REGULAR MEETING MINUTES: 1 FEBRUARY 13, 2024 MINUTES FOR THE REGULAR MEETING OF THE MAYOR & COUNCIL OF THE BOROUGH OF WALDWICK HELD ON TUESDAY, FEBRUARY 13, 2024 AT 7:00 PM VIA ZOOM Mayor Giordano called the meeting to order and read the Statement of Compliance. Mayor Giordano asked for a roll call. Present on roll call: Mayor Giordano, Mr. Brennecke, Ms. Cericola, Mr. Martinello, Mr. Ramundo, Mr. Ritchie and Mrs. Weber. Also present: Steven J. Neale, Borough Administrator; Colleen Ennis, CFO/Tax Collector/Treasurer; Matthew Guilder, Grants Administrator; Kelley Halewicz, Municipal Clerk and Craig Bossong, Municipal Attorney. Mayor Giordano asked everyone to join in the Pledge of Allegiance, remain standing for a moment of silence honoring our Veterans and to remain standing for the prayer. PROCLAMATIONS & PRESENTATIONS – None. MAYOR’S REPORT AND REPORTS OF COMMITTEES Mayor’s Report. Mayor Giordano commented that we are on Zoom this evening due to the storm. Financial & Administrative Committee. Mr. Ritchie had no report and will save his comments for discussing the budget in Unfinished Business. Fire & Police Protection Committee. Mr. Brennecke commented that he believes we can move forward on the Fire Department by-law changes this evening. Public Safety Committee. Ms. Cericola will save her report for the next meeting. Recreational & Health Committee. Mr. Martinello reported that he attended the Board of Health meeting to review the contract and obtain details on services. He commented on the Rabies Clinic and Events page of the NWBRHC page. Public Works Committee. Mr. Ramundo spoke with Mike LaTorre about today’s snowstorm. There have been three snow events so far this year and DPW has done a great job clearing the roads to the asphalt in a very timely manner. There were three water main breaks since our last meeting. There is a punch list items for the ambulance building and nurse station being handled by DPW. Buildings & Grounds Committee. Mrs. Weber reported that WALVAC project is moving along nicely has Mr. Ramundo just mentioned. The Borough is not moving forward with the NWBRHC project until further notice. With regards to the Pistol Range Project, the Chief and Lieutenant are here this evening to provide a presentation on moving forward with this project. REGULAR MEETING MINUTES: 2 FEBRUARY 13, 2024 DEPARTMENT HEAD REPORTS Administrator. Mr. Neale provided an update to the Water/PFOS remediation project is ongoing. All the electrical has been completed. There has been roadwork done this past week and thanked the PD/Village School for coordinating traffic control. The Borough is awaiting the vessels and they will be received throughout the month of April, staggered. We will put out communications to residents when their area is to be affected by the installation and additional construction. Thank you to DPW for great job with the snow. Municipal Clerk. Mrs. Halewicz will hold her report until the next meeting. Grants Administrator. Mr. Guilder not on call at this time. Attorney. Mr. Bossong will hold his comments on several consent agenda resolutions this evening. Mr. Brennecke asked for 2024-77 be pulled for discussion and separate vote. Mayor Giordano discussed Resolution 2024-74 regarding the purchase of land. The Borough of Waldwick had an opportunity to purchase a piece of property from a resident. We have ideas what we want to do but nothing firm at this time. Once we figure out what we want to do, we will let residents know. Mayor Giordano discussed Resolution 2024-81 which is something we do every year with Midland Park Continuing Education Summer Camp. Waldwick children are able to attend this camp and the Borough allows Midland Park to bring the campers in twice a week to enjoy the pool. Mr. Bossong explained Resolution 2024-75. A tax appeal was filed by The Bristol which goes back to 2021 – 2023. The Borough filed a counterclaim alleging they were underassessed. When we were about to go to trial and we had our appraisals. The Bristol conceded that they were underassessed. By a substantial amount. They will owe the Borough approximately $205,000 for these years. They have asked for a payment plan to pay over the course of 18 months provided the Governing Body approves this, which will have The Bristol write a check for $11,000 each month. Huge win for the Borough. Mr. Bossong explained Resolution 2024-76. We realized when the resolution was adopted, Block 116/Lot 18 was left off the resolution. It was in the plan, studied and recommended. There was a typo so all this resolution does is include that block and lot. Council Member Motion Second Ayes Nays Abstain Absent Brennecke X Cericola X X Martinello X Ramundo X Ritchie X X Weber