REGULAR MEETING MINUTES: 1 OCTOBER 22, 2024 MINUTES FOR THE REGULAR MEETING OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK HELD ON TUESDAY, OCTOBER 22, 2024 AT 7:30 PM Mayor Giordano called the meeting to order and read the Statement of Compliance. Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Mr. Brennecke, Ms. Cericola, Mr. Martinello, Mr. Ramundo, Mr. Ritchie and Mrs. Weber. Also present: Steven J. Neale, Borough Administrator; Kelley Halewicz, Municipal Clerk and Craig Bossong, Municipal Attorney. Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of silence honoring our Veterans and to remain standing for the prayer. PROCLAMATIONS & PRESENTATIONS - None. MAYOR’S REPORT AND REPORTS OF COMMITTEES Mayor’s Report. Mayor Giordano attended an Eagle Scout ceremony on Sunday for the bench project outside town hall and the walking path in HCA Park. Mayor Giordano attended two ribbon cutting ceremonies. Mayor Giordano also had a park bench dedication. This Saturday is the Ragamuffin Parade and Trunk or Treat and thanked Chuck for doing this. Financial & Administrative Committee. Mr. Ritchie reported that the Finance Subcommittee met to prepare for next year’s budget. The operating budget is razor thin and we are trying to make changes to the capital budget to reduce the down payment needed for projects and equipment. At the last meeting we introduced ordinances to create the position of confidential assistant and fund that position. This is after the resignation of our Grants Administrator, and we felt the roles and responsibilities needed to be divided up into different positions. We will be appointing after a vote to Tatiana to that position and couldn’t be more pleased with that. She has been with us a short time but has been live changing for the Borough. Fire & Police Protection Committee. Mr. Brennecke reported that the Fire Department had 16 calls so far this month. The month of October is Fire Prevention Month. They held the annual Open House which was well attended. The Fire Department will vote on the slate of officers at the November meeting and Mr. Brennecke will provide the names at the November meeting. Public Safety Committee. Ms. Cericola reported that notable for the month so far includes the following: WALVAC responded to the Route 17 hit and run with the Allendale Police Department and Upper Saddle River Police Department, transporting one patient to Hackensack; WALVAC worked hand in hand with Waldwick Fire Department on the Route 17/ Sheridan Avenue roll over this past Monday night; Standbys are ongoing for WHS football and Waldwick Junior football. WALVAC looks forward to participating in the Ragamuffin Parade this Saturday. Additionally, Ms. Cericola attended the presentation of a generous check to the Ambulance Corps on Wednesday night by the Nicholas Negroni Mental Health Foundation coordinated by former member, now NJ State Trooper Jack Rosen. WALVAC and the Foundation are in talks to hold a mental health training. REGULAR MEETING MINUTES: 2 OCTOBER 22, 2024 Recreational & Health Committee. Mr. Martinello reported that last weekend was senior night for 8th grade Waldwick sports programs. We congratulate the students and look forward to seeing them in high school. The baseball program held the annual mum’s sale at American Legion and thank residents for purchasing and American legion for hosting. Our wrestling program registration is open and will be posted online. Mr. Martinello reported at the Health department meeting that the annual audit for immunization records is completed. COVID numbers and hospitalization still remain low. The Child Health Clinic is offered on the third Wednesday of each month. During the water main break, the Health department inspected 47 establishments to ensure they were adhering to the boil water advisory. There were 11 retail inspections, 1 temporary food establishment inspection, 3 complaints followed up on. The Health department holds clinics in Tamaron and the Health clinic. Their website offers a number of support groups and classes for residents. Public Works Committee. Mr. Ramundo reported that leaves should not be placed curbside too early as it affects parking. New Jersey is in a fire watch. No open flames or backyard firepits. Buildings & Grounds Committee. Mrs. Weber reported that the tennis court work is ongoing. New trees will be planted at Borough Hall to replace the ones that didn’t make it. At Vets Park there was pruning and mulch work completed. Regarding the new playground at Lions Club park there were two submissions from the engineering firm, and we will be deciding on a design for that park. DEPARTMENT HEAD REPORTS Administrator. Mr. Neale