regular inspections.
Mr. Martinello reported that Pool registration is open; get your early bird discounts. Baseball opening
day is Saturday, walking from Waldwick High School to Borough Park. The players have made signs for
their team to walk with. There are over 430 players and 100 volunteers. Waldwick Soccer fall registration
is open. Waldwick Soccer Football Club accepting travel soccer tryouts for the fall.
Public Works Committee. Mr. Ramundo reported that several cones have been placed on East Prospect
Street. Water and DPW personnel will be looking at water boxes for lead. They are hoping they do not
have to penetrate the roadway. The valve leak on Salrit Avenue was rectified last Saturday.
Buildings & Grounds Committee. Mrs. Weber reported that paving work on Hudson and Bohnert started.
WALVAC needs a new HVAC system, the vendor has been selected and work will start next week. The EV
charging stations, PSEG hooked up the stations and the electrician will be back to complete the job. The
town pool has been cleaned and there will be some painting done.
Mrs. Weber attended the Library board meeting. The Library bathrooms will be under renovation in the
next few weeks. The library is looking to put together a new program called the Library of Things.
Residents would be able to borrow small appliances, electric leaf blower etc. The pine tree in front of the
library has died and will be replaced. The Mayor is looking for a replacement.
DEPARTMENT HEAD REPORTS
Administrator. Mr. Neale had no report but will comment later in the meeting.
Municipal Clerk. Mrs. Halewicz had no report this evening.
Grants Administrator. Mr. Guilder was absent from the meeting.
Attorney. Mr. Bossong reported that they are still conducting their due diligence on 197 Wyckoff Avenue
but still on schedule to close by the end of May.

Public Hearing on the Submission of a 2024 Bergen County Trust Fund Municipal Program for Park
Development Funding Application - Lions Club Memorial Playground at Borough Park • Block 154 Lot 34
• 217 Pine St. Waldwick, NJ 07463
Mr. Neale explained that this application mimics last year’s application for the Lions Club playground. This
playground is in need of replacement and will also be ADA compliant. This includes new equipment,
general maintenance and rubber surface. If awarded this grant and in conjunction with the Local
Recreation Improvement grant, we have applied for will yield $320,000 in grant money toward the

project. The total cost of the project is $550,000. In next year’s capital budget, we will need to fund
$200,000/$250,000 for this project.
Mayor Giordano asked if anyone from the public wanted to speak on this application. There being no
one, Mayor Giordano closed the public comment.

RESOLUTION NO. 2024-129
Endorsement of the Submission of the Bergen County Open Space Trust Fund Grant Application for Park
Development at the Lions Club Memorial Playground at Borough Park
WHEREAS, the Bergen County Open Space, Recreation, Floodplain Protection, Farmland & Historic
Preservation Trust Fund (“County Trust Fund”), provides matching grants to municipal governments and
to nonprofit organizations for assistance in the development or redevelopment of outdoor municipal
recreation facilities; and,
WHEREAS, the Borough of Waldwick desires to further the public interest by obtaining a matching grant
of $250,000 from the County Trust Fund to fund the following project: Improvements to Lions Park
Memorial Playground at Borough Park; and,
WHEREAS, the Governing Body has reviewed the County Trust Fund Program Statement, and the Trust
Fund Municipal Program Park Improvement application and instructions, and desires to make an
application for such a matching grant and provide application information and furnish such documents as
may be required; and,
WHEREAS, as part of the application process, the Governing Body held the required Public Hearing to
receive public comments on the proposed park improvements in the application on April 23, 2024; and,
WHEREAS, the County of Bergen shall determine whether the application is complete and in conformance
with the scope and intent of the County Trust Fund; and,
WHEREAS, the applicant is willing to use the County Trust Fund in accordance with such rules, regulations
and applicable statutes, and is willing to enter into an agreement with the County of Bergen for the above-
named project and ensure its completion on or about the project contract expiration date.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick:
1. That it is hereby authorized to submit the above completed project application to the County by
the deadline of May 3, 2024, as established by the County; and,
2. That, in the event of a County Trust Fund award that may be less than the grant amount requested
above, the Borough of Waldwick has, or will secure, the balance of funding necessary to complete
the project, or modify the project as necessary; and,
3. That the Borough of Waldwick is committed to providing a dollar-for-dollar cash match for the
project; and,
4. That only those park improvements identified and approved in the project application, its Trust
Fund contract, or other documentation will be considered eligible for reimbursement; and,

5. That the Borough of Waldwick agrees to comply with all applicable federal, state, and local laws,
rules, and regulations in its performance of the project; and,
6. That this resolution shall take effect immediately.