X Mayor Giordano ********** REGULAR MEETING MINUTES: 4 FEBRUARY 13, 2024 RESOLUTION NO. 2024-77 Authorizing Approval of a Portion of Waldwick Volunteer Fire Department By-laws Amendments WHEREAS, the Waldwick Volunteer Fire Department (“WFD”) have reviewed their by-laws and submitted to the Borough a comprehensive and substantial number of requested by-law amendments; and, WHEREAS, the requested by-law changes were organized into two groups (Group 1 and Group 2) and numbered 1-40 and are annexed hereto; and, WHEREAS, pursuant to Waldwick Borough Ordinance 12-6, all amendments to the WFD by-laws must be reviewed and approved by the Mayor and Council; and, WHEREAS, upon review, the Mayor and Council are hereby approving certain by-laws, but withholding approval on others for further discussion with members of the WFD prior to making a final decision on the same. NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of Waldwick hereby approve the following WFD by-laws with the removal of Group 1 #14: Group 1 By law amendment: #2, 8-11, 15-16, 18, 24-34, 37-40 Group 2 By law amendment: #1-4 BE IT FURTHER RESOLVED, that the Mayor and Council hereby directs the Fire and Police Protection Committee to schedule a meeting with representatives of the WFD by-law committee to discuss the remaining requested by-law amendments so the Fire and Police Protection Committee can make a recommendation to the Mayor and Council regarding the remaining requested by-law amendments; and, BE IT FURTHER RESOLVED, that a copy of this resolution be provided to the WFD for their records. Discussion. Mr. Brennecke explained that the proposed by law changes were reviewed by Borough Attorney. Results came back in two groups. Group 1 are essentially benign. Group 2 our policy votes. The first group starts with #2 but in order to take a look at other proposed by law changes, we first have to look at #1, new definition of line officers. Taking out second captains, first captain, first lieutenant and second lieutenant. There will be no differentiation between captains and lieutenants. This has to be adopted in order to discuss 24-24. Mr. Bossong explained #1 cannot be done tonight as it involves an ordinance change. Line officers are set via ordinance and it is Ordinance No. 12-3. In order to make that by law change, you need the Borough ordinance, which includes an introduction and public hearing. Therefore, #1 cannot be accomplished tonight. Mr. Brennecke commented then anything that pertains to the new definition of officer cannot be done until that ordinance is done. REGULAR MEETING MINUTES: 5 FEBRUARY 13, 2024 Mr. Ramundo commented that would include 24-34. If the reference for election or nomination, 1st lieutenant and 2nd lieutenant. Mr. Bossong commented that lieutenant is already in the ordinance, so that is not a problem. It is just a matter of how many lieutenants or captains. Mr. Bossong commented that anything at a level 1 can be done tonight; level 3 involves and ordinance change and level 2 are policy discussions. Mr. Martinello commented on #19, Article 6, Section 1 where a person can have two different types of elected positions, either on line or executive side, is that allowed to hold two different types of positions within the association or is that a conflict of interest? Mr. Bossong responded that is a concern I would have. The concern is that a conflict could easily arise with this. That is why this is a level 2 and will require additional discussion and not included tonight. Mr. Brennecke pulled Group 1, #14. The rest to be included in the resolution as listed. Ordinance No. 2024-#01 - AN ORDINANCE AMENDING ORDINANCE NO. 2020-#01 TO ADD SECTION 10-6 BEAUTIFICATION SUBCOMMITTEE, DUTIES AND RESPONSIBILITIES AND RENUMBER REMAINING SECTIONS ACCORDINGLY Council comments. Mayor Giordano explained that the Beautification Committee will be part of the Environmental Committee. They will join together as one committee. By doing this we are forming one big committee, money can be given out for extra projects. There is nothing against anyone, we are trying to make the town better by all three groups working together. Mr. Ramundo commented that one of the advantages of putting everything under the Environmental Committee is to secure monies available for various projects including community gardens. By coming together, we can obtain grant money from PSEG, ANJEC and Sustainable Jersey. Leverage some of the projects the Beautification Committee wants to do without the expense on the Borough. The Beautification Committee has done great work over the years and to get some of the bigger projects they want to do from grant monies instead of the Borough would be a win for everyone. REGULAR