reported on the resolution to close out the 2024 Road Program and ADA Curb Ramp Project. We are very excited to create the position of Confidential Assistant within Administration and excited to get that new person started. Municipal Clerk. Mrs. Halewicz reported that she and Tatiana attended the BCMCA Mini Conference in Ramsey last week. The County Election officials presented some last-minute details for November 5. We also heard from the BCPO on how they will be assisting us on Election day. Also, a terrific session by LGCCC, Scott Steinman. Finally, Lori Buckelew, Deputy ED of NJLM provided important updates on the new OPRA law that went into effect on September 3. Reminder for Vote by Mail voter – if you are having issues completing your VBM ballot, go to the Elections page of our website (waldwicknj.gov) click on the link to a video on how to complete your vote by mail ballot. The last day to apply for VBM by mail is October 29; however, at this point, voters must bring the application to Hackensack as there is no way to guarantee the post office will deliver by October 29. Avoid the lines and consider Early Voting! October 26 – November 3. Monday – Saturday 10 am – 8 pm and Sundays 10 am – 6 pm. Two closest early voting sites are Wyckoff Library, Shotmeyer Room, 200 Woodland Ave, Wyckoff and Tice Senior Center, 411 Chestnut Ridge Road, Woodcliff Lake. Nixle will continue to be used by the PD for their emergency notifications. The October monthly newsletter will go out on Friday. Attorney. Mr. Bossong reported that there is no movement and no estimated date with regards to PFOS litigation with 3M and DuPont. The Tyco/BASF should be approved next Friday and then the new claim window opens for us to submit. REGULAR MEETING MINUTES: 3 OCTOBER 22, 2024 Mr. Bossong reported that the fourth round of COAH numbers were released Friday. Waldwick’s plan calls for 178 units by 2035. It considers what we have, so we are looking at 100 affordable housing units or 500 units to obtain the number of affordable units in the Borough. The Borough’s plan needs to be submitted by the end of January. Ordinance No. 2024-#30 - AN ORDINANCE AMENDING ORDINANCE NO. 2024-#27 CHAPTER 90, “TREES AND SHRUBS”, ARTICLE I, SECTION 90-8A TREE REMOVAL PERMIT AND SECTION 90-12C TREE REMOVAL CONTRACTOR REQUIREMENTS; NOTICE AND DEADLINES OF CODE OF THE BOROUGH OF WALDWICK Council comments. Mr. Neale explained that we are just cleaning up some language. The application fee should have been $50 per application; $1 million in general liability will now follow what the State requires. Public comment. Bianca Marossi spoke to the issue of emergency removal and then going back. Mr. Neale responded that the Borough will take that on a case by case basis. Al Coldon spoke to the issue of the clear cutting on Wyckoff Avenue. Mr. Neale explained that trees will be plants as part of their final site plan for the group home. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Waldwick, that the Governing Body hereby appoints Tatiana Marquis to the position of Confidential Assistant beginning October 23, 2024; and, REGULAR MEETING MINUTES: 6 OCTOBER 22, 2024 BE IT FURTHER RESOLVED, that she shall serve at an annual salary of $85,000 with annual adjustments for to her salary effective January 1, 2025 commensurate with the annual cost of living increases awarded to other Borough employees. Ordinance No. 2024-#33 - ORDINANCE OF THE BOROUGH OF WALDWICK, ADOPTING THE HARRISON AVENUE REDEVELOPMENT PLAN PURSUANT TO THE LOCAL REDEVELOPMENT AND HOUSING LAW, N.J.S.A. 40A:12A-1, ET SEQ., FOR PROPERTY LOCATED AT 37-49 HARRISON AVENUE AND 13 WEST PROSPECT STREET AS IDENTIFIED AS BLOCK 107, LOTS 1 ,3, 5, 7, 8, 9, 10 and 11 Council Comments. Mr. Ritchie commented that we have been working hard on redevelopment and put those areas out to study. The planning board is involved. We would look to redevelop Franklin and Harrison between Prospect Street and Frederick Street. We hired a planner to put ideas together and this ordinance takes this plan and gives it to the Planning Board to review, study, make changes and recommendations. Then the Council still has an opportunity to make any changes. Once adopted, the plan puts guardrails on what can be done in that area when developers come in. We all essentially want the same thing to keep this quiet, retail on the first floor, with no high-density housing. Mayor Giordano stated that a motion is in order to move and pass the ordinance on first reading and that it be advertised in the official newspaper of the municipality as required by law, setting a public hearing for November 12, 2024 at 7:30 pm or as soon thereafter as the matter may be heard. REGULAR