Ordinance No. 2024-#15 - AN ORDINANCE CONTINUING THE “MUNICIPAL OPEN SPACE, RECREATION,
FARMLAND AND HISTORIC PRESERVATION TRUST FUND” IN THE AMOUNT OF $.005 PER $100 OF
ASSESSED VALUE UNTIL CHANGED
Council comments. Mr. Bossong reported this is the Open Space Trust the Borough has had on the books
since 2004 and this just allows it to continue.
Public comment. None.
Mayor Giordano closed the Public comment. Ordinance No. 2024-#15 was advertised and on second
reading is adopted. This ordinance will go into effect immediately after approval and publication according
to law.

Mayor Giordano asked the Clerk to read Ordinance No. 2024-#16 by title.
Ordinance No. 2024-#16 - AN ORDINANCE TO AMEND CHAPTER 32 – ANIMALS, TO ADD ARTICLE VI PET
SHOPS OF THE REVISED ORDINANCES OF THE BOROUGH OF WALDWICK TO PROHIBIT THE SALE OF DOGS
AND CATS BY RETAIL PET STORES IN WALDWICK
Council comments. Mr. Bossong reported that this is for puppy mills to not be permitted in the Borough.
There is proposed legislation, and this ordinance mirrors that and is proactive on the issue.
Public comment. Mr. LaPorta asked if this affects rescues. Mr. Bossong commented that his ordinance
supports people purchasing from rescues and shelters and not a pet store.

placed at the curb, for how long and what time period.

NEW BUSINESS
Mr. Martinello reported on the WEF Townwide Garage Sale this weekend and asked that residents come
out to support their neighbors.
Mr. Ramundo reported on the Environmental Committee members of the public brought up why the
cardboard is not picked up by Gaeta. The EPS collection was successful, and we filled three-quarters of a
dumpster. Question regarding tree ordinance in town if they need help. Put trees that are from New
Jersey, so they are not evasive.
Mr. Neale commented that he met with the arborist on Monday. The NJ Tree Federation comes out with
a list every year and we will include that so we know they will thrive in this area.
Mr. Ramundo asked about BC HUB met regarding flooding from the Saddle River. Ridgewood took the
lead, but we were asked if we as a Council can bring it up at a meeting to bring all the other mayors in
line. Suggestions were rain garden like we put in.
Mr. Ramundo asked about Rockland and the dumping of the overfill from the sewer plant and how it
affects the river. Have we seen spikes in contaminants?
PUBLIC COMMENT
Mayor Giordano asked if any member of the public wished to come forward and to discuss anything and
if so, please state your name only for the record.
Eric LaPorta spoke to the issue of the sewer authority, the trucks before hours and idling. He is going
through the proper protocols, but the dispatcher did not even know who the sergeant on call was.
Mayor Giordano asked the Administrator to speak with the Police Department and set up a meeting with
Danubio.
Mr. LaPorta is also concerned about the car wash on Franklin Turnpike with cars on the street. The
Planning Board specifically stated there should be no parking on Franklin Turnpike.
Mayor Giordano asked the Administrator to send Joe there tomorrow on this. They are in violation.
REGULAR MEETING MINUTES: 8 APRIL 23, 2024
Theodore Sanzo spoke to the issue of videos on previous meetings congratulated the person who made
petition on parking in the area of Alexander and PSEG humming. This is the only way to make change.
Mr. Sanzo asked about the settlement for PFOS out of South Carolina. Mr. Bossong responded that the
way the numbers will be generated will be based upon contaminant levels. They do not have a number
for us, but Mr. Bossong asked them for an estimate.
Mr. Sanzo commented that in putting out garbage, whoever is doing the shredded paper from here is
putting it in the garbage. We are required to bring that to the Recycling Center.
Mr. Sanzo commented that the replacement tree in front of the library should not be a flowering tree as
it tracks all over the library.
Bob Rose spoke to the issue of the water being put in the pool and striping on Wyckoff Avenue by the
bridge. Mrs. Weber commented that the water is coming from the main system. Mr. Neale responded
that the Borough reached out to the county on striping that area and a number of roads that the end of
last year. The county agreed to restripe the other streets, but they are now waiting to pass their budget
to put together their striping program. Mr. Neale will follow up with them.