MEETING MINUTES: 6 FEBRUARY 13, 2024 Public comment. Mayor Giordano closed the Public comment. Ordinance No. 2024-#01 was advertised and on second reading is adopted. This ordinance will go into effect immediately after approval and publication according to law. Lori Gillen spoke to the issue of the Water project. Mayor Giordano interrupted her and explained this is the public portion for this particular ordinance. You can speak on the Water project under Public Comment later in the meeting. Ms. Gillen explained she is part of the Beautification Committee and enjoys being part of this group. They work hard and accomplish a lot. Just wants to make sure that what they have done can continue. She enjoys working throughout the town on projects. UNFINISHED BUSINESS a. 2024 Municipal Budget Discussion. Mr. Ritchie commented that the Finance Committee has met a few times and as a Council as few times. We have a better idea now where we stand than when we first met. The goal is to talk about where did we wind up on Capital and Operating and then have the two options for the Council to discuss. Capital budget = $3.2 million and a couple minor things that could fluctuate with the Water project but only a little depending on the monies from American Rescue Plan. Capital largely unchanged a lot from last time. Hoping to have grant awarded for the purchase of the property but we cannot anticipate that in the budget until we receive it. That increases down payment required. To have a balance budget we are looking to use $2.2 million in surplus with a 1 ½% tax increase and we could use more surplus to bring that down. Operating budget = is very thin, no fluff and it was reduced it. It has been reduced over the last couple of years by millions of dollars. The Borough does not have a spending problem. The goal as a Council over the next 3-5 years is new tax revenues to be able to offset these increasing costs and not put them on the shoulders of the taxpayers. That is why redevelopment studies are being proposed, hoping that will generate new tax revenues. REGULAR MEETING MINUTES: 7 FEBRUARY 13, 2024 Mr. Neale explained that they have gone through the Operating budget line by line to make adjustments where we can and believe it is in a really good place, comfortable that we can survive. We do feel confident that we can offset the large purchase with grants, in addition to state funding including county and local funding. Our recommendation is 1.5% with $2.2 million out of surplus which is about $130,000 increase that we would be taking out of surplus from last year. Mr. Ritchie commented that there is a little more going into surplus than originally thought. It is not being depleted quite as much. It is all about taking another $55,000 from surplus to get to 1%. Average assessed home - 1.5% increase = $34.00; 1% = $21.00, prior to new assessment. Mrs. Ennis commented that 1.0% vs 1.5% is something that we would use surplus to do the balance because the operating budget has been cut very lean. As we go, if we do not continue to replenish surplus and this is one of the first years that we are not going to be replenish surplus as we are using it, it becomes a slippery slope. Just understand how surplus works. Council Members discussed the down payment and the list of projects to be included; staffing levels. The police pistol range which is in the budget. The Lions Playground funds were largely taken out of the capital budget and will use what we have this. Staffing levels would remain the same in either scenario. The Borough is not overstaffed by any means and could use some additional staff. The additional police officer would need to be considered. Redevelopment study monies is not included and the cost for an additional redevelopment study, $25,000-$30,000 could be added and would be beneficial. Whether we take $50,000 out of surplus it is not going to make a difference in the long term. We want to generate new revenue streams in the million- dollar range. Pistol Range presentation by Chief Messner and Lieutenant Seifert. Chief Messner and Lieutenant Seifert went through the history of the range as well as range operations. It was decided in January of 2020, mostly due to fiscal constraints, to complete the range improvements in two phases. The roof, well beyond the scope of its warranty has required repairs on a number of occasions. The HVAC system is 24-years old and has required repairs on a number of occasions. Replacement parts are almost impossible to find. The access door to the HVAC unit is literally held closed by tape. Filter maintenance, which cost $2,905.42 in 2019, will be $5,168.49 minimum for 2024 with filter replacement increasing rapidly as the