MEETING MINUTES: 7 OCTOBER 22, 2024 NEW BUSINESS Mr. Martinello reported that he attended the Board of Education meeting. Test scores have increased since last year and there is significant progress. The holiday season is upon us, starting with Halloween. Mr. Martinello congratulated Tatiana on her promotion. Mr. Ramundo spoke to the issue of the Environmental Committee proposal for Hopper Avenue bridge flower boxes and solar powered irrigation system. Mr. Ramundo reported on the Styrofoam Collection event with assistance from Boy Scout from Allendale who wish to participate quarterly in this event. We were able to fill the container three quarters of the way. This year’s events kept 12,000 lbs of Styrofoam out of landfills. PUBLIC COMMENT Mayor Giordano asked if any member of the public wished to come forward and to discuss anything and if so, please state your name only for the record. John Vervoort as many of you know, I am a fairly regular attendee of these Council Meetings for several years now. I have lived in Waldwick for the past 35 years. I hear a lot of recurring banter every election season about open transparency. I would like to take a moment to commend the Mayor, Council and the Administrators on their open transparency. During my long military deployment in the Middle East this past year, I was able to get out of the scorching heat and retire to my hooch where I was able to watch every meeting on YouTube. This allowed me to keep up with the latest and greatest happenings from my beloved hometown of Waldwick. I was able to watch the proceedings in near real time, deep in the desert, on the other side of the world. Since my return home in July, I’ve missed but a few but have always been able to get caught up using YouTube feed. I’m sorry that I missed the last meeting, as watching the feed later, I discovered I missed quite an interesting and spirited evening. It appears that the upcoming election has brought some new visitors to the council meeting. Interestingly, I have not seen them here before… and more coincidently, some of these visitors happen to be challenging the incumbent council members in the November election. It’s nice to see new people at these meetings and to hear all of the different perspectives from our community. This is the heart of democracy and it’s heartwarming to see. However, one observation, why are these new visitors only showing up shortly before the election? Where have they been all of this time? Will they continue to participate after the election if they are defeated? If past history is a guide, the defeated candidates seldom return… I’d like to address some of the comments made at the last meeting, and give you my opinion, as I see it. An active candidate for a seat on the borough council, introduced herself and noted her “deep disappointment” with the Council’s support of (S2103/A971). This bill is to prohibit affordable housing obligation exemptions for urban aid municipalities. She explained from her role as a social worker why she felt this bill decreases our legal responsibility for more affordable housing, and she believed that we have a housing affordability crisis. She went on to say that we all know someone who can’t afford to live in a place they want to live, or where their family lives due to the cost of housing. “It is up to upstanding communities such as ours to increase the amount of available affordable housing.” It creates a stigma against affordable housing, and that we should see more affordable housing as something that improves our community, not something that takes away from it. I was not familiar with this bill or even the council vote, so I did some research. The council voted to support a bill where the prior rules of the Council on Affordable Housing excluded Municipal (Urban) Aid Program municipalities like Camden, Paterson, Newark and others from providing any contribution toward a region's affordable housing need. Those exemptions, however, can lead to REGULAR MEETING MINUTES: 8 OCTOBER 22, 2024 undue development burdens on the other municipalities in the region. Additionally, directing more affordable housing development to urban municipalities would help minimize urban sprawl and would direct development to areas that already have extensive infrastructure in place, allowing for more cost- effective accommodation of new development. These exemptions, added to the affordable housing obligations for a town like ours, must support to make up the shortfall. This has a direct impact on the taxes that you and I ultimately pay at the end of the day. To explain it simply, let’s say that the State mandates that 1 million affordable housing units be