Subject Matter: The Petitioner, Omved Corp., proposes to own and operate a smoke shop in the existing retail store front on Main Street. The shop will be situated at 887 Main Street. Location and Zoning District: 887 Main Street; Business B Zoning District. Provisions of Zoning Ordinance Involved: Article III, §§ 3.647 and 3.222b. Specific Relief Sought: §3.647 provides that a special permit for a smoke shop, as defined in subsection 3.222b, may be permitted when a special permit has been granted by the City Council, subject to certain findings and conditions. §3.647(3) states no smoke shop shall be located less than 300 feet of any residential zoning district. Here, the proposed smoke shop shall be located less than 300 feet, approximately 139 feet, from a residential zoning district.