WHEREAS, the applicant is willing to use the County Trust Fund in accordance with such rules, regulations
and applicable statutes, and is willing to enter into an agreement with the County of Bergen for the above-
named project and ensure its completion on or about the project contract expiration date.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick:
1. That it is hereby authorized to submit the above completed project application to the County by
the deadline of May 3, 2024, as established by the County; and,
2. That, in the event of a County Trust Fund award that may be less than the grant amount requested
above, the Borough of Waldwick has, or will secure, the balance of funding necessary to complete
the project, or modify the project as necessary; and,
3. That the Borough of Waldwick is committed to providing a dollar for dollar cash match for the
project; and,

WHEREAS, the Borough requires architectural and engineering services for design, bidding, and
construction observation in related to roofing and HVAC system replacements at the Waldwick Police
Firing Range; and,
WHEREAS, DRG Architects submitted the attached proposal which encompasses all services required at a
cost of $48,960; and,
WHEREAS, the New Jersey Local Public Contracts Law authorizes the award of contract for "Professional
Services" without competitive bids; and,
WHEREAS, DRG Architects total aggregate awards, including this award, will exceed the Pay-to-Play limit
of $17,500 over a one-year period; and,
WHEREAS, DRG Architects has completed and submitted a Business Entity Disclosure Certification which
certifies DRG Architects has not made any reportable contributions to a political or candidate committee

Ordinance No. 2024-#15 AN ORDINANCE CONTINUING THE “MUNICIPAL OPEN
SPACE, RECREATION, FARMLAND AND HISTORIC
PRESERVATION TRUST FUND” IN THE AMOUNT OF $.005
PER $100 OF ASSESSED VALUE UNTIL CHANGED
WHEREAS, in 2003, the Governing Body of the Borough of Waldwick, pursuant to N.J.S.A. 40:12-15.7
issued a non-binding referendum to ascertain the sentiment of the voters of the Borough of Waldwick as
to whether the voters would like to establish a “Municipal Open Space, Recreation, Farmland and Historic
Preservation Trust Fund” (Open Space Trust Fund) in the amount of $.005 per $100 of assessed value for
a period of ten (10) years; and,
WHEREAS, the voters overwhelmingly supported the establishment of such Open Space Trust Fund and
the Borough began collecting the tax in 2004; and,
WHEREAS, the Borough once again issued a non-binding referendum in 2013, to continue the Open Space
Trust Fund for an additional ten (10) years at which time the voters once again overwhelmingly supported
the Open Space Trust Fund and so the Governing Body continued the collection of the tax for the Open
Space Trust Fund; and,
WHEREAS, this Governing Body has determined that as a result of the overwhelming support of the Open
Space Trust Fund via the prior non-binding referendums, the Governing Body would like to codify and
continue the collection of the Open Space Trust fund permanently.
NOW, THEREFORE, BE IT ORDAINED that the Municipal Council of the Borough of Waldwick hereby
continues the “Municipal Open Space, Recreation, Farmland and Historic Preservation Trust Fund”; and,
BE IT FURTHER ORDAINED that the Municipal Council of the Borough of Waldwick hereby determines that
the dedicated tax rate of $.005 per $100 of assessed value shall continue to be collected until such time
as the amount may be changed by further action of the Governing Body; and,
BE IT FURTHER ORDAINED, that the Borough’s Tax Collector is hereby authorized to continue to collect
such dedicated tax of $.005 per $100 of assessed value with the funds being dedicated to the Municipal
Open Space, Recreation and Farmland Historic Preservation Trust Fund to be used in accordance with the
same; and,
BE IT FURTHER RESOLVED, that in case for any reason, any section or any provision of this Ordinance shall
be held to be unconstitutional or invalid, the same shall not affect any other section or provision of this
Ordinance, except that the provision so declared unconstitutional or invalid shall be severed from the
remainder or any portion thereof of the Ordinance; and,
BE IT FURTHER RESOLVED that the ordinance shall take effect upon publication and adoption as required
by law.