system ages. Replacement of the bag filters especially, seems to be accelerating. NEW BUSINESS Mayor Giordano commented that this item will be on the next agenda. Mayor Giordano asked Steve and Andy should reach out to the Fire Department Bylaw Committee as there are rumors there are more Bylaws coming in. Mrs. Weber thanked the Police Department and WALVAC for responding to a medical emergency for her son. The two Communications officers and three WALVAC members response time and level of professionalism was superior. Her son was transported to the hospital but is home now doing well. She is thankful we have first responders like we do in this town. Ms. Cericola will thank WALVAC as well from the Council. REGULAR MEETING MINUTES: 8 FEBRUARY 13, 2024 Mr. Ramundo provided an update from the Environmental Committee. The two trek benches have been installed at the Public Safety Complex to replace the two old rusted ones. Mr. Ramundo thanked the residents for their continued support of the program. New plaques have been ordered and once they are installed, there will be a rededication of the benches to the families. The Environmental Committee hosted the Bergen County HUB Sustainable Jersey group along with our administrator. There was discussion about grants Steve and Matt are going for to help offset costs. The EV stations have taken some time but PSEG is set to complete them soon. Styrofoam Collection in January was a huge success, yielding 40-yard dumpster. We are working to send our next collection to Ridgefield at no cost. There will be a spring clean-up with the Beautification Committee and Green Team but more to come on this event. Appreciate all the support of the Mayor and Council. Mr. Martinello attended the last two Board of Education meetings. In January, students participated in a week of service; a new program the faculty introduced. 325 students and 40 staff members participate in events at The Bristol, Everyday Heroes Dog Rescue, Community Food Bank of NJ, Oasis, Haven for Women and Children, Habitat for humanity and also members of the WALVAC and Fire Department spoke about what they do for the town as volunteers. Students provided a recap to the Board of these events as well as the Principal and Staff and commit to continuing this program in the future. The construction project phase 6 is completed, with punch list items. The trailers are scheduled to be removed in June and the construction will be completed by the end of this summer. The Board of Education passed it annual audit report. Dominic Marquis was recognized for winning the School Spelling Bee and will now compete and represent Waldwick at the Bergen County Community College in the County Spelling Bee. Also, freshman student participated in the 15th Annual Sean Fischer Memorial Foundation for Heart Screening and hoping that student athletes took part in it. There are 25 students who participate in the NJ Regional DECA Competition at Ramapo College. Several students will participate in the State Competition in Atlantic City. A new Waldwick High School football coach was hired. Coach DiStasi joined us from Don Bosco Football Program. He is enthusiastic with working in the community and our youth programs and students in the school. There was one request to the Board of Education about help with policing some of the activity on the new fields constructed and what we can do from an ordinance perspective on that. Possibly meet this week with Steve to go over it. Mayor Giordano commented that he will be recognizing groups of people in our community this year. He will start with those that received Citizen of the Year award. Who they are, what they did to receive the award and what are they doing now. The recognition could be for an Eagle Scout to see what are they doing now. He will do this at each meeting. REGULAR MEETING MINUTES: 9 FEBRUARY 13, 2024 PUBLIC COMMENT Mayor Giordano asked if any member of the public wished to come forward and to discuss anything and if so, please state your name only for the record. Lori Gillen spoke to the issue of the Water PFOS project and its impact on her as she lives near the pump houses. She spoke with Steve about her concerns last month. Then there was three weeks of work that she was unaware of. It was loud, construction workers parking along the street, the start time is 7:30 am but they have been starting even earlier. Is it possible to have them start at 8:00 am and for them to park in the park parking lot. Her view is being blocked, needs fencing and trees planted on her property by the town to obstruct the view. Feels this is a quality-of-life issue. Mayor Giordano asked if she could come in on Friday to speak with him and Steve to come