Councilmember Vincent C. Gray, Chairperson of the Committee on Health, announces a Public Hearing on Bill 24-0025, the “Medical Necessity Restroom Access Act of 2021”, Bill 24-0026, the “Maternal Health Resources and Access Act of 2021”, Bill 24-0029, the “Minor Consent to Healthcare for HIV and AIDS Clarification Amendment Act of 2021”, Bill 24-0065, the “Interagency Council on Behavioral Health Establishment Amendment Act of 2021, and Bill 24-0092, the “Substance Use Prevention and Treatment Omnibus Amendment Act of 2021.” The hearing will be held on Monday, March 29, 2021, at 9:00 a.m, via Webex. This hearing notice is revised to reflect the addition of Bill 24-0092 to the hearing agenda. Bill 24-0025, the “Medical Necessity Restroom Access Act of 2021”, would provide an individual with an eligible medical condition (inflammatory bowel diseases or pregnancy) with the right to use a public or employee toilet facility at a retail establishment under certain limited conditions including if the individual presents an id prepared by the Department of Health and signed by a physician, nurse practitioner, or a physician assistant.  Bill 24-0026, the “Maternal Health Resources and Access Act of 2021”, would establish a pilot program for Medicaid reimbursement of doula services, which includes emotional and physical support during pregnancy, labor, birth, and postpartum. Among other things, it would also require the Department of Health to conduct a study of the feasibility of establishing a birthing center east of the river. Bill 24-0029, the “Minor Consent to Healthcare for HIV and AIDS Clarification Amendment Act of 2021”, would clarify that a minor of any age may consent to health services for the prevention, diagnosis, or treatment of HIV or AIDS. A health services provider may determine whether the minor is capable of providing informed consent. Bill 24-0065, the “Interagency Council on Behavioral Health Establishment Amendment Act of 2021”, would establish an Interagency Council on Behavioral Health to establish interagency, cabinet- level leadership to develop a behavioral health system of care, that includes prevention, harm reduction, treatment, and recovery support services related to mental health disorders, addictions, and other substance abuse. The City Administrator or their designee shall serve as chairperson. Bill 24-0092, the “Substance Use Prevention and Treatment Omnibus Amendment Act of 2021”, would amend the Opioid Overdose Treatment and Prevention Omnibus Act of 2018 to require the Department of Behavioral Health to mandate the expansion of assessment and referral services by authorizing mental health and primary care providers to conduct assessment and referral services; to require the Department of Health Care Finance to pay for assessment and referral services under the District’s Medicaid State Plan; to mandate the Department of Behavioral Health and Department of Health Care Finance to jointly develop a plan to provide care coordination for individuals experiencing substance use disorders, and to establish minimum criteria for care coordination plans; to amend An Act To relief physicians of liability for negligent medical treatment at the scene of an accident in the District of Columbia to expand naloxone distribution; to amend the District of Columbia Substance Abuse Treatment and Prevention Act of 1989 to expand use of Food and Drug Administration-approved opioid use medication; to permit the use of mobile methadone; and to authorize the use of the Opioid Treatment Exception Request. The Council will make every effort to fulfill timely requests, however requests received in less than five (5) business days may not be fulfilled and alternatives may be offered.