OF DOGS AND CATS BY RETAIL PET STORES IN WALDWICK
BE IT ORDAINED that the Municipal Council of the Borough of Waldwick hereby amends Chapter 32 –
Animals to add Article VI Pet Shops of the Revised Ordinances of the Borough of Waldwick to prohibit the
sale of dogs and cats by retail pet store in Waldwick as follows:
ARTICLE VI
Pet Shops
A. Definitions.
For the purposes of this Article, the following terms shall have the following meanings:
Retail pet store means a commercial establishment that sells or offers for sale animals on its premises at
retail.
Sell or offer for sale means to display for sale or to exchange for consideration, adopt out, barter, auction,
trade, lease, or otherwise transfer.
Animal rescue organization means a non-profit organization incorporated under the law of any state and
exempt from federal taxation under Section 501(c)(3) of the federal Internal Revenue Code, as amended,
and whose principal purpose is the prevention of cruelty to animals and whose principal activity is to
rescue sick, injured, abused, neglected, unwanted, abandoned, orphaned, lost, or displaced animals and to
adopt them to good homes. “Animal rescue organization” does not include any entity that breeds animals
or that (1) is located on the same premises as; (2) has any personnel in common with; (3) obtains, in
exchange for payment or any other form of compensation, dogs or cats from; or (4) facilitates the sale of
dogs or cats obtained from a person that breeds animals.
Animal shelter means a facility, whether located in or outside the State of NJ, that is operated by or under
contract with the Borough of Waldwick for the purpose of impounding or caring for seized, stray,
homeless, abandoned, unwanted, or surrendered animals.
B. Prohibition on Sale of Dogs or Cats by Retail Pet Stores.
1. Notwithstanding any other provision of law to the contrary, it is unlawful for a retail pet store, as
defined in Section A, to sell or offer for sale a dog or a cat.
2. Nothing in this section shall be construed to prohibit a retail pet store from providing space to an
animal rescue organization or an animal shelter, as defined in Section A, to publicly showcase dogs
or cats available for adoption.
C. Penalty for violation.
A retail pet store that sells or offers for sale a dog or cat in violation of Section B shall be fined by a sum of
$500. Each sale or offer for sale in violation of Section B shall constitute a separate offense.
This ordinance shall take effect from and after [#] days from the date of its passage.

BE IT ORDAINED that the Municipal Council of the Borough of Waldwick hereby amends Chapter 48 –
Fees, Section 82-4(A) – Dumpster/Container Permit Escrow Required and 82-8 Dumpster/Container
Permit Fee of the Revised Ordinances of the Borough of Waldwick as follows:
§48:82-4 Dumpster/Container permit escrow required.
Prior to the issuance of a permit under Chapter 82, the applicant shall:
A. Escrow in the amount of $400 cash or check must be provided to the Borough Clerk at the time of
application filing and deposited by the Borough, guaranteeing that any and all such damage resulting
to the streets, curbs or sidewalks by reason of the use for which the permit was granted shall be
repaired in a manner satisfactory to the Borough. After satisfactory inspection is conducted by
Borough personnel, the Municipal Council will consider a resolution refunding the escrow. There
shall be no additional escrow collected for the renewal of a permit in the same calendar year.
§48:82-8 Dumpster/Container permit fee.
The fee for the issuance of each permit including renewals in the same calendar year, shall be $75 payable
by the Applicant upon the issuance of the permit.

It shall be unlawful to put or place or keep any obstructions in any of the gutters or on any of the curbs or
sidewalks of any street of the Borough of Waldwick, or to put or place or keep any glass, ashes, cans, bags,
boxes, garbage or refuse materials on any of the streets, curbs or sidewalks of the Borough; but nothing
herein contained shall be deemed to make it unlawful for any resident of the Borough to put or place on
the street in front of the property or premises occupied by him a can, box or other container containing
household garbage and/or refuse, on the night before the regularly scheduled day for the collection of
garbage and refuse in his section of the Borough. These containers shall be removed from the curb no
later than the end of the day of the regularly scheduled day for the collection of garbage and refuse in
their section of the Borough. Outdoor display of goods and sales authorized under Chapter 62A are
excluded under this section.
§ 82-2 Permit required to store dumpster/container on street.
It shall be unlawful to drive any vehicle on or over any curb or sidewalk of any street of the Borough,
except on a driveway provided for that purpose, or to put, place or keep any building or other materials
on any street, curb or sidewalk of the Borough.
A permit is required to store a dumpster/container in the street and must be taken out with the Borough
Clerk.
§ 82-3 Application for dumpster/container permit

The permit required by this ordinance shall be issued by the Borough Clerk on application, in writing,
signed by the person, firm or corporation seeking permission to place dumpster/container on any street
in the Borough. The application shall state the time when and exact location on street where
dumpster/container will be placed. A description of the work to be performed is required.
Permit is valid for a period of up to three (3) months. The permit may be renewed once in the calendar
year.

§ 82-5 Storage of dumpster/container.

All dumpster/containers shall be placed next to the curb and shall not extend more than six (6) feet from
said curb into the street, and shall be properly guarded by red lights at night. There shall be no
dumpster/container storage on the street from December 1 through April 1.
§ 82-6 Repairs to be made.
The applicant shall, within one (1) month of the causing of any such damage to street, sidewalks or curbs
for which permit was grant, to repair in a manner satisfactory to the Borough.
§ 82-7 Revocation of permit.
The Mayor and Council shall have the right to revoke any permit when in their judgment it shall be for the
best interests of the public so to do.

§ 82-10 When effective.
This ordinance shall become effective immediately upon passage and publication as required by law.