created, municipalities like Paterson, Newark et al are exempt, so that shortfall now is divided up among the remaining municipalities, increasing their quota to make up for those units not covered by the exempt ones. This bill would remove that exemption and make the mandate equitable. I would argue that the added tax burden would amplify the affordable housing crisis in our community. I just don’t get it… our Borough is not trying to abdicate or sidestep its affordable housing obligations; this bill simply makes the legislation equitable. All along our Borough Attorney and the Mayor and Council have been proactive to stay ahead of the Fair Housing legislation and ensure that Waldwick is on track and compliant with ALL Fair Housing mandates. Our administrator maintains a dedicated webpage on the Borough website just to Affordable Housing. My home is my most valuable asset. I have worked hard to pay for it; to keep it maintained and to improve it, it is my primary family investment. I have raised two children in it. I expect the value of my home to increase over time. I believe that our Borough leadership has a solemn duty to maintain and support our property values. Not only to support a strong tax base, but to make Waldwick a sought-after place to be, a place where people want to move their families. A place with strong property values, great educational opportunities and safe streets. So, while I certainly appreciate the perspective of the prospective council candidate, I must respectfully agree that we disagree. I fully support the Council’s vote to support this bill, and I fully support the ongoing effort to stay ahead of any Fair Housing Legislation in order to maintain full compliance with our current obligations. The council candidate was followed by a current Borough employee and previous Mayoral candidate, who was soundly defeated in the past election. This gentleman is a regular attendee of these meetings, and we’ve all heard from him before. He started out his comments calmly asking about contributing to disaster relief for Helene and Milton victims. He proceeded with a litany of random, disjointed complaints and highlighted that he wanted answers from the elected officials, not appointees. He made a point to say “Just so you know, I’m not running for any office”. As the complaints went from couches on Wyckoff Avenue to “Is the water at my home safe?” His tone became more manic and at times seemed to me to become almost unhinged, verbally sparring and attacking the Mayor and Council members. The volume and tone continued to rise as he described how the “F” and the “I” looks lousy on the Fire Department sign. Why aren’t our elected officials doing anything about this? This display was not only disrespectful to all present but was simply shameful and embarrassing. It should be noted that the elected and appointed officials present that day maintained their poise and dignity, answering each and every legitimate question in a respectful and dignified manner. It must have been tough to maintain your professional demeanor while listening to this sharp-tongued rant. And when he ended his tirade with the comment that he’s “not trying to get anyone elected”. I think the collective long sigh was palpable even on YouTube. We all want what’s best for Waldwick. I think it will certainly be interesting to see what happens in 13 days, not only for our nation, but in our little borough of Waldwick, a place that I am proud to call my REGULAR MEETING MINUTES: 9 OCTOBER 22, 2024 home. I encourage everyone to participate in the election, to go out and make your vote count. It’s a responsibility that I have personally fought for you to have the right to do. It is an obligation that you have as a citizen of our great nation. Joann Mitchell spoke to the issue of the battered bus station and requested an update. Also, the approach to that station should be looked at. Mr. Neale responded that we reached out to the county to get the repair done as well as analyzing the station itself. Bianca Marossi spoke to the issue of so many people at the Council meeting being a good thing. Are you aware of the drought issue and fire hazard with the leaves. How does constant flushing affect our water tanks? How is the yellow water issues being monitored? Also, how you can get the word out to the residents on social media. Mr. Neale explained that we are not depleting our water system. We have backup with our storage tanks, and it is monitored. We are monitoring this issue, and we are checking specific properties and having various check-ins with residents. It might not help everyone’s situation, but it is helping. Eric LaPorta spoke to the issue of every town