up with a plan. Gilson, Esq. being present; and, WHEREAS, the hearing was opened to all persons from the public who were generally interested in or would be affected by a finding that the property within the Area of Investigation constitutes an area in need of redevelopment under N.J.S.A. 40A:12A-5 and N.J.S.A. 40A:12A-3; and, WHEREAS, on April 24, 2023, the Planning Board received uncontested testimony from Mr. Grygiel providing a first-hand account of the conditions that he observed during his exhaustive examination of the property within the Area of Investigation, which confirmed the description of the conditions and his findings contained in the Investigation Report; and, WHEREAS, on April 24, 2023, the Planning Board unanimously recommended that the governing body of the Borough designate the Area of Investigation as a non-condemnation area in need of redevelopment due to the substantial evidence that the Area of Investigation meets the criteria enumerated in the Investigation Report, pursuant to N.J.S.A. 40A:12A-5. The Environmental Advisory Commitee shall establish a subcommitee called the “Waldwick Beau�ﬁca�on Commitee” who shall have the du�es and responsibili�es as follows: A. The Waldwick Beau�ﬁca�on Commitee shall designate and plan speciﬁc sites and extended areas, primarily under governmental ownership or control, for the beau�ﬁca�on of major roadways systems, median islands and entranceways throughout the Borough of Waldwick. B. The Waldwick Beau�ﬁca�on Commitee shall focus on developing and maintaining gardens around the Borough as well as working on projects that can improve the look of the town and quality of life. C. Consist of volunteer members of the community. Volunteer applica�ons shall submit the completed Borough of Waldwick Ci�zen Leadership Applica�on as required by law and may also include a resume. a. All applicants will be reviewed by the Environmental Advisory Commitee. b. The Environmental Advisory Commitee, upon comple�on of review of the applicants, will submit Waldwick Beau�ﬁca�on Commitee members to the Borough Council via the Council Liaison for approval at council mee�ng. D. Mayor shall appoint a Member of the Borough Council as Council Liaison to the Waldwick Beautiﬁcation Committee who shall be the Chair of the Waldwick Beautiﬁcation Committee. E. The Execu�ve Director and Council Liaison will atend mee�ngs of the Waldwick Beau�ﬁca�on Commitee as representa�ves of the Borough of Waldwick. F. All proposed projects for the Borough of Waldwick must be approved by the Council before the Environmental Advisory Commitee/Waldwick Beau�ﬁca�on Commitee can implement or execute them. Sec�on 10-7. Commitee Mee�ngs/Commitments of Members. A. No�ce of Mee�ngs. The Environmental Advisory Commitee shall meet on a regular, monthly basis at a �me and date to be decided by a majority of its members, or as o�en as may be necessary for the proper conduct of its du�es and responsibili�es. B. Mee�ng Procedures. Agendas to mee�ng should be sent to all members prior to mee�ng on the scheduled date. The order of the agenda can be changed for any mee�ng provided that the majority of the members present at the mee�ng agree to the change. The Environmental Advisory Commitee shall follow Roberts Rules of Order for Parliamentary Procedures where there is no conﬂict or disagreement with this Ordinance in which each case this Ordinance shall take precedence. A quorum of the Environmental Advisory Commitee must be in atendance for the conduct of business. This should consist of a minimum of ﬁve members. C. Minutes. The Secretary of the Environmental Advisory Commitee shall keep minutes from each mee�ng and present the minutes to the Environmental Advisory Commitee to vote on their acceptance at subsequent mee�ngs. Sec�on 10-8. Annual Report. The Environmental Advisory Commitee shall keep minutes of its mee�ngs and at least once per year submit to the Mayor and Council a summary of accomplishments and project statuses for the prior year as well as goals for the following year. Sec�on 10-9. Establishing Budget for Commitee. The annual budget for the commitee shall be established as per the Borough of Waldwick budgetary process and guidelines. The Commitee will recommend to the Borough Council, via the liaison, money needed to move forward with projected costs to cover memberships, training and/or projects related costs. Sec�on 10-10. No salary or compensa�on. The members of the Environmental Advisory Commitee shall receive no salary or other compensa�on for their services. BE IT FURTHER RESOLVED that if any sec�on of this Ordinance shall be held to be invalid for any reason, such decision shall not aﬀect the remaining por�ons of this Ordinance.