having a representative but Waldwick. Mayor Giordano provided Mr. LaPorta with the answers to his questions regarding the Sewer Authority. Mr. LaPorta reported about the smell this evening. Also, he reached out to the Police Department on Saturday for a smell. No one from DEP came until 5:30 pm and said he couldn’t smell it. Also, trucks are still coming. Mr. Neale will follow up. Elise Dittamo spoke to the issue of different events planned, particularly where the businesses could participate in them. With regards to water, we are in a State drought watch, could we send something out to show people how to conserve water. CLOSED SESSION - Any matter permitted to be discussed in Closed Session pursuant N.J.S.A. 10:4-12 RESOLUTION NO. 2024-274 Authorize Closed Session WHEREAS, Section 8 of the Open Public Meetings Act (N.J.S.A. 10:4-12(b)(1-9) permits the exclusion of the public from a meeting in certain circumstances; and, WHEREAS, the Mayor and Council is of the opinion that such circumstances exist. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Waldwick, County of Bergen, State of New Jersey, as follows: The public shall be excluded from discussions of the Closed Session. The general nature of the subject matter to be discussed is as follows: Confidential legal advice REGULAR MEETING MINUTES: 10 OCTOBER 22, 2024 It is anticipated at this time that the above-mentioned subject matter will be made public within 60 days or as soon thereafter as it is deemed to be in the public interest to do so based on the conclusion of the matter. NOW THEREFORE, BE IT ORDAINED by the Governing Body of the Borough of Waldwick, in the County of Bergen, State of New Jersey, as follows: ARTICLE I TREE PROTECTION REMOVAL & REPLACEMENT § 90-8. Tree removal permit. A. Tree removal permits for Qualified Trees shall contain the following: An application for a tree removal permit shall be filed with the Building Department to remove any Qualified Trees and to determine any applicable exemptions. The tree removal permit fee shall be $50 per tree application to be removed. Trees determined to be a Hazard Tree shall require a permit but not require a permit fee. A tree removal permit shall be valid only for the location (property) for which the application is made. The permit shall not authorize trespass on any adjoining property. Applications shall provide the following information: (1) If using a Licensed Tree Expert for any determinations regarding trees, provide their name, address, title, and license number. (2) The lot and block or lots and blocks of the proposed Qualified Tree removal work. The street address of the proposed work. The identity of the owner(s) of the land where the work is proposed. (3) A sketch of the property, preferably on a property survey, depicting the location of the Qualified Tree on the property (front yard, rear yard, side yard). (4) The purpose or reason for the removal of the Qualified Trees. (5) List the number of Qualified Trees being removed by species and size (diameter at breast height). (6) Proposed start date of the work. Proposed date of completion. (7) A plan for either replacing or offsetting the Qualified Trees proposed to be removed with the replacement tree's location on the property. § 90-12. Tree removal contractor requirements; registration; notice and deadlines. C. All tree removal contractors shall carry and provide proof of at least the following minimum insurance coverage: $2,000,000 $1,000,000 property damage and bodily injury insurance per incident; $300,000 automobile insurance per incident; and workers' compensation insurance in such amounts as required by law. All tree removal contractors shall require their insurers to provide the Borough with a minimum of 30 days advance notice of the cancellation of any required coverage. Upon the cancellation of any required insurance coverage, the tree removal contractor's registration shall automatically be suspended, and the tree removal contractor shall be prohibited from performing thereafter. Upon the submission of satisfactory proof of insurance coverage, licensure in accordance with the New Jersey Tree Experts and Tree Care Operators Licensing Act, and a certification that the tree removal contractor has read, understands, and will comply with all requirements of this rule, then the Borough Clerk shall register the tree removal contractor as approved to do business in the Borough. If any section, sub-section, paragraph, sentence, or any other part of this ordinance is adjudged unconstitutional or invalid, such judgment shall not affect, impair, or invalidate the remainder of this ordinance. All ordinances or parts of ordinances that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. MAYOR AND COUNCIL OF THE BOROUGH OF WALDWICK Bergen County, New Jersey RESOLUTION NO. 2024-273 Appointment of Tatiana Marquis as Confidential Assistant WHEREAS, Borough Ordinance No. #2024-31 created the position of “Confidential Assistant” within the Borough Code under the auspices and direction of the Borough Administrator; and, WHEREAS, the Borough is in need of a Confidential Assistant to this newly created position. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Waldwick, that the Governing Body hereby appoints Tatiana Marquis to the position of Confidential Assistant beginning October 23, 2024; and, BE IT FURTHER RESOLVED, that she shall serve at an annual salary of $85,000 with annual adjustments for to her salary effective January 1, 2025 commensurate with the annual cost of living increases awarded to other Borough employees. Motion: ______ Seconded: ______ Roll Call: _____ _____ _____ _____ _____ _____ _____ Brennecke Cericola Martinello Ramundo Ritchie Weber Giordano Ordinance No. 2024-#33 ORDINANCE OF THE BOROUGH OF WALDWICK, ADOPTING THE HARRISON AVENUE REDEVELOPMENT PLAN PURSUANT TO THE LOCAL REDEVELOPMENT AND HOUSING LAW, N.J.S.A. 40A:12A-1, ET SEQ., FOR PROPERTY LOCATED AT 37-49 HARRISON AVENUE AND 13 WEST PROSPECT STREET AS IDENTIFIED AS BLOCK 107, LOTS 1 ,3, 5, 7, 8, 9, 10 and 11 WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq., as amended from time to time (the “Redevelopment Law”), provides a process for municipalities to participate in the redevelopment and improvement of areas in need of redevelopment; and WHEREAS, pursuant to the Redevelopment Law, the Borough of Waldwick (the “Borough”), by way of Resolution approved on September 10, 2024, designated Block 107, Lots 1, 3, 5, 7, 8, 9, 10, 11, 13 and 17 on the Official Tax Map of the Borough and more commonly known as 37-49 Harrison Avenue, 13 West Prospect Street, and 60-62 Franklin Turnpike to be an area in need of redevelopment (“Study Area”); and WHEREAS, the Mayor and Council directed the Borough Planner to prepare a redevelopment plan for a portion of the Redevelopment Area, namely Block 107, Lots 1, 3, 5, 7, 8, 9, 10 and 11, commonly known as 37-49 Harrison Avenue and 13 West Prospect Street (“Redevelopment Area”); and WHEREAS, consistent with the Redevelopment Law, the Borough Planner drafted the attached Redevelopment Plan, entitled “Harrison Avenue Redevelopment Plan” dated October 2024 (“Redevelopment Plan”), for the Redevelopment Area and by introduction of this Ordinance, the Mayor and Council forwarded the Redevelopment Plan to the Borough Planning Board for review and comment; and WHEREAS, at a public meeting held on November 6, 2024 and after providing due notice, or a meeting held thereafter, which shall occur within 45 days of such referral, the Planning Board reviewed the proposed Redevelopment Plan; and WHEREAS, the proposed Redevelopment Plan was presented to the Planning Board by Paul Grygiel, a New Jersey licensed professional planner employed by Phillips Preiss Grygiel Leheny and Hughes LLC; and WHEREAS, by correspondence approved by the Planning Board and forwarded to the Mayor and Council, the Mayor and Council provided comments and recommended the adoption by ordinance of the proposed Harrison Avenue Redevelopment Plan to guide its redevelopment. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Waldwick, County of Bergen, State of New Jersey, as follows: Section 1. The preceding recitals are incorporated herein as though fully set forth herein at length. Section 2. The Redevelopment Plan dated October 2024 entitled “Harrison Avenue Redevelopment Plan” is hereby adopted to guide the development of the Redevelopment Area. The Redevelopment Plan shall supersede all provisions of the Borough of Waldwick Land Development Ordinance regulating development of the Redevelopment Area that is the subject of this Redevelopment Plan and this adoption of the Redevelopment Plan shall be considered an amendment to the Borough of Waldwick zoning map for that portion of the Redevelopment Area. Section 3. The Mayor and Council are hereby authorized to seek potential redevelopers for the Redevelopment Area and to designate such redeveloper and enter into a redevelopment agreement with the same. Section 4. If any part of this Ordinance shall be deemed invalid, such part shall be severed and the invalidity thereof shall not affect the remaining parts of this Ordinance. Section 5. A copy of this Ordinance shall be available for public inspection at the offices of the Municipal Clerk. Section 6. This Ordinance shall take effect after the first publication thereof after final adoption, as provided